'The City Council of the City of Azusa met in regular session at the above date and time in the Civic Auditorium. Mayor Madrid called the meeting to order and led in the Salute to the Flag INVOCATION was given by Father Granadino of Saint Frances of Rome Church. ROLL CALL PRESENT: COUNCILMEM 3ERS: HARDISON, STANFORD, ROCHA, BEEBE, MADRID ABSENT: COUNCILMEMBERS: NONE ^.D ALSO PRESENT: City Attorney Carvalho, City Manager Cole, Chief of Police Broderick, Superintendent of Recreation and Parks Noriega, Community Development Director Bruckner, Assistant City Manager Craig, City Clerk Solis, Deputy City Clerk Toscano. CEREMONIAL Call to Order Invocation Roll Call Also Present Ceremonial The entire Council presented Certificates of Achievement to winners of the Montview Cert of Achieve. League Wrestling Championship as follows: Ricky Sotela and Tommy Warner. Miguel Montview League Fregoso and Nader Haddad were not present, but were also recognized. Wrestling Champ The entire Council presented Certificates of Achievement to Superior and Excellence Cert of Achieve. Ribbon winners at the Los Angeles County Science Olympiad as follows: Matthew Superior & Ward, Thomas Martinez, Lorraine Marchan, Jose Trinidad Lopez, Jerry Sisneros, Excellence Guisley Harris, Paul Valdez, Alcira Terrazas, Pablo Aguilar, Sharon Perez, Daniel Ribbon winners Saechange, David Lopez, Lizeth Ramirez, Armando Cortez, Summer Butler, Cynthia Hato, Diana Lopez, Darlene Rodriguez, and Ever Valenciano. Ivan Perez, Edward Reyes, Chad Miller, and Alexander Connely were not present but, were also recognized. At this time the Honorable Judge George Lomeli administered the Oath of Office to the Oath of Office newly elected officials, as follows: Mayor Cristina Cruz Madrid, Councilmember to newly elected Diane M. Beebe, and Councilmember David Hardison. Council Moved by Mayor Madrid, seconded by Councilmember Hardison and unanimously Stanford, Mayor carried that Councilmember Stanford be appointed as Mayor Pro Tem. Pro Tem Councilmember Beebe offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, Res. 99-C37 CALIFORNIA, RECITING THE FACT OF THE GENERAL MUNICIPAL Results of ELECTION HELD IN THE CITY OF AZUSA ON MARCH 2, 1999, DECLARING Election THE RESULTS AND SUCH OTHER MATTERS AS PROVIDED BY THE PROVISIONS OF LAW. Move by Councilmember Beebe, seconded by Councilmember Stanford to waive further reading and adopt. Resolution passed and adopted by the following vote of the Council: AYES: COUNCILMEM 3ERS: HARDISON, STANFORD, ROCHA, BEEBE, MADRID NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: NONE The City Council recessed at 7:46 p.m. to have refreshments in celebration of the newly Recess elected Councilmembers. The City Council reconvened at 8:03 p.m. Reconvened Ms. Regina Reinitz of Residential Addressing Service (RAS) addressed Council R. Reinitz of presenting a check in the amount of $570.46, representing 15% of the donations her RAS/donation company received while painting curbs in the City of Azusa. The money is to be used toward Band toward the building of the Azusa Band Shell. Shell Mr. Miles Rosedale, representing Monrovia Nursery, presented a check to the City in M. Rosedale the amount of $500,000, as the escrow portion of the Development Agreement Fee. Dev Agmt Fee PUBLIC PARTICIPATION Pub Participation Z t) Ms. Lurece Hunter addressed Council thanking all who participated in the success of the L. Hunter/V. U Miss Azusa Pageant. She then presented a Certificate of Recognition award provided Mendoza by Senator Hilda Solis, to Mrs. Vera Mendoza, Executive Director of the Chamber of comments Q Commerce, in honor of the Miss Azusa Pageant Anniversary. Mrs. Mendoza then Miss Azusa presented Miss Azusa Lynette Sumner and her Court, Ms. Stacey Alvitre and Lorene Errington. Ms. Hunter than provided an update on the Golden Days Celebration. The fust meeting L. Hunter will be held on Wednesday, March 24, 1999, at the Sister City House. The Golden Days comments Parade will be held on October 9, 1999, with the kick off on Friday, October 1, 1999 Golden Days and will run through October 10, 1999.. Celebration Mr. Kevin Nunez addressed Council announcing the All Nation Gathering Inter -Tribal K. Nunez Pow Wow, to be held on Saturday, March 20, 1999, and Sunday, March 21, 1999, All Nations beginning at 11 a.m. at Azusa High School. He stated that the goal is to provide people Gathering with knowledge about North American Indigenous people and invited all to attend the Inter -Tribal festivities. Mayor Madrid requested that the announcement be placed on the City's Pow Wow Reader Board as well as the Cable Channel. Ms. Melissa Barbosa, a Junior at Gladstone High School, addressed Council and M. Barbosa audience with an update of her trip to the Presidential Classroom in Washington D.C., update on trip a unique program that gives scholars a broad view of the Federal Government. She to Presidential detailed highlights as follows: she met Representative David Drier, saw the Classroom in Impeachment Trial, went to Arlington Cemetery and saw the Tomb of the Unknown Washington Soldier, changing of the Guards, Holocaust and News museum, heard CIA Briefing and D.C. the Role of the Media discussion. Mr. Jesse Carlos, Representative of Congressman Matthew Martinez office, offered J. Carlos congratulations to Councilmembers on their re-election and winners of the Miss Azusa rep, Matthew Pageant. He stated that there is a need for more communication between the community Martinez Office and his office, and provided the address and phone number as follows: 2550 West Main Street, Suite 301, corner of Fremont and Main, Alhambra, (626) 458-4524. Mr. Corey of State Assemblyman Bob Margett's Office, offered congratulations to the Mr. Corey newly elected Councilmembers, and recognized the volunteers of the community such State Assembly as Lurece Hunter and Vera Mendoza. He extended an invitation to the community to call Margett's Office or visit Mr. Margett's Office at 55 East Huntington Drive, Suite 120, Arcadia, if they have an issue dealing with State. Mayor Madrid stated that there is a continuing issue regarding the lack of sound walls on the 210 freeway. 03/16/99 PAGE TWO i Mr. Ron Legault addressed Council congratulating the newly elected members, R. Legault appointment of Mayor Pro Tem to Councilman Stanford, and Miss Azusa and her Court. comments He stated that there is a question of why the $500,000 check from Monrovia Nursery was accepted before the results on the Referendum petition are known. He questioned the issue of plaques on City buildings being dedicated/named for people that are living versus notliving. City Manager Cole responded to question regarding the $500,000 check from Monrovia City Mgr Nursery, stating that in accordance with the terms of the Development Agreement, thirty response days after the approval of the project, the money needs to be put into escrow. The Development Agreement also says if the Council, upon presentation of a valid number of signatures, repeals the ordinance or if by election the ordinance is repealed, the money would be refunded and the Development Agreement would be voided. Further, if the Monrovia Nursery did not present the check, they would be in violation of the contract. Councilmember Stanford addressed the issue and requested a report from the City Stanford Attorney regarding the status of the Referendum petition that is at the Registrar comments Recorders office, further, he stated that just because there is a petition out there, it doesn't stop the process. c� REPORTS. UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS FROM Rpts/Cncl/Staff Q STAFF City Manager Cole, on behalf of the employees of the City of Azusa, congratulated the City Mgr newly elected Councilmembers and Councilmember Stanford on his appointment of comments Mayor Pro Tem. He then announced the dedication and grand opening of the new PD Grand Open Police Department facility on Friday, March 26th and Saturday, March 27th. A tour, badges and an oath will be given to attendees as part of the celebration. A film of the 'tour was then presented via video. Assistant City Manager Craig and Chief of Police Broderick addressed Council and Assist City Mgr audience providing information on the ceremonies that will take place for the Police & COP Facility Grand Opening and the many mementos that will be available. Friday, March comments 26, 1999, will be a day for Dignitaries, such as District Attorney Gil Garcetti, Sheriff PD Grand Open Lee Baca, Assemblyman Bob Margett, Senator Hilda Solis, Mayor, Councilmembers, etc. On Saturday, March 27, 1999, the public will be invited for an open house type of celebration, with refreshments and jazz band. Ms. Drettania Gonzalez of Azusa Aztec Singers, addressed Council stating that she will be attending a competition in San Francisco and has raised $160 and still needs $100; D. Gonzalez the competition will be April 16-18. It was consensus of Councilmembers to donate Azusa Aztec $100 to Drettania for her trip. Singers request for donation Councilmember Stanford presented the issue of naming of City buildings, suggesting that they be named for someone who is not living and provided service to the City. Policy on Discussion was held among Councilmembers regarding the naming of City buildings. naming City Councilmembers expressed their concerns regarding the issue, which was criteria for Buildings, parks, naming buildings, schools, parks, trees, etc. It was consensus of Council that schools, etc. Councilmember Beebe and Councilmember Stanford form a committee to work on developing criteria/policy on the issue and that policies will not be changed midstream. Discussion was held between Councilmembers and staff regarding the naming of the recent Police Facility Addition and Renovation Project, and the fact that four years ago, Dis addition to the prior Council directed that then Chief of Police Byron Nelson be named on the new Policy Facility addition to the Police Building. It was consensus of Councilmembers that there be a Plaque to contain compromise of a plaque that contains the initial City Council and Police Chief and the initial Cncl & current City Council and Police Chief. Chief and current Cncl & Chief 03/16/99 PAGE THREE 018 Councilmember Stanford praised the Police department for its work in confiscating 95lbs Stanford of marijuana in the City. He requested a status report on the Rosedale Referendum comments Petition, and the validity of the petition. City Clerk Solis and City Attorney Carvalho responded stating that they are dealing with City Clerk/City the County Registrar Recorder on the issues. Attorney resp. 'Councilmember Beebe announced that Helping Hand will be having a fundraiser at the Beebe Azusa Woman's Club on Saturday, March 20, 1999, from 3p.m. to i 1p.m. comments Councilmember Rocha reminded all to keep in prayer and positive thoughts, Reverend Rocha Rick Mac Donald who is dealing with Pneumonia, and Al Chagolla who is recuperating comments from surgery. He thanked the citizens who participated in the clean up on March 6, 1999 and announced that there will be another clean up on Saturday, April 3, 1999, at 9 a.m.; and all wanting to participate should meet in front of Light and Water Department. He requested that a Community Calendar be created in order that there not be overlapping of events. He asked if the Public Library could be kept open on Wednesday, as many residents are being turned away. It will cost approximately $6,500 per year; he asked Council to keep this in mind. aMayor Madrid asked that all keep in prayer, the family of Bob Hartunian, who passed Madrid Cti away recently. She announced the Woman's Health Conference on March 20, 1999, comments at Kaiser Permanente in Baldwin Park, American Cancer Society meeting on Relay for Life on March 22, 1999, the Azusa Woman's Club Prayer Breakfast on March 30, 1999, from 8 a.m. to 9 a.m., at the Azusa Woman's Club for $4, and Opening Day for the American and National Little Leagues. The CONSENT CALENDAR consisting of Items III -A through III -M, was approved Consent Cal by motion of Councilmember Stanford, seconded by Councilmember Beebe and B, Special Call unanimously carried, with the exception of item III -B, which was considered under the Special Call portion of the Agenda. A. The Minutes of the regular meeting of March 1, 1999, were approved as written. Min approved B. SPECIAL CALL. Spec Call C. Human Resources Action Items were approved as follows: Human Res. Merit Increases: G. Romo, C. Wichmann, M. Bertelsen. Action Items Separations: A. Toscano, Jailer, effective March 7, 1999. Leave Request: K. McMath, Community Services Officer, eff. 3/7/99. D. Approval was given to proclaim April 15, 1999, as "Arbor Day", and the third Arbor Day Thursday in April, each year be designated as City of Azusa's official Arbor Day. Proc E. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, Res. 99-C38 CALIFORNIA, INITIATING PROCEEDINGS FOR THE ANNUAL Initiating ASSESSMENTS FOR "CITY OF AZUSA LANDSCAPING AND LIGHTING Proceed. ASSESSMENT DISTRICT NO. 1(COMMUNITY MAINTENANCE FEE)" FOR Landscaping & THE FISCAL YEAR 1999-00 AND ORDERING THE PREPARATION AND Lighting Dist. FILING OF A REPORT IN ACCORDANCE THEREWITH. F. Formal bidding procedures were waived pursuant to the Azusa Municipal Code and Purchase of the purchase of on Dedicated Compressed Natural Gas (CNG) F-250 Ford Truck CNG truck with combo body from Wonderies Ford in the amount of $26,150, was approved. Bid opening was held in the Office of the City Clerk on March 8, 1999, for the Replacement Play replacement of Plan Structure at Head Start. Two bids were received. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Res. 99-C39 WAIVING FORMAL SEALED BIDDING AND AWARDING THE UPGRADE Upgrade Group OF THE NOVELL GROUPWISE EMAIL SYSTEM TO SOCRATES Wise to Socrates COMPUTER SYSTEMS. J. Consulting Contract with existing employee, Robert Bowcock, was discussed in Consult Agmt Closed Session and was then approved. B. Bowcock K. Request for Proposals for an evaluation and analysis for the Azusa Civic Evaluation & Auditorium were solicited. Four firms responded and were evaluated by staff. Analysis Approval was given to Henry H. Woo Architects, Inc. to perform the structural Civic And evaluation and specifications for the window replacement at the City Auditorium H. Woo Arch. in the amount of $38,400. L. Agreement with Lisa Brownfield to perform General Plan Coordination and Agmt w/L. Preparation Services was approved. Brownfield C� M. Two separate resolutions authorizing payment of warrants by the City were adopted and entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Res. Nos. 99-C40 ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE & 99-C41 FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. Warrants I SPECIAL CALL ITEMS Special Call Items Councilmember Rocha requested that the policy for Marquee Displays be amended to Marquee Display combine display of names of death of individuals who served on Council, Boards or Policy Commission and death of local veteran(s). The policy was also amended to read that city events take precedence over the death of individuals. Moved by Councilmember Rocha, seconded by Councilmember Beebe and unanimously Policy appvd carried to approve the Marquee Display Policy as amended. SCHEDULED ITEMS Scheduled Items Community Development Director Bruckner and Henry Woo of Henry Woo Architects, Com Dev Dir addressed Council detailing the four options for the proposed water feature on the north & Henry Woo east comer of Foothill and Azusa Avenue in front of the proposed Rite Aid store. The Architects options consisted of 1) Active Fountain Design, 2) Passive Fountain Design, 3) Hybrid comments Design and 4) Interactive Design. Mr. Woo showed slides of the options as well as the advantages and disadvantages of each fountain. Mr. Tom Mix addressed Council presenting his artwork of a proposed wall fountain for T. Mix the side of the Rite Aid building, which Council complimented. comments Lengthy discussion was held between Councilmembers and staff regarding the Lengthy presentation and direction was sought from Council on a choice of one of the options to Discussion be designed and brought back for handling. Discussion was held between Councilmembers and staff regarding SB 216, San Gabriel Dis re: SB 216 River & Mountains Conservancy Legislation. City Manager Cole advised that a San Gabriel conservancy will safeguard and protect the San Gabriel river and mountains and is a River & positive step forward and requested Council input and recommendations. Mountains Councilmembers expressed concerns regarding the following: how much power the Conservancy agency (conservancy) would have, that Azusa would have no control in this area, that the Legislation conservancy would dictate, how the funds would be channeled, the only City to be involved would be the City of Long Beach, a need for guarantees that Azusa will have equal representation, local controls over zoning, planning and general plan, stance the Army Corp of Engineers will take, and that appointments to board don't recognize the City of Azusa. An item of subsequent need arose regarding Rosalinda Martinez to be added to the Item of Closed Session portion of the agenda and it was Moved by Councilmember Stanford, Subsequent Need seconded by Councilmember Beebe and unanimously carried to add the item.
