' The City Council/Board members of the City of Azusa and the Redevelopment Agency met in adjourned regular session at the above date and time in the Civic Auditorium. Mayor/Chairman Madrid called the meeting to order. ROLL CALL PRESENT: COUNCILMEMBERS: HARDISON, STANFORD, ROCHA, BEEBE, MADRID ABSENT: COUNCILMEMBERS: NONE ALSO PRESENT: General Counsel Carvalho, Executive Director Cole, Chief of Police Broderick, Redevelopment/Economic Development Director Andrews, Community Improvement Manager Rudisel, Community Development Director Bruckner, Deputy City Clerk/Deputy Secretary Toscano. Call to Order Roll Call Also Present Discussion was held regarding request from Ms. Rosemary Ramirez, Co -President of Saint Discussion re: Frances of Rome Parish School, to waive fees for the Annual Family Festival 99 and to use Request for the Krems property for parking,. It was noted that cost for Police Services is approximately waiver of fees ' $2000, which were not recommended to be waived and temporary use permit is $110. The St. Frances of cost for the entire fee waiver was not ready for presentation. Certificate of insurance was Rome Annual presented by Ms. Ramirez; she was referred to meet with staff to discuss the particulars of Family Fest 99 the event and as well as the costs, to be brought back to the next meeting for handling. cont to 5/3/99 It was consensus of the Councilmembers* to recess to Closed Session to discuss the following: CLOSED SESSION CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION/LIABILITY CLAIM Gov. code Sec. 54956.9 (b)). PUBLIC PARTICIPATION Pub Part. Mr. Art Morales addressed Council reminded all not to forget about the Azusa Soap Box A. Morales Derby. comments Ms. Peggy Martinez addressed Council expressing her support of the proposal presented by P. Martinez the Haagen Development Company for the development of the Krems property. comments Ms. Donna Fraijo Juarez addressed Council expressing her support of a shopping center to D. Juarez be developed on the Krems property. comments Mr. Curtis Napier addressed Council expressing his support of a revenue making C. Napier development for the Krems property. comments Mr. Art West addressed Council expressing his support of placing a Lucky market on the A. West Krems property. comments Ms. Diana Offen addressed Council expressing her support of a market being placed on the D. Offen Krems property. comments City Manager Cole detailed the process that Council used to decide their vote on the Krems City Mgr property sale. Each Councilmember* detailed reasons for their vote on the proposals for the Krems property. ' Moved by Councilmember* Beebe, seconded by Councilmember* Hardison and carried by Approval of roll call to approve the proposal from Azusa Pacific University and direct staff to continue proposal with negotiations with APU on certain other economic terms and to maximize return on a long APU for Krems term basis. Councilmember* Stanford abstaining and Mayor* Madrid dissenting. Property sale. PUBLIC HEARING - regarding moratorium of all Land Use Entitlements or issuance of Pub Hrg building permits for the construction of all new residential units on real property adjacent to Moratorium Azusa Greens Golf Course pursuant to Government Code Section 65858. The Mayor declared the Hearing open. Deputy City Clerk read the affidavit of proof of Hrg open publication of notice of said hearing published in the San Gabriel Valley Tribune on April 16, 1999. Community Development Director Bruckner addressed the issue stating that the existing moratorium on the property adjacent to the Azusa Greens Golf Course with respect to future land use due to the impact of potential errant golf balls from the golf course, is due to expire today, and staff has made progress in devising zoning tools to address these types of issues. Planning Commission has held a public hearing and has recommended Council consider and adopt the zoning tool, which is an overlay zone that would be in place on property that has the potential of locating future development in and adjacent to the golf course. City Council will consider this in May and due to the fact that the effective date of the new ordinance is after the expiration of the moratorium, it was requested that the moratorium be continued for one year or the length of time that may be necessary. Testimony was solicited, but none was received. Com Dev Dir comments Testimony/none Moved by Councilmember Beebe, seconded by Councilmember Rocha and unanimously Hrg closed carried by roll call to close the Hearing. 04/26/99 PAGE TWO 1 1 1 It was consensus of Councilmembers to extend the moratorium for one hundred and eight Extend mora days. 180 days Councilmember Stanford offered an Ordinance entitled: AN URGENCY ORDINANCE OF THE CITY OF AZUSA, CALIFORNIA, Ord 99-09 TEMPORARILY PROHIBITING APPROVAL OF ALL LAND USE ENTITLEMENTS Extend OR THE ISSUANCE OF BUILDING PERMITS FOR THE CONSTRUCTION OF ALL Moratorium NEW RESIDENTIAL UNITS ON REAL PROPERTY ADJACENT TO AZUSA GREENS property adjacent GOLF COURSE PURSUANT TO GOVERNMENT CODE SECTION 65858. to Azusa Greens Moved by Councilmember Stanford, seconded by Councilmember Hardison to waive further meeting and adopt.
