The City Council of the City of Azusa met in regular session at the above date and time in the City Managers Office to conduct a Closed Session on the following: CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION (Gov. Cncl recess to closed session The City Council returned from Closed Session at 7:20 p.m. and City Attorney Reconvened Carvalho advised that the City Council authorized, by a 5-0 vote, that the City of Azusa City Arty. be added to an Amicus Curiae, friends of the court, in Howard Jarvis Taxpayers advised Association v. City of La Habra. Mayor Madrid called the meeting to order and led in the Salute to the Flag INVOCATION was given by Reverend Leroy of the First Assembly of God Church. PUBLIC PARTICIPATION. Mrs. Frances Gonzales, on behalf of Edith Russek of the Cultural and Historical Commission, the Azusa Woman's Club, and as a private citizen, addressed Council regarding agenda item, Specifications for the Woman's Club Hardwood Floor Replacement. She stated that the flooring is still in good shape and does not object to replacing some boards, but, the floor in the kitchen and steps leading out of the back door would be a better repair project; also the electrical wiring, bathrooms and main chandelier in the hall need maintenance. She stated that by replacing the original flooring, dating back to 1927, would destroy the authentic historical value of the building; she recommended repairing not replacing action for this project. Gonzales comments re: new flooring @ Woman's Club Ms. Gloria Rauchle, of the Crystal Canyon, addressed Council requesting a ban on G. Rauchle Fireworks in the Crystal Canyon Housing Development. City Attorney Carvalho advised comments that the Homeowner's Association as a private entity at Crystal Canyon could make the decision/rule not to allow fireworks in the Development. Mr. Fernando Del Rio, Mrs. Anna Del Rio and their family addressed Council sharing F. & A. Del Rio information regarding the loss of their daughter, Teresa, who was murdered in Los comments Angeles by being shot by an assailant. They requested that Council adopt a resolution Million Mom endorsing the Million Mom March to be held on Mother's Day, May 14, 2000, where March mothers, friends of mothers, and Honorary Mothers will march in Washington D.C. and in Southern California to unite voices and urge Congress to pass common sense gun legislation. It was consensus of Councilmembers that they go on record in support of the Million Cncl to support Mom March and that the City Clerk prepare a resolution endorsing the Million Mom Million Mom March to be brought back for adoption at the next Council meeting. March Ms. Lana Grizzell, Executive Director of the Miss Azusa local Pageant, addressed L. Grizzell Council introducing three of eight contestants for the pageant, Christy Ybarra, Michelle comments Wade and Anna Lisa Ebbs. She announced that there will be a rummage sale the Azusa Chamber of Commerce on Saturday, February 26s, and further that the Miss Azusa Pageant will be held on March 18' at the Munson Chapel and urged all to attend. REPORTS UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF Update/Rpts City Attorney Carvalho announced that she will be taking maternity leave from March City Attorney 1, 2000 through April 30, 2000. comments Moved by Councilmember Rocha, seconded by Councilmember Hardison and $100 to Gladstone unanimously carried to give a scholarship of $100 to the Gladstone High School Football Football team Team towards purchase of uniforms. uniforms Councilmember Rocha invited all to come and help plant oak trees along San Gabriel Rocha Boulevard on Saturday, March 4, 2000, at 8:00 a.m., meeting place will be At the Ranch comments Market. He urged all to support Proposition 14, regarding California Reading and Literacy Improvement and Public Library Construction and Renovation Bond Act of 2000. He expressed his apologies to the Ramos family for not being there in their time of need. Councilmember Beebe requested that at a future meeting, staff provide a presentation Beebe regarding the issue of Fireworks in the City of Azusa, i.e. history, procedure for halting, comments the whole process in general. Councilmember Stanford also stated that he would like to know the status of the issue of Stanford Fireworks in the City. He then advised that Leo Nasser's store on Azusa Avenue has comments been open lately and that the public should stop by and say hello to Mr. Nasser. Councilmember Hardison also questioned the issue of Fireworks and commented on the Hardison negative quality of air the day after the 4' of July. comments Mayor Madrid announced that she is serving on a committee that will be a part of the Madrid preparation of the San Gabriel River Master Plan with the Department of Public Works comments and asked for Councilmembers input or additional information she could submit for consideration, based on the river. 02/22/00 PAGE TWO SCHEDULED ITEMS Sched Items PUBLIC HEARING - to receive testimony from affected property owners with regard Pub Hrg to weed abatement by the Los Angeles County Fire Department. Weed Abmt The Mayor declared the Hearing open. City Clerk read affidavit of proof of publication Hrg open of notice of said hearing published in the San Gabriel Valley Tribune on 2/11/00. Mr. Richard Anderson of the Los Angeles County Fire Department, Brush Clearance R. Anderson Office, addressed the Hearing stating that he is on the enforcement side of brush LA Co. Fire clearance. He stated that the local Fire Department will come to properties once a year Brush Clearance and inspect it for Fire Code violations and if there are any, they give the property owner Office thirty days to come into compliance, and if they do no action is taken, but if they don't comply he gets involved. He detailed the process. Testimony was solicited from affected property owners, but none was received. It was consensus of Councilmembers to approve the motion and abatement order Abatement Order directing abatement of the nuisances by removing all weeks and rubbish from affected approved improved parcels. The CONSENT CALENDAR consisting of Items V-A through V -R, were approved by Consent Cal. motion of Councilmember Stanford, seconded by Councilmember Rocha and V-A - V -R unanimously carried, with exception of items V -D, E, F, H, and Q, which were V -D, E, F, H, & considered under the Special Call portion of the Agenda. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Res. 00-C23 WAIVING FORMAL SEALED BIDDING AND AWARDING THE PURCHASE Purchase 8 OF EIGHT PERSONAL COMPUTERS TO COMPAQ COMPUTER computers CORPORATION. Compaq Corp. L. The agreement for Consultant for pavement analysis and improvement was Agmt Pavement awarded to PA& Associates in the amount not to exceed $40,500 and a transfer of Analysis $16,000 in realized savings to the Public Works Division's small tools account was PA& Associates approved for the purchase of tools. M. The Progressive Buddhist Association, owner of property located at 1830 N. Grant of Azusa and San Gabriel Canyon Road is expanding and making improvements to Easement/Grant its facilities. In consideration of a sum of $4,300 offered to the City, approval of Quitclaim was given to accept the grant of a road easement on Azusa and San Gabriel Deed Canyon Road, to grant a quitclaim deed on the same road and to authorize the City Progressive Clerk's office to file the instruments with the County Recorder's Office. Buddhist Assoc. N. SB 244 are amendments to the Surface Mining & Reclamation Act (SMARA), to Support of SB provide clarification with regard to the authority of cities in the SG Basin Water 244 Surface Quality Authority areas to enact more stringent ordinances than state law Mining & concerning assurances required of mining operators! The Mayor was authorized Reclamation Act to sign a letter in support of SB 244. (SMARA) O. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Res. 00-C24 R. Resolution authorizing payment of warrants by the City was adopted and entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Res. 00-C24 ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE Warrants FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. SPECIAL CALL ITEMS City Manager Cole addressed item regarding Specifications for the Woman's Club Hardwood Floor Replacement, recognizing the concerns of the Azusa Woman's Club as well as the Cultural and Historical and Landmark Commission and of staff, since the construction period has already been scheduled. He suggested to allow staff to advertise, collect bids and meet with Azusa Woman's Club and h&c landmarks commission, if it is determined that they should not proceed they won't, but if it determined that they go forward, they will be ready without delay. He then answered questions posed by ' Councilmembers. Moved by Councilmember Stanford, seconded by Councilmember Hardison and unanimously carried to approve the Specifications for the Woman's Club Hardwood Floor Replacement, advertise for bids, and authorize the City Manager to award low bid, with the agreement by the Azusa Woman's Club and Cultural and Historical Landmark Commission. Councilmember Beebe added to the motion that the item come back to the March 6, 2000 meeting for an update on the meetings. 02/22/00 PAGE FOUR Special Call Items Discussion re: Spec Woman's Club Hardwood Floor Replacement Specs approved contingent upon rings w/Woman's Club & C&H Commission WAIVING FORMAL SEALED BIDDING AND AWARDING THE PURCHASE Purchase GIS ' P. OF ESRI HARDWARE SOFTWARE BUNDLE TO DEITERICH POST. The agreement with Reim Commercial Properties, to hold a Used Oil Collection System & Plotter Agmt w/Reim center at the Edgewood Shopping Center on March 11, 2000, was approved. Comm Prop Q. He stated that this Proposition would authorize $350 million in bond money for building a new library and for replacing and repairing the existing facilities. He stressed the need for a new facility and urged all to vote yes on Proposition 14. Councilmember Stanford offered a Resolution entitled: 'A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Res. 00-C21 SUPPORTING THE PASSAGE OF PROPOSITION 14, THE "CALIFORNIA Support Prop 14 READING AND LITERACY IMPROVEMENT AND PUBLIC LIBRARY California CONSTRUCTION AND RENOVATION BOND ACT OF 2000". Reading & Literacy Moved by Councilmember Stanford, seconded by Councilmember Rocha to waive further Improvement & reading and adopt. Resolution passed and adopted by the following vote of the Council: Library Construction & AYES: COUNCILMEMBERS: HARDISON, STANFORD, ROCHA, Renovation Act. BEEBE, MADRID NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: NONE Councilmember Hardison addressed item regarding Proposition 26, "Let's Fix Our Hardison & Beebe Schools" Initiative. He expressed his opposition to anything that would take taxation comments from its current levels, the current two-thirds, to a simple majority. Councilmember re: Prop 26 Beebe also expressed her opposition, stating that changing the rules to get what is wanted is not appropriate. Both noted that they are in favor of fixing schools. Councilmember Stanford offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Res. 00-C22 SUPPORTING THE PASSAGE OF PROPOSITION 26, THE "LET'S FIX OUR Prop 26 "Let's SCHOOLS" INITIATIVE. Fix Our Schools" Initiative Moved by Councilmember Stanford, seconded by Councilmember Rocha to waive further reading and adopt. Resolution passed and adopted by the following vote of the Council: AYES: COUNCILMEMBERS: STANFORD, ROCHA, MADRID NOES: COUNCILMEMBERS: HARDISON, BEEBE ABSENT: COUNCILMEMBERS: NONE Councilmember Beebe expressed her opposition to NCI "Navigant" consultant Agreement Beebe comments for expense reduction/revenue generation, stating that she feels staff has developed a re: Navigant tremendous list of fees and charges that she would like to see completed before money Agmt approved is spent on a consultant. Moved by Councilmember Stanford, seconded by Councilmember Rocha and carried to approve the agreement with Navigant Consulting, Inc. Councilmember Beebe dissenting. Councilmember Rocha expressed concerns regarding possible damage to trees when Rocha comments Street Improvements 2000 work begins. He requested that a condition be put in the re: Street contract to protect the trees which states that Ross Montes, Arborist, of the Recreation Impvmts Agmt 'and Parks department will be contacted to insure protection. Staff advised that this is only the specifications for the project, and they would be amended. Moved by Councilmember Stanford, seconded by Councilmember Rocha and Street unanimously carried that Plans and specifications for Street Improvements 2000, be Improvements approved and the City Clerk was authorized to advertise for bids. The improvements 2000 Agmt are for the following streets: Irwindale Avenue; First to Gladstone, Motor Avenue; approved. First to Gladstone, San Gabriel Avenue; from Foothill to Second Street, Encanto Parkway; Markwood to Huntington Drive. 02/22/00 PAGE FIVE 1 THE CITY COUNCIL RECESSED AND THE REDEVELOPMENT AGENCY Cncl recess CONVENED AT 8:24 P.M. CRA convene THE CITY COUNCIL CONVENED AT 8:29 P.M. Cncl reconvened Ms. Nancy Moore of the Azusa Unified School District addressed Council providing an N. Moore update on Youth in Government Day to be held in the City of Azusa at City Hall on AUSD re: Monday, March 6, 2000. She also provided an update on the "Fix Our Schools" Prop 26 initiative. City Manager Cole advised that the City will be opening a General Plan store front at 629 City Mgr N. Azusa Avenue on Sunday, March 5" at 1:30 p.m. comments It was consensus of Councilmember to adjourn in memory of Teresa Del Rio. Meeting Adjourn in was adjourned to Saturday, February 26, 2000, 8:30 a.m. in order to conduct a memory Teresa Council/Staff Workshop and a Library Workshop, in the Library Auditorium.
