The City Council of the City of Azusa met in Special session at the above date and time Cncl recess to in the City Managers Office to conduct a Closed Session on the following: closed session CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION (Gov. Code. See, 54956.9). Armando Meras vs. Moises Hernandez Rodarte, Jose M. Sanchez, City of Azusa, Andrea Egan and DOES 1-100, inclusive. Los Angeles County Superior Court Case No. KC 030774. PUBLIC EMPLOYEE PERFORMANCE EVALUATION (Gov. Code. Sec. 54957). Title: City Manager. The City Council returned from Closed Session at 7:30 p.m., City Attorney there advised Reconvened that there was no reportable action, but that the City Manager Performance Appraisal City Atty. was continued to the meeting of April 3, 2000. Mayor Madrid called the meeting to order and led in the Salute to the Flag. Call to Order INVOCATION was given by Reverend Mark Carlson of the First Presbyterian Church. PUBLIC PARTICIPATION Roll Call Also Present Pub Participation Mr. Rick Graham of the Azusa Educators Association and its Treasurer, Larry Azusa Educators Woodruff, presented a check to the City in the amount of $500 for the Water Safety Assn - $500 to Program. Wtr Safety Pgrm Ms. Lorraine Feith addressed Council requesting that they appeal an action of the L. Feith re: Planning Commission regarding a Construction Labor School on the property located at Appeal of PC 'Todd and Sierra Madre. She advised that she did not want to pay the appeal fee of $175 action. To be and that there was a need to take action because the time for appeal would soon expire. placed on 4/3/00 It was decided that the issue be placed on the agenda for consideration for the meeting agenda of April 3, 2000, as the appeal period wouldn't expire until April 4th. REPORTS, UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF Update/Cncl/staff City Manager Cole provided updates on the issues of Fireworks in the City, increases in City Mgr Cable Television rates, and the Day Labors. He advised that input will be sought from updates Historical Commissioners regarding Civic Auditorium renovation. Councilmembers advised they would like to provide input also. He reminded all of the Solid Waste Workshop to be held on Monday, March 27, 2000, in the Civic Auditorium at 7:30 p.m. Councilmember Stanford offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPOINTING JOSEPH R. ROCHA AS MAY PRO -TEM. Moved by Councilmember Stanford, seconded by Councilmember Hardison to waive further reading and adopt. Resolution passed and adopted by the following vote of the Council: AYES: COUNCILMEMBERS: HARDISON, STANFORD, ROCHA, BEEBE, MADRID NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: NONE Res. 00-C34 J. Rocha appointed as Mayor Pro -tem Councilmember Stanford displayed a photograph of Miss Azusa and her Court and the Stanford program for the event, noting all of the participants and sponsors. He provided a history comments of the Munson Chapel. He displayed Business Life Magazine and noted the ad on the City of Azusa on the back cover. Councilmember Hardison requested that Council abide by rules of decorum for Council Hardison meetings and stick to the time of adjournment which is 10:30 p.m. comments Councilmember Beebe announced the Woman's Club Prayer Breakfast, on Wednesday, Beebe April 12' at the First Presbyterian Church at 639 Soldano, at 8 a.m. comments Councilmember Rocha asked all to keep in prayer the families of Gilbert and Ruben Alva who recently passed, and Daniel Rosales, a 5" grader who has been suffering from headaches. He reminded all that there will be a City Cleanup on Saturday April 11t, and they will be planting Oak trees; meet at the Ranch Market at 8 a.m. He requested that staff research the feasibility of placing a watering system and grass at the City owned 'property on Sixth Street and San Gabriel and Fifth Street and Azusa Avenue, in order for kids to play during the summer. He made comments regarding the dedication of the bike trail, the problems the residents have been having with golf ball in that area and the liabilities involved. He graciously accepted the position of Mayor Pro Tem and dedicated this year of service to all the grandparents who devote their time to their grandchildren and to his parents who gave up much in order for him to become a teacher. Mayor Madrid announced that the City is accepting applications for Police Records Specialist and Police Officer Trainee. She also reminded all to fill out the Census 2000 in order to receive a complete count for the community. She thanked all who attended the Miss Azusa Pageant, especially the Master of Ceremonies Christopher Carruthers, Tony Maturo and Tyler Somes. SCHEDULED ITEMS Rocha comments Madrid comments Scheduled Items Study of a Proposed Utility Cut Ordinance. Excavations in paved street degrade and Study of shorten the life of pavements beyond the area of the excavation; imposition of a trench Proposed Utility cut fee will fund the maintenance, repair, or resurfacing necessary to fully mitigate Cut Ordinance damage and degradation caused by excavations. City Engineer Abbaszadeh addressed the issue summarizing the Utility Cut Ordinance City Engineer 'of Bakersfield and League of California Cities. The Bakersfield ordinance is a comment workmanship ad performance warranty fee, and an infrastructure coordinating committee. The League of California Cities ordinance establishes a zone of influence that a trench creates around the cut and seek funds to repair the damage. He then answered questions posed by Councilmembers and discussion was held. Councilmember Beebe requested that staff include survey of what surrounding cities are doing. Ms. Helen Romero Shaw of the Southern California Gas Company and Ms. Donna Lee H. Shaw & D. of Southern California Edison addressed the issue in favor of the Bakersfield Ordinance. (Mayor Madrid increase the amt. requested that she get a report on how much is being spent on bus passes versus the Metrolink subsidy). A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Res. 00-C38 AUTHORIZING THE ISSUANCE OF A PURCHASE ORDER IN AN Underground AMOUNT OF $10,314.06 TO HENDRIX CABLE CO. OF MILFORD NEW Copper Cable HAMPSHIRE, FOR THE PURCHASE OF 6,000 FEET OF 15KVA 1/0 Hendrix Cable PRIMARY UNDERGROUND COPPER CABLE. H. Grant Funds sought by the Police Department entitled Community Oriented COPS MORE Policing Services (COPS MORE) were awarded in October 1999, in the amount Expenditure ' of $158,270. The approved projects are the Public Safety Computer System Plans and Upgrade, including Mobile Data Computers. Approval was given to amend the Purchases City's 1999-00 budget to include the appropriation of funds to be received from approved the U.S. Department of Justice's Office and the proposed expenditure plans and purchases. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, Res. 00-C39 CALIFORNIA, APPROVING THE THIRD AMENDMENT TO THE SAV -ON Third Amend (FORMERLY RITE AID) DRUG STORE PURCHASE AND SALE Agmt Sav-on AGREEMENT AND AGREEMENT CONTAINING COVENANTS AND RESTRICTIONS AFFECTING REAL PROPERTY. N. Resolution authorizing payment of warrants by the City was adopted and entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Res. 00-C40 ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE Warrants FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. SPECIAL CALL ITEMS Special Call Items Mayor Madrid expressed concerns regarding the return check policy of the Rules and Madrid Regulations for the Light and Water Department. The policy states that if there is a comments check returned, the customer would have to pay their bill in cash or money order for the next six months. Utilities Director Hsu stated that the rule regarding return checks is in the policy but is Utility Dir handled very delicately and if the customer has a good payment record they take that response ' into consideration. Mayor Madrid asked that the statement regarding customer service be included Madrid & Hsu somewhere, that with "a customer that has a good payment record," discretion will be comments used. Utilities Director Hsu advised that it will be placed in employee training manual. Councilmember Rocha offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, Res. 00-07 CALIFORNIA, AMENDMENT THE SCHEDULE OF CHARGES AND RULES AND Amend Schedule REGULATIONS GOVERNING THE ELECTRIC AND WATER SERVICE SUPPLIED of Charges & BY THE LIGHT AND WATER DEPARTMENT OF THE CITY OF AZUSA. Resolution passed and adopted by the following vote of the Council: AYES: COUNCILMEMBERS: HARDISON, STANFORD, ROCHA, BEEBE, MADRID NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: NONE Councilmember Rocha addressed item regarding participation in Foothill Regional Air Rocha Support Team (FAST), questioning the hours of operation that the helicopter will patrol. comments Interim Chief of Police Garcia responded stating that the helicopter patrol and air support COP Garcia services to the city of Azusa will be on Friday and Saturday evenings from 6 p.m. to response midnight. 03/20/00 PAGE FOUR Moved by Councilmember Rocha, seconded by Councilmember Stanford and Foothill Regional unanimously carried to approve expenditure of $28,181 from the Citizen's Option for Air Support Team Public Safety (COPS or the Brulte Bill) funds and authorize the Police Department to (FAST) participate in the Foothill Regional Air Support Team (FAST) with participating departments, and accept the terms of the Joint Powers Agreement. Councilmember Rocha voiced concerns regarding the lack of new appointments of Park Rocha Maintenance workers or Tree Trimmers; as they are understaffed. He advised that he comments re: would like to see Park Maintenance fully staffed.
