The City Council/Redevelopment Agency of the City of Azusa met in regular session Cncl/CRA recess 'at the above date and time in the City Manager's Office to conduct a Closed Session on to closed session the following: PUBLIC EMPLOYEE PERFORMANCE EVALUATION (Gov. Code Sec 54957) Title: City Manager. CONFERENCE WITH REAL PROPERTY NEGOTIATOR (Gov. Code Sec. 54956.8). Property Address: 237 S. Azusa Avenue Negotiator: Economic/Redevelopment Director Andrews Under Negotiation: Terms for sale or lease. LABOR NEGOTIATIONS (Gov. Code. Sec. 54957.6). Agency Negotiator: City Manager Cole Re: Golden Handshake. CITY COUNCIL AND REDEVELOPMENT AGENCY CONVENED IN THE Convened CIVIC AUDITORIUM IN ORDER TO CONDUCT ITS REGULAR MEETING. Civic And The City Council/Redevelopment Agency returned from Closed Session at 7:23 p.m., No Rpts City Attomey/General Counsel Martinez advised that there was no reportable action Clsd Sess taken in Closed Session. Mayor Madrid called the meeting to order and led in the Salute to the Flag. Call to Order INVOCATION was given by Reverend Rick Mac Donald of the Foursquare Gospel Invocation Church. CEREMONIAL Ceremonial The entire Council presented Certificates of Recognition to Saint Frances of Rome Cert of Recog. School Lancers, Boys Varsity Basketball Team. Lancers The entire Council presented a proclamation to Associate Director of Recreation and Proc Arbor Day Parks Noriega, proclaiming April 20, 2000, as Arbor Day in the City of Azusa. The entire Council presented a proclamation to City Librarian Maghsoudi, proclaiming Proc National the week of April 9-15, 2000, as National Library Week. Library Week The entire Council presented a proclamation to Ms. Lana Grizzell and members of the Proc Civitan Civitans, proclaiming the month of April, 2000, as Civitan Awareness Month. Awareness Month The entire Council presented a proclamation to Ms. Kathy Ford of Project Sister, Proc Sexual proclaiming the month of April, 2000, as Sexual Assault Awareness Month. Assault Aware Ms. Lana Grizzell, Executive Co -Producer of the Miss Azusa Pageant introduced Miss Intro Miss Azusa Queen Janell Proctor and court member Princess Annalisa Abbs to members of Azusa & Court the Council and audience. Princess Hannah Lucas was unable to attend the meeting. Mr. Searcy Principal of Gladstone High School presented the State of the School Address. State of the Sch. PUBLIC PARTICIPATION Pub Participation The following members of the audience expressed their opinion regarding City Manager Comments from Cole covering over sexually suggestive language on a billboard advertising: Randy audience re: Noriega, Gilbert Becerril, Art West, Ron Legault, Mike Lee, Keith Hanks, Rick covering over MacDonald, Mark Ades, Hank Bode, Yolanda Pena, and Art Morales. Each suggestive Councilmember voiced their opinion regarding the issue. City Manager Cole addressed language on the issue offering to pay a $1000 fine for his actions. Mayor Madrid suggested that the billboard City accept the $1000 and that Mr. Cole work on Councilmember Rocha's Saturday clean up crew as a community service. SCHEDULED ITEMS Scheduled Items PUBLIC HEARING - to consider Azusa Landscaping and Lighting Assessment District Pub Hrg for Fiscal Year 2000-2001, and annually thereafter. Assessment Fees The Mayor declared the Hearing open. The City Clerk read the affidavit of proof of Hrg open publication of notice of said hearing published in the Azusa Herald on March 29, 2000. City Manager Cole advised that there was no change in Assessment Fees for this year. City Mgr comments Moved by Councilmember Stanford, seconded by Councilmember Beebe and Hrg clsd unanimously carried to close the Public Hearing. Councilmember Beebe offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, Res. 00-C41 CALIFORNIA, CONFIRMING THE ENGINEER'S REPORT, DIAGRAM AND Confirming ASSESSMENT FOR THE 2000-2001 FISCAL YEAR IN CONNECTION WITH "CITY Engr Rpt, OF AZUSA LANDSCAPING AND LIGHTING ASSESSMENT DISTRICT NO. 1 Diagram & (COMMUNITY MAINTENANCE FEE)" PURSUANT TO THE LANDSCAPING Assessment AND LIGHTING ACT OF 1972. for 2000-2001 Moved by Councilmember Beebe, seconded by Councilmember Stanford to waive further reading and adopt. Todd Avenue, was moved to Special Call Items portion of Laborers' the Agenda in order to be considered with item V -J. A. The Minutes of the regular meeting of March 20, 2000, and the adjourned regular Minutes Appvd meetings of February 26", and adjourned regular/special meetings of March 13`h and March 27th, were approved as written. B. Bid opening was held in the Office of the City Clerk on March 28, 2000, for Street Agmt for Street Improvements 2000; five bids were received. The contract was awarded to Impvmts 2000 Mobassaly Engineering, Inc., low bidder, in the amount of $625,380.80. Mobassaly Engr. C. Agreement with Urban Forest Maintenance Program in the amount of $94,000, Agmt w/Urban was approved and its execution was authorized. The agreement will be a piggy Forest Maint. back contract under a previous bid approved by the City of San Bernardino; City Program of Azusa contract and tree trimming specifications will govern the contract. D. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, Res. 00-C42 CALIFORNIA, DECLARING ITS INTENTION TO CONSIDER VACATING Dec intention A PORTION OF ELEVENTH STREET, EAST OF OLD MILL ROAD. (Staff to vacate portion is to include price or cost, charged historically, in upcoming Public Hearing). 11th Street. E. The Meter Service Agreement for Scheduling Coordinators was approved and the Meter Svs Agmt City Manager or his designee was authorized to administer it pursuant to the terms for Scheduling and conditions of the Agreement. Coordinators F: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Res. 00-C43 AUTHORIZING THE DESTRUCTION OF CERTAIN RECORDS IN THE Auth Destruction HUMAN RESOURCES OFFICE. HR records G. Human Resources Action Items were approved as follows: Human Resources Merit Increase and/or regular appointment recommendation: L. Onaga, K. Action Items Williams, J. Velasco, B. Bailey, and D. Shuttleworth. H. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Res. 00-C44 PROCLAIMING APRIL 22 AS "EARTH DAY" AND ENDORSING THE Proclaim 4/22 EARTH DAY CLEAN ENERGY AGENDA. Earth Day I. The California Transportation Commission's 1999 Needs Study Report identified Support Street a backlog of $12.8 billion in road and bridge rehabilitation needs at city and Roads county level. The Mayor was authorized to send a letter to the Governor and to Appropriation in Azusa's legislative delegation requesting an appropriation of $500 million in new State Budget funding for city street and county roads in the 2000-2001 State Budget. The City Treasurer's Report as of January 1, 2000, was received and filed. Treas Rpt N. Resolution authorizing payment of warrants by the City was adopted and entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Res.00-C45 ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE Warrants FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. 04/03/00 PAGE THREE SPECIAL CALL ITEMS Special Call Items Discussion was held between Councilmembers and staff regarding SB 1377 and AB 2188 Discussion re: SB which would eliminate existing sales taxes on any Internet transactions in California. 1377 & AB 2188 Since the City depends upon its sales tax revenue to pay the cost of public safety and - eliminate maintenance, it was moved by Councilmember Stanford, seconded by Councilmember existing sales tax Hardison and unanimously carried by roll call to approve joining with the League of on Internet California Cities and the California Business Tax Association in opposing these (opposed) _ measures. Item regarding consideration to "Call Up" the Planning Commission's decision to "Call Up" of PC approve Conditional Use Permit C-2000-01 and Precise Plan of Design P-2000-01, to decision re: construct a Laborers' Training School at 1201 N. Todd Avenue, and Acceptance of a Laborers' Dedication of Land and Grant Deed for the "Trail" on the Northwest corner of Sierra Training School Madre and Todd Avenues, were considered jointly and lengthy discussion was held & Dedication of between Councilmembers, staff and applicant, Vince O'Hare Mc Morgan and Company, land & Grant representative of Southern California Laborers' Training and Re-training Trust Fund. Deed The "Call Up" was requested at the last meeting by Mrs. Feith, who asked Council to "Call Up" re: consider appealing Planning Commission approval of the proposed Laborers Training Laborers' School, as she did not have the fees to appeal the matter herself, she felt that the Training surrounding residents were not adequately notified and that the noise would be a School on Todd problem. After discussion by Councilmembers and staff, there was no action taken on Avenue (No this item. NEXT ORDINANCE NO. 2000-06. 04/03/00 PAGE FOUR Cncl reconvened Adjourn in memory of Bill Hunter, Leslie Steele, Lucy Ramos and Bob White Community Development Director Bruckner detailed item regarding "Acceptance of a Com Dev Dir Dedication of Land and Grant Deed for the "Trail" on the northwest corner of Sierra comments Madre and Todd Avenues" as follows: the original subdivision establishing the trail was re: Acceptance supposed to be maintained by Cal Mat, Vulcan, owners of the property, as they were of Dedication of going to build an industrial park and the trail would double as a fire access lane. Now the Laborers' Training School is purchasing the entire property and there is no need for land and Grant Deed for the the original subdivision, as it exists, to continue and no need for the fire access lane to "Trail" on the be there. The applicant asked if the city will accept the trail as a public facility because northwest corner they did not want to accept the liability. Staff advised that this could not be considered of Sierra Madre unless there was protection against errant golf balls and ongoing maintenance, which was and Todd calculated at $100,000.
