The City Council of the City of Azusa met in regular session at the above date and time Cncl recess to in the City Manager's Office to conduct a Closed Session on the following: closed session LABOR NEGOTIATIONS (Gov. Code. See. 54957.6). Agency Negotiators: City Manager Cole, Chief Negotiator Bill Floyd, Assistant City Manager Craig, and Human Resources Manager/Personnel Officer Wallace. CITY COUNCIL CONVENED IN THE CIVIC AUDITORIUM IN ORDER TO Convened CONDUCT ITS REGULAR MEETING. Civic Aud The City Council returned from Closed Session at 7:25 p.m., City Attorney/General Clsd Sess Counsel Martinez advised that there was no reportable action taken on the fust two City Atty. Closed Session items, but that Council approved the Amicus Brief. comments Mayor Madrid called the meeting to order and led in the Salute to the Flag. INVOCATION was given by Father Granadino of Saint Frances of Rome Church. Martinez, City Manager Cole, Captain Pihlak of the Azusa Police Department, Economic/Redevelopment Director Andrews, Planning Secretary Rocha, Public Information Quiroz, Community Development Director Bruckner, Assistant Community Development Director Onaga, Business Retention/Development Coordinator Marez, Senior Office Specialist Rezentes, Associate Directors of Recreation and Parks Jacobs, Economic Development Specialist Paz, Deputy City Clerk Toscano. CEREMONIAL Call to Order Invocation Roll Call Also Present Ceremonial ' Councilmember Beebe presented a Proclamation to Michelle Bart, proclaiming the month Proc Cancer of April, 2000, as Cancer Control Month. Control Month CLIC PARTICIPATION Pub Participation Mr. Paul Naccachian of the Balzac Cafe addressed Council expressing his opinion P. Naccachian regarding past motions and practices by Councilmembers. Balzac Cafd Ms. Peggy Martinez of the Downtown Business Association addressed Council P. Martinez presenting and detailing the Calendar of Events for the Downtown area and introduced Downtown Area four new business owners in the Downtown area. Ms. Diane Andersen addressed Council questioning the status of the planting of trees on D. Andersen Sierra Madre and noted that there are some oak trees that are dying in that area. She also comments expressed concerns regarding the Stop and Go Market on Sierra Madre, the fencing on the triangle on Sierra Madre and a possible conflict of interest because Councilmember Stanford also owns a newspaper that is circulated in Azusa. Mr. Jerry Rocha addressed Council in favor of new sidewalks in the 100 block of South Sunset and advised that there is a petition circulating among the residents against the sidewalks. He advised that the area is a drop off place for students going to Paramount 'School and that it is a safety issue and need for sidewalks. City Manager Cole advised that there is a need for discussion between the residents and staff to discuss options. Ms. Irma Patino and Maribel Ramirez, victims of the recent fires on Gladstone Street at the Nijar apartments, addressed Council detailing the damage the fire has caused in their lives and requesting aid for shelter. City Manager Cole advised that between the Red Cross, the City's Emergency Services Coordinator, Bruno, Community Improvement Department, Family Resources Center, and Mr. Nijar, owner of the apartments, they would come up with a solution to the problems. REPORTS, UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF Updates/Rpts Moved by Councilmember Stanford, seconded by Councilmember Rocha and National Day of unanimously carried by roll call that all fees be waived in the use of the Civic Prayer 5/4/00 Auditorium for National Day of Prayer Services on Thursday, May 4, 2000. Civic Aud 7pm City Manager Cole addressed Council and audience providing an update on the Citizens' City Mgr Congress, and the purpose is to build a new General Plan for the City: The Congress Updates on: will meet four times. Opening session is Friday, May 12, 2000, with the key note Citizens Congress speaker being Henry Cisneros. The session will continue on Saturday, May 13, 2000, NIZ, Lib Mixer, at the Civic Auditorium and Senior Center. Translations will be offered as well as Child Slauson 'Care for those attending the sessions. He then provided updates on the Neighborhood Improvement Zone, Alternative Fuel Vehicles, Library Mixer, Slauson Park tree planting Memorial for Fernando Vega, the Downtown Charrette, and the Cinco de Mayo Celebration on April 30". Councilmember Hardison requested that staff contact Cathedral City to explore the Hardison feasibility of a skate park, as they have just placed one in their City. comments Councilmember Stanford announced that they have a new grandchild, and further that he Stanford and his wife will be visiting Coventry, England, soon and wishes to be the Good Will comments Ambassador for the City of Azusa. Councilmember Rocha invited all to attend the 4`" of July Parade in Azusa, at 10:00 a.m. Rocha He stated that the family of Dylan Chavarin sends thanks to all and that he is doing fine comments after his operation. He too wishes to look into the feasibility of a skate park and requested that all keep in prayer the families of Amy Perez and former Chief Albert Kendrick, who recently passed away. Councilmember Beebe invited all to the American Cancer Society Relay for Life walk Beebe on 5/20 & 5/21, and thanked all involved in the NIZ. comments Mayor Madrid welcomed all to the coming events. SCHEDULED ITEMS Madrid comment Scheduled Items PUBLIC HEARING - to consider appeal of Planning Commission denial of Zone Pub Hrg Change No. Z-99-01, made by Alexander/Catania and consideration of Planning Zone Change, Commission recommendation for denial of General Plan Amendment No. GPA -99-01 GPA, & TTM and Tentative Tract MP No. 52800, for the property located at 1724, 1730-1770 & 1790- N. Azusa & SG 1830 North Azusa & San Gabriel Canyon Road. Canyon Rd 04/17/00 PAGE TWO The Mayor declared the Hearing open. The City Clerk read the affidavit of proof of Hrg open publication of notice of said hearing published in the San Gabriel Tribune April 7, 2000. Assistant Community Development Director Onaga addressed the issue stating that this is an appeal on a request for a Zone Change, General Plan Amendment and Tentative Tract Map denied by Planning Commission, by Alexander Cantania who wishes to build 30 single family dwellings on the lots located on Azusa & San Gabriel Canyon Road. The main reasons for denial were: density, increased traffic problems, and no submission of a precise plan of design by applicant. He then detailed the proposed project, noting that the applicant has modified its request to 7500 square foot minimum lot size, and reducing lots from 30 to 26 lots in order to reduce density, and to address traffic issue, they will contribute one thousand dollars per lot to go towards mitigating traffic, and one thousand dollars per lot over and above the usual park fee that the City normally collects on projects, to go towards future park developments. He then noted the two options recommended by staff to deny or approve the appeal. Asst Com Dev Dir Comments Ms. Carrie Sawyer addressed the Public Hearing with comments in favor of the C. Sawyer development project proposed by Alexander/Cantania, and submitted twenty-two letters comments in favor of the project. Ms. Jackie Foley addressed the Public Hearing with concerns regarding traffic and J. Foley accurate traffic counts with regard to the project. comments Mr. Angus O'Brien addressed the Public Hearing and read a letter into the record in A. O'Brien favor of the project. comments Mr. Frank Joseph Ledesma addressed the Hearing reading a letter into the record F. Ledesma expressing numerous reasons why he is against the proposed project. comments Ms. Diane Andersen addressed the Hearing with comments regarding the project. D. Andersen comments Mr. Dean Manners of Alexander Community, the applicant, announced that he has D. Manners displayed exhibits of the project for all to view. comments Moved by Councilmember Beebe, seconded by Councilmember Rocha and unanimously Hrg Closed carried to close the Public Hearing. Discussion was held between Councilmembers and staff regarding possible solutions to traffic issues, circulation element of the general plan, funds generated from this development to seek solutions, exit for condo dwellers, possibility of study on widening San Gabriel Canyon Road, possibility of temporary barriers for east and west traffic, traffic impacts, traffic analysis, density, police monitoring during as a proposed solution to during the holiday, concerns with horse property, loss agricultural property, and the need for good quality housing. The following were noted as finding of facts and are to be included as part of the motion by Council approving the Alexander/Cantania appeal of Planning Commission decision to deny request for Zone Change, General Plan Amendment and Tentative Tract Map for the property located at 1724, 1730-1770 & 1790-1830 North Azusa & San Gabriel Canyon Road - (1) That the proposed amendment is in the public interest, and that there 'will be a community benefit resulting from the amendment. The proposed project will provide new housing with larger lot sized in excess of the minimum R-1 6000 requirement than these previous developments and increase the number of single-family homes within the community. (2) That the proposed amendment is consistent with the goals, policies, and objectives of the General Plan. Furthermore, due to the existing R3-2, 000 and R3-3, 000 zoning designations and associated condominium and single- family home developments located west of the site, the R1-6,000 designation is consistent with the pattern of development in this area, and, as proposed, exceeds the General Plan requirements. ;II!%V7DII]Dili _ y Discussion Findings of Facts for approval of Zone Change, General Plan Amendment and Tentative Tract Map Alexander/ Cantania (3) That the proposed amendment will not conflict with the provisions of the zoning ordinance, subdivision regulations, or any applicable specific plan. The proposal meets and exceeds the applicable provisions of the Zoning Code for the proposed R1- 6, 000 zoning designation. (4) That the proposed amendment will not adversely affect surrounding properties. Adverse impacts to subject properties may result if not allowed to change due to trend away from RA to R1 in surrounding neighborhood such as Mountain Cove, Alexander/Cantania, and Mirador Condos. Councilmember Beebe advised that these findings would be also applicable to the proposed Tentative Tract Map. It was consensus of Councilmembers that traffic and park mitigation fees be discussed ' at the next meeting. Moved by Councilmember Hardison, seconded by Councilmember Stanford, and carried by roll call to approve recommendation No. 2, direct staff to prepare the necessary ordinance and resolutions for approval, based on the modified proposal by the applicant for 26 lots and a minimum lot size of 7500 square feet, and based on the findings as articulated in the public hearing. Mayor Madrid dissenting. City Manager Cole provided an overview of the Day Labor issue, which included: a number of meetings held, framework in identifying an alternative location for Day Laborers to do Constitutionally protected activities; not in a residential area, an ordinance that would restrict the solicitation of Laborers, only under those Constitutionally protected activities, a transition plan, and lastly, the cost for the plan. He requested Council support in moving forward to implementation. Finding of Facts continued Staff to prepare necessary documents City Mgr Day Labor Update Bob Donnelson, Yolanda Pena and Dan Ryan addressed the issue in favor of staff Public input recommendations as stated above. The CONSENT CALENDAR consisting of Items VI -A through VI -I, were approved Consent Cal. by motion of Councilmember Rocha, seconded by Councilmember Hardison and VI -A - VI -I unanimously carried A. General AUTHORIZING THE ISSUANCE OF A PURCHASE ORDER FOR AN Pump Co. Well AMOUNT NOT TO EXCEED $87,500.00 FOR REPAIR OF WELL NO. 5. No. 5 Emergency E. Authorization was given to authorize the Mayor to send a letter to the South Coast Ltr support Rule Air Quality Management District supporting Proposed Rule 1191 regarding the 1191, So. Coast Clean On -Road Light and Medium Duty Public Fleet Vehicle. Mgmt District G. Human Resources Action Items were approved as follows: Human Resources Merit Increase and/or regular appointment recommendation: D. Munoz and Action Items J. Polizzi. New Appointments: M. Westrup, Customer Service Representative I, effective 4/24/00. H. The first of four Citizen Congress sessions will convene on Friday, May 12'" and Citizen Congress Saturday, May 13th, in the Civic Auditorium and Senior Center. Confirmation of Delegates the 264 community members as Citizen Congress Delegates was approved. confirmed I. Resolution authorizing payment of warrants by the City was adopted and entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Res.00-C47 ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE Warrants FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. THE CITY COUNCIL RECESSED AND THE REDEVELOPMENT AGENCY Cncl recess CONVENED AT 9:50 P.M. CRA convened THE CITY COUNCIL CONVENED AT 9:51 P.M. Cncl reconvened ORDINANCES/SPECIAL RESOLUTIONS Ord/Spec Resos City Manager Cole explained the proposed ordinance which authorizes staff to solicit City Mgr proposals to build a shelter and collect revenues from entities wishing to advertise. comments Discussion was held regarding proposed contents of the Franchise Agreement. Discussion re: Councilmember Rocha requested that "Upon request, franchisee shall transmit to the City Proposed color copies of any or all adds proposed, etc." be amended to read "As a matter of Franchise Agmt routine or a requirement is that, franchisee shall transmit to the City color, etc." for Bus Shelters & Further discussion was held and Council requested that the City have final review of Bus Benches content of ads and the City Attorney advised that they would strengthen the agreement as much as possible. Councilmember Rocha offered an Ordinance entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, 1' Rdg Ord CALIFORNIA, ADDING ARTICLE VIII TO CHAPTER 62 OF THE CITY OF Franchise for AZUSA MUNICIPAL CODE PERTAINING TO BUS SHELTER AND BUS BENCH Bus Shelters & FRANCHISES FOR CITY SERVICE. Bus Benches Moved by Councilmember Rocha, seconded by Councilmember Beebe and unanimously Proposed Ord carried to waive further reading and introduce the ordinance.
