The City Council of the City of Azusa met in a regular session at the above date and Cncl recess time in the City Manager's Office to conduct a Closed session of the Following: to closed session CONFERENCE WITH LEGAL COUNSEL -EXISTING LITIGATION (Gov. Code Sec. 54956.9 (a)). McCurdy vs. City of Azusa, et. al. Case No. 99CO2938, Los Angeles Municipal Court. CONFERENCE WITH LABOR NEGOTIATOR (Gov. Code. Sec. 54957.6). Agency Negotiators: Chief Negotiator Bill Floyd, City Manager Cole, and Human Resources Manager/Personnel Officer Dottie Wallace. RE: Bargaining Units: ACEA, AMMA, APOA, IBEW, APMA and CAPP. COUNCILMEMBERS CONVENED IN THE CIVIC AUDITORIUM IN ORDER Convened TO CONDUCT ITS REGULAR MEETING. Civic And The City Council returned from Closed Session at 7:25 p.m.; there was no reportable action taken in Closed Session. Mayor Madrid called the meeting to order and led in the Salute to the Flag. Call to order INVOCATION was given by Reverend Gilbert Becerril of Pathfinder Veterans Invocation Outreach Ministries. Public PUBLIC PARTICIPATION Participation Mrs. Rosemary Salce, Chairperson of Golden Days Committee, addressed Council and R. Salce audience to gave an update on Golden Days events. Golden Days update Randy Noriega, addressed Council to give an update on Golden Days Parade, he also R. Noriega, I extended an invitation to the first annual "Dfa de Musica" event that will be held on Golden Days August 8, in the 600 block of Azusa Avenue. Parade Update Joe Guarrera gave an update on events planned for this year's Golden Days Parade. J. Guarrera He also congratulated Joe Rocha for the 4`s of July parade. Golden Days Update Gloria Calderon, Special Events Chairperson, gave an update on planned Golden Days G. Calderon Events for this year. Golden Days Update Jim Rose, Post Commanding Officer for VFW, and also represening the American J.Rose BFW Legion, The Foundation of Families in Need and the Eagles, expressed their thanks for appreciation, on their behalf, to the City for its cooperation on the Walk of Freedom Walk of Memorial in front of City Hall. He also presented the City with a check in the amount Freedom of $3,200.00 to help with this project. Marc McMurchie Community Collaborator for Azusa Pacific University (APU) Marc Community Services Learning, addressed Council to announce the new student McMurchie ' orientation service day at APU on September 5, at which students can participate by APU offering Community Services. REPORTS, UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF Rprts & Updates Manager Rick Cole addressed Council and announced a report which will be presented R. Cole to Council at a later meeting. This report will include information on Azusa's housing, report Azusa education, commercial developments, business etc. Develop Councilmember Stanford addressed Council expressing his concerns on hate crime. Stanford re. hate crime Councilmember Hardison, directed staff to follow up on ADA requirements on Hardison sidewalk located on the West side of Todd Ave. He also requested staff to check the comments possibility of opening up a skate board park in the city. Councilmember Rocha, extended an invitation for all to participate on the monthly Rocha invite clean up activity that will take place on Saturday, August 5, on Dalton St. from First clean up to Fourth Street. He also announced the 1959-69, Azusa High School Reunion on month October 2151 at the Pomona Fairplex. ISCHEDULED ITEMS Sched Items PUBLIC HEARING - on C-98-13 & P-98-144: Modification to Conditions of Pub Hrg on Approval of Conditional Use Permit No. C-89-20, Precise Plan of Design No. P-89- Azusa Rock 181, and City Resolution No. 8553 for the Azusa Rock Quarry located at 3901 Fish Canyon Road. The Mayor declared the Hearing open. The City Clerk Read the affidavit of proof of Hrg open publication of notice of said hearing published in the Azusa Herald on July 6, 2000. Community Development Director Bruckner addressed the Hearing stating that this is a recommendation by the Planning Commission to approve an application by Azusa Rock (Vulcan Material). Azusa Rock is requesting to increase the hours of operation to allow the existing conveyor belt to operate after-hours, Monday through Friday, 10:00 p.m. to 6:00 a.m. After-hours operation would be limited to the transportation of overburden unsable material which consists of small grain sand. Conditions are in place for this request, which will be enforced if approved, and tests have been conducted for noise and dust. He then answered questions posed by Councilmembers regarding noise and dust control, monitoring and tonnage increase. ' Steve Cortner, Area Manager for Vulcan Material, Ca1Mat Division, addressed the Hearing pointing out issues and concerns that were discussed before Planning Commission. Some of these concerns were the increasing activity of mining the mountain, noise & dust if the operating hours of the conveyor belt are increased. He explained that increasing the operations of the conveyor belt would be only to remove the overload by using the conveyor belt instead of using trucks to remove it. He also informed that third party experts had been hired to do a study on noise and dust, to make sure that they are in compliance. 07/17/00 PAGE TWO Bruckner request to extend hrs to operate conveyor belt S. Goacher addressed the Hearing explaining the studies that have been conducted regarding the noise issues noise that is produced by the operation of the conveyor belt.' He explained other noise sources around that area, and that this operation meets the noise level in compliance with the Azusa Noise Ordinance. Manager Rick Cole addressed the Hearing to clarify that there were no formal tests Cole address done prior to this hearing, all tests done were informal. hrg. ' Several residents surrounding this area addressed the Hearing expressing their concerns Residents on the existing noise, dust and the mining of the mountain. They all expressed their expressed opposition to extending the hours of operation to the conveyor belt. These residents opposition were the following: Ms. Carol Montano, 1465 N. Hilltop Dr. C. Calle de La Luna #3 D.Thompson Mr. Andy Valentine and Mrs. Pam Valentine, 1829 Mirador Dr. Valentines Ms. Deborah Richardson, 1191 Calle Del Sol #1 Richardson Ms. Betty Thomas, 302 Channing B. Thomas Mr. Dan Slater, Attorney for Rutan and Tucker of Costa Mesa, and representing City D. Slater of Duarte, addressed the Hearing expressing opposition, on behalf of the City of Atty City of Duarte, to the request. He also expressed concerns from the City of Duarte on the Duarte methods of enforcement to some of the conditions of approval. opposed Mayor Madrid announced two written opposition letters received from Ms. Barbara written A. McIver and Mr. and Mrs. John and Dianne Mansfield. oppositions Moved by Councilmember Beebe, seconded by Councilmember Stanford and Close unanimously carried to close the Hearing. Hearing City Attorney Carvalho addressed Council to the recommendation made by Planning Atty Commission. Two Resolutions are being presented for consideration. comments Discussion was held among Councilmembers regarding noise, environment, safety and Discuss extraction fees. There was further discussion concerning the possibility of allowing more time to conduct formal research involving the residents and/or creating a committee to help correct existing problems, and report findings to Council at a future meeting. Moved by Councilmember Beebe, seconded by Councilmember Hardison and Deny unanimously carried to deny the request made by Planning Commission and to create Hearing a citizens' committee to define issues currently existing. The CONSENT CALENDAR consisting of Items V-A through V -F, was approved by Consent Cal motion of Councilmember Stanford, seconded by Councilmember Beebe and F Spec Call unanimously carried with the exception of item F, which was considered under the Special Call portion of the Agenda. BEAUTIFY SAN GABRIEL CANYON RD. 07/17/00 PAGE THREE i C. The Annual Renewal Agreement for Operation of the Head Start Program for Head Start 2000-01, was approved and its execution was authorized. Annual Agmnt. D. Human Resource Action Items were approved as follows: Human Res Merit Increase and/or Regular Appointments Recommendation: R. Hart, J. actions Knowlton, C. Kalscheruer, M. Delano, M. Quiroz, and R. Torres. New Appointments: G. Zendejas, Police Officer Trainee, effective 7/18/00. F. Wong, Assistant Planner, effective 8/2/00, contingent upon passing physical examination. E. Bid opening was held in the Office of the City Clerk on July 10, 2000, for the Preferred Contract for Child Care Food Program for the Azusa Head Start State/Pre- Meal for school, two bids were received. The Contract was awarded to Preferred Meal Head Start System, Inc., low bidder, in the amount not to exceed $88,818.75. meals F. SPECIAL CALL ITEM. SPECIAL CALL ITEMS Spec Call Spec Call Councilmember Rocha expressed his concern regarding taxi cabs parking in residential Rocha areas and drivers taking naps, as well as congregation of taxis in unpermitted areas. comments taxi cabs Mayor Madrid stated that rates are being requested to bring them up to compare with Madrid the Los Angeles and other San Gabriel Valley areas. She explained that in Azusa, comments transportation is less than other areas and parking is free of charge, therefore she does not see a need for rates to be increased. Azusa, in order to have a joint L&W 7/24 meeting with Planning Commission and to address the issue of appointing a Community Committee for the recruitment process of Police Chief.
