The City Council of the City of Azusa met in regular session at the above date and time in the City Manager's Office to conduct a Closed Session. I PUBLIC PARTICIPATION Pub Part. Ms. Peggy Martinez voiced opposition to selling the above noted parcel to a developer P. CITY COUNCIL CONVENED IN THE CIVIC AUDITORIUM IN ORDER TO Convene to And CONDUCT ITS REGULAR MEETING. City Attorney Carvalho reported that Manager was authorized by a 5-0, vote of the City Attorney Council to officially release Police Officer Joel Crawford, on an Industrial Disability advised of action Retirement. An item of subsequent need arose and it was moved by Councilmember Closed Session Stanford, seconded by Councilmember Beebe and unanimously carried to agendize Item of Sub need Closed Session item under Government Code Section 54957, Public Employment, Title: Closed Sess Police Chief. The item will be handled at the end of the Council meeting. Mayor Madrid called the meeting to order and led in the Salute to the Flag. Call to Order INVOCATION was given by Reverend Jimmy Armendariz of New Harvest Church. Roll Call Also Present Mayor Madrid, accompanied by Councilmembers, administered the Oath of Office to Oath to Officer new Azusa Police Officer George Zendejas, and welcomed him to City employment. Zendejas PUBLIC PARTICIPATION Pub Participation Mrs. Rosemary Salce, Chairperson of the Golden Days Committee, and Associate R. Salce & R. Director of Recreation and Parks Noriega, requested that all fees in association with the Noriega waive Golden Days events be waived, i.e. Business licence fees for carnival and parade fees Golden Days operators, use of City facilities, Woman's Club and Senior Center. Moved by Councihnember Stanford, seconded by Mayor Pro -Tem Rocha and carried that Fee waived the fees for Golden Days events be waived. Councilmember Beebe abstained. GD Ms. Gloria Calderon and other members of the Golden Days Committee, announced the G. Calderon week long Golden Days events as follows: Chamber of Commerce Free Family Health & GD Committee Fair, Helping Hand Dinner/Dance, APU 5K Run for the Gold, Free Family Festival, Calendar of Azusa Civitans Chicken and Ribs Dinner, Azusa Woman's Club Tamale Dinner, Events Downtown Business Association Talent Show, Helping Hand Bingo Night, Azusa Sister City Semi -Formal Reception, Elks Pancake Breakfast, Classic Car Show, Deacons Golden Days Fiesta and parade. Mr. Edward M. Jackson addressed Council and audience offering $1,000 to go towards E. Jackson a reward that leads to the arrest of the person responsible for taking the life of Gejuan comments Salle, a youth that was shot to death in Azusa. He read a letter into the record that expressed his feelings regarding the freedom for all in this Country. Interim Chief of Police Garcia responded to the issue stating that staff has contacted COP Garcia Governor Davis's office and is applying for a reward from a State fund in the amount of comments $50,000. 'City Manager Cole also responded stating that they will begin with the State, but have City Mgr placed flyers throughout the community asking for any information relating to the crime. comments He advised that staff will look into the feasibility of other options and will bring back a list. He noted that other incidents that have occurred were classified as hate crimes, but, this homicide is not classified as a hate crime. Ms. Reagan Tucker, Senior at Azusa Pacific University, addressed Council advising that R. Tucker she has been elected as the Azusa Senator of APU, and that she will be getting more comments involved in City issues to raise awareness at APU; she can be reached at 812-3019. Mr. Jaime Martinez addressed Council expressing his appreciation to the Azusa Police J. Martinez Department and its officers for an incident in which he was involved a few months ago. comments Mr. Dennis Rose addressed Council expressing his opposition to the Adventure Pass in D. Rose Azusa Canyon. comments Mr. Bob Bartsch addressed Council expressing his opposition to the Adventure Pass and B. Bartsch asked that Council not renew the lease of Canyon entry booth on City property. comments Ms. Joy Bianchi Brown of Azusa Pacific University addressing Council advising that she is leaving APU and will be moving back to San Francisco and thanked all the people with ,whom she had been working in the City. Ms. Alice Rubio, Ms. Cheryl Norton and their grandchildren addressed Council expressing appreciation concerning the City's plans for a Skate Park and invited all to attend a car wash and bake sale to raise fund for the Park, to be held on Saturday, September 23, 2000, at the VFW, and invited all to come and help out with the event. Ms. Alicia Jimenez solicited tickets sales for the event. Mr. Bill Sena also thanked all for their involvement with the Skate Park. 09/18/00 PAGE TWO J. B. Brown comments A. Rubio & C. UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF Rpts/Updates Mayor Pro -Tem Rocha thanked Bill Sena for donating the pre -sale tickets for the car Rocha wash/bake sale, to raise funds for the Skate Park. comments City Manager Cole announced that the 2d Citizen's Congress will be held on October 21, CityMgr 2000, from 9 a.m. to 4 p.m. at Azusa Pacific University. comments Library and Community Services Director Maghsoudi, Senior Librarian Stewart Maghsoudi & addressed Council detailing the Satellite Project with Mountain View and Murray Stewart Schools; they thanked Principals Blinkenstaff and Hamilton, and School Board comments representative Ilene Ochoa, who also addressed the issue and spoke about the program. Children from both schools will be brought into the Library on Tuesdays and Thursdays for lessons in Library skills, story time and opportunity to borrow library books. Associate Director of Recreation and Parks Noriega invited all to attend the first public Noriega outreach meeting regarding the Skate Park to be held on Tuesday, September 26, 2000, comments in the City Auditorium. He then displayed new t -shirt, jackets, and sport shirts that Recreation and Parks Department will be selling. Councilmember Hardison expressed his concern to Mr. Jackson about the children and Hardison residents of the City and their safety. He asked his colleagues to dress up in the comments appropriate Golden Days attire for the next meeting. Mayor Pro -Tem Rocha invited all to the VFW car wash and bake sale to raise money for Rocha the Skate Park. He expressed concern about the high speeds of traffic on San Gabriel comments Boulevard, stating there is a need to do something about it. Mayor Madrid reminded all about the Hazardous Waste Clean up on Saturday, Madrid September 23, 2000, at Aerojet. She also invited all to the Rincon Station this Saturday comments to plant trees. SCHEDULED ITEMS Scheduled Items CONTINUED PUBLIC HEARING -to consider amending the Azusa Municipal Code, Pub Hrg deleting Division 3 of Article V, Chapter 2, regarding procedures for the Cultural and Historic Historical Landmark Commission, and adding Chapter 55, creating new procedures for Preservation Ord. the Cultural and Historical Preservation Commission and adding Historic Preservation regulations and to adopt a list of Potential Historical Landmarks. The Mayor declared the Hearing open. City Clerk read the proof of publication of notice Hrg open of said Hearing published in the San Gabriel Valley Tribune on August 11, 2000. Community Development Director Bruckner addressed the issue providing background Com Dev Dir on the issue of Historical Preservation and stated that the Cultural and Historical comments Landmark Commission is recommending two major items, a Historic Preservation Ordinance and a List of Potential Historic Landmarks. He highlighted and detailed the two categories of designations; Potential Historic Landmarks and Historic Landmark. He stated that the proposed ordinance provides for the use of incentives, such as: use of the State Historical Building Code, Mills Act contracts, Building Permit fee relief (60%), Setback flexibility, nonconforming parking relief, and recognition program. He noted demolition, residency requirements, items to be corrected on the proposed ordinance, a letter from APU and answered questions posed by Councilmembers regarding residency requirements, demolition, clarification of sections of the ordinance; Evidence of Notice and Action of Hearing Body and Continuance of Hearing, criteria for designation, and how properties get on the list. City Attorney Carvalho also responded to Council concerns. 09/18/00 PAGE THREE City Clerk Solis read a letter into the record from Clifford E. and Mary S. Wetherbee, City Clerk read requesting that their property be removed from the designated list. Ltr into record Mr. Hank Bode of Azusa Pacific University addressed the Hearing stating that he is in H. Bode favor of legitimate historical sites in communities, but that this ordinance is drafted comments where it's almost punitive to homeowners, or property owners and detailed why he thought that; further stating that he would like to see an ordinance where it is voluntary for people to participate, he advised that there was no notification of the Public Hearing, that his main concern, as he is going to purchase the property, is that the marquee at the Azusa Drive In is on the designated list and requested that the ordinance be amended. He then answered question from Mayor. Mr. Jay Swerdlow, Executive Vice President of Pacific Theaters and new owner of the J. Swerdlow Azusa Drive In, addressed the hearing advising that he was never notified of the Public comments Hearing and objected to the Azusa Drive In marquee being on the designated list of properties, as to him, it has no architectural significance. Mr. Bill Larson, Attorney for Azusa Pacific University, reiterated that he is in favor of B. Larson historical preservation, but questioned several sections of the proposed ordinance and comments wanted to know why the marquee was selected as a designated site. Mayor Madrid responded that it is the only one left in the valley from Route 66 era. Mr. Klaus Kravis addressed the Hearing stating that he is in favor of preservation of K. Kravis historical buildings, but that he was led to believe it was voluntary. He summarized the comments criteria for getting on the list of designated and questioned why his property is on the list, his neighbors are not; further that he sees no incentives to being on the list. Mr. Mark Ades, a property owner on the potential list, advised that he is in favor of the M. Ades ordinance, because he thinks its time the City of Azusa has a historical ordinance to comments protect it's history; further, most cities have them. I. Edward Hlava, member of the Cultural and Historical Landmark Commission, E. Hlava ressed Council and audience detailing the goals of the proposed ordinance, and comments compared it with some stronger ordinances that are in existence. He then answered questions posed by Councilmembers regarding alternative types of preservation, status of property on potential lists with or without the ordinance, the canal, and the Drive In. After lengthy discussion, it was moved by Councilmember Stanford, seconded by Pub Hrg Councilmember Beebe and unanimously carried to continue the Public Hearing to the continued to next Council meeting on October 2, 2000. 10/2/00 mtg PUBLIC HEARING -to consider the adoption of a Resolution finding the City of Azusa to be in conformance with the Congestion Management Program (CMP) and adopting the Pub Hrg CMP Local Implementation Report in accordance with California Government Code CMP Section 65089. Moved by Mayor Madrid, seconded by Councilmember Beebe and unanimously carried Hrg continued to that the Public Hearing be continued to the meeting of October 16, 2000. 10/16/00 Mountain Cove Development - Water District Annexation Issues. Standard Pacific Homes, Mountain Cove Development intends to file an application with the Los Angeles 'County Local Organization Formation Commission (LAFCO), for annexation of approximately 80 acres on the north side of their proposed project. Moved by Councilmember Stanford, seconded by Mayor Pro -Tem Rocha and unanimously carried to ask the Upper San Gabriel Valley Municipal Water District to de -annex their island territory and ask the San Gabriel Valley Municipal Water District to annex it into their territory. 09/18/00 PAGE FOUR Mountain Cove Water District Annex Issues The CONSENT CALENDAR consisting of Items V-A through V -H, was approved by Consent Calendar motion of Councilmember Beebe, seconded by Councihnember Stanford and unanimously V-A - V -H carried. Mayor Madrid dissented on item V -B. approved A. Minutes of the regular meeting of September 5, 2000, were approved as written. Min Approved B. Landowners installing utility -owned electric facilities in their private property are Grants of required to grant an easement to Azusa Light & Water Department, which allows Easement the utility -owned right-of-way for operation and maintenance of such facilities. ' Five resolutions accepting Grant of Easement were adopted for the following addresses: 605 Alameda Avenue, 855/875 N. Todd Avenue, 985 N. Todd Avenue, 935/955/965 N. Todd Avenue, and entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Res. Nos. 00-C97 ACCEPTING CERTAIN GRANTS OF EASEMENT AND DIRECTING THE 98, 98A, 99 & RECORDING THEREOF. 100. C. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Res. 00-C101 AUTHORIZING THE AZUSA CITY LIBRARY TO JOIN THE ARROYO SECO Lib to join Arroyo LIBRARY NETWORK. Sec Lib Network D. The City Treasurer's Report as of July, 2000, was received and filed. Treas Rpt E. Human Resource Item was approved as follows: Human Resource Merit Increase or Regular Appointment: S. Goggins, S. Noble. Action Item Separations: R.E. Smith, Police Officer, effective September 6, 2000. M. Westrup, Customer Service Representative I, effective August 29, 2000. F. Approval was given to extend the Acting Pay status for Water Utility Equipment Extend Acting Operator, Stewart Noble, until the position is filled, in accordance with the Pay S. Noble provisions of the Azusa Personnel Rules and Regulations. �. Regarding the Day Laborer Site, the following was approved: 1) an MOU with Agmts for Day the City of Irwindale to establish access to day laborer site and terms and Laborer Site conditions for operation and monitoring; and 2) lease agreement with Azusa Land Reclamation, Incorporated (Waste Management, Incorporated), for property located at 1313 W. Gladstone Street for use as a day laborer site. H. Two separate resolutions authorizing payment of warrants by the City were adopted and entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Res. Nos. 00 - ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE C102, and 103 FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. Warrants THE CITY COUNCIL AND THE REDEVELOPMENT AGENCY CONVENED Cncl/CRA JOINTLY TO CONDUCT THE FOLLOWING PUBLIC HEARING: convene jointly JOINT PUBLIC HEARING - regarding the sale of Redevelopment owned property Joint Pub Hrg located at 626 West Eleventh Street (ROP N3). The Mayor/Chairperson declared the Hearing open. The City Clerk/Secretary read Hrg open affidavit of proof of publication of notice of said Hearing published in the Azusa Herald on September 7, and 14, 2000. Economic Development/Redevelopment Director Andrews addressed the issue stating CRA Dir that the Public Hearing is required in connection with sale of the house located at 626 comments West Eleventh Street in the amount of $205,000. He noted that a summary of expenses and revenues are in the staff report and also an error that the counter offer was in the amount of $207,000, not $209,000, as stated in the staff report. 09/18/00 PAGE FIVE Ms. Mirah Rifkin and Mr. Michael Kellison, buyers and teachers of AUSD, addressed Rifkin & Kellison CouncilBoardmembers and introduced themselves.
