The City Council of the City of Azusa met in regular session at the above time and date in the Civic Auditorium, 213 East Foothill Boulevard, Azusa, California. ' ROLL CALL Roll Call PRESENT: COUNCILMEMBERS: HARDISON, STANFORD, ROCHA, BEEBE, MADRID ABSENT: COUNCILMEMBERS: NONE ALSO PRESENT: Also Present City Attorney Carvalho, City Manager Cole, Interim Chief of Police Garcia, Utilities Director Hsu, Community Development Director Bruckner, Associate Directors of Recreation and Parks Noriega and Jacobs, Economic Development/Redevelopment Director Andrews, Public Information Officer Quiroz, Senior Management Analyst Kalscheuer, Assistant Director of Community Development, Senior Recreation Leader Gonzales, Planning Secretary Rocha, City Clerk Solis, Deputy City Clerk Toscano. CEREMONIAL Ceremonial Mr. Tommy Randle of the U.S. Department of Commerce, Bureau of the Census, A. Olson presented a Partnership Award plaque to Mayor Cristina Cruz -Madrid and the City of Sister City Azusa in recognition of contributions towards the success of Census 2000. Director of Community Services/City Librarian Maghsoudi and Senior Librarian Stewart Summer Reading recognized and presented gifts to sponsors of the Summer Reading Program. Program sponsors Mr. Jerry Hirsch, Principal of Adult Education presented the State of the School J. Hirsch Stat of Address. School Address It was consensus of Council to recess to Closed Session to discuss the following: CLOSED SESSION CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION (Gov. Code Sec. 54956.9 (c )). One Case - Amicus Brief - Lim v. Long Beach. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION (Gov. Code Sec. 54956.9 (c)). One Case - Amicus Brief - Young v. City of Simi Valley. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION Gov. Code Sec. 54956.9 (b). Arrow Pines Mobile Estates Rent Threat of Writ of Mandate concerning Rent Increase Application. The City Council recessed to Closed Session at 7:08 p.m. The City Council reconvened at 7:38 p.m. Closed Session Recess Reconvened It was consensus of Councilmembers to join the Amicus Brief for Young v. City of Simi Amicus Brief Valley and Lim v. Long Beach. Young & Lim It was also consensus of Councilmembers that staff be directed to return to the next Staff Direction meeting and identify the hearing body regarding the Arrow Pines Mobile Estates Rent re: Arrow Pines Increase Application. Rent Inc Apt. Mayor Madrid called the meeting to order and led in the Salute to the Flag. Call to Order INVOCATION was given by Dr. Carolyn Lopez. Invocation PUBLIC PARTICIPATION Pub Part Mr. Charles House addressed Council questioning the status of the $50,000 from the C. House State of California regarding the reward to lead to the arrest of the persons responsible comments for the murder of Gejuan Sallee; he asked if similar rewards would be retained for firebombing of homes in December and February, and requested that staff or Hate Crime Task Force Members meet with judges and prosecutors who serve the area for the purpose of opposing any plea bargaining on cases that arise in Azusa regarding hate crimes. City Manager Cole responded stating that staff is in daily contact with the State filling City Mgr out, filing, and answering questions regarding the application for reward money leading response to the arrest of persons responsible for the murder of Gejuan Sallee, but have not received an answer from them. He thanked Mr. House for writing a letter to the State on the City's behalf. He advised that it is not known when the Governor will decide. He addressed the other crimes that have occurred in the City stating that as serious as they are, they are unsolved crimes that did not result in a death. The reward is to seek to focus on the crime that led to the death of Mr. Sallee. He agreed that working with the prosecutors is a good suggestion, and they have been, and will seek to work with the judges also. Mr. Edward M. Jackson addressed Council and audience and expressed condolences to E. Jackson the family of the young Latino man who was murdered on Saturday; further, that he comments thought it was the result of racial overtones. He shared his inspiration regarding war heros and then offered a $1,000 reward for information leading to the arrest of the persons responsible for the murder of the aforementioned young Latino man. Ms. Diana Valenciano of Azusa Pacific University addressed Council displaying D. Valenciano photographs of an event that took place over the week end at Lee elementary school, comments sponsored by Hearts of Joy. Students of APU hold games, sports, crafts, entertainment and lunch in order to serve the community of Azusa. Mr. Jaime Martinez expressed his opinion regarding hate crimes and also describes how J. Martinez his spiritual belief help him survive in the world. comments REPORTS UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF Updates/Rpts City Manager Cole announced that on December 9, 2000, from 9 a.m. to noon, at the City Mgr Senior Center there will be a Citizens Congress Community Forum and that on Friday, comments November 10, 2000, there will be the Day Labor Dedication at 1313 Gladstone Street near Irwindale Avenue. Chief of Police Davis announced the 225th Birthday of the United States Marine Core, COP and invited all to attend the celebration also on Friday, November 20, 2000, at 8 a.m. comments in front of the City Hall Flag pole. 'Economic Development/Redevelopment Director Andrews announced the Second Annual CRA Dir Business Image Awards to be held on Thursday, November 9, 2000, at the Senior Center comments and Groundbreaking and dedication of the fountain in front of the Sav-on on November 15i1. Ms. Peggy Martinez addressed the issue and stressed the importance of the celebration and invited all to attend. Mayor Pro -tem Rocha expressed his views on the Day Labor issue and how the City and Rocha residents have come together to make it work. He announced the celebration of the comments Veterans Day celebration on Saturday, November 11t1 at 11:00 a.m. 11/06/00 PAGE TWO He announced that additional Veteran's names have been identified and will be placed Rocha on the Veteran's Memorial at the event. He then announced the annual food drive for continued the Azusa Food Bank and that the Boy Scouts will also be collecting food from houses comments by placing bags at homes on Saturday November 11th and collecting them the following Saturday. Councilmember Beebe thanked all for participating in the tree planting on October 28" Beebe and announced that another way to benefit and with the food drive is to use home comments grocer.com. 'Councilmember Hardison reminded all about the food drive and requested an update on Hardison the Azusa Skate Park. City Manager Cole advised that information will be brought to comments the meeting of November 20i1. Councilmember Stanford commented on how marvelous and impressive the State of the Stanford School Address was for Azusa Adult School. comments Mayor Madrid requested that a meeting be coordinated between the AUSD and the City. Madrid City Manager Cole suggested November 27t1 after Thanksgiving. comments Moved by Councilmember Stanford, seconded by Councilmember Beebe and Appointing unanimously carried that the staff report submitted appointing members to a Hate Crime members Hate Task Force be approved. Crime Task Force The CONSENT CALENDAR consisting of Items IV -A through IV -P, was approved by Consent Cal motion of Councilmember Stanford, seconded by Councilmember Hardison and IV -A - IV -P unanimously carried with the exception of items IV -D, H, I, K, and IV -L, which were appvd, D,H,I,K, considered under the Special Call portion of the Agenda. & L Spec Call A. Minutes of the regular meeting of October 16, 2000, were approved as written Min approved B. Maintenance Service Agreement for the Inspection of 5000 Power Poles was Maint Agmt approved to Osmose Inc., for the inspection, treatment and restoration of the poles Osmose, Inc. at a price not to exceed $50,000, in the first year with option to renew for three Pwr Poles additional years. C. Specifications for the CDBG Project No. D96040-00, Wheelchair Ramp Spec CDBG Construction, were approved and the City Clerk's Office was authorized to Wheelchair advertise for bids. Ramps D. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, Res. 00-C126 CALIFORNIA, APPROVING THE FIRST AMENDMENT TO THE Amendment to EXCLUSIVE FRANCHISE AGREEMENT WITH ARAKELIAN Arakelian Ent., ENTERPRISES, INCORPORATED, TO ADD LOCKED LID CHARGES FOR Inc. THESE SERVICES TO THE AGREEMENT. MAYOR MADRID DISSENTING. F. Human Resources Action Items Merit Increase and/or regular appointment Hum Res Action recommendations were approved as follows: A. Assoc. O. Authorization was given to the City Manager to establish a reward in the amount Reward of $1,500 of $15,000 from the City of Azusa General Fund for information leading to the for info leading to arrest and conviction of the suspect(s) in the murder of Mr. Gejuan Sallee. In death of Gejuan addition, the Chief of Police was authorized to be the responsible party for Sallee establishing a protocol for the issuance of the any monetary rewards. P. Resolution authorizing payment of warrants by the City was adopted and entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Res. 00-C132 ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE Warrants FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. SPECIAL CALL ITEMS Councilmember Hardison addressed the Lease Agreement with Verizon for Cellular Tower at the City Yard and advised that this is a good time to ask Nextel about putting up an antenna. He commented at the plainness of the pole and suggested that in the future a possible disguise be considered to enhance the look. Moved by Mayor Madrid, seconded by Councilmember Stanford and unanimously carried to approve the lease agreement with Verizon for Cellular Tower at the City Yard and authorize the Mayor to execute same. Representative of the Azusa Bombers Baseball Club addressed Council requesting the waiver of fees for use of Northside Park Ballfield for Toys for Tots Baseball Tournament, from December 1 through 3rd. He advised that this is an opportunity to give back to the community and set a good example to the kids on the meaning of giving. For further information regarding the teams contact Gary Turflinger at 337-3187 or 356- 6000. The fees are $125.00 per team. Moved by Mayor Madrid, seconded by Councilmember Stanford and unanimously carried to waive fees for use of the ballfield at Northside Park. Trotter for the City of Azusa and answered questions posed by Councilmembers. Moved by Presentation Councilmember Stanford, seconded by Mayor Pro -tem Rocha and unanimously carried Tree Master Plan to approve the revised Tree Master Plan created to specific tree species designated for public properties, ie.
