The City Council of the City of Azusa met in regular session at the above date and time in the City Manager's Office to conduct a Closed Session. I It was consensus of Council to recess to Closed Session on the following: CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION (Gov. Code Sec. 54956.9 (b)). One Case. Claimant: Joel Crawford. CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION (Gov. Code Sec. 54956.9 (a)). Johnson v. City of Azusa, Los Angeles Superior Court No. BC 194900. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION (Gov. Code Sec. 54956.9 (a. b. & 01. Two Cases. Recess to Closed Session CITY COUNCIL CONVENED IN THE AZUSA AUDITORIUM IN ORDER TO Council convened CONDUCT JTS REGULAR MEETING. Azusa Aud City Attorney Carvalho reported that there was no action taken in Closed Session. No Reports Mayor Madrid called the meeting to order and led in the Salute to the Flag. Call to Order INVOCATION was given by Reverend Leroy of the First Assembly of God Church. Invocation ROLL CALL Roll Call PRESENT: COUNCILMEMBERS: HARDISON, STANFORD, ROCHA, BEEBE, MADRID ABSENT: COUNCILMEMBERS: NONE ALSO PRESENT: Also Present City Attorney Carvalho, City Manager Cole, Assistant City Manager Person, Chief of Police Davis, Community Development Director Bruckner, Associate Director of Recreation and Parks Noriega, Assistant Community Development Director Onaga, Utilities Information Services Morningstar, Electrical Engineer Langit, Deputy City Clerk Toscano. PUBLIC PARTICIPATION Public Part. Mr. Bob Levinson provided an update on the Human Relations Commission (formerly B. Levinson the Hate Crime Task Force). Update HRC Ms, Reagan Tucker of Azusa Pacific University addressed Council and announced the R. Tucker 'Azusa Winter Family Fiesta in the City of Azusa which will be held on Saturday, APU December 2nd in front of City Hall. Mr. Mark McMurchie of Azusa Pacific University addressed Council and advised that M. McMurchie as part of the the new Sav-on construction, the sign in front of the project was made into APU a mural entitled "Daisy" and was painted by the Azusa Pacific University students and Azusa elementary students. REPORTS. UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF Updates/Rpts City Manager Cole announced that a Joint Meeting between Council members and the City Mgr Azusa School Board is scheduled for Tuesday, November 28, 2000 at 6:30 p.m. He Joint Mtg w/ Also announced the Citizens Congress Community Forum on Saturday December 9, Azusa School Brd 2000, at 9:00 a.m. at the Senior Center. 11/28/00 Joshua Barroga, a sophomore at Azusa High School addressed Council requesting support to attend the National Youth Leadership Forum on Medicine in Los Angeles. 'He provided information regarding the Forum. Moved by Mayor Pro -tem Rocha, seconded by Councilmember Beebe and unanimously carried to support Joshua Barroga to attend the Forum on Medicine in the amount of $100. Mayor Pro -tem also presented Joshua with a check from the VFW in the amount of $100. Associate Director of Recreation and Parks Department Noriega made a presentation on 2000 Trees in the Year 2000 Program. He provided a brief overview stating that $250,000 to purchase trees to be planted in Azusa will come from the CIP and $50,000 will be in the form of grant funds. He detailed the history of the tree planting project and advised how, where and when the planting will take place and then answered questions posed by Councilmembers. He then invited all to the Winter Family Fiesta on December 2nd and the Tree Lighting Ceremony on December 4th at 5:30 p.m. in the front of City Hall. J. Barroga request support NYLF $100 to J. Barroga & $100 from VFW Noriga re: update 2000 trees in the year 2000 Moved by Mayor Madrid, seconded by Councilmember Stanford and unanimously Reviewing body carried that a sub -committee of the Council, Councilmembers Stanford, Rocha and Rent Inc Appl. Beebe, be the reviewing body for the Arrow Pines Mobile Estates Rent Increase Stanford, Rocha Application issue. & Beebe Mayor Pro -tem Rocha announced and invited all to come out and help plant trees on Rocha December 2nd at 8 a.m.; all will meet on Orange Avenue and Bayless. He also thanked comments all responsible for the Marine Birthday, Day Labor and Veterans Day celebrations. He asked to keep in prayers the families of Ricky Leo Alkana and Lawrence Garcia, who recently passed away. He wished all a very Happy Thanksgiving. Councilmember Beebe thanked all who worked on the Sav-on sign and suggested that Beebe it be kept after the project is ended. She wished all a Happy Thanksgiving. comments Councilmember Hardison requested that staff inspect all lights on city streets in order Hardison to add additional light and replace others. He advised that he will be out of town for the comments December 4' meeting and asked to be excused. He wished all a Happy Thanksgiving. Councilmember Stanford thanked all involved in the Human Relations Committee. He Stanford announced the Winter Fiesta to held on December 21, made comments regarding the comments ABC License notice for the property at 944 N. Azusa Avenue, the USMC Birthday celebration, the letter from the Chamber of Commerce in support of proposed City measures on proposed business license adjustments and rental tax. He wished all a Happy Thanksgiving. Mayor Madrid announced that the City has job openings for Office Specialist II and Madrid Police Dispatchers. comments SCHEDULED ITEMS Scheduled Items PUBLIC HEARING - on Code Amendment No. 213, amending the Azusa Municipal Pub Hrg Code Chapter 88, adding definitions for "Business Support Services" and Printing and Code Amend Publishing" and adding Business Support Services as permitted uses in the C-1, C-2, C- #213 3, PID, and 1 and M2 zones. Business Support Svs 11/20/00 PAGE TWO The Mayor declared the Hearing open. Deputy City Clerk read the affidavit of proof Hrg open of publication of notice of said Hearing published in the Azusa Herald on November 9, 2000. Assistant Community Development Director Onaga addressed the issue stating that this is an amendment to the zoning code by adding a new Land Use category entitled "Business Support Services", that will include certain types of printing and photocopying businesses. The current Code only has one category for all printing and publishing businesses, it makes no distinction between a major printing plant and a photocopying business. He stated that the Code allows Printing and Publishing businesses as permitted uses within the PID, and M-2 zones, with a CUP in the C-3 and CBD zones, but prohibits them with the C-1 and C-2 zones, staff is recommended the Code be amended, to address the new technological changes in the printing industry. The new category would include certain types of commercial printing businesses and photocopying businesses that will be allowed in all commercial and manufacturing zones without a CUP. Testimony was solicited, but none was received. Councilmember Stanford offered an Ordinance entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA 1" Rdg Ord AMENDING THE ZONING ORDINANCE (CHAPTER 88 OF THE AZUSA Amend AMC MUNICIPAL CODE) ARTICLE XIV, DEFINING "BUSINESS SUPPORT Business Support SERVICES" AND 'PRINTING AND PUBLISHING" AND APPENDIX A, ADDING Svs & Printing BUSINESS SUPPORT SERVICES AS PERMITTED USES IN THE C-1, C-2, C-3, & Publishing CBD, PID, AND M-2 ZONES, CODE AMENDMENT 213. 'Moved by Councilmember Stanford, seconded by Councilmember Hardison and Proposed Ord unanimously carried by roll call to waive further reading and introduce the proposed introduced ordinance. The CONSENT CALENDAR consisting of Items V-A through V -N, was approved by Consent Cal. motion of Councilmember Beebe, seconded by Councilmember Stanford and V-A - V -N unanimously carried with the exception of items V -C, D, F and V -H, which were V -C, D, F, & H considered under the Special Call portion of the Agenda. Councilmember Beebe Special Call Abstained from item V -I. A. Minutes of the regular meeting of November 6, 2000, were approved as written Min approved B. The Notice of Completion for the installation of the new traffic signal by Macadee Notice of Comp. Electrical Construction was approved and the City Clerk was authorized to file Macadee Elect. same with the Office of the County Registrar Recorder. C. SPECIAL CALL ITEM. Spec Call D. SPECIAL CALL ITEMS. Spec Call ' E. The City Treasurer's Report as of September, 2000, was received and filed. Treas Rpt F. SPECIAL CALL ITEM. Spec Call G. Authorization was given that the grant funds, California Law Enforcement Grant Funds Equipment Procurement Program (CLEEP), received by the Azusa Police CLEEP Department be utilized to purchase 40 notebooks and $15-20,000 to accomplish system integration between the field reporting software and Lucent's Records Management System. 11/20/00 PAGE THREE H. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, Res. 00-C134 CALIFORNIA, APPROVING THE MEMORANDUM OF UNDERSTANDING MOU w/CAPP BETWEEN THE CITY AND THE CIVILIAN ASSOCIATION OF POLICE PERSONNEL EFFECTIVE AUGUST 1, 2000, THROUGH JULY 31, 2004. (Councilmember Beebe abstained) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, Res. 00-C135 I CALIFORNIA, APPROVING THE MEMORANDUM OF UNDERSTANDING MOU w/IBEW BETWEEN THE CITY AND THE INTERNATIONAL BROTHERHOOD OF ELECTRICAL WORKERS, LOCAL 18, EFFECTIVE AUGUST 1, 2000, THROUGH JULY 31, 2004. (Councilmember Beebe abstained) J. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA Res. 00-C136 ADOPTING CLASS SPECIFICATIONS FOR ADULT EDUCATION AND Specs Adult LITERACY COORDINATOR AND LITERACY PROGRAM ASSISTANT AND Ed & Literacy ESTABLISHING SALARIES THEREFOR. Prgm K. The Workers' Compensation Service two year contract renewal with Fleming & Contract Renewal Associates was approved effective January 1, 2001 through December 31, 2002, w/Fleming & at the rate of $5,750 per quarter and the Mayor was authorized to execute. Associates/Work Comp. L. The Azusa Light & Water rate allocations for street lighting and undergrounding of power lines was approved. The City is to establish a non -bypassable street L&W rate lighting rate on total electric consumption (kWh) for electric customers while allocations for simultaneously reduce existing rates by like amounts and internal allocation of street lighting & electric system revenue and that funding level be set in accordance with current undergrounding method prescribed by California Public Utilities Commission. of power lines ' M. The reduced subsidy for Foothill Transit bus passes would enable the City to subsidize the average number of passes that have been sold per month for the last Reduced Subsidy 14 months, and make it possible to initiate a $20 for express passes as well. The for Foothill change in Bus Pass subsidy was approved. Transit bus passes N. Resolution authorizing payment of warrants by the City was adopted and entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE Res. 00-C137 FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. Warrants SPECIAL CALL ITEMS Special Call Items Councilmember Hardison addressed the item regarding contract increase with West Coast Arborist, questioning whether the contract includes the trees; staff responded that Contract w/West it does. Moved by Councilmember Stanford, seconded by Councilmember Beebe and Coast Arborist unanimously carried to approve the increase to the contract with West Coast Arborist, approved the City of Azusa's professional full service public tree maintenance and planting contractor in the amount of $240,000. Mayor Pro -tem Rocha questioned various sections of the specifications for Landscape Maintenance contract and staff responded as follows: Vacant lot on Azusa and San Question re: Gabriel is not included in this contract, but is under a separate contract under the Specs for Redevelopment Agency. The access trail was discussed and Council feels that if Vulcan Landscape still owns the subject property, it should be maintained by Vulcan. City Manager Maintenance advised that this section should be removed from the contract. Council discussed a Contract certain medium on Foothill that was damaged in a accident and requested that staff try to get reimbursed for the damage. Staff took direction on other items. 11/20/00 PAGE FOUR Moved by Councilmember Stanford, seconded by Councilmember Beebe and Specs Landscape unanimously carried to approved specifications for Landscape Maintenance contract, as Maintenance amended, and authorize the City Clerk's Office to advertise for bids. approved Mayor Pro -tem Rocha addressed Human Resource Action Items expressing his Rocha comments opposition to a merit increase that was dating back over a year. City Manager Cole Human Res responded explaining that a performance appraisal for that position was not done in a Action Items timely manner due to the absence of a Police Chief. Moved by Councilmember Stanford, seconded by Councilmember Beebe and carried that Motion to approve the Human Resource Action Items be approved as follows: Human Resources Action Rocha - no Items Merit Increase and/or regular appointments: J. Gurbada, R. Arevalo, and D. Human Res Items Irish. Mayor Pro -tem Rocha dissenting. approved. Mayor Madrid addressed item regarding establishment and amending Light & Water Rules and Regulations, stating that with regard to NSF checks, could the City redeposit check a second time in order to help the customer clear the check. Staff responded that the NSF checks could be submitted an additional time, but the customer will be charged the additional redeposit fee. Staff then answered questions posed by Councilmember regarding credit checks, mechanism of refunding of deposits and temporary power pole or water hook-up fee refunds. Councilmember Stanford offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, AMENDING THE SCHEDULE OF CHARGES AND RULES AND REGULATIONS GOVERNING THE ELECTRIC AND WATER SERVICE SUPPLIED BY THE LIGHT AND WATER DEPARTMENT OF THE CITY OF AZUSA. Moved by Councilmember Stanford, seconded by Councilmember Beebe to waive further 'reading and adopt.
