The City Council of the City of Azusa met in regular session at the above date and time in the Azusa Auditorium. CLOSED SESSION It was consensus of Council to recess to Closed Session in the Office of the City Manager, to discuss the following: CONFERENCE WITH LEGAL COUNSEL -ANTICIPATED LITIGATION (Gov. Code Sec. 54956.9 Closed One Case - Amicus Brief Support for the California Dump Truck Owners v. Gray Davis, Session et al. CONFERENCE WITH LEGAL COUNSEL - PUBLIC EMPLOYEE REVIEW (Gov. Code Sec. 54957) Title: Water Utility Equipment Operator. PUBLIC EMPLOYEE PERFORMANCE EVALUATION (Gov. Code Sec. 54957). Titles: City Manager and City Attorney Annual Evaluation Process. Councilmembers recessed to Closed Session at 6:45 p.m. Councilmember reconvened at 7:30 p.m. Recess Reconvened City Attorney Carvalho reported that there was reportable action taken in Closed Session; City Attorney authorization was given to participate in the amicus brief regarding California Dump Truck Owners v. Gray Davis, et. al. Mayor Madrid called the meeting to order and led in the Salute to the Flag. INVOCATION was given by Pastor Vincent Margolis of Praise Chapel. ROLL CALL PRESENT: COUNCILMEMBERS: HARDISON, STANFORD, CHAGNON, MADRID ABSENT: COUNCILMEMBERS: ROCHA (entered later in the meeting) ALSO PRESENT: City Attorney Carvalho, City Manager Cole, Assistant City Manager Person, Chief of Police Davis, Director of Community Development Bruckner, Director of Public Works Nakasone, Lieutenant Collins, Associate Director Recreation and Parks Noriega, City Engineer Abbaszadeh, Human Relations Commission Coordinator Parker, City Treasurer Macias, Deputy City Clerk Toscano, City Clerk Mendoza. CEREMONIAL Call to Order Invocation Roll Call Also Present Ceremonial Ms. Lana Grizzell, presented nine contestants of the Miss Azusa Scholarship Pageant, and they L. Grizzell introduced themselves to the audience as follows: Naomi Ramos, Gloria Hernandez, Monica, Miss Azusa Lisa Walsh, Kiana Ayers, Sara Diaz, Sophia Montano, Jillian Pollard, Annalisa Abbs. Christa Scholarship Allison, present Miss Azusa, thanked all for her reign as representative of the City. Pageant City Manager Cole presented a proclamation to Ms. Natasha Morisawa, Assistant Manager Proc America of the American Red Cross, San Gabriel Chapter, declaring the month of March as AMERICAN Red Cross RED CROSS month, in the City of Azusa. Month Mr. Bill Baca, Field Representative/Caseworker for Senator Gloria Romero, addressed audience B. Baca advising that he is available to the public for assistance in State matters at (626) 312-2800. PUBLIC PARTICIPATION Ms. Peggy Martinez, Executive Director of the Downtown Azusa Business Association, introduced new officers for the DABA, as follows: President Joseph Perez, Vice President Marshall Jorge, Treasurer Gloria Delgado, Secretary Debbie Moore, Membership Officer Sharon Lewis, Boardmembers Jim Cortez and Nieves Wynn, Past President Advisor Paul Naccachian, City Representative John Andrews, Azusa Unified School District Representative Lisa Harrington. She then announced the upcoming Mariachi Festival to be held on Saturday, April 20, 2002, at the Azusa Pacific University Event Center. She provided details about the event. REPORTS. UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF City Manager Cole announced that the update on home ownership, housing trends, and Monrovia Nursery future developments has been postponed. He introduced the new Human Relations Commission Coordinator Donna Parker and elaborated on the specific job duties and project she will embark upon, such as the development of a strategic plan, and training of Human Relations Commissioners. Ms. Parker expressed her appreciation at becoming a part of the City of Azusa. Pub Part P. Martinez DABA 8- Mariachi Festival Rpts/Updates City Mgr comments Councilmember Stanford advised all to stop by and meet Ms. Parker. He then related his Stanford experience at being present and Wells Fargo bank during an attempted robbery. He invited comments all to attend the Miss Azusa Scholarship Pageant as well as the Mariachi Festival. Mayor Madrid thanked the Miss Azusa contestants and outgoing Miss Azusa, Christa Allison Madrid for representing the City of Azusa at many events. comments ' Councilmember Rocha entered the Council meeting. He Invited all to attend the Azusa Adult Rocha School at Drendal on Wednesday at 12 noon for the final readings of the WASC accreditation comments findings. Moved by Councilmember Stanford, seconded by Councilmember Chagnon and unanimously Hardison carried that Councilmember Hardison be selected as the Mayor Pro -Tempore from March, selected as 2002 through March 2003. Mayor Pro -Te Lieutenant Jim Collins of the Azusa Police Department provided an update on the Azusa Police Police Comm Community Academy. He Invited community members to join the academy and learn more Academy about Azusa. Sched Items SCHEDULED ITEMS PUBLIC HEARING - An appeal by Mr. Vincent Margolis, of the Planning Commission's denial Pub Hrg of a Conditional Use Permit (C-2001-09) to allow a church (Praise Chapel) at 521 North Azusa Praise Avenue. Chapel The Mayor declared the Hearing open. City Clerk read the affidavit of proof of publication of Hrg open notice of said Hearing published in the Azusa Herald on March 7, 2002. M1, Community Development Director Bruckner addressed the Hearing providing background Com Dev Dir information on the matter and answered questions posed by Councilmembers regarding the comments Settlement Agreement. He advised that the church had moved into the building illegally, it was zoned C2 and it needed to be zoned C3. The Downtown Azusa Business Association objected to the church being there and the church advised that they would only be there for two - three years. The matter was sent to mediation and the Settlement Agreement is now being considered. Pastor Margolis of Praise Chapel and Ms. Peggy Martinez of the DABA addressed Council Margolis & thanking Captain Karen Pihlak of the Azusa Police Department for being an excellent facilitator Martinez of the mediation process. They stated that it was a good experience for both parties. comments 03/18/02 PAGE TWO Moved by Councilmember Chagnon, seconded by Councilmember Rocha and unanimously Hrg clsd carried to close the Hearing. Moved by Councilmember Stanford, seconded by Mayor Pro -Tem Hardison and unanimously Settlement carried to concur with the recommendation that resulted from the mediation process between Agmt approv the applicant and the Downtown Azusa Business Association, and to approve a settlement agreement to allow the church to remain at its current location for a maximum of two years, and authorize Staff to make any minor changes deemed necessary by both parties. Councilmember Stanford offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA AFFIRMING THE DECISION Res. 02-C32 OF THE PLANNING COMMISSION TO DENY CONDITIONAL USE PERMIT NO. C-2001-09 FOR Deny CUP A CHURCH USE AT 521 NORTH AZUSA AVENUE. C-2001-09 Moved by Councilmember Stanford, seconded by Mayor Pro -Tem Hardison to waive further reading and adopt. Resolution passed and adopted by the following vote of the Council: AYES: COUNCILMEMBERS: HARDISON, STANFORD, ROCHA, CHAGNON, MADRID NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: NONE The CONSENT CALENDAR consisting of Items VI -A through VI -M, was approved by motion Consent Cal of Councilmember Stanford, seconded by Councilmember Chagnon and unanimously carried. Approved A. The Minutes of the regular meeting of March 4, 2002 and the adjourned regular meeting Min approve of February 11, 2002, were approved as written. B. Approval was given to the Public Works Department to install four-way stop signs at the Install Stop intersections of Angeleno with Fourth &Second Streets. Signs ' C. Approval was given to purchase Acrlms Hardware and Software Bundle For Deployment Pur ACRIMS of Geographic Information Systems Via the Web and Internet. Total software, hardware Hardware & purchase amount including tax not to exceed $22,750.00. Software D. The Agreement with HDL Software to convert and integrate antiquated database Agmt w/HDL information into existing HDL Software Systems, was approved and the City Manager Software was authorized to execute same. Total software purchase and conversion amount is not -to -exceed $30,000. Authorize the City Manager to execute the proposal and the agreement. E. Notice of Completion for Roof Replacement at Various City Facilities was approved in Note of Com the amount of $204,977.60, and the extra work in the amount of $26,324.60. Roof Replace F. Amendment to the City's Position Classification Plan Establishing the Classification of Police Corp. Police Corporal was approved. Class G. Recruitment Incentive for Police Officer Lateral and Police Dispatcher Lateral New Hires. Incentive New Approval was given to provide an incentive of $5,000 for Police Officer Lateral and Hires Police O $3,000 for Police Dispatcher Lateral as defined by the parameters of the & Pol Dispatc "Reimbursement Agreement". H. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING THE CITY'S Res. 02-C33 CLASSIFICATION PLAN AND ESTABLISHING COMPENSATION FOR THE Facilities Crew CLASSIFICATION OF FACILITIES CREW SUPERVISOR. Supervisor 1. Amendment to the City's Position Classification Plan Establishing the Position of and Assist PW Di Compensation for the Assistant Public Works Director/City Engineer were approved. City Engr Contract for City Auditorium Interior Renovations was awarded to Card Construction, low bidder in the amount of $131,78 1 .00. K. Human Resources Action Items were approved as follows: Merit Increase and/or Human Res regular Appointments: R. McMinn, and M. Gonzales. Action Items New Appointments: D. Shuttleworth, Facility Maintenance Crew Supervisor, effective 3/19/02. S. Henry, Street Maintenance Crew Supervisor, effective pending physical. 03/18/02 PAGE THREE 1 L. Reconvene C ORDINANCES/SPECIAL RESOLUTIONS Ord/Spec Re Councilmember Stanford offered an Ordinance entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING CHAPTER 50 1" Rdg Ord SECTION 50-1 OF THE AZUSA MUNICIPAL CODE PERTAINING TO PARK CLOSURE HOURS. Re: Park Clos Hours Moved by Councilmember Stanford, seconded by Mayor Madrid and unanimously carried by roll call to waive further reading and introduce the ordinance. Councilmember Rocha requested that signs at parks be posted in Spanish also. It was consensus of Councilmembers to adjourn to Friday, March 22, 2002, from 2:00 p.m. Adjourn to 4:00 p.m. at Monrovia Nursery to conduct a land plan review. to Monrovia Nursery Councilmember Rocha invited all to attend the Skate Park Groundbreaking Ceremony on Rocha Saturday, March 30'h 10 a.m. at Memorial Park.
