The City Council of the City of Azusa met in regular session at the above date and time in the Azusa Auditorium. CEREMONIAL Ceremonial Mayor Madrid administered the Oath to new Azusa Police Officer Michael Bires and Chief Oath M. Bier Davis administered the Code of Ethics of the Azusa Police Department. New Police o The City Council presented Certificates of Recognition to the members of the Ballet Folklorico Certificates Performers of the Azusa Recreation Center who participated in the USA National Folklorico Folklorico Competition. Ms. Julia Duran, Instructor, provided details of the event as well as bacl�ground Performers information of each participant. CLOSED SESSION Closed Sess The City Council recessed to Closed Session to discuss the following: PUBLIC EMPLOYEE PERFORMANCE EVALUATION (Gov. Code Sec. 54957) Title: City Manager. The City Council recessed at: 7:05 p.m. Recess The City Council reconvened at: 7:30 p.m. Reconvened City Attorney Carvalho reported that there was no reportable action taken in Closed Session. City Attorney Mayor Madrid called the meeting to order and led in the Salute to the Flag. Call to Order INVOCATION was given by City Manager Cole. PUBLIC PARTICIPATION Pub Part Mr. Art Ramirez, Chairman of the Azusa Golden Days Committee announced the upcoming Art Ramirez Golden Days Events for the week of October 5`h through 13th, 2002. He announced that any Golden Days one interested in becoming a food vendor should contact Randy Noriega. Applications for Activities honored citizens will be in Light and Water bill, parade applications are now available, and if people are interested in advertising the Golden Days booklet the can contact Sharon Lewis. Ms. Gina Sanchez addressed Council requesting that they oppose the persecution of Falun- G. Sanchez Gong practioners in China. She described the horror and inhumane treatment that people are Comments subject to due to their practice of the Falun-Gong activities. She submitted a petition and asked that C overnment to sneak nut acainst the nersecntinn. Mr. Daniel Wanv read a letter asked that Government to speak out against the persecution. Mr. Daniel Wang read a letter D. Wang into the record from a couple who were in the audience. The matter was referred to City Falun-Gong Manager Cole for handling. Mr. Bill Baca from Senator Gloria Romero's office addressed Council and audience stating that B. Baca if anyone has problems with State issues they could contact him. Comments Mr. Allen Solomen of Assemblyman Ed Chavez office addressed Council and audience stating A. Solomen that if anyone has any problems with local issues they could call him. Comments REPORTS, UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF Rpts/Updates ' Associate Director of Recreation and Parks Norlega Introduced the Azusa Dolfins Swim Team R. Noriega who talked about fund raisers on July 25" they will have a swim meet, August 8' McDonalds Dolfins Swim night, Aqua Day, Swim-a-Thon during a week of July, all fundraising will go towards Team maintenance of'the pool. Associate Director of Recreation and Parks Noriega announced the Dia de Musica to be held on R. Noriega Saturday, July 20, 2002 and also introduced the Garage Band Jam 3 that will be performing on Dia de Music Friday, July 19, 2002, for a donation of $3; they then played a selection for the audience. & Garage Ba Councilmember Chagnon expressed concern regarding a letter to the editor which talked about Chagnon the lack of care of trees that were planted up in the Canyon. She then thanked all responsible comments for the Skate Park. Associated Director Noriega responded stating that with regard to the trees, the area will be the R. Noriega beginning of the bike path and the trees will be receiving the attention needed. Comments Councilmember Rocha thanked all responsible for obtaining the Skate Park. He also thanked all Rocha who participated in the Freedom Is Not Free Parade, which included, but was not limited to, Comments Art Ramirez Masonry, Johnny's Tow, Cities Tow, etc. He invited all to a Health and Safety Fair on July 27`" at Memorial Park from 9 a.m. to 4 p.m.; Richard Naranjo is putting it together as an Eagle Scout Project. He then voiced his objection to the $3.00 donation to the Garage Band Event to be held on Friday, July 19`" He stated that some youth many miss out on the event because the may not have the money; he asked that it be changed to a "suggested" donation. Councilmember Stanford presented a proposed resolution regarding his opposition to the Ninth Stanford Circuit Court ruling the "under God" in the United Stated Pledge of Allegiance is Comments unconstitutional. He asked that the resolution be presented at an a adjourned regular meeting to be held on July 22ntl. He then provided an update on his recent illnesses and stays in the hospital. Mayor Pro -Tem Hardison thanked all responsible for the Skate Park and congratulated the kids Hardison in the Garage Band. Comments Mayor Madrid thanked Council, on behalf of the Saint Frances of Rome Church, for helping Mayor them raise $60,000, at their Festival. She invited all to the Parks Master Plan meeting on Comments Tuesday, and thanked all involved in the Skate Park. SCHEDULED ITEMS Sched Items PUBLIC HEARING — regarding the approval of the Issuance of Tax Exempt Bonds by the Pub Hrg California Statewide Communities Development Authority for Azusa Pacific University for the construction of a student dormitory building and related infrastructure at 901 E. Alosta Avenue. ' The Mayor declared the Hearing open. The City Clerk read the affidavit of proof of publication Hrg open of notice of said hearing published in the San Gabriel Valley Tribune on June 28, 2002. Mr. Stanford abstained from this item due to a possible conflict of interest as Mrs. Stanford is a Stanford professor at Azusa Pacific University. abstained Community Development Director Bruckner addressed the issue stating that in order for Azusa Com Dev Dir Pacific University to construct a 352 -bed five -story student dormitory, there is a need to obtain Comments funding for the construction and they are proposing the issuance of tax-exempt financing and have applied to the California Statewide Communities Development Authority (CSCDA), which is a Joint powers authority. One of the requirements of Federal Law is that the local agency is to conduct a public hearing and to approve a resolution to authorize the issuance of the tax exempt financing, but, there is no other involvement of the City. 07/15/02 PAGE TWO 11 He stated that the purpose of the public hearing is to consider any public testimony there might be regarding the tax exempt bonds and the financing. He stated that the benefits of the project are a continued enhancement of the university campus with new up-to-date- buildings, the eventual removal of the modular student housing building on the main campus, and the reduced need for the university to seek off -campus student housing, thereby improving housing availability for other segments of the community. He then answered questions posed by Councilmembers regarding public benefit and the fiscal impact report. Ms. Joan Singleton of Azusa Pacific University, detailed the need for additional student housing, specifically, that there is an increase in the educational population and many wish to reside on campus. She noted how this would reduce traffic congestion as students will not be commuting from home to school, and as more students will be living in the City, more will be devoting to local programs such as homework house, reading programs, City Links, etc. The will eat locally and contribute to the public good. She then answered questions posed by Councilmembers. Com Dev Dir Comments J. Councilmember Rocha offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, APPROVING Res 02-C76 THE ISSUANCE OF CALIFORNIA STATEWIDE COMMUNITIES DEVELOPMENT AUTHORITY Appvg Issue REVENUE BONDS FOR THE PURPOSE OF FINANCING THE COSTS OF ACQUISITION, Rev Bonds CONSTRUCTION, INSTALLATION, FURNISHING AND EQUIPPING OF CERTAIN EDUCATIONAL APU FACILITIES AND CERTAIN OTHER MATTERS RELATING THERETO Moved by Councilmember Rocha, seconded by Councilmember Hardison to waive further reading and adopt. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, Res. 02-C79 APPROVING AN AMENDED AND RESTATED EMPLOYMENT AGREEMENT FOR THE CITY Agmt w/ MANAGER. City Mgr M. The following Resolution was adopted and entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN Res. 02-C80 CLAIMS AND DEMANDS AND *SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE Warrants TO BE PAID. SPECIAL CALL ITEMS Spec Call ' Discussion was held regarding proposed resolution setting forth compensation for part-time Discussion employees. It was consensus to strike health insurance clause as it is in conflict with State Re: reso Law. City Attorney Carvalho responded recommended that the resolution be revised as Part time follows: remove the terms and benefits on elected and appointed officials of the City, and the Employees title, delete section 2, 3, and 4, and the words "and benefits of elected and appointed officials as set for in Resolution 01-C4, and the now there fore statements". Councilmember Chagnon offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING RESOLUTION 01- Res. 02-C78 C4 WHICH SETS FORTH COMPENSATION AND BENEFITS OF NON -CLASSIFIED POSITIONS. Amend Part Time salary Moved by Councilmember Chagnon, seconded by Mayor Pro -Tem Hardison to waive further structure reading and adopt. Resolution passed and adopted by the following vote of the Council: Councilmember Rocha addressed Item regarding agreement with West Coast Arborists asking Rocha someone to define tree lifting and asked about re -staking trees and whose responsibility it is to Questions do it. Director of Public Works Nakasone responded stating that if the bottom part of the foliage is Dir Pub Wks getting low, it is cut to lift the tree and that with regard to re -staking trees, it is part of West Response Coast Arborist scope of work and he will follow up on it; further he would follow up on other areas of concern. Moved by Councilmember Chagnon, seconded by Mayor Pro -Tem Hardison and unanimously Agmt w/ carried that the renewal agreement with West Coast Arborists for the 2002-03 FY for tree West Coast maintenance services be approved for one year. Arborist Community Development Director Bruckner responded to questions from Mayor Madrid and Com Dev Dir Councilmember Chagnon regarding the environmental impact analysis for Azusa Pacific Response to University with questions regarding the timeline, the APU Master Plan, results of their marketing Questions study, outreach with the community, process for selection of the consultants, Environmental Impact Report's inclusion of cumulative effect on the community with regard to traffic, air, noise, etc. Moved by Councilmember Chagnon, seconded by Mayor Pro -Tem Hardison and carried to EIR for approve the selection of Impact Sciences in association with San Buenaventura Research APU Spec Associates to prepare the Environmental Impact Report for the Azusa Pacific University Specific Plan Plan, and authorize the City Manager to finalize and execute the contract, contingent upon the execution of a Reimbursement Agreement with APU. Mayor Madrid dissenting. Councilmember Rocha questioned the start date of the Pool Maintenance Agreement for the Rocha Azusa Aquatics Center, pointed out typos and requested clarification on some aspects of the Questions agreement. She Question asked that the issue be looked into. It was then moved by Councilmember Chagnon, seconded by Mayor Pro -Tem Hardison and Financial Stm unanimously carried that the Financial Statement for Year Ended June 20, 2001, for the City of Multifamily Azusa Multifamily Housing Program, $19,515,000, Multifamily Housing Revenue Refunding Hsg Revenue Bonds, Series 1994, be received and filed Councilmember Rocha addressed Item regarding agreement with West Coast Arborists asking Rocha someone to define tree lifting and asked about re -staking trees and whose responsibility it is to Questions do it. City Manager Cole responded. 07/15/02 PAGE FOUR Moved by Councilmember Chagnon, seconded by Mayor Pro -Tem Hardison and unanimously Caliber Pool carried to approve the agreement with Caliber Pool Services for pool maintenance of the Azusa Services/Poo Aquatics Center/James Slauson Community Pools for a thirteen -month duration commencing Maint Agmt July 1, 2002 and ending July 31, 2003 and to authorize the Mayor to execute same. Cncl THE CITY COUNCIL RECONVENED AT 9:11 P.M. reconvened An item of subsequent need arose regarding a cost to attend the Garage Band Jam 3 to be held Item of Sub - on Friday, July 19, 2002, and it was moved by Councilmember Stanford, seconded by Mayor Sequent need Madrid and unanimously carried to agendize it. Councilmember Rocha voiced concern regarding the request for donation of $3.00 in order to Rocha hear the Garage Band Jam 3. He stated that the majority of the attendees will be kids and Concerns some of them may not be able to afford the money. City Manager Cole advised that he would contact the Downtown Azusa Business Association to City Mgr discuss the matter. Coments Moved by Councilmember Stanford, seconded by Councilmember Chagnon and unanimously Motion to as carried to direct the City Manager to work this out at the wishes of the Councilmembers, which DABA not to is that there be no charge for entrance to Garage Band Jam 3. City Manager Cole responded charge for stated that he intends to speak to DABA and come up with a solution to the issue. City Mgr Direction It was consensus of Council to adjourn to Monday, July 22, 2002, at 7:30 p.m. at the Light and Adjourn Water Department Conference Room in order to consider a Cost of Service Study Recommendation and the Fire Contract.
