1 CITY OF AZUSA MINUTES OF THE CITY COUNCIL REGULAR MEETING MONDAY, FEBRUARY 3, 2003 - 6:30 P.M. The City Council of the City of Azusa met in regular session at the above date and time in the Azusa Auditorium. CEREMONIAL Ceremonial Chief of Police King Davis introduced Police Officers Ricky Moreno, John Wachowski, Rocky Oath R. More Wenrick and Jorge Arias and provided a brief history of each officer. Mayor Madrid J. Wachowsk administered the Loyalty Oath to each Officer and Chief Davis then administered the Code of Wenrich, J. A Ethics. An item of subsequent need arose regarding a request to address Council during public Item of subse participation by Mr. K.S. Pattabiraman relating to the property at 146 S. Motor Avenue, and it quent need was consensus of Councilmembers to agendize it as follows: Pattabiraman CLOSED SESSION Clsd Sess Conference with Lem] Counsel - Government Code Section 54956.9 (b). The City Council recessed at: 6:48 p.m. Recess The City Council reconvened at: 7:25 p.m. Reconvened City Attorney Carvalho announced that the item was scheduled under the public participation City Attorney portion of the agenda regarding a nuisance abatement and conditions and fines against the Comments subject property, further, that there was no reportable action taken in Closed Session. Mayor Madrid called the meeting to order and led in the Salute to the Flag. Call to Order INVOCATION was given by Reverend Rick Mac Donald of the Christian Family Center. CEREMONIAL (Continued) Ceremonial Councilmember Chagnon read and presented a proclamation to Ms. Kennedy of Huntington Proc Volunte Memorial Hospital proclaiming the month of January as "Volunteer Blood Donor Month". Blood Donor Month PUBLIC PARTICIPATION Pub Part Ms. Ginny Dadaian, Director of Student Financial Services at Azusa Pacific University, G. Dadian introduced Cece Castro and Joe Denny, students of Azusa Pacific University and recipients of APU the Nancy Moore Scholarship. The urged students to apply for the Nancy Moore Scholarship, Nancy Moore which is $5,000, by March 1, 2003. Scholarship Mr, K.S. Pattabiraman addressed Council regarding 146 S. Motor Avenue and fines associated K.S. with the property. He detailed the issue and requested that the City removed liens that they Pattabiraman have against the property in the amount of $22,000. He offered $10,000 and asked that the Request wa reminder of the fine $12,000 be waived. It was consensus of Councilmembers to deny the of liens request. Ms. Marcia Ammons, Resident Relations Director of the Haven for Affordable Housing, Inc., and M. Ammons, Rana Afra, a student at Gladstone High School, addressed Council requesting support to attend & Rana Afra Teenwork 2003. Ms. Ammons detailed the program and Ms. Afra requested support. She Request supp advised that the total cost was $250.00 and that the application is due February 14. It was consensus of Council to support with Rana Afra in the amount of $100. City Librarian Tovar presented two books written by Wesley IUoepfer, a former photographer, City Librarian and resident of the City of Azusa who has since passed away; the books are entitled: Azusa Presented bo the First Hundred Years, and East San Gabriel Valley Pioneers. The cost is $100 each. re: Azusa Mr. Bill Carpenter, addressed Council providing information regarding the Dhamakaya B. Carpenter Mediation Center located on the Monrovia Nursery property. He objected to the noise Re: Dhamak pollution that would surround the temple during construction of the project. Meditation C Ms. Hope Passero and Friends addressed Council regarding the Angeles National Forest — H. Passero Hawkins Lookout at the National Forest, stating that they would like to rebuild it, which would Hawkins cost $85,000, with volunteers. The requested moral support, publicity, and finance support if Lookout possible. They asked that business people in the audience support their efforts and that they would be having fundraising events, such as, spaghetti dinners, door prizes, etc Mr. Seamus McKeever addressed Council expressing his opinion regarding Councilmember S. McKeever ' I Stanford and Council decorum. Mr. Matt Hill, a sophomore at Azusa High School announced that he will be conducting a Flag Comments M. Hill Retirement Ceremony at June 14, 2003, at City Hall. This will help him earn his Eagle Scout Comments Award. Mr. Todd Afshar, Candidate for the March 4`h election, addressed Council expressing his sorrow T. Afshar over the Space Shuttle Columbia disaster that occurred on Saturday, February 1, 2003. He Comments asked that the City come together in unity to mourn, as a community, the death of the seven astronauts. Ms. Guillermina Sanchez, of Diamond Yellow Cab, addressed Council requesting that Council G. Sanchez re -consider their application to conduct business in the City. The Hearing was held at the Comments meeting of January 21, 2003, but the applicant was not present due to certain misunderstandings. She was advised that she could re -submit her application at a later date. Ms. Stephanie Mills addressed Council expression her opinion regarding freedom of expression S. Mills and the remarks of Councilmember Stanford at Council meetings as well as through his Comments newspaper. jjj 1 Ms. Rosemary Agabra, Editor of the Azusa Gazette, Councilmember Stanford's paper, R. Agabra fresponded stating that she personally edits the newspaper and stated that there are no racists Comments comments and that he does not tear down people. ' Mr. Jesse Martinez Carlos, Candidate for the March 4`" election, addressed Council expressing J. Carlos his vision for the City of Azusa in the future. He then expressed his opinion regarding Comments Councilmember Stanford and his remarks in the past and requested that all pray for him. Councilmember Chagnon responded to comments made noting the definition, qualification, Chagnon purpose and importance of being a Councilmember as well as being only 20% of the decisions Comments made. City Attorney Carvalho responded to concerns regarding campaigning at Council meetings S. Carvalho noting that the Brown Act does allow public participation which allows comments regarding Comments campaigns, but, that all persons at the meeting should keep to the norms of the City Council Rules of Conduct for City Council meeting resolution. 1 02/03/03 PAGE TWO t SCHEDULED ITEMS Sched Items PUBLIC HEARING - on Los Angeles County Fire Department Weed. Abatement of Improved Pub Hrg Properties. Weed Abmt The Mayor declared the Hearing open. The City Clerk read the affidavit of proof of publication Hrg open of notice of said hearing published in the San Gabriel Valley Tribune on January 27, 2003. Discussion was held between Councilmember and Community Improvement Manager Rudisel, Discussion regarding the process for updating and removing properties from the rolls. Mr. Rudisel advised that he would submit a letter to County on behalf of the properties that he believed should no longer be on the rolls. Testimony was solicited from the public, but, none was received. Testimony/no Moved by Councilmember Stanford, seconded by Mayor Pro -Tem Hardison and unanimously Hrg Clsd carried to close the public hearing. Moved by Councilmember Stanford, seconded by Mayor Pro -Tem Hardison and unanimously Order to carried to approve the motion and abatement order directing abatement of the nuisance by Abate appvd removing all weeds, and rubbish from the affected improved parcels. CONTINUED PUBLIC HEARING - to consider a General Plan Amendment from Conservation Cont Pub Hrg (C) and Rural (R) to Specific Plan (SP), Zone Change from Single-family Residential, 10,000 sf Monrovia lot minimum (R -a-10,000) and Residential Agriculture (RA) to Specific Plan 6 (SP -6), adoption Nursery of the Monrovia Nursery Specific Plan, Vesting Tentative Tract Map 54057, and pre -zone for property proposed for annexation located in the City's sphere of influence. The following persons commented on the project as part of public participation: Rona Lunde, Various Lana Grizzell, Mark W. Davis, Cindy Turcios, Dan Simpson, Don Clark, Richard Rubio, Joe Comments Guarrera, Art Morales, Diane Walters, and Michael Scheer. j City Manager Cole addressed the issue making a presentation on the status of the project and ' I further recommendation from staff. He stated that from the beginning, the project was a collaborative process via the Citizen Congress. He noted the guiding principles: Natural and Community Environment, Quality Neighborhoods and Homes, Mobility and Mix of Uses and Green Spaces and Public Uses. He noted Council action to date included: reduction of maximum densities in Promenade District, design study for 10' Street, confirmed neighborhood street widths, elimination of Cerritos connection, establishment of Assessment District to eliminate fiscal shortfall, historic resource protections strengthened, and City of Glendora drainage and traffic concerns addressed. He stated that the draft final plan density consisted of a range of 1475-1575 total units; the Applicant then proposed a reduction to 1350 total units, and now Staff recommendation is further reduction to 1250 total units. The project consists of Park Neighborhoods: All Single-family detached, average lot size over 6,350 square feet, the Village Core: Mix of single-family attached and detached, average density 13.3 units per acre, and Promenade: Mix of single-family attached and detached, predominately.townhomes, average density 13.3 units per acre. Mr. Peter Carlson of Vandermost Consulting, addressed the issue detailing the process and history of the project since its inception. He referred to the several agreements they have reached regarding the Heff Reservoir, Water Infrastructure, and the Vosburg House. He stated i that they have agreed to reducing the cap to 1250, with the same amenities. He then Ianswered questions posed by Councilmembers regarding where the reduction of units will be made, palm trees, status of the area of Dalton School, suggestions of a committee for mitigation measures, plaques, naming of streets, and cultural heritage - professional video taping/stills for historical purposes. At this time lengthy discussion was held regarding many conditions of approval as well as mitigation measures regarding ratio of replacement of trees, landscape plan, commission relationship to historical sites, palm tree preservation ratio, change to condition #84, utility related fees adding to the last section "an annual adjustments to reflect increases in the Construction Cost Index', Dhamakaya neighbors and construction nose, grading activities, + restrictions on conditions for Saturday, conditions with regard to Glendora issues, total number of units changed from 1350 to 1250, and walnut trees. UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF Updates/Rpts Mayor Pro -Tem Hardison addressed the issue of graffiti, stating that he would like to see that Hardison program continued, which states that If graffiti Is seen, it is removed, and that the Comments responsibility/liability be relayed to the owner of the building. Mayor Pro -Tem Hardison requested that staff review County ordinance #99-0072, relating to Hardison gangs, to see if the City would like to adopt one similar as a way to address gang issues. Comments Councilmember Chagnon advised that the turn lanes on Todd Avenue are going in today, but, Chagnon she noticed that people are making illegal u -turns; she asked that traffic department look into 1 Comments ' this. Councilmember Rocha announced and invited all to participate in the tree planting project that Rocha will take place at the Azusa Health Center on Azusa Avenue, on Saturday, February 8". He also Comments requested that the meeting be adjourned in memory of Bob Torrance, former Fire Chief of the City, of Azusa, who passed away recently. Mayor Pro -Tem Hardison congratulated Lieutenant Collins for the great job he has been doing Hardison with the patrolling of the Atlantis Gardens. Comments Councilmember Stanford expressed his disappointment with the people who addressed Council Stanford and expressed their opinion of him at this meeting. He stated that a citizen of Azusa, Bernie Comments Huerta, has created a memorial In his front yard surrounding a flag pole, to the seven astronauts who died as a result of the Columbia Space Craft recent air disaster. He asked that the meeting be adjourned in memory of his brother in-law Rod Carey who passed away last week, and he congratulated Richard Naranjo on attaining the Eagle Scout Award; he is the nephew of former Councilmember Tony Naranjo and the grandson of Art Morales.
