MINUTES OF THE CITY COUNCIL
REGULAR MEETING
MONDAY, DECEMBER 15, 2003 - 6:30 P.M.
The City Council of the City of Azusa met in regular session at the above date and time in the
Azusa Auditorium.
CEREMONIAL Ceremonial
Mrs. Barbara Dickerson and Ann Moritz, on behalf of the Azusa Woman's Club, announced that

the Woman's Club has been collecting food for the Azusa Food Bank and also presented Ms.
Food for
Candice Pipkin and Pete of the Azusa Food Bank with a Check for $406.00 to purchase other
Food Bank
perishable food to distribute to residents of Azusa.
The entire Council presented a proclamation to Ms. Anna Kwak honoring her for receiving the

Ms. Mercedes Cortez spoke in favor of Monrovia Nursery, she also requested that the rules of M. Cortez
decorum for Council meetings be enforced and that disrespectful behavior not be allowed. Comments
Mr. Mark Martin, a resident of Mountain Cove, addressed Council requesting that Mayor M. Martin
Madrid change her decision regarding Monrovia Nursery and to stop the relationship with ARG, Comments
Azusa for Responsible Growth.
Mr. Patrick J. Mallon, resident of Mountain Cove, stating that Councilmembers need to see and P. Mallon
approve items that further the City of Azusa, i.e. Monrovia Nursery. Comments
Mr. Michael Tyner of ARG, Azusa for Responsible Growth, addressed Council expressing his M. Tyner
opinion regarding the open letter in the Tribune about ARG, etc. Comments
Ms. Marie Kukula Tyner addressed Council expressing her opinion regarding Councilmembers. M. Tyner
Mr. Nicolas Pisano, a resident of Mountain Cove, requested Mayor Madrid to reconsider the N. Pisano
Monrovia Nursery Issue. Comments
Mr. Fred Spoliansky, a resident of Mountain Cove, addressed Council regarding Monrovia F. Spollansiry
Nursery project. Comments
Mr. Art West addressed Council with a statement regarding Monrovia Nursery, "let the Judge Art West
decide, let the People decide". Comments
REPORTS, UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF

Mayor Madrid commented on the beauty and authority of democracy and the question of what Madrid
Is best for Azusa. Comments
Councilmember Hardison commented on the differences of opinion people may have regarding Hardison
the Monrovia Nursery project. He stated that there is a need to make sure that the railroad Comments
crossing be consistent all through the San Gabriel Valley. He also requested that City
Management look Into an Issue regarding a 50% increase in rent for one of the residents and
that they try to assist this person. He mentioned a letter regarding a five day work week and
asked Council to take it In the spirit that It is meant.
Councilmember Stanford asked to keep the troops in thought this Holiday Season. He provided Stanford
an update on the mosquito problem, noting that the cold is keeping them under control. He Comments
provided an update on the Gold Line draft environmental effort. He noted his disappointed at
personal attacks towards Councilmembers from the public and explained the reason for
comments in the Azusa Gazette.
Councilmember Chagnon announced that the ground breaking ceremony for the National Guard
Armory on Friday was very exciting. She encouraged all to donate to the Azusa Food Bank. She
asked that item regarding the railroad track which Councilmember Hardison noted be directed
to staff to bring back to the agenda for action. She wished all a Merry Christmas and Happy
'New Year.
Mayor Pro -Tem Rocha asked that the meeting be adjourned in memory of Dolores Ayon. He
thanked the Knights of Columbus for honoring the Azusa Police Department and also thanked
all who have volunteered for Azusa Food Bank. He stated that an Azusan, Joe Cassanova, had
recently died in the war and asked that the meeting also be adjourned In his memory. He
wished all a peaceful and Happy Holidays.
Mayor Madrid congratulated the Jr. Paramedic of Paramount School and thanks all who
were responsible for the Jr. Paramedic Program.

'Community Development Director Bruckner announced that the General Plan draft document is Com Dev Dir
available as well at the Environmental Impact Report on the General Plan, both could be viewed Update on
at the Library and the West Wing counter, and the cost to purchase one is $45. Efforts are General
being made to place the documents on the City's web site. He stated that the EIR,is being Plan
circulated right now for public review and the public comment period will be over on January
12, 2004. The Planning Commission will begin the Public Hearing process on January 14, 2004
and again on January 281" if needed, and there will be a joint workshop with the City Council on
February 9fh, and then more public hearing jointly with the City Council He stated that the
Development Code will follow shortly thereafter with a series of Public Hearings. Discussion
was held regarding the process and content of the documents. Mayor Pro -Tem Rocha
commented that some language in the documents, i.e. "substandard Library", "substandard
schools", needs to be clarified as it does not explain the area of substandard.
City Manager Cole presented the 2004 Chamber of Commerce Calendar and detailed its City Mgr
contents. Comments
Assistant City Manager Person presented the Azusa Health Clinic Facility lease for the property Asst City
located at 150 N Azusa Avenue to EI Proyecto Del Barrio. He noted that the Issue of Utilities is Mgr
still being negotiated, but requested that it be approved and that staff be allowed to finalize the Health Clinic
process.
Moved by Councilmember Stanford, seconded by Councilmember Chagnon and unanimously EI Proyecto
'carried to approve the lease, after negotiations regarding utilities, between the City of Azusa Del Barrio
and Ei Proyecto del Barrio to establish a non-profit community health clinic within the City of Lease Agmt
Azusa.

CONTINUED PUBLIC HEARING —on an amendment to an existing conditional use permit C-89- Con't Pub Hrg
20 requested by Vulcan Materials/Azusa Rock, 3901 Fish Canyon, to modify the conditions of Vulcan Materials
approval to delete the requirement for a grade separation of the existing haul road and the
existing bike trail.
The Mayor declared the Hearing open. The City Clerk read the affidavit of proof of publication Hrg open
of notice of said hearing published In the Azusa Herald on October 23, 2003 and on December

B. Side Letter of Agreement with Azusa Police Management Association (APMA)and Azusa Side Ltr
Police Officers Association (APOA). This amends the MOU covering salary and benefits for APMA/APOA
the period of August 1, 2000 through July 31, 2004. It also amends the Budget in the
General Fund by $254,730 to fund the agreements.
C Approval was given to authorize a budget amendment to appropriate $9,300 from the Orthophoto
General Fund to fully fund the Orthophoto Project. Project

D. Expenditure Plan — 2002 Homeland Security Grant. Approval was given for the purchase Purchase alarm
of a personal alarm dosimeter and an inspector probe from Laurus Systems, Inc. for dosimeter and
$10,269.62. All equipment was selected from a state approved list established for Law Inspector probe

H. Approval was given to amend the contract with Forsight Creations in the amount of

$12,000 for a total contract amount of $72,000, and to amend the 2004 Capital
Forsight
Improvements Project (CIP) Budget by transferring $12,000 from the Beautification
Creations
Enhancements Account to the San Gabriel Avenue Beautification Project, and to recognize
$1,500 in revenue from civic organizations and appropriating the funds to the San Gabriel
Avenue Beautification Project to be used toward the purchase of a new flag pole.

City Attorney Marco Martinez referred to item regarding the appeal of the Planning Commission Ci y Attorney
approval of the Dr. Reyes Building Project, located at 613/615 N. Azusa Avenue, noting several Comments
changes to the document.
Moved by Councilmember Chagnon, seconded by Councilmember Hardison and unanimously Follow-up
carried to approve the settlement, as amended, and to authorize the Mayor to execute the Appeal PC
agreement, and approve the budget amendment of $28,000 for unanticipated legal and Reyes Bldg
consulting costs with funding from the Central Business District Capital Project Fund Balance.
