Code Sec. 54956.9(a) — Conf w/legal Concerning threatened Brown Act Litigation by Azusans for Responsible Growth v. City of Counsel Azusa, Case No. BS088326. The City Council recessed at 6:30 p.m. and reconvened at 7:21 pm. Rcss/rcnvn City Attorney Martinez announced that there was no reportable action taken in Closed Session, CityAtty but, stated that item regarding Public Employee Appointment was continued to the meeting of Reports March 1, 2004. Mayor Madrid called the meeting to order and led in the Salute to the Flag. INVOCATION was given by Pastor Logan H. Westbrooks of Faith Temple Church of God in Christ. PUBLIC PARTICIPATION Call to Order Invocation Roll Call Also Present Pub Part Dr. Michael Hurtado, Dean of Continuing Education of Citrus College, addressed Council M. Hurtado regarding Measure G- Citrus College Facility Bond. He detailed the need for improvements at Citrus College Citrus College and the Facilities Master Plan. He stated that for every hundred thousand dollars your house is assessed, it will cost $25 a year for 20 years. He stated that if anyone wishes to help they can call: (626) 914-8561. Mr. Seamus McKeever addressed Council expressing his opinion regarding the city measures. S. McKeever Ms. Lana Grizzell addressed Council expressing her opinion regarding the Monrovia Nursery L. Grizzell Project. Comments Mr. Mark Davis addressed Council expressing his opinion regarding the Monrovia Nursery M. Davis Project. Comments Mrs. Marie Kukula Tyner addressed Council expressing her opinion regarding the Monrovia M. Tyner Nursery Project. Comments Mr. Ronald Lohr addressed Council and complimented Rick Cole for a job well done in Azusa R. Lohr and wished him good luck in Ventura. He then expressed his opinion in favor of the Monrovia Comments Nursery Project. Mr. Art Morales addressed Council regarding various Items of interest to him. A. Morales Mr. Mark Ades addressed Council expressing is opinion in favor of the Monrovia Nursery M. Ades Project. Comments REPORTS, UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF Rpts/Updates City Treasurer Macias provided an update on Certificates of Participation and Tax Allocation City Treas Bonds. He detailed how they refinanced the debt of the Redevelopment Agency saving COP a TAB $659,000 . With regard to the TAB they saved $7 million dollars by refinancing the debt. He provided a brief overview on how that able to accomplish this was due to healthy reserves. He thanked Steve Kenoyer, Rose Jara, Julie Gutierrez and Mike Hennessey for their help. Mayor Pro -Tem Rocha requested that the meeting be adjourned in memory of Mike Zarate, Rocha Tree Elias Sotelo Fierro, who recently passed away. He advised that Michael Troncoso former Planting student of Lee School is leaving for Bagdad to serve he country; he reminded all that supplies are still needed and being accepted to send to Bagdad. He thanked officers Mark Walters and Brandon Bailey for their help to a resident, "Barbara", when they checked her house for possible Intruders. He announced that there will be tree planting at Northside Park at 8 a.m. on March 6th, and at the Library on March 6th will be the ABC's of Library Literacy from 1 1 a.m. — 12 p.m. 'He invited all to the UMYPA dinner/dance at the Woman's Club. He then requested that a commemorative tree planting be planted at Slauson Park In memory of a lady who was killed, hit by a truck at Cerritos and 5th Street. He relayed the impact that this has had on the community and especially the family. He asked that a policy be set that trees could be planted at the Interpretive Center in the Canyon, in memory of love ones. It was consensus to use Slauson park to plant the tree in her memory and have a plaque with her name. He asked that staff provide updates on La Tolteca, Breezeway, and Dr. Reyes property at the next meeting to let people know that there are exciting things happening in the downtown area. Councilmember Chagnon requested that the Traffic Bureau of the Azusa Police Department look Chagnon Into traffic and safety issues In front of a Day Care Center located at 509 N. San Gabriel Avenue. Comments She noted that the project was approved by the Planning Commission and asked about the appeal process noting that she would confer with staff and asked the Chief of Police to come back with a report at the March 15th Council meeting. Councilmember Stanford responded to negative comments regarding the Monrovia Nursery Stanford Project: noting possible inaccuracies regarding them. Comments Councilmember Hardison stating that he too would like to have an update on the projects in the Hardison Azusa Downtown area and possibly announcements from Downtown Business Association and Comments the Azusa Chamber of Commerce. Mayor Madrid added comments regarding the Downtown areas, specifically, one way versus Madrid two way traffic cities, stating that perhaps Azusa could incorporate what is working. She Comments announced that on Saturday, February 21, 2004, there will be tire recycling on Gladstone and Irwindale Avenue. She also stating that she is circulating an Initiative, regarding Local Tax Payers Public Protection Act and asked her colleagues to support it. City Manager Cole addressed Council stating that the Governor's proposed budget reduces the City Mgr City of Azusa's local revenue by $400,000 and that staff will be presenting three scenarios for a Comments balanced budget at a meeting next month based upon the Governor's cutbacks should they pass and become law, another based upon the City's current revenue, before cutbacks, and a scenario based upon going to the residents and businesses of the City for additional revenue. He stated that under all of the scenarios there are significant reductions. 02/17/04 PAGE TWO SCHEDULED ITEMS Sched Items INFORMAL PUBLIC HEARING — on Los Angeles County Fire Department Weed Abatement Informal Hrg Protest Hearing. Weed -Abate The Mayor declared the Hearing open. The City Clerk read the affidavit of proof of publication Hrg open of notice of said hearing published in the Azusa Herald on February 5, 2004. Testimony was solicited, but, none was received. Testimony/none Moved by Councilmember Chagnon, seconded by Councilmember Stanford and unanimously Hrg clsd carried to close the Public Hearing. Moved by Councilmember Chagnon, seconded by Mayor Pro -Tem Rocha and unanimously Option and carried to approve the option and abatement order directing abatement of the nuisance by Abatement removing all weeds, and rubbish from the affected improved parcels. Order Moved by Councilmember Stanford, seconded by Councilmember Hardison and unanimously Bus Lic Rev carried to continue the Business License Suspension/Revocation Hearing for the "Last Chance Continued Saloon", located at 832 N. Azusa Avenue, to the meeting of March 1, 2004. 3/1/04 PUBLIC HEARING — on the General Plan and General Plan and Development Code Draft Pub Hrg Environmental Impact Report (DEIR) for the City of Azusa. General Plan The Mayor declared the Public Hearing open. The City Clerk read the affidavit of proof of Hrg Open publication of notice of said hearing published in the Azusa Herald on February 5, 2004. Moved by Councilmember Chagnon, seconded by Councilmember Hardison and unanimously Continued to carried to continue the Public Hearing to the meeting of March 15, 2004. 3/15/04 CONTINUED PUBLIC HEARING —on an amendment to an existing conditional use permit C-89- Continued Pub 20 requested by Vulcan Materials/Azusa Rock, 3901 Fish Canyon, to modify the conditions of Hrg Vulcan approval to delete the requirement for a grade separation of the existing haul road and the Materials/Azusa existing bike trail. Moved by Councilmember Stanford, seconded by Councilmember Chagnon Rock ' and unanimously carried to continue the Public Hearing to the meeting March 15, 2004. The CONSENT CALENDAR consisting of Items V-A through V -H was approved by motion of Consent Cal Councilmember Chagnon, seconded by Councilmember Hardison and unanimously carried with V -E & G the exception of items V -E, and G, which were considered under the Special Call portion of the Spec Call Agenda. A. The Minutes of the regular meetings of February 2, 2004, were approved as written. Min appvd B. Human Resources Action Items were approved as follows: Human Res Merit Increase and/or Regular Appointment: P. Dennis and R. Chavez. Action Items Separations: S. Kenoyer, Associate Finance Director, effective 2/12/04. C. The City Treasurer's Report as of January 31, 2004, was received and filed. City Treas Rpt D. Plans and specifications for "Pavement Management Plan Improvements" Project were Pavement approved for Overlays, and Slurry and Cape Seal, and authorization was given to advertise Management for bids. Plan E. SPECIAL CALL ITEM. Spec Call ' F. Approval was given to a City employee for leave of absence without pay pursuant to Azusa Leave of Civil Services Rules, Section 6,8. Absence G. SPECIAL CALL ITEM. H. The following Resolution was approved and adopted: Spec Call A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN Res. 04-C17 CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE Warrants TO BE PAID. 02/17/04 PAGE THREE SPECIAL CALL ITEMS Councilmember Chagnon expressed her appreciation to Director of Park Planning Development Noriega for his work on bringing about the Rio San Gabriel Bike Path Project. Spec Call Items and Chagnon She Comments stated that it will be funded with $108,000 of Mountain Cove Facility District money, a $350,000 grant from the 1996 Los Angeles County Proposition A Bond Act, in conjunction with the Los Angeles Regional Park and Open Space District and the Los Angeles County Board of Supervisor, Gloria Molina, for a project budget of $458,000. She described the project. Moved by Councilmember Stanford, seconded by Councilmember Chagnon and unanimously carried to approve the plans and specifications for the Rio San Gabriel Bike Path Project for the purpose of formal bidding and authorize to advertise for bids. Councilmember Chagnon addressed item regarding Notices of Completion and savings realized 'of $35,000 that will be put into a special fund to procure and install security measures in the City Council Chambers, stating that identification of measures have not been decided yet. Staff responded and discussion was held regarding the Council Chambers and security. It was consensus that the savings will be put into a fund for security measures for the Council Chambers and that recommendations would come back to Council and they can choose what project to fund. Moved by Councilmember Stanford, seconded by Councilmember Chagnon and unanimously carried to approve the Project Completion Notices for West Wing Improvements and Recreation Building as follows: 1) the Notice of Completion for Advantage Project Builders, West Wing Improvements, and the final contract price of $86,440.41, 2) the Notice of Completion for Yocum Business Furnishings, West Wing Building Furniture, and the final contract price of $45,336.40, 3) the Notice of Completion for Award Project Builders, Recreation Building Improvements, and the final contract price of $149,471.00, and 4) transfer of $35,000, from savings realized in the Recreation Building Improvements project, to a special fund to procure and install security measures in the City Council Chambers.
