The City Council of the City of Azusa met in regular session at the above date and time in the Azusa Auditorium. CEREMONIAL Presentation was made to Azusa Homework House for Its dedication to the Youth of Azusa through Its tutoring and mentoring program. Ms. Carolyn Crawford, on behalf of the Azusa, Glendora, Irwindale Foothills Sunrise Rotary Club presented Homework House with a check for $1000. Ms. Nora Gutierrez of Assemblyman Ed Chavez recognized Homework House for Its work In the Community. Mr. Don Allen, of the Los Angeles County Department of Parks and Recreation presented the City of Azusa with a scroll recognizing its partnership in public service. The entire Council presented a proclamation to Ms. Kathy Ford, President of the Board of Project Sister, proclaiming the month of April as "Sexual Assault Awareness Month". Ceremonial Presentation Homework House Scroll from LA Park & Rec Proc to K. Ford Sexual Assault Awareness Mo. The entire Council presented a proclamation to representative of EI Dia de los Ninos Los Dia De Los Angeles Committee, designating Friday, April 30, 2004, as EI Dia de los Ninos. Ninos 4/30 Adult Education and Literacy Coordinator Lulvette Resto accepted Certificates of Appreciation Adult Ed l;_ Lit to local Businesses who supported the 2004 Scrabble Tournament. These donors provided Coordinator door prizes and offered support to the Azusa City Library Adult Education Literacy Center. Code Sec. 54957.61 Agency Negotiators: City Manager Rick Cole and Assistant City Manager Robert Person. Organization/Employee: Community Development Director Councilmember Chagnon requested that an item on the Consent Calendar regarding the reclassification of Chief Information Officer position to Director of Information Technology, be taken Into Closed Session for discussion. City Attorney Carvalho asked if there is a need to take Immediate action on the Item and stated that there Is a provision of the Brown Act that, for very limited purposes, allows to convene in Closed Session to discuss the issue that Councilmember Chagnon believe warrant going into Closed Session with that item, without actually adding it to the Closed Session. It was moved by Mayor Pro -Tem Stanford, seconded by Councilmember Hardison and unanimously carried to use the provision of the Brown Act with regard to the item. This Item was not added to Closed Session. Conf w/Labor Negotiators Discussion regarding adding an item to Closed Session The City Council recessed at 6:45 p.m. and reconvened at 7:30 pm. Rcss/rcnvn City Attorney Carvalho advised that due to time constraints, items A & B were not discussed City Atty and that they would continue Closed Session to the end of the Council meeting. Reports Mayor Madrid called the meeting to order and led in the Salute to the Flag. Call to Order INVOCATION was given by Reverend Mark Carlson of the First Presbyterian Church. He then expressed his opposition to the Monrovia Nursery Project. Comments Mr. Mike Tyner addressed Council expressing his opinion in opposition to the Monrovia Nursery M. Tyner Project. PUBLIC PARTICIPATION Pub Part City Mgr Ms. Patricia Hanks, Executive Director of the Miss Azusa Scholarship Program, introduced Miss P. Hanks Azusa Ashley Fenison, and stated that her court, Julie Marie Froyum, and Kristen Ford, were Miss Azusa unable to attend. Mr. Victor Valenzuela Jr., addressed Council and audience announcing that he will be running for V. Valenzuela the 2' Assembly. Comments Mr. Art West addressed Council providing information regarding Monrovia Nursery Project and A. West his opposition to the project. Comments M. Davis Mr. Mark Davis provided his comments in opposition to the Monrovia Nursery Project. Comments Mr. Richard Rubio expressed his opinion in opposition to the Monrovia Nursery Project. R. Rubio 'Mr. Seamus McKeever addressed Council and expressed his opinion in opposition to the Monrovia S. She then expressed her opinion regarding the Monrovia Comments 'and Nursery Project. E. Ramirez Ms. Elizabeth Ramirez addressed Council and expressed her opinion in favor of the Monrovia Comments Nursery Project. M. Cueva Ms. Maricela Cueva addressed Council asking what Is being done about the Gun Club in the Comments Canyon area and the noise it is causing to the residents of Mountain Cove. City Manager Cole responded stating that the Gun Club is not in violation of the law, but, they City Mgr have said they will work to mitigate the problem. Response 04/05/04 PAGE TWO Assistant City Manager addressed the issue referring to a fact sheet he had previously handed Assist CityMgr out the Council. City Manager advised that a staff report would be brought back to Council at a Comments later date. REPORTS. UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF Rpts/Updates Councilmember Chagnon announced the following: Woman's Club Prayer Breakfast on April Chagnon 7`h, I(ids Come First Golf Tournament on June 11 d', Easter Egg Hunt at Memorial Park on April Comments 10`h, and Zacatecas Sunday on April 18th at Azusa Pacific University. She also advised that she has had talks with Vulcan regarding the Gun Club and that studies and recommendations are in the works for alternative uses. Councilmember Rocha thanked all for help with tree planning and clean ups, throughout the Rocha 'City. He asked that parking overflow from the swapmeet at Citrus College into the shopping comments center behind Marie Calendars, be looked into. He asked that the meeting be adjourned In memory of Paul Mendoza, Frank "Chango" Manqueros, and Leticia Barajas. Mayor Pro -Tem Stanford expressed appreciation to the following Rick Cole for all his work ask Dick Stanford City Manager, Patricia Hanks and the Azusa Chamber for their work on the Miss Azusa Pageant, Mayor Pro -Tem Homework House, the Mariachl Festival and all involved in the success of the events. Councilmember Hardison commented on the San Gabriel Gun Club and the need for Hardison Improvement. He also expressed his frustration regarding the issue of cars for sale on public Comments street as a car lot, he noted overlay problems on Foothill Boulevard, and an issue with water. Mayor Madrid expressed thanks to Rick Cole for his services to the City of Azusa and to Madrid everyone who has participated In conversations regarding Monrovia Nursery. She announced Comments that this is Clean and Green Month and announced the Hazardous Waste Clean Up on April 17`h at Northrop -Grumman Corp. City Manager Cole announced that a grant has been received In the amount of $424,000, to refurbish the Azusa Health Center. SCHEDULED ITEMS Sched Items PUBLIC HEARING — on a review of the Planning Commission's Approval of Conditional Use Pub Hrg ' Permit to Operate a Large Family Daycare Business at 509 N. San Gabriel Avenue. Cup 509 N. San Gabriel The Mayor declared the Public Hearing open. The City Clerk read the affidavit of proof of Hrg open publication of notice of said hearing published In the Azusa Herald on March 25, 2004. Chief of Police Davis addressed the Hearing providing a summary of traffic issue at 509 N. San COP Gabriel Avenue noting that the conclusion states that there are no extraordinary concerns for Comments the location and the objective of running a Day Care. Mr. and Mrs. Grace and Eric Albrechtsen, owners and operators of the proposed Day Care Albrechtsen addressed the issue and provided a detailed history of how she came to operate a Day Care at Comments that location and how she has made many improvements to the home. She then answered questions posed by Counciimembers. Testimony was received from Lorraine Hernandez, Lynette Barlett, and Susan Rodriguez in Testimony favor of the day care center. Moved by Councilmember Chagnon, seconded by Councilmember Rocha and unanimously Hrg Clsd carried to close the Hearing. Moved by Councilmember Chagnon, seconded by Councllmember Rocha and unanimously Decision carried to affirm the decision of the Planning Commission approving Conditional Use Permit C- Of PC '2003-08, based on the finding of fact and subject to the Conditions of Approval listed in Exhibit affirmed "A" dated January 28, 2004. Assistant City Manager Person provided an update on San Gabriel and 2nd Street Traffic Issues. Update on Director of Public Works Nakasone also provided additional comments regarding the subject, Traffic issues that they will be resurfacing the street some time in the future. SG & 2"d CONTINUED PUBLIC HEARING — City of Azusa General Plan and General Plan and Cont Pub Hrg Development Code Draft Environmental Impact Report. General Plan 04/05/04 PAGE THREE Community Development Director Bruckner presented the third presentation on the Azusa Com Dev Dir General Plan stating that on March 16, 2004, there was a presentation concerning Economic Comments and Urban Form, and on March 29, 2004, Land Use, Infrastructure, Governmental Services, Recreation, Geologic Hazards, and Cultural and Historic Resources. He stated that this will be the final presentations regarding Mobility, Open Space and Biological Resources, Mineral Resources, Air Quality and Noise and General Plan Element, and there will be a presentation of the Draft Environmental Impact Report presented by Terry Hayes and Associates. Mr. Michael Bates of the Mobility Group provided a presentation on the Mobility portion of M. Bates General Plan which included, but was not limited to: street connections, improved transit Mobility Group services, develop bicycle and pedestrian facilities, citywide access and circulation, fully develop the street system, and transportation choices. He detailed the mobility element and answered questions posed by Councilmembers. 'Ms. Katherine Pate of Vicom Corporation, addressed the Hearing providing a detailed K. Pate presentation on Open Space and Biological, which Included elements and policies to conserve Vicom Corp and protect nature, establishing a biological resource database, types of habits and creating a Comments detailed Biological Resource Area Overlay Zone, to restore habitats within nature preserves for rare, threatened and/or endangered species, create wetlands, encourage ponds, lakes and old mines, restore the river lost fisheries, and creation of the city nature preserve; to name a few. She then answered questions posed by Councilmembers. Mr. Jeff Harvey of Graystone Environmental Consultant, presented the Mineral Resources J. Harvey element of the General Plan. He stated that it is designated as a high level of resource zone, Graystone focused on balancing the need for extraction of mineral with the City's goals for environmental Environmental quality. He detailed the mining operation process and goals and impacts of the mining Consultants companies. He then answered questions posed by Councilmembers. Councilmember Chagnon requested that staff investigate the possibility to create a revised reclamation plan within five years to consider or pursue a joint use with the quarries, the Gun Club, the Army Corp of Engineers, the River, in terms of a reuse for the river pathway. Mr. Kevin MacDonald, Attorney for Vulcan Materials, addressed the Issue and expressed K. MacDonald concern regarding answers to some of the letters that he had sent prior to this hearing. Comments Discussion was held among Councilmembers, staff and Mr. MacDonald, regarding mining Discussion requirements, mineral resources, policies of the General plan, the new EIR, State policies regarding mining, the Development Code and additional information on MRZ-2 areas. ' Mr. Bob Stark of Terry Hayes and Associates addressed Council providing a presentation on Air B. Stark Quality and Noise which included the following: Air Quality and Noise. He promoted Terry Hayes development that encourages alternate forms of transportation, to minimize pollution by &Associates providing consistent and effective code enforcement, work with regional agencies, to name a Comments few. He also stated that noise could be addressed by the implementation of design guidelines for residential developments, use noise studies in the planning process and use them as an evaluating factor in permitting new development. He stated that with regard to transportation noise studies, the City should work with CalTrans, review and update the City's truck route, works with the PUC and use traffic calming measures. He then answered questions posed. After additional discussion, It was moved by Councilmember Chagnon, seconded by Pub Hrg cont Councilmember Hardison and unanimously carried to continue the public hearing to the To 4/19 meeting of April 19, 2004, Further, it was consensus of Council that the Draft Environmental Draft EIR Impact Report on the Azusa General Plan be adjourned to Monday, April 12, 2004, for Adjourned to discussion. Staff noted that they would like to have a Special Meeting on that same date In 4/12 order to conduct a Closed Session, this meeting would have to be noticed separately. The CONSENT CALENDAR consisting of items VI -A through VI -H was approved by motion of Consent Cal Mayor Pro -Tem Stanford, seconded by Councilmember Chagnon and unanimously carried with Approved the exception of Item VI -H, which was considered under the Special Call portion of the Agenda. Councilmember Rocha abstained from VI -A, the minutes of the last meeting, as he was not present at that meeting. Item VI -G, was removed from the Agenda by Staff. ' A. The Minutes of the regular meetings of March 15, 2004, were approved as written. Min appvd B. Human Resources Action Items were approved as follows: Human Res Merit Increase and/or Regular Appointments: S. Gonzalez, 1. Tingley, and P. Yugar. Action Items New Appointments: A. Solis, Apprentice Line Mechanic, effective April 19, 2004. Separations: J. Hernandez, Police Dispatcher, effective March 18, 2004. C. The City Treasurer's Report as of February 29, 2004 was received and filed. Treas Rpt 04/05/04 PAGE FOUR D. Approval was given to award the contract for the Pioneer Park Restroom CIP Project to Pioneer Pk Jergensen Construction Company In the amount of $70,000, which includes a $12,000 Restroom contingency to cover any unforeseen issues that may come up during construction. Jergensen E. Approval was given to award the bid for the Pavement Management Plan to the selected Pavement Plan low bidders as follows: Cape Seal and Slurry Seal — American Asphalt South, Inc., in the American amount of $833,765 and Overlays — Gentry Brothers, Inc., In the amount of $937,729. Asphalt Gentry Bros. F. The Purchase of 25 HP Compaq PC's to CDWD under California Multiple Awards Schedule Pur of PC's (CMAS) was approved in the amount of $34,16.00. Formal bidding was waived In CDWD accordance with the Azusa Municipal Code ' G. ITEM REMOVED FROM THE AGENDA. - Authorization for reclassification of Chief Rmvd from Information Officer position to Director of Information Technology an to reclassify the Agenda Incumbent Acting Chief Information Officer. H. SPECIAL CALL ITEM. SPECIAL CALL ITEMS Spec Call Spec Call Items Councllmember Rocha voiced concern regarding spending $200 for car washes. Rocha Councilmember Hardison asked If the City owns it own car wash atone of the facilities. Chief Comments of Police Davis advised that the trustees do wash the police cars and that the cost is for the Warrant Reg. washing machines. Further, that the trustee only wash police cars. Councilmember Rocha offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS Res. 04-C28 AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. Warrants Moved by Councilmember Rocha, seconded by Councllmember Chagnon to waive further reading and adopt. CRA convened Mayor Pro -Tem Stanford offered AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA CALIFORNIA, AMENDING Ord 04-05 CHAPTER 34, ARTICLE I, SECTION 34-1 OF THE AZUSA MUNICIPAL CODE CONCERNING Amend AMC HEALTH AND SANITATION REGULATIONS BY DELETING THE EXISTING SECTION 34-1 AND Health ✓i ADOPTING DIVISION 1, ITLES 8 AND 1 1 OF THE LOS ANGELES COUNTY CODE IN ITS PLACE, Sanitation AND DELETING CHAPTER 34, ARTICLE II OF THE AZUSA MUNICIPA CODE CONCERNING Regulations FOOD ESTABLISHMENTS IN ITS ENTIRETY. Moved by Mayor Pro -Tem Stanford, seconded by Councllmember Chagnon to waive further reading and adopt.
