REGULAR MEETING
MONDAY, SEPTEMBER 7, 2004 - 6:30 P.M.
The City Council of the City of Azusa met in regular session at the above date and time in the
Azusa Auditorium.

The entire Council presented a Certificate and Blue Star to the Ms. Slawinski, the mother of K. Slawinski

Literacy Day on September 8, 2004. City Librarian Tovar Invited all to attend a presentation by Literacy Day
poet, author and activist, Jimmy Santiago Baca, to be held in the Civic Auditorium on Tuesday,
September 21"at 7 p.m. noting that it will be in celebration of International Literacy Day in the
City of Azusa.

Mr. Akramian addressed Council regarding the property located at 237 S. Azusa Avenue stating Akramlan
that four years ago he requested to lease the property. He provided a short history of the Comments
property and stated that the City/Redevelopment Agency has been considering leasing it to him,
but, it has not been done yet. He requested that Council consider leasing the property to him
for eight years.
The City Council recessed to Closed Session at 6:53 p.m. to discuss the following:

The City Council reconvened at 7:30 p.m.

City Attorney Carvalho advised that there was no reportable action on the above listed items, City Attny
and additional discussion will be held at the end of the meeting regarding most of the items.
Mayor Madrid called the meeting to order and led in the Salute to the Flag.

PUBLIC PARTICIPATION
Ms. Ginny Dadaian, Director of Community Relations of Azusa Pacific University addressed
Council introducing Melissa Nichols, ASB Senator for the City of Azusa and Director of
Administrative Services Tim Hooten, who provided an update on the City Links Project to be
held on Saturday, September 18, 2004. He invited all to attend the festival at 1 pm at Azusa
Square; for more information the website is: apu.edu.citylinks. He advised that there will be
breaking ground on a Community Garden Project later on this year.
Mr. Art Ramirez, Chairman of the Azusa Golden Days Committee addressed Council requesting
waiver of fees In connection with the Azusa Golden Days Events and provided an update on the
events and fundraisers. He displayed the Golden Days t -shirts and announced the theme:
"Surfing Thru Azusa", designed by Ms. Lorraine Dominguez. He provided the following
information regarding Golden Days events: Fri -Sun, Oct. 1-3 - Canyon City Chalk Walk -
Slauson Park, Saturday October 2, Downtown Business Association Historical Tour and
Luncheon, Tour -Monrovia Nursery - Lunch at the Vosberg House, Sunday October 3 - 51( Run,
Senior Center, "Surf's Up at the Pool" Slauson Park, 25cent swimming, hot dogs, popcorn and
sno cones. Live entertainment and free health fair, Tuesday October 5 - Azusa Chamber of
Commerce and APU's "Azusa Taste of the Town" APU Felix Event Center Courtyard,
Wednesday October 6 - Azusa Woman's Club Luau Dinner Show 5-1 tat the Senior Center,
Thursday October 7 - Helping Hands Bingo Night Azusa Senior Center, Fri -Sun October 8-10 -
Carnival at Memorial Park, Saturday October 9 - Elks Pancake Breakfast Azusa Light & Water
Parking Lot, and Parade on San Gabriel Avenue and Car and Truck Show Sponsored by Oldies
Car Club at Memorial Park. Ms. Ginny Dadaian, announced that Bryan Clay, of APU, who won
the Silver Medal for Decathlon for the U.S. in the Olympics, will be the Grand Marshal of the
Golden Days Parade.
City Manager Gutierrez clarified that the fees proposed to be waived are approximately $6,000;
other related fees are in-kind services. No action was taken; it was consensus of
Councilmembers that the item be brought back to another meeting with a break down of the
fees requested to be waived and how costs can be brought down or negotiated.
Mr. Paul Naccachian addressed Council regarding entitlements that were granted to him in the
Settlement Agreement with regard to Block 37. He stated the issue is that the new
Development Code language which says that "it will supersede any private agreements that
were entered into prior to it".
'City Attorney Carvalho responded stating that there is a settlement agreement with Mr.
Naccachian which states that the City would allow any property that he develops in Block 37 to
enjoy the same types of variances and parking, in particular the types that Dr. Reyes and
developer of the Talley building have. Mr. Naccachian Is concerned that nothing in the new
proposed development code acknowledges that the City has a settlement agreement with him
and that the agreement seems ambiguous. Ms. Carvalho stated that it is clear that he has the
same variance rights and free parking, unless some day a parking structure Is built and Reyes
and Talley developers would have to contribute towards parking structure as Mr. Naccachian
would, but, he is requesting that specific language be placed in the development code to
acknowledge his agreement. She advised that the agreement is Independent of the
development code; therefore this could not be done.

After additional discussion, it was advised that when Council considers the new development Discussion
code, Mr. Naccachian attend the meeting and express his concerns at that time.
Councilmember Hardison inquired whether City Attorney Carvalho could Include an amendment
to Mr. Naccachians' agreement which says the agreement supersedes the Development Code.
She advised that if the City Council directs her to do so she will.
Ms. Rosemary Agabra, Library Commissioner, addressed Council providing an update on Library R. Agabra
events which included the Summer Reading Program and an Adult Computer Classes, stating Update on
that they very successful. She announced that on September 26`" the Friends of the Library are Library events
having a Centennial Celebration at the Library which will include historic events, between 2 p.m.
and 4 p.m. She offered condolences to Mrs. Jenny Avila and her family on the recent passing
of her husband, Tom Avila.
'Mr. Jim Rose of the Veterans of Foreign Wars addressed Council and requested monetary J. Rose
contributions to the Veterans for the care and/or replacement of the American flags on Foothill VFW request
Boulevard; he advised that it is very costly. He stated that the City had originally agreed to help Contribution to
with the replacement of the flags. Councilmember Rocha advised that there was no official purchase flags
record but, the City was going to donate $1,000 a year to purchase new flags. CityManager
Gutierrez responded stating that she will research the subject and return to Council for
consideration by the October 4' meeting or sooner.
Ms. Stephanie Mills and Ms. Maria Zapata addressed Council thanking them with a situation S. Mills &M.
regarding the sale/or rather non sale of her home. Zapata comment
Mr. Greg Ahern of Azusa Aztecs Football Team addressed Council and thanked them for past G. Ahern
support. He stated that they now have a score board up and he invited all to the high school Comments
games at the school and at Citrus College. He also urged all to purchase an ASB card to receive
discounts at local restaurants.
Mr. Dan Simpson addressed Council requesting that a committee be formed to address the D. Simpson
problem with illegal fireworks; noting that it was a suggestion of Councilmember Rocha. Comments
Councilmember Rocha responded stating that he is mainly against illegal fireworks.
Mr. Dennis Willut addressed Council regarding handicapped drive ways, advising that the Jack in D. Willut
the Box on Citrus and Alosta is lacking one. He stated that the drive way is too narrow and that Comments
it is a safety hazard. Mayor Madrid advised that staff would look into the issue. He also
'advised that the wall In back of the Senior Center is being used as a short cut to Dalton Street
and that he has to clean it up the area. City Manager Gutierrez responded stating that staff
would look into the issue and report back to Council.

Director of Recreation and Family services Jacobs introduced new employee, Nancy Hogan, Comments
Recreation Superintendent/Senior Services.
Recreation Superintendent/Senior Services Nancy Hogan provided and update on the Senior N. Hogan
Program, which included Senior Meal Program, bingo, movies, day trips, classes, water exercise Comments
classes, case management, and stated that the staff and volunteers are wonderful.
It was consensus of Councilmember that interviews for vacancies on City Boards and City Brd & Com
Commissions be scheduled for Wednesday, September 29, 2004, at 6:30 p.m. at the Azusa Interviews

Mayor Madrid offered a Resolution entitled:

Mayor Pro -Tem Stanford offered condolences to the Avila Family on the passing of Tom Avila. Stanford
He recognized Bryan Clay, winner of the Olympic Decathlon, and Curtis Napier for his services. Comments

Councilmember Chagnon announced that in addition to the service personnel honored during Chagnon
the Ceremonial portion of the agenda, Joey Cervantes of Azusa was also awarded a Blue Star in Comments
August and that he will also be leaving to Iraq this week. She advised that Tuesday, September
14'h is Azusa Day at the Fair and invited all to join the celebration to honor Azusa's Community
Hero, Jeffrey Cornejo.
Councilmember Rocha expressed congratulations to Jeffrey Cornejo; he asked to adjourn the Rocha
meeting in memory of Jose Martinez and Tom Avila, who recently passed away. He read the Comments
letter into the record from the Lee Family who expressed thanks to all who donated funds for
the purchase of her son's doc band.
Mayor Madrid expressed condolences to Jenny, Suzanne and Tommy Avila on the loss of Tom Mayor Madrid
Avila, husband and father. She announced that the Kids Kar -A -Van at Slauson will be ending on Comments
September 14' and will be referring people to the Azusa Health Center. She then stated that
the AQMD has 7.4 million to fund alternative fuel for vehicles; she passed the letter to staff.
She asked if the Chamber will be funding the Miss Azusa Pageant and City Manager Gutierrez
advised that it is within the contract.
City Manager Gutierrez requested that Consent Calendar Item L, regarding Implementation of Item VI -L

Ms. Laura Jimenez addressed Council on behalf of the Peregrinos de Emau, expressing gratitude L. Jimenez
for the redirection of the funds, noting that they do appreciate the City recognizes the Comments
contributions that the shelter gives to the health and well-being gives to the community. She
and a gentleman from the program described the program and answered questions posed by
'Councilmembers.
Demolition Permit for the Perimeter Metal Fence and Fence Posts at the Former Azusa Demo permit
Drive -In Theater, located at 675 E. Foothill Boulevard Mayor Pro -Tem Stanford abstained Azusa drive in
from the above noted item due to a conflict of interest. Fences
Assistant City Manager Person addressed the Issue stating that the request was submitted by R. Person
Azusa Pacific University for the demolition permit and staff is recommending approval. He Comments
stated that the Cultural and Historical Preservation Commission has reviewed the permit and
recommended approval with the conditions included. He detailed history of the item and
conditions which included panels be photographed in placed, individually, and as they are being
stored, as well as other conditions. He responded to questions posed by Councilmembers,
stating that APU would be responsible for storing the panels and that they would be stored on
site. Councilmember Rocha requested that fencing be placed on top of the storage fence so
that they would have additional protection.
The following persons addressed the issue and recommended approval of the demolition Testimony
permit: Mark Dickerson of Azusa Pacific University, Mercedes Cortez, Patrick Perry, Dennis By Public
Willut, Jeffrey Cornejo of the Azusa Cultural and Historical Preservation Commission, and Mark & applicant
Ades; all persons cited safety hazards due to sheet metal flying off during high winds.
Mayor Madrid read the letter into record from the Los Angeles Conservancy, Ken Bernstein, Ltr in Opposition
Director of Preservation I, in opposition to the demolition permit. LA Conservancy
' City Attorney Carvalho addressed the Issues correcting statements made in the letter submitted City Atty
by the LA Conservancy, and stating that she has looked at the certified Engineers Report and Comments
City staff report and advised that she believes they have not met the legal threshold and the
Item can be approved.
After comments, It was moved by Councilmember Chagnon, seconded by Councllmember Demolition
Hardison and carried to approve the demolition permit of the perimeter metal fence and fence Permit
posts at the former Azusa Drive -In theater with conditions. Further that the top fencing be Approved
added as one of the conditions. Mayor Madrid dissenting and Mayor Pro -Tem Stanford
abstaining.

Mayor Pro -Tem Stanford returned to the dias and expressed his opinion regarding the issue. Stanford rtn
Director of Recreation and Family Services Jacobs and Parks and Recreation Commissioner Joe Dir Rec & Fam
Torres presented a report on the implementation of a Community Tree Planting Program. City Svs and Park
Manager Gutierrez spoke about options and criteria for the program and discussion was held & Rec Comm
regarding Memorial Grove. City Clerk Mendoza asked if trees previously planted by the Azusa J. Torres
Chamber of Commerce would still be honored and the response was yes they would be
honored without further fees. Additional discussion was held regarding trees versus plaques.
Moved by Councilmember Chagnon, seconded by Counciimember Hardison and unanimously Com Tree
carried to accept the Parks and Recreation Commission recommended program for the Planting
implementation of a community tree -planting program. Program
The CONSENT CALENDAR consisting of Items VI -A through VI -M was approved by motion of Consent Cal
Mayor Pro -Tem Stanford, seconded by Councilmember Hardison and unanimously carried, with VI -D & VI -H
the exception of items VI -D and VI -H, which were considered under the Special Call portion of Spec Call
the Agenda.

Mayor Madrid addressed Item regarding the Bike Path Project questioning whether the water CIP Budget
feature at Pioneer Park was going to be eliminated as stated in the staff report. Assistant City Amendment
Manager Person responded stating that the water is going to be re-routed down stream. Bike Path
Moved by Councilmember Rocha, seconded by Mayor Madrid and unanimously carried to Project
approve the budget amendment for the Bike Path Project and authorize the transfer of $55,000
from an obsolete project at Pioneer Park to the Bike Path Project and revise the contract
purchase order with TMT Development dba TK Engineering from $377,000 to $432,000.
Councilmember Rocha addressed Item regarding specifications for Cltywide Concrete Citywide
Improvements, and reminded Director of Public Works Nakasone about extending the sidewalk Concrete
on Azusa Avenue below 12"', due to a safety issue; Mr. Nakasone responded that it is in the Improvements
specifications. It was then moved by Councilmember Rocha, seconded by Mayor Madrid and
unanimously carried to approve specifications for the Citywide Concrete Improvements project
and authorize the City Clerk to advertise for bids.
