The City Council of the City of Azusa met in regular session at the above date and time In the Azusa Auditorium. CEREMONIAL Ceremonial The entire Council presented a proclamation to the representatives of the National Guard Proc to Nat'l Armory of Azusa, Battery A, First Battalion. Guard Armory CLOSED SESSION The City Council recessed to Closed Session at 6:30 p.m. to discuss the following: REAL PROPERTY NEGOTIATIONS (Gov. Code Sec 54956 81 Address: 303 East Foothill Blvd., Azusa, CA 91702 Agency Negotiators: City Manager Gutierrez and Assistant City Manager Person ' Under Negotiation: Price and Terms of Payment The City Council reconvened at 7:30 p.m. City Attorney Carvalho advised that there was no reportable action taken in Closed Session. Mayor Madrid called the meeting to order and led in the Salute to the Flag. INVOCATION was given by Ven. Narong Kunesako of the Damakaya Meditation Center. Foothill Azusa Recess/Rec City Attny No Rpts Call to Order Invocation Roll Call Also Present Pub Part Ms. Ginny Dadaian, Director of Community Relation of Azusa Pacific University addressed G. Dadaian Council inviting all to Family, Fun and Football in the City of Azusa on Friday, November 12, Comments 2004. She stated that APU Football and the Mighty Mights will be playing and also Gladstone Band and the location which is the APU East Campus on Citrus and Alosta. Mr. Chris Gibbs, President of Azusa Land Partners, new owner of Monrovia Nursery Property C. Gibbs addressed Council expressing congratulations to the City of Azusa on the plan that the City as Comments created for Monrovia Nursery and that they are looking forward to working with Azusa staff. He provided an update on the project stating that they will be submitting infrastructure plans to the City, will begin grading in May or June, will be hiring an advertising agent, and creating a vision statement and a newsletter will be coming soon. He then answered questions posed by Mayor Madrid and he introduced Mr. Holman of ALP. Ms. Peggy Martinez of Downtown Business Association addressed Council providing an update on events in the downtown area. She stated that there was a Halloween Parade held this past weekend and thanked all who donated towards the event. She stated that there will be a Grand Opening of the Portal Zacatecano Restaurant on Wednesday, November 10th, at 5 p.m. and is located at 627 N. Azusa Avenue. The Mariachi Festival will be held on February 19", 2005 at the Citrus College Performing Arts Center and finally that she is glad to see business signs at Sav-on Furniture and that two grand openings are coming up. Rev. Rick MacDonald on behalf of Human Relations Commission addressed Council requesting Information regarding the Human Relations Commission Coordinator position, stating that he would like to have a meeting with City Manager Julie Gutierrez, the HRC and two Councilmembers to provide input on what a replacement would be desired. He advised that 'Hands Across Azusa is not being held next year and also requested all to support Measure A the '/z cent tax Increase. P. Martinez Comments R. MacDonald Comments City Manager Gutierrez responded to the issue stating that there will be a flyer going out by the Clty Mgr end of this year advertising the position; she has been working with Ms. Parker on the job Response description and the position will probably be filled sometime in January and that It will be a Civil Service position. Councilmember Chagnon requested that a discussion be held regarding the HRC Coordinator position and the pros and cons of the contract versus Civil Service Position heading the commission. Mayor Madrid asked that the question be placed in a workshop setting. REPORTS. UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF Councilmember Rocha announced the annual Food Drive for the Azusa Food Bank and thanked all who participated by donating or driving to pick up and delivery the food. He stated that boxes will be placed at every elementary, middle and high school in the City as well as the City Library, Light And Water Department and City Hall. He stated that pick up dates are as follows: November 19', December 3', 10`h, and 17'. He announced that on November 6'h he and his crew will be working at Atlantis Gardens, and on November 13`h he will be working with the APU Environmental Program they will be cleaning the park on the way to the Canyon and on November 1 1 `h at 1 1 a.m., is the Veteran's Day Observation, at the City Hall Flag pole honoring 14 Azusans, and Congresswoman Solis be will there presenting three medals to three Azusans. He requested that the meeting be adjourned in memory of Jesse Ramos. He also announced that there will be a tree planting in memory of Mr. Paul Mendoza on Saturday, November 6'h, at 11:00 a.m. at the Sister City House behind City Hall. Councilmember Hardison urged all to vote In the November 2"' election. Mayor Pro -Tem Stanford also encouraged all to vote in the election. Rpts/Updates Rocha Comments Hardison Stanford Mayor Madrid welcomed all the people who are in attendance at the meeting in support and Madrid opposition to the Gun Club. City Manager Gutierrez stated that the Metro Gold Line Foothill Extension Construction Authority City Mgr has requested that City Managers put together a review committee that would assist on station Comments design and public art work for the Gold Line Stations of which Azusa will be having two stations. She advised that she is recommending a review committee consisting of one member of the Planning Commission, one member of the Architectural Barriers Commission, one member of the Cultural and Historical Commission, and a community member at large with a background in art. Economic and Community Development Director Sharon Hightower addressed Council and S. Hightower provided an update on the following Redevelopment Projects: Reyes Building, Talley Building, Update on the Breezeway, Azusa Commons — Mixed Use Rebuilt Center, Block 36 — Town Center, Dalton Redevelopment Street Acquisitions, 100 West Foothill Blvd, and Tax Allocation Bonds. She then answered Projects questions posed by council. SCHEDULED ITEMS Sched Items PUBLIC HEARING —a request to amend various sections of the Azusa Municipal Code to ensure Pub Hrg conformance between the City's recently adopted General Plan and the City's Development Dev Code Code. Zone Change Number Z-2004-01. The Mayor declared the Hearing open. The City Clerk read the affidavit of proof of publication Hrg open of notice of said hearing published in the Azusa Herald on October 21, 2004. 11/01/04 PAGE TWO Assistant Community Development Director Onaga addressed the Public Hearing providing background of the Development. Code, noting its connection to the recently adopted General Plan, which has a strong emphasis of community design. Mr. Onaga provided details of the following: The proposed Development Code is a departure from a standard zoning code in that it focuses on the neighborhood, districts, and corridors concepts as established In the recently adopted General Plan. The proposed Development Code proposes standards and design guidelines that will encourage the creation of pedestrian friendly neighborhoods and vibrant districts. It also contains standards that will assist with the conversion of the strip corridors into connectors lined with mixed use and residential development. The proposed Code standards encourage the preservation of the foothills, canyons, and rivers. Development Code Project Manager Lisa Brownfield addressed the Hearing providing an overview of what the Development Code entails. She detailed the Zoning Code Content, Development Code Content, Azusa Development Code, and the differences from the current code. Ms. Brownfield presented a document entitled "Development Code Planning Commission Summary Statement" which consists of Items of Planning Commission particular concern/discussion as follows: Gun Club Planning Commission decided (4-1) to recommend that the outdoor shooting range be a permitted use in the Open Space land use category. i'encingMateriais- that new fences be made of block, replacement fences can be constructed of masonry, wood, and/or other durable and low maintenance materials as approved by the Economic and Community Development Director, chain link or wire mesh fences where visible from a public right-of-way on a site with new and /or replacement construction, or on the perimeter of a residential site are prohibited; and barbed/razor wire are prohibited. Lot Size - Neighborhood Compatibility- they voiced concerns that minimum lot sizes in the low density category might encourage larger parcels in some neighborhoods to be subdivided and therefore, changing the character of the neighborhoods. The proposed Development Code was revised to accommodate the Commission's concern. Arrow Highway- Pedestrian Orientation- The draft Development code proposed that stronger and higher development standards for the Arrow Highway corridor be implemented, it does not propose that the corridor's design and use standards mandate pedestrian orientation. Minimum Unit Size - the Planning Commission included a minimum unit size for all housing types. Second Units- Included wording to ensure that where there is a second unit on a site, one of the units must be owner occupied. She advised all that a Development Code workshop Is scheduled for Monday, November 8, 2004, at 6:30 p.m., at the Light and Water Department Conference Room. Mr. Onaga clarified and described a question of second units and answered questions posed. Assist Dev Dir Comments Project Mgr Comments Ms. Sandra Rentschler addressed the Public Hearing expressing her opinion against the Gun Club S. Rentschler stating that the gunfire echoes in the canyon where she lives, that there are investigations going Comments on regarding the gun club and that it causes lead contamination. She also noted that there is potential for forest fires from stray bullets. Mr. Robert Wayne Steel Sr., addressed the Public Hearing in favor of the Gun Club advising that R. Steel he has enjoyed the facility for most of his life and that the Gun Club was there before the Comments homeowners in the area. Mr. William Colts addressed the Public Hearing expressing his opinion regarding the Gun Club W. Colts and its impact to the operation of the City. He also expressed his opinion against the billboard Comments up at the entrance to Azusa Canyon. Ms. Brownfield and the City Attorney responded to his comments. Mr. Rick Trotter, President of the San Gabriel Valley Gun Club addressed the Public Hearing in R. Trotter favor of the Gun Club as the Planning Commission recommended. He advised of the mitigation Comments measures he has taken -Le. planting trees, number of members, other things, are working on sound mitigations. He then responded to questions posed by Councilmember Hardison. Mr. James Dorty, Jr., Chairman of the Gun Club addressed the Public Hearing stating that some J. Dorty Olympic Champions had come out of programs at the Gun Club and advised that there are Comments other programs such as beginning shooters and ladies day; he detailed. Moved by Mayor Pro -Tem Stanford, seconded by Councilmember Hardison and unanimously Public Hearing carried that the Public Hearing be continued to the City Council meeting of Monday, November Continued to 15, 2004; further that a workshop on the Issue will be held on November 8, 2004, at the Azusa November 15, Light and Water Conference Room at 6:30 p.m. 2004 meeting The CONSENT CALENDAR consisting of Items VI -A through VI -IC was approved by motion of Consent Cal Councilmember Hardison, seconded by Councilmember Chagnon and unanimously carried with Approved the exception of item VI -J, which was considered under the Special Call portion of the Agenda. VI -J Spec Call Assistant City Manager Robert Person addressed item VI -E, regarding the budget transfer for Pioneer Park, with a note of correction that funds that are being transferred are not CDBG. 11/01/04 PAGE THREE A. The Minutes of the regular meeting of October 18, 2004, were approved as written. Min approved B. Human Resources Action Items were approved as follows: Human Res. Merit increase and/or regular appointment: T. Divens, F. Chavez, R. Montague, and F. Action Items Cawte. Separation: D. Parker, HRC Staff Coordinator, effective 10/28/04. C. The bid award for Citywide Concrete Improvements was awarded to Martinez Concrete, Inc. Martinez Con. in the amount of $$432,133. Ctywde Cncrt D. The Police Department's Hybrid end of shift review was received and filed. PD Hybrid Rpt E. The Amendment of the 2005-09 Capital Improvement Project (CIP) Budget and Transfer of Bdgt Trnfr ' Funds in the amount of $28,332.00 from Siauson Park (42003E) to Pioneer Park (42003D) Pioneer Pk for the purpose of completing and enhancing the Pioneer Park Restroom Project and Restroom augmenting funding for future amenities at Pioneer Park was approved. Project F. Specifications for 2005 CIP Project #42003C, Northside Park Improvements/Basketball and Specs Northside Volleyball Court were approved and the City Clerk's Office was authorized to advertise for Park Imprvmts bids. G. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA CALLING Res. 04-C84 AND GIVING NOTICE OF THE OLDING OF A GENERAL MUNICIPAL ELECTION TO BE HELD Calling for ON TUESDAY, MARCH 8, 2005, FOR THE ELECTION OF CERTAIN OFFICERS AS REQUIRED 3/8/05 BY THE PROVISIONS OF THE LAWS OF THE STATE OF CALIFORNIA RELATING TO GENERAL Election LAW CITIES. H. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, REQUESTING Res. 04-C85 THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES TO RENDER SPECIFIED Requesting SERVICES TO THE CITY RELATING TO THE CONDUCT OF A GENERAL MUNICIPAL Co. Svs ELECTION TO BE HELD ON TUESDAY, MARCH 8, 2005. 3/8/05 Elect. ii K. The extension of terms of Professional Services Agreement with Cotton Bridges Associates Extension was approved to include extension to June 30, 2006, added project, "Azusa Commons Prof Svs Agmt Environmental Documentation", updating the fee schedule, deleting the not -to -exceed CBA amount, and the Mayor was authorized to execute the amended agreement. SPECIAL CALL ITEM. The following Resolution was adopted and entitled: Spec Call A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN Res. 04-C86 CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO Warrants BE PAID. SPECIAL CALL ITEMS Spec Call Items Councilmember Hardison addressed item regarding the construction of a Mobile Telephone Cell Hardison Site at the City Yard expressing his concern regarding the antenna mounted on a "monopole, Comments Instead of a "mono palm or mono pine". Assistant City Manager Person responded stating that the two issues considered were Asst City Mgr appearance and location and Planning Commission considered both. He stated that one Response additional pole would not blight the area, and if a mono palm or mono pine were used it would be obvious that the trees are fake, but, he referred the question to Mr. Randy Rainer of Nextel. Discussion was held between Councilmembers, staff and Mr. Rainer regarding the issue and how 'It fits in the new development code. Moved by Councilmember Hardison, seconded by Councilmember Rocha and unanimously carried to approve the lease with Nextel Communication for the construction of a Mobile Telephone Cell Site at the City Yard, but, to amend the lease agreement to have the pole resemble a palm tree, and recognize revenue to the General Fund in the amount of $9,000 from lease revenue to the General Fund.
