HomeMy WebLinkAboutMinutes - December 20, 2004 - CCCITY OF AZUSA ' MINUTES OF THE CITY COUNCIL REGULAR MEETING MONDAY, DECEMBER 20, 2004 - 6:30 P.M. The City Council of the City of Azusa met in regular session at the above date and time in the Azusa Auditorium. CLOSED SESSION Closed Session City Attorney Carvalho advised that the City has received a letter regarding the San Gabriel Valley CityAttorney Gun Club and since the City has officially closed the public comment portion of the Public Comments Hearing there is a need to discuss the matter in Closed Session. Moved by Councilmember Hardison, seconded by Councilmember Chagnon and unanimously Item of subse- carried to add an Item of subsequent to the Closed Session portion of the agenda entitled quent need Anticipated Litigation, Government Code Section 54956.9 (b). The City Council recessed to Closed Session at 6:35 p.m. to discuss the following: Recess PUBLIC EMPLOYEE APPOINTMENT (Gov. Code Sec. 549571 Pub Emp Appt 'Title: Finance Director Fin Director CONFERENCE WITH LEGAL COUNSEL— POTENTIAL LITIGATION Gov. Code Sec. 54956.9 (b). Conf w/ Legal San Gabriel Valley Gun Club. Counsel The City Council reconvened at 7:30 p.m. Reconvened City Attorney Carvalho advised that there was no reportable action taken in Closed Session, but CityAttny stated that there will be an announcement made later on in the meeting regarding the Comments threatened litigation. Mayor Madrid called the meeting to order and led In the Salute to the Flag. INVOCATION was given by Reverend Kristina Collins of the San Gabriel Valley Church ROLL CALL PRESENT: COUNCILMEMBERS: HARDISON, STANFORD, ROCHA, CHAGNON, MADRID ABSENT: COUNCILMEMBERS: NONE ALSO PRESENT: City Attorney Carvalho, City Attorney Martinez, Assistant City Manager Person, Chief of Police Davis, Assistant Community Development Director Onaga, Development Code Project Manager Lisa Brownfield, PIO Quiroz, Economic and Community Development Director Hightower, Assistant Director of Resource Management Tang, Paul Reid, City Librarian Tovar, City Treasurer Macias, City Clerk Mendoza, Deputy City Clerk Toscano. Mayor Madrid requested that item regarding the San Gabriel Valley Gun Club, Development Code, be brought forward for handling at this time due to the many people in attendance who wish to address it. City Attorney Carvalho announced that the City received a letter today entitled San Gabriel Valley Gun Club and Proposed New Zoning Ordinance/Pre-Litigatlon Demand of which they discussed In Closed Session and reminded all that the Public Hearing for the Development Code which includes the issue of the Gun Club had been closed and that all comments regarding the issue would not be considered as public record but would be considered under public comment/pubiic participation. Call to Order Invocation Roll Call Also Present Mayor & City Attorney Comments PUBLIC PARTICIPATION Pub Part The following person addressed Council in favor of the operation of the Gun Club: Xavier Public Hermosillo, Steve Bumstead, Don Bowlean, Jerry Martinez, John Hutchinson, and James Yang. Comments The following persons addressed Council against the operation of the Gun Club: Maricela Cueva, William Coats, Horacio Godoy, Sandra Rentchler, Patrick Mellon and Chuck Limer. Mr. Steve Cortner of Vulcan Materials, owner of property where Gun Club is located, advised S. Cortner that he is willing to work with City of Azusa and the Gun Club for a resolution to the problems. Vulcan Mat. CONTINUED PUBLIC HEARING —a request to amend various sections of the Azusa Municipal Pub Hrg Dev Code to ensure conformance between the City's recently adopted General Plan and the City's Code Development Code. Zone Change Number Z-2004-01. After additional discussion was held it was moved by Mayor Pro -Tem Stanford, seconded by Continued Councilmember Rocha and unanimously carried to continue the Public Hearing to the City 1/18/05 Council Meeting of Tuesday, January 18, 2005. Ms. Evelyn Kahn, Executive Director of the Azusa Chamber of Commerce addressed Council and E. Kahn Introduced one of the contestants of the Miss Azusa Pageant, Melinda Monte; she advised that C of C there are thirteen contestants in all. She provided an update on the Chamber events as follows: Update Miss Azusa Pageant, March 2005, Membership Survey, Toy Drive, sale of Chopper tickets fundraiser, Azusa Unified School District Job Shadow Program, Wednesday February 15', she encouraged all to participate, Two Candidates Forums for the upcoming election and a Fashion Show Luncheon in April at the Woman's Club. Mr. John Moore of Smart City Grinds addressed Council thanking all who attended their J. Moore fundraiser for Soldiers in Iraq and also received gifts for Toys For Tots; he advised that Anna Comments Nichol Smith was the celebrity on hand. Mr. Art Ramirez, Azusa Golden Days Chairman addressed Council and displayed new Golden A. Ramirez Days fundraising Coverlets for sale for $50 at Vanities Beauty Salon and Park and Recreation Comments Department; he invited all to attend the January 2G'" Golden Days Meeting. Mr. Michael Tyner addressed Council expressing concern regarding speeding cars and stop sign M. Tyner runners at Pasadena and 10' Street; he noted the need for more money for the Police Comments 'Department complaining about money used for the Pioneer Park Restroom project. Mrs. Marie Kukula Tyner addressed Council expressing her opinion, suggesting which kinds of M. Tyner new businesses should come to Azusa and how the Council run the meetings. Comments Mr. Jim Dodenhoff of Greenman Technologies addressed Council expressing his concern J. Dodenhoff regarding the new requirement of the proposed Development Code which requires operation of Comment a recycling processing use to operate in a "fully enclosed building". He stated that his operation is in an area where it can't be done; he submitted a letter to staff noting his objections. Ms. Rosario Lucas of EI Camino Auto, auto repair, addressed Council stating that their property R. Lucas will become nonconforming if the new Development Code is adopted as is; she asked if there Comments were options for extensions and was referred to staff. REPORTS, UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF Rpts/Updates Councilmember Chagnon wished everyone a Happy Holiday Season and asked all families in Chagnon Azusa to keep in thoughts and prayers military personnel who are serving our country. Comments Councilmember Rocha thanked all who volunteered for the Food Drive and he noted the Rocha problem of graffiti on the 210 Freeway. Staff was directed to contact Cal -Trans regarding the Comments issue of Graffiti on the 210 Freeway and/or other local legislators. Mr. Rocha advised that he received thanks from Mr. Chaverine, an Azusa in Iraq, for the candy and other sweets that were sent to the soldiers. He advised that there is a need for handi-wipes for the troops; he requested that Azusans donate what they can and he will send them off. He asked that the meeting be adjourned in memory of Bill Michelli, retired City of Azusa employee, WWII Veteran and devoted husband. He wished all a Merry Christmas with joy and tranquility throughout the year. Mayor Pro -Tem Stanford expressed concern regarding traffic issues In front of a mobile home Stanford park on Citrus, west of Foothill and the wash on Citrus where parking issues exist and block the Comments pedestrian crossing; he asked staff to look into the matter and wished all a Merry Christmas. 12/20/04 PAGE TWO Councilmember Hardison wished all a Merry Christmas. Assistant City Manager Person provided an update on the Atlantis Garden Neighborhood Revitalization Project stating that all the curbs, streets and gutters have been raised to 100% level, that two tree planting projects have been held in that area and they are surveying the remaining public landscaping to see what can be done. He asked If the City would like to provide financial assistance to public property owners, possibly with CDBG funds. Mayor Madrid asked that the concept be checked out through the League. SCHEDULED ITEMS Mayor Madrid Inquired whether campaign donations were disclosed in the Conflict of Interest filings. City Attorney Carvalho responded stating that at this time it does not, but, that there are disclosure supplement codes that can be included In the Code, if the Council so desires. Mayor Madrid suggested that a supplement be added which discloses the receiving of campaign contributions. City Attorney Carvalho advised that she could return with a sample of options that can be considered as supplements to the Conflict of Interest Codes. Councilmember Rocha offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, APPROVING AND ADOPTING AN AMENDED APPENDIX TO THE CONFLICT OF INTEREST CODE PURSUANT TO THE POLITICAL REFORM ACT OF 1974. Moved by Councilmember Rocha, seconded by Councilmember Chagnon to waive further reading and adopt. Resolution passed and adopted by the following vote of the Council: AYES: COUNCILMEMBERS: HARDISON, STANFORD, ROCHA, CHAGNON, MADRID NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: NONE Hardison Update on Atlantis Gardens Sched Items Mayor Comments Re: Supplement Codes Res. 04-C97 Adopting Amended Appendix to the Conflict of Interest Code Moved by Councilmember Hardison, seconded by Councilmember Stanford and unanimously Deposit Agmt carried to approve the Landowner Deposit Agreement with Azusa Land Partners; approve an w/Azusa Land addendum to the existing legal services agreement with Best, Best & Krieger for Bond Counsel Partners, CFD and Disclosure Counsel; and approve the selection of Financial Advisor and authorize the City Bond Counsel Manager to negotiate and execute a professional services agreement. Mon Nurs 'Moved by Councilmember Chagnon, seconded by Councilmember Hardison and unanimously Removal carried to accept the Parks and Recreation Commission recommended program for the removal Ficus Trees and subsequent short-term and long-term maintenance plan for (22) ficus trees. Moved by Councilmember Chagnon, seconded by Councilmember Hardison and unanimously Community carried to accept the Parks and Recreation Commission recommendation for amending the Tree Planting previously approved Implementation of a community tree planting program. Program The CONSENT CALENDAR consisting of Items V-A through V -J was approved by motion of Consent Cal Councilmember Rocha, seconded by Councilmember Hardison and unanimously carried with the Approved exception of items V -G, V -H, and V -J, which were considered under the Special Call portion of the Agenda. Accept the Grant Agreement from the State of California Office of Traffic Safety (OTS), Grant Agmt amending the FY205 budget in the amount of $17,728. The City of Azusa has been OTS awarded up to $26,592 for a thirteen month period covering personnel costs to conduct 6 sobriety checkpoints within the City of Azusa from December 1, 2004 through January 10, 2006. 12/20/04 PAGE THREE E. To approve the purchase of three (3) Gator TS Traditional Series Utility Vehicles, at a total of Pur 3 Gator $17,163.18, to be used at Memorial Park, Northside Park and Gladstone Park respectively Traditional from Coast Line equipment, utilizing an existing CMAS contract. Series Util Veh F. To approve the Professional Services Agreement for Director of Finance Recruitment Prof Svs Agmt Services with Peckham B.Mcl(enney in an amount not to exceed $25,000 as amended. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING THE CITY'S Res. 04-C98 CLASSIFICATION PLAN AND ESTABLISHING COMPENSATION FOR THE CLASSIFICATION Establishing OF SENIOR INFORMATION TECHNOLOGY ANALYST. Class Sr. Info Tech Analyst J. SPECIAL CALL ITEM. Spec Call SPECIAL CALL ITEMS Spec Call Items Counc]Imember Chagnon addressed item regarding replacement of Azusa Light & Water Utility Chagnon Poles advising that she has investigated the cost comparison and time issue regarding the item Comments and found that It will be cheaper to do the project in-house. Assistant Director of Resource Management Tang responded stating that Mrs. Chagnon is B. Tang correct, but that the reason for the outside contractor was in order to comply with Government Response Order 165 which mandates inspection cycles for electric distribution equipment and he detailed the need to catch up on repairs of transformers and replacement of poles. After discussion was held between Councilmember Chagnon and Mr. Tang, it was moved by Item referred Councilmember Rocha, seconded by Councilmember Hardison and unanimously carried that Back to Staff Item be referred back to staff In order to look at options regarding cost comparisons without Impact to the time schedule regarding replacement of Azusa Light 8. Water Utility poles. The Item was postponed to the first meeting in. January, 2005. Councilmember Hardison addressed item regarding the Pioneer Park Restroom Project NOC, Notice of Comp 'stating that Light and Water has assured him that there will be no problems when the Monrovia Pioneer Park Nursery Project is being done that affect the park and also commented on the long time Restroom planning of the project. Councilmember Rocha also addressed the item questioning how many Project drinking fountains will be installed and where throughout the park. Assistant City Manager Person responded stating that he would let him know as soon as he is able. Moved by Councilmember Rocha, seconded by Councilmember Hardison and unanimously Approved carried to authorize the filing of the Notice of Completion on the Pioneer Park Restroom Project Notice of (CIP #42003D) as completed by Jergensen Construction in the amount of $290,224.41, and to Completion authorize staff to file the Notice of completion with the Los Angeles County Clerk and pay the 10% retention to the contractor. Councilmember Rocha questioned item on the warrant register regarding the Burro Canyon Rocha Range Rental and asked if the Azusa Police Department was utilizing it; staff responded yes. The Questions point he was making was that it is open for rental and Mayor Madrid advised the audience that Burro Cnyn the Burro Range is open for business. Councilmember Rocha offered a Resolution was adopted and entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS Res. 04-C99 AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID.
