The City Council of the City of Azusa met in regular session at the above date and time in the
Azusa Auditorium.

Reverend Gilbert Becerrill delivered the Benediction over the appointment of new Chief of Benediction

It was consensus of Council to recess to a reception in order to celebrate the above noted Recess/

Public Part
Mr. Jorge Rosales congratulated all newly sworn Officers on their promotions as well as City J. Rosales
staff for their accomplishments over the last year. He addressed item B-3, information Comments
'report re: Rosedale expressing his concern regarding possible violations of the Brown Act.
Mr. Mike Lee congratulated all Police Officers who were promoted, thanked Mayor Pro -Tem M. Lee
Rocha for organizing the great July 4th celebration and noted other exciting events happening Comments
in the City.
Mr. Dan Simpson publicly thanked the City Council for combating illegal fireworks with D. Simpson
increased public information and help from law enforcement and offered suggestions for Comments
improvement.
Ms. Luisa Miranda announced the upcoming Azusa Heritage Project, The Azusa Heritage L. Miranda
Project which will be a video and oral history program of people who lived in Azusa in the Comments
early 1900's through the 1950's that helped define and build Azusa through their
accomplishments in the fields of business, community service, sports or artistic pursuits.
Mr. Art Morales addressed Council expressing his concern regarding graffiti on the water A. Morales
tank on Sierra Madre and asked that it be removed. He praised the Police Officers that were Comments
promoted Sergeant Badoni, Sergeant Arnold, Lieutenant Hunt, Captain Street, and Chief
Garcia.
Ms. Jule Arevalo, representing Sierra Palms Homeowners Association addressed Council J. Arevalo
presenting photos of the palm trees on the Rosedale property, stating that they are dying, Comments
'overgrown, rodent invested, and not being watered. She stated that there are paint cans,
debris and garbage around the area. She was asked to give her name and phone number to
the City Manager and Economic Development Director.
Ms. Ginny Dadaian Director of Community Relations of Azusa Pacific University and Lorena L. Marquez
Marquez of Azusa Pacific University, addressed Council and audience stated that they have B.G. Dadaian
Soccer Clinic's on behalf of APU on Saturdays from 10-12 and now they have developed the Comments
Viva Azusa Soccer Camp which will be held from Monday, July 31" through Thursday August
3rtl at Azusa Square and the cost is free and they are seeking sponsors for the Camp.

City Manager Delach announced the Citizens Committee to advise on Recreation Vehicle Citizen's
Parking and structures in the Front Yard Set -Back, members as follows: Frances Melanson, Committee
James Sanford Jr., Art Morales, Don Boline, Peggy Martinez, Jorge Rosales, Bart Luce, Mike
Trelles, and Roman Seano.

Update on Various Rosedale Issues. City Manager Delach emphasized that the Rosedale Update on
Park Plan will be taken back to the Parks and Recreation Commission for further Rosedale issues
consideration at a duly agendized meeting. Discussion was held regarding the effects of the
lack of restrooms in some parks in the Rosedale Project. City Attorney Carvalho advised that
since the Specific Plan did not call for restroom facilities in some of the smaller parks and it
is not in the Development Agreement the City would initiate the change to the Specific Plan
and find the funding. City Manager noted comments.
City Manager Delach and Assistant City Manager Person reported information regarding the LA Co. Tax
FY 2006 Assessed Valuation Annual Report from Los Angeles County Tax Assessor's Office. Assessor's Rpt
Mr. Delach stated that Azusa was ranked 3rd in Los Angeles County for change or growth in
'assessed valuation. City Manager Delach stated that the growth has been 17% over the last
year and the report does not even include the Talley Building, Block 36, Foothill Shopping
Center, FSC Housing Development, Rosedale, the South Azusa Town Homes, the Downtown
North Development Project or the Foothill Boulevard Town Homes.
Assistant City Manager Person highlighted the Forest Gateway Interpretive Center project R. Person
and the agenda item to approve a contract with Klassic Engineering Construction Inc.; he Update
detailed the funding sources and provided additional detail on the projects history. He Forest Gateway
talked about the repayment plan, groundbreaking and dedication.
Mayor Pro -Tem Rocha started the following: thanked volunteers of 4`" of July celebration, J. Rocha
asked that bus stops at Foothill and San Gabriel be sanitized, invited all to attend Korean War comments
Armistice Day on Thursday, July 27`"; at City Hall Flag pole, to clean up day at Lee School on
August 5d' , advised of the last ride on the Sierra Madre dip, asked item be added to the
August 12" workshop regarding increased traffic on Foothill Boulevard and First Street and
the feasibility of setting up a Traffic Safety Committee. He asked about retailer's convention
dates, and status of Red Team. It was consensus of Council to give the following issues to
City Manager to see If they will be considered for the Workshop on August 12`": traffic
issues, policy on restrooms in the parks — Rosedale, how to work with major developers, i.e.
Red Team concept. Mayor Pro -Tem Rocha expressed congratulation to Chief of Police
Garcia.
Councilmember Hardison addressed the Rosedale Palm Tree issue stating that prior to the Hardison
contract to ALP, the emphasis on Palm Drive was the palm trees; they are responsible for the Comments
sub -contractors or primary contractors In providing the maintenance for the trees and
thoroughfare. City Manager Delach advised that he would have staff come back with a
report regarding the issue at the August 7'" meeting.
Councilmember Carrillo thanked all who participated in the 4" of July, congratulated new Carrillo
Chief, Captain, Lieutenants, and Sergeants, expressed his delight regarding the Assessed Comments
Valuation, for support in San Gabriel Pomona Parents Place and their application for a grant
to establish a family empowerment center on disability. Direction was given to the City
Manager to provide the letter of support.
Mayor Chagnon announced the groundbreaking on Leton and Newburgh for the building of Chagnon
new town homes in that area, congratulated Mr. and Mrs. Mendez on their 501h wedding Comments
anniversary; invited all to Sister City Tree Planting at Zacatecas park on July 19"B"d advised of
Kids Come First Golf Tournament proceeds in the amount of $35,000 which will go to
Gladstone Park Improvements.

PUBLIC HEARING — CODE AMENDMENT 221: Ordinance Approving Miscellaneous Code Amend
Adjustments (Code Cleanup) to the 2005 Development Code; Ordinance Amending Division 221 2005 Dev
2, Noise of Article IX Of Chapter 46 of The Municipal Code; and Resolution regarding Code
'Penalties for Violations of the Development Code
The Mayor declared the Hearing open. City Clerk read the affidavit of proof of publication of Hrg open
notice of said hearing published in the Azusa Herald on July 6, 2006.
Assistant Community Development Director Onaga addressed the issue providing a L.Onaga
background of the 2005 Development Code adjustment stating that it was first addressed at Ass't Com Dev
the May 15`" Council meeting and was continued in order to discuss items related to Dir.
recreation vehicle parking and portable shelter structures as well as other items which are
now going to be addressed via a committee so they are being excluded from this public
hearing.

He noted that there will be a change to noise standards which will be addressed by a second
ordinance which will repeal the noise chapter to make it exactly as it Is in the Development
Code. He highlighted other changes, i.e. fence height limit, existing code has a 36" limit
and recommended change is 42", noise regulation — slightly change hours with regard to
construction, and a typo on page 14 of 28, Item #14, 88.24.050 Landscape Location
Requirements, (2) — insert "residential" between "a" and "structure".
Mr. Jorge Rosales provided comments in favor of used or converted room to function as a
bedroom and will be counted as a bedroom in all instances where a Development Code
standard is based on the number of bedrooms per unit; he stated item 9 would conflict with
6 foot retaining walls at Rosedale, in favor of 42 in height within a corner cut-off area, not in
favor of change for allowable hours of construction on Sunday and National Holidays from 7
a.m. — 6 p.m., and recommended 8 a.m. — 5p.m., Telecommunication Facilities, stating that
on Baseline and Rockvale the AUSD is placing a cell tower and there should not be set back
restrictions and 50 foot should be allowed with conditions, and he agrees with Design
Review process for filing of appeals.

Mr. Art Morales addressed the issue stating that wall at 5th and San Gabriel, visible steel by A. Morales

Moved by Councilmember Hardison, seconded by Councilmember Carrillo and unanimously* Hrg Closed
carried to close the Hearing.
Discussion was held among Councilmembers regarding the issue and it was consensus that Discussion
the 42 inches for wall height was okay with the exception of area at 5h and Alosta,
construction hours on Sundays and Nationals Holidays with a review authority through
conditions of approval, parking lot and driveway improvements, and driveway obstructions.

Councilmember Hardison offered an Ordinance, as amended, entitled:

Moved by Councilmember Hardison, seconded by Mayor Chagnon and carried*, as

7. The contract for construction of the Forest Gateway Interpretive Center was awarded to Forest Gateway
I(lassic Engineering Construction Inc. in the amount of $862,915.55 and approval was Klassic Engr
given to increase the total project budget by an additional $170,000 from the City's
Water Fund for a total Budget of $1,295,000
