The City Council of the City of Azusa met in regular session at the above date and time In the Azusa Auditorium. CLOSED SESSION Closed Sess The City Council recessed to Closed Session at 6:46 p.m. to discuss the following: CONFERENCE WITH LABOR NEGOTIATOR (Gov. Foothill Negotiating Parties: Mr. Wayne Fletcher and Mr. Jim Yenyo Blvd Agency Negotiators: City Manager Delach and Assistant City Manager Person Under Negotiation: Price and Terms of payment The City Council reconvened at 7:30 p.m. City Attorney Martinez advised that there was no Reconvened reportable action .taken in Closed Session and that Mayor Chagnon abstained from City Attorney participation in Real Property item regarding 303 East Foothill Boulevard, due to a conflict of Report Interest. Mayor Chagnon called the meeting to order and led in the Salute to the Flag. Call to Order INVOCATION — Pastor Samuel Martinez of Christian Faith Center of the Valley Invocation ROLL CALL Roll Call 'PRESENT: COUNCILMEMBERS: HARDISON, CARRILLO, HANKS, ROCHA, CHAGNON ABSENT: COUNCILMEMBERS: NONE ALSO PRESENT: Also Present City Attorney Martinez, City Manager Delach, Assistant City Manager Person, Captain S. Gonzalez, Economic Development Director Coleman, City Engineer Scott, Superintendent of Parks Chavez, City Treasurer Hamilton, Public Information Officer Quiroz, City Clerk Mendoza, Deputy City Clerk Toscano. 1 PUBLIC PARTICIPATION Public Part Mr. Mike Lee expressed his joy regarding the event held over the weekend for M. Lee Mayor Pro -Tem Rocha who will be in the race for Mayor. He reminded all to register to vote Comments for the upcoming November election as well as March 2007, asked to keep all war heroes In prayer, and announced that Veteran's Care Day will be held on Saturday, August 26`h at the Armory on Todd and Sierra Madre. Ms. Peggy Martinez of Downtown Business Association announced the grand opening of the P. Martinez UPS Store on Wednesday, August 23', and of Mr. C's Barber Shop on Saturday, August 26, Comments 2006 for 1:30 — 3:00 p.m. She introduced Miss Azusa Outstanding Teen, Rebecca Mejla who in turn noted that it's been an outstanding experience. The next pageant will be on March 17' 2007, at Citrus College. Ms. Rainbow Yeung of Air Quality Management District introduced herself and thanked R. Yeung Council for their leadership and support of all rules, legislations and programs. She noted AQMD that AQMD is responsible for leading the region into compliance with clean up standards, Comments she provided updates and current programs and events regarding clean air; for further Information go to their website: www.aamd.gov. Mr. Ralph Pifia addressed Council asking why there is no rent control within the City of Azusa R. Pina and why they cannot have rent control in the City. City Manager Delach was directed to Comments prepare a response to the question and will bring it back to the next city council meeting, September 51°, Tuesday. Ms. Nicole Shaheian of Congresswoman Solis' office Invited all to Veterans Care Day on N. Shaheian Saturday, August 26th at the National Guard Armory at Todd and Sierra Madre in the City of Comments Azusa. She stated there will be over 49 vendors, free services and free food for veterans. Mr. Jorge Rosales, Chair of the RV Committee, entitled: Azusa Citizens For Code Compliance J. Rosales addressed Council naming members as follows: Frances Melanson, James Sanford Jr., Art Comments Morales, Don Boline, Peggy Martinez, Jorge Rosales, Bart Luce, Mike Trelles, and Roman Seano. The committee will be addressing issues regarding temporary signs, recreation vehicles, parking and storage issues, selective parking issues, commercial vehicles parking issues, tents and canopies. There will be a meeting every Thursday, at 6:30 p.m. in the West Wing Conference Room; public is invited, recommendations on issues will be December 17". He stated that he was disappointed to hear there may not be sufficient funds for the 4th year street paving project in the south end of town. Mr. Joe Guarrera questioned street work being done on 10' street and Sunset in Azusa, J. Guarrera stating that it has blocked the residents in their home all day with no communication from Comments the City. City Manager Delach advised that he would look Into the matter. Ms. Barbara Dickerson addressed Council reminding all that school begins on August 30`h, B. Dickerson and to watch out for the kids coming and going to school. Comments Mr. Art Morales talked about the great time he had at concerts in the parks, the great hot A. Morales dogs by Jakes, and the celebration kick-off for Mr. Rocha for Mayor; stating he supports Joe Comments for Mayor. REPORTS, UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF Rpts/Updates City Manager Delach stated that the Capital Improvement Program will be presented to City Mgr Council at the September 5`h meeting and that although he had previously reported that Comments there may not be enough funding for the entire 4`h year Pavement Management Plan they are working towards finding funding for the entire project; they still lack $200,000. Discussion was held regarding the issue. Mayor Chagnon announced the filing deadline to apply for local City Board and Commissions Chagnon Is August 24th. Staff was directed to schedule a date among the Council for Interviews with Comments applicants. She announced that Concerts in the Park have been great; she thanked all vendors and announced there this week there would be City Hall on the Move beginning at 6 p.m. Councilmember Carrillo commented that this has been an exciting summer and year, the Carrillo Council has worked together as a team on a variety of successful projects, Concerts in the Comments Parks has been very successful and reminded all that there are cooling center available at the Senior Center and Library during extreme heat waves. 08/21/06 PAGE TWO Councilmember Hardison complimented Mr. Morales on his nice shirts and advised him that Hardison there are good hot dogs sold at Costco. Comments Councilmember Hanks requested that the meeting be adjourned in memory of Ethelyn Hanks Weisman. Comment Mayor Pro -Tem Rocha also requested that the meeting be adjourned in memory of Ethelyn Rocha Weisman as well as Leo Nasser. He invited all to attend the dinner/dance fund raiser for the Comments Azusa Veteran's Monument Committee to be held on Saturday, August 26 at the VFW. He wished all a school safe and productive year and reminded all to watch out for the kids. He noted that people are having trouble entering the parking lot to Starbucks and asked if the ' City Engineer could look into the matter. SCHEDULED ITEMS Sched Items PUBLIC HEARING — to consider the adoption of a resolution finding the city to be in Pub Hrg conformance with the Los Angeles County Congestion Management Program (CMP) and CMP adopting the CMP Local Development Report. The Mayor declared the Hearing open. City Clerk read the affidavit of proof of publication of Hrg open notice of said hearing published In the Azusa Herald on August 10, 2006. Associate Planner Cole addressed the issue stating that the Congestion Management S. Cole Program requires every city in LA County to determine If there are in compliance with the Comments plan annually, which Is done with the Local Development Report, presented. She stated that failure to comply with the Program could result In the loss of gas tax money. The Report documents the number of residential units built, construction for commercial and industrial purposes and demolitions. She stated that since August 2003 the cities have not been required to track the traffic mitigation measures, but are required to report the amount of new construction; she recommended adoption of the Report. Mr. Jorge Rosales addressed the Hearing stating that the Report doesn't address the reality J. Rosales of the issue of traffic and expressed concerns that with the recent temporary closure of Comments Sierra Madre, traffic patterns have changed drastically, further, with the new Rosedale and APU expansion there will be very long traffic delays and severe congestions; he urged the City to implement mitigation measures in the plan. Ms. Peggy Martinez addressed the Hearing asking why the traffic report isn't a part of the P. Martinez congestion plan. Comments Moved by Councilmember Hanks, seconded by Councilmember Carrillo and unanimously Hrg Closed carried to close the Hearing. City Manager Delach responded that the information for the report Is still required and the City Mgr credit system has been suspended because the MTA Board is working on the Gold Line and Comments similar lines throughout the south land and until they work out all the details, they are expecting the rail programs to help with the congestion significantly. The mitigation measures are being taken into account and the fees have been collected and will be coming forward as part of the Capital Improvement Program with Rosedale and APU will be coordinated separately. Additional discussion was held regarding traffic studies at Foothill Shopping Center and other traffic impact analysis. Councilmember Hardison offered a Resolution entitled: 'A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, FINDING THE Res. 06-70 CITY TO BE iN CONFORMANCE WITH THE CONGESTION MANAGEMENT PROGRAM (CMP) CMP AND ADOPTING THE CMP LOCAL DEVELOPMENT REPORT, IN ACCORDANCE WITH CALIFORNIA GOVERNMENT CODE SECTION 65089. Moved by Councilmember Hardison, seconded by Councilmember Hanks to waive further reading and adopt. Minutes of the regular meeting of August 7, 2006, were approved as written. Min appvd 2. Human Resources Action Items were approved as follows: HR Action Merit Increase and/or Regular Appointments: B. Badoni, and X. Torres. Items New Appointments: W. Johnson, Police Officer - Trainee, E. Mendoza, Police Officer - Trainee, R. Gonzales, Wtr Distribution Worker I, and D. Baird, Wtr Distribution Worker 1. 3. The purchase of seven 2007 Ford Police Interceptor Vehicles was approved in an Purchase amount not to exceed $170,118.95, from Clippinger Ford. The purchase of these 2007 Ford vehicles based on a competitive bid process completed by the Los Angeles County Police Sheriff Department Contract. Interceptor veh 4. Notice of Completion for the Athletic Field Improvements at Zacatecas Park as NOC completed by Trugreen Landcare was approved and staff was authorized to file same Zacatecas with the Los Angeles County Clerk and pay the 10% retention to the contractor. Improvements 5. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING Res. 06-C71 AGREEMENT FOR "COST - SHARING OF FACILITIES ON STATE HIGHWAYS IN THE Cost Sharing CITY OF AZUSA" Traffic Signals 6. SPECIAL CALL ITEM. Spec Call 7. SPECIAL CALL ITEM. Spec Call 8. The contract for consultant engineering services with Quantum Consulting, Inc. was Quantum Cnslt approved. Engineering 9. The Novell Software Maintenance and Licensing Agreement in the amount of Software Maint $16,641.01 was approved to PC Mall GOV. Mayor Chagnon commented that if the PC Mall GOV ' City Is moving towards Outlook, she suggested minimizing cost to group wise. City Manager responded that he would take that into consideration. 10. The following resolution was adopted and entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN Res. 06-C73 CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME Warrants ARE TO BE PAID. SPECIAL CALL ITEMS Spec Call Itms Mayor Chagnon noted a typographical error in item regarding bid award for the primary Purchase copper cable and asked that it be corrected. It was then moved by Mayor Chagnon, Copper seconded by Councilmember Hardison and unanimously carried that the issuance of a Cable purchase order in an amount not to exceed $478,552 to Hughes for the purchase of 12,000 circuit feet of 500 KCMIL Primary Copper Cable, and a separate purchase order to Wesco Distribution in an amount not to exceed $135,400 for the purchase of 6,400 circuit feet of #4/0 19 Strand Primary Copper Cable, be approved. Mayor Pro -Tem Rocha addressed item regarding resolution in support of the City Duarte's Rocha re: Encanto Nature Walk Trail Projects asking who will be responsible for maintenance. City Encanto Nature Manager Detach responded stating that he believes it is the City of Duarte, but would check Walk Trail with them before the project proceeds and if that is not the case It will come back for reconsideration. Mayor Chagnon offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, SUPPORTING Res. 06-C72 THE CITY OF DUARTE'S ENCANTO NATURE WALK TRAIL PROJECT. Councilmember Hardison offered an Ordinance entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, AMENDING CHAPTER 14 OF THE AZUSA MUNICIPAL CODE TO ADD ARTICLE XVI REGARDING FLOODPLAIN MANAGEMENT REGULATIONS Moved by Councilmember Hardison, seconded by Councilmember Carrillo to waive further reading and adopt. Ordinance passed and adopted by the following vote of the Council: AYES: COUNCILMEMBERS: HARDiSON, CARRILLO, HANKS, ROCHA,CHAGNON NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: NONE City Attorney Martinez explained that the Urgency Ordinance authorizes Informal bidding procedures for purchase of transformers and/or primary copper cable up to $75,000. It also authorizes the City Manager to award such purchases up to $75,000. It will take effect immediately upon adoption and a regular ordinance is presented to take effect in the standard time frame 30 days after adoption at second reading at which time the Urgency one will be repealed. He also stated the ordinance increases the informal bid limits for public project in accordance with recent increases by the State Controller' office. Councilmember Hardison offered an Ordinance entitled: AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, AMENDMENG SECTION 2-518 OF ARTICLE VIl OF CHAPTER 2 OF THE AZUSA MUNICIPAL CODE REGARDING PURCHASES OF ELECTRICAL TRANSFORMER EQUIPMENT PRIMARY COPPER CABLE Moved by Councilmember Hardison, seconded by Councilmember Hanks to waive further reading and adopt.
