The City Council of the City of Azusa met in regular session at the above date and time In the Azusa Auditorium. CEREMONIAL Ceremonial Ms. Carol Montano, Director of the San Gabriel Valley Municipal Water District, representing C. Montano Azusa, presented checks in the amount of $1950.00 to staff and students of Azusa and Present Checks Gladstone High schools for their participation in the Low Toilet Giveaway Program. High schools The entire Council presented a certificate to the Reverend Angel De Rosas of Filipino First 25`h Anniversary Presbyterian Church in celebration of its 25`h Anniversary. Filipino Church Certificates of congratulation to Paulo Sandoval, who placed I" in California State Games Cert to Paulo and 4`h place in Junior Olympic National Championships. Sandoval Certificates of congratulation to students of Azusa who won awards at the Los Angeles Cert Student County Fair as follows: Emily Bennion, Victoria Duke, Eric Lopez, Liam Meuse, Olga Lobaco, Winners LA Louise Trevino, Gloria Taylor, Frances Okura, Munci Gunner, Karen Taylor, Xochitl Cruz- Co Fair Gonzalez. The City Council reconvened at 7:38 p.m. City Attorney Carvalho advised that there was no Reconvened reportable action taken in Closed Session and that Item number two, real property City Attorney negotiations, will be discussed at the end of the meeting and that Mayor Chagnon will not Comments participate due to a Conflict of Interest. Mayor Chagnon called the meeting to order and led in the Salute to the Flag. Call to Order INVOCATION - was given by J. Burke Hamilton. PUBLIC PARTICIPATION Public Part Mr. Mike Lee addressed Council recognizing that Art Morales appeared on television M. Lee recently, shared newspaper article a letter from a mom to her son who died in Iraq; urged all Comments to vote in election, expressed opinion regarding Prop.90, and shared attendance at the dedication of the W.C. Post Office in memory of Lillian Keil, the most recognized woman in World War II. Mr.JorgeRosales addressed Council with J. Rosales J questions regarding item Block 36 Report as follows: does the proposed structure include Wimpeys, what is the status Club D property Comments purchase, at the 110-190 W. 9" street sites, what opportunities exist for the current business to participate in the Downtown Redevelopment and is there a written plan? With regard to Foothill Status Report he received confirmation that there are 102 rolling units, there will be an extension of Haltern, and the EIR Is available now for the public review. With regard to proposed commercial vehicle parking ordinance he voiced concern that it Includes all vehicles less than 10,000 lbs, which would cover any and all trucks used for commercial and under the new dev code 88:36.130 commercial vehicle completely conflicts with chapter 74 of the old code language. With regard to the Talley building he stated that the Cultural and Historical Preservation Commission indicated that elevator would not be appropriate for the building yet the original approval Included adding a third story, further many Commissions will be reviewing this with the exception of the ABC, of which he Is a member. Ms. Lynne Dwyer addressed Council inviting all a public planning meeting of the EI Encanto L. Dwyer site; stating that they will be developing a master plan. The meeting is Thursday, November Comments 16, 2006, from 6:30 - 8:30 p.m. in the Azusa Auditorium. They will schedule three meetings, the other two are on February 13, 2007 and May 3, 2007. Ms. Blanch Weir of the Architectural Barriers Commission addressed Council asking why it B. Weir was decided not to put an elevator in the Talley Building. She asked if they think that the comments handicap don't conduct business. Ms. Christie Melanson addressed Council stating that the Rosedale construction has been in C. Melanson operation till about 1 1 p.m. at night. She asked what she could do the next time they violate Comments operation hours; she was advised to call the police and report It. Councilmember Hardison also expressed the same concern. Mr. Joe Guarrera addressed Council expressing concern regarding the budget transfer for J• Guarrera ' Palm Tree Trimming asking if it comes from Gas Tax, why they need a transfer. He also Comments expressed concern regarding agenda Item changing department heads to at will employees stating that the Civil Service System has been in effect since 1950 and the Intent was that all employees were to be under the civil service system; he expressed concern and requested that Council not take a vote on it tonight, but to look further into the situation. Lastly, he expressed concern regarding the increased graffiti in Azusa. Mr. Art Morales addressed Council recognizing many people in the audience and at home, A. Morales he talked about his visit to the observatory, expressed thanks to the City for all their help to Comments Mr. Pina, regarding rent control at Villa Azusa he asked that the City also do the same at Soldano Village. 11/06/06 PAGE TWO Ms. Lana Grizzell addressed Council expressing her opposition to agenda Item regarding at L. Grizzell will employment, she stated that there is a need to look at it again and it not a good policy, Comments She also talked about parking problems in Azusa, specifically at semi -truck parking on First Street and disabled vehicles at 10th and Palm. REPORTS, UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF Director of Recreation and Family Services Jacobs introduced new Recreation Superintendent Heath Hamilton who Is originally from the City of Azusa and came from employment from the City of Chino; he will be running Azusa Senior Center, which Includes Woman's Club and 'many other Recreation Programs, began on October 23, 2006. Heath Hamilton addressed Council and audience Inviting all age 50 and over to visit the Senior Center, where there are a number of variety of activities, bingo, bunco, trips, afternoon programs, and evening activities as well as a nutritious lunch. Councilmembers' welcomed him to the City. Mayor Pro -Tem Rocha introduced the Granados family, Lupe, Arthur, and announced that their son Arthur was recently promoted to Chief Petty Officer at a ceremony back East and he is now a Chief Damage Control Man. There were only 39 gentlemen from across the Country that were pinned and Arthur Granados was from Azusa. Mr. Rocha read into the record the expectations of the U.S. Navy and Mr. and Mrs. Granados talked about the pinning ceremony; and thanked Council for the recognition. Economic and Community Development Director Coleman provided an update on Block 36 and Dalton Avenue stating that the Agency is negotiating with Lowe Enterprises for the redevelopment of Block 36; they are finalizing the deal -points to be presented to Council In December and it does include the Wimpeys property. Further, the Agency owned buildings on Block 36 are scheduled to be demolished during January 2007 and also the Agency owned properties on Dalton. On the south west corner of Ninth, staff has been working with all of the businesses to talk about relocation needs. Club D was purchased by the City last month. Rpts/Updates J. Mayor Chagnon announced that Planning Commission Public Hearings on the Foothill Chagnon Shopping Center will begin on November 15th , which is the formal process. She announced Comments that Nomination Period for anyone wishing to run for City Council begins on November 13, and the filing deadline is December 1 1 th. She thanked and expressed congratulations to Azusa High School for the successful celebration of Its 50' Anniversary. She announced the Graffiti removal phone number as follows: 812-5200 ext 5489. 11/06/06 PAGE THREE Economic and Community Development Director Coleman presented the Status Report on B. Coleman ' the Foothill Center Project stating that It is an existing center developed in 1950's, located at Alosta and Citrus; it will be a mixed use residential and commercial. He stated there will be Update Foothill Shopping demolition of approximately 87,500 square feet of existing buildings and development of Center approximately 186,500 square feet of retail space, 110 Townhouses, and redesign of parking. There will be a design review, a subdivision map, development agreement, signed program EIR review; a mitigation negative declaration was released back in mid October which covers traffic, circulation, cultural resources, geology and a variety of issues. The developers have worked on retail recruitment and have had many community meetings. Next there will be a Planning Commission Public Hearing scheduled for November 15, following that all will come before Council for a Public Hearing and if the project is approved It will then begin and take approximately 24 months Councilmember Hanks addressed item regarding consideration of $1,000 donation to the Hanks Esperanza Fire Arson Reward, stating that since an arrest has been made and charges filed Comments he wasn't sure there was a local reason to justify the donation and the City Attorney agreed Arson that there is no public reason. He asked that the City memorialized its sentiments. Victims Councilmember Hardison suggested that the money go towards the survivors, but the City Hardison Attorney Carvalho responded stating that the City would have to show a connection with the City Attorney money that they are spending and a local impact, due to the money being taxpayer dollars, Re: contribute that would not be appropriate. She announced the Graffiti removal phone number as follows: 812-5200 ext 5489. 11/06/06 PAGE THREE Mayor Pro -Tem Rocha requested the meeting be adjourned in memory of Frank Aguirre, Joel Gonzales, Erick Bermudez, Frank Salce, and Mrs. Donnelson. He invited the City Council to Paramount school on Tuesday, November 7th , where a Veterans Day celebration, honoring local Veterans will be held. He thanked staff for the timely trimming of the palm trees on Cerritos Avenue. He thanked Andrea Cruz for skull caps knitting sessions she has every Saturday, from 12:30 to 2:30 p.m. for the American soldiers in Iraq. He stated that a local company donated $1000 to help defray the cost of postage, and to buy hard candy for the soldiers. The Azusa Veterans send handl-wipes, disposable cameras, and they will be collecting items on December 2nd at the VFW, he provided statistics of donations last year. He announced the Annual Veterans Day Ceremony, on Saturday, November 11, at 1 1 a.m. at the Flag Pole at City Hall; they will be welcoming back three Azusan who returned from Iraq, 'Abel Jimenez, Ricky Sotela, and Carmen Magana Venegas. Lastly, he noted the problems with graffiti and stated there was a need to meet with the Azusa School Board regarding the Issue. Rocha Comments Councilmember Carrillo congratulated all Involved In the Azusa High school 50' Anniversary Carrillo celebration. He also congratulated the Parks and Recreation Department on another Comments successful Trunk or Treat event for Halloween. Lastly he thanked the Azusa Police Department for the recent arrests for tagging. He urged all to vote in tomorrow's election. Councilmember Hardison urged all to vote in the election. He announced that he will not be Hardison seeking another term as City Council member. Comments City Manager Delach stated that there were 53 arrests for graffiti; under the prior program City Mgr there were about 1000 graffiti calls for abatement in six months, and with the contract, In Comments the last three months they responded to 2000 calls; he stated the program is going well. SCHEDULED ITEMS Sched Items SDAR (Station Design and Art Review) Recommendations To Council. Director of Public Station Design Works/Assistant City Manager Makshanoff Introduced members of the Gold Line Monica And Art Review Borne and Leslie Elwood, and artist that were chosen for the stations, one at Alameda and one at Citrus, artwork, Jose Antonio Aguirre and Lynn Goodpastor, Ms. Leslie Elwood acknowledged Blanch Weir, Chris Dodson, Jeffrey Cornejo and Guy and L. Elwood, Jennifer Kinnear, who were the committee who served as stewards of visual components. J. Aguirre and She presented, in detail the design concepts and art review. Mr. Jose Antonio Aguirre talked L. Goodpastor about how he arrived at the design noting that he included the uniqueness of Azusa. Lynn Goodpastor spoke about the history of the City and how she related it to her design. They responded to questions posed by Councilmembers regarding maintenance of the stations, consistency of bicycle racks, custom style benches and their repair, color of the Alameda Station to lean more towards darker colors due to graffiti temptation and also the to Include arms on the benches. Moved by Councilmember Hardison, seconded by Councilmember Hanks and unanimously SDAR carried to accept the recommended City's Station Design and Art Review (SDAR) Committee Approved. for the Metro Gold Line Foothill Extension (Foothill Extension) station, specifically the Artist advanced artwork -design and the Station secondary visual elements. City Department Head Ordinance and Employment Agreements. City Attorney Carvalho City Attorney addressed the item stating that this is a follow up Items that were placed on the City Comments Managers, former and current, work plans. She detailed the issues that occur when trying to hire qualified department heads and how it was arrived that there was a need to enter into contracts for those positions; further the actions needed to make sure all was consistent 'with the Azusa Municipal Code. She talked about numerous amendments throughout the history where amendments to the Civil Service Rules and Regulations, not subject to voter approval, took place and in the Government Code it indicates department heads can be removed from the Civil Service Rules by a majority vote of the City Council. She stated that the proposed would give City Manager to enter into such contracts, but it doesn't change the Civil Service Rules and that would be addressed at a later time. She responded to question stating that the item did not go through the Personnel Board first, because it was not required to do so. City Manager Delach responded to questions stating that this policy provides performance City Manager based on review and reward process, since California is a "for cause" State, there has to be Comments cause or justification to be removed from a position. 11/06/06 PAGE FOUR Lengthy discussion was held between Councilmembers and staff regarding the issue, Its Lengthy advantages, benefits for recruiting, at -will employees, severances, etc. Discussion Mr. Jorge Rosales addressed the issue expressing his frustration in understanding the report, J. Rosales Le. position ranges, step increases, retro -active Increases, status of other department heads Comments and differences in time period of severance and fringe benefits. Mr. Uriel Macias addressed the Issue suggesting that the City Council use the Personnel U. Macias Board as an advisory to Council in order that they come back with recommendations: he Comments asked that the Personnel Board be able to review the Item first. City Manager Delach responded to comments stating that in the past executives had City Mgr Incentive pay, all will be rolled over and full disclosure of what the employee receives will be Comments available. He stated that some employees were significantly behind the market, when they had the first round of contract employees, he met with Personnel Board and told them it would not affect regular employees. Mr. Joe Guarrera addressed the issue expressing his frustration stating that when the first J. Guarrera round of appointed directors was initiated, he was told it would not affect any other Comments employees. He stated that Civil Service Rules states "all employees", and it does not exclude department heads. Ms. Andrea Cruz addressed the Issue expressing concern regarding the authority staff has in A. Cruz decision making, and hoped that Council served the public and not listen solely listen to Comments recommendations of staff, and is concerned with the increasing concentration of authority of some staff members. Mr. Walter Harvell addressed the issue expressing his opinion regarding the publics' right to W Harvell know what is going on in a situation. Comments Mayor Pro -Tem Rocha requested that "domestic partner" be added to list of relatives with Rocha regard to bereavement leave. Comment After additional discussion, Councilmember Hardison offered an Ordinance entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING SECTION 2.90 1" Rdg Ord OF THE AZUSA MUNICIPAL CODE TO AUTHORIZE THE CITY MANAGER TO ENTER INTO AT- At -Will Agmts WILL EMPLOYMENT AGREEMENTS FOR ALL DEPARTMENT HEAD POSITIONS. Dept Heads Moved by Councilmember Hardison, seconded by Mayor Chagnon and carried to waive further reading and introduce the proposed ordinance. Mayor Pro -Tem Rocha dissenting. Mayor Chagnon requested that "cash bonus" be added to section 2.2 in the At -Will Chagnon Department Head Employment Agreement. Comments Moved by Mayor Chagnon, seconded by Councilmember Hardison and carried to approve Employment the form of an Employment Agreement, as amended, which the Ordinance authorizes the Agmt form City Manager to execute. Mayor Pro -Tem Rocha dissenting. Mayor Chagnon noted two typographical errors In sections 3.5.2, insert "employment Chagnon status" and 3.5.3, last sentence "3.5.2", of the Standard Benefit Guidelines for Department Comments Heads. 11/06/06 PAGE FIVE Moved by Mayor Chagnon, seconded by Councilmember Hardison and carried to approve Benefit Guidelines Standard Benefits Guidelines for Department Heads, as amended. Economic Prop Ord Proposed Ordinance Amending Azusa's Commercial Amending and Community Development Director Coleman addressed the Issue stating staff was Azusa's directed to prepare an ordinance to regulate the parking of commercial vehicles weighing 10,000 pounds or less In a manner similar to the existing regulation of commercial vehicles Commercial over 10,000 pounds. The restrictions would regulate the amount of time commercial Vehicle Parking Regs vehicles could be parked, and add new definitions to clarify the parking regulations. City Attorney Carvalho advised of the need to correct certain terms within the proposed City Attorney Comments ordinance, i.e. District Corridor instead of Commercial, and that In preparing the item they were referencing the old chapter instead of the new Development Code which has not been codified to date. 11/06/06 PAGE FIVE She responded to questions and talked about the intent of the ordinance which is to take the City Attorney commercial cement pump vehicles, tree shredders, semi -trucks, off of the City streets. Pursuant to the City of Azusa Civil Service Rules Section 3.3 and 3.7, that the City Supervisor Council adopt the classification specification for Community Improvement Supervisor along with recommended salary range. Class Specs Sr Planner 7. Pursuant to the city of Azusa Civil Service Rules Section 3.3 and 3.7, the classification specification for Senior Planner along with recommended salary range was approved. Class Specs Management 8. Pursuant to the City of Azusa Civil Service Rules Section 3.3 and 3.7, the classification Analyst group specifications for Management Analyst Trainee, Management Analyst, and Senior Management Analyst along with recommended salary ranges were adopted. Class Specs Urban Forester 9. Pursuant to the City of Azusa Civil Service Rules Section 3.3 and 3.9, the revised classification specification and salary range adjustment retroactive to July 1, 2006 for the Urban Forester was adopted. Pursuant to the City of Azusa Civil Service Rules Section 3.3 and 3.7, the classification specification for Recreation Supervisor along with recommended salary range was adopted. Spec Call 1 1. SPECIAL CALL ITEM Homeland Security Grant 12. Approval was given to the Expenditure Plan — 2006 Homeland Security Grant for Pur equipment purchase of radio equipment offered through the reimbursable State of California FY2006 Homeland Security Grant Program (HSGP). ' Res. 06-C 104 13. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, OTS APPROVING A GRANT AGREEMET WITH THE CALIFORNIA OFFICE OF TRAFFIC SAFETY STEP Project (OTS)FOR THE -SELECTIVE TRAFFIC ENFORCEMENT PROGRAM" (STEP) PROJECT #PT0758 Final Tract Map Edgemont at 14. FINAL TRACT MAP NO. 63336-1, EDGEMONT AT ROSEDALE. The following was Rosedale approved: a. That this project complies with the General Plan and is consistent with the approved tentative map and any amendments thereto. b. That this project will not violate any of the provisions of Sections 66473.5, 66474. 1, and 66474.6 of the Subdivision Map Act. c. The dedications of easements for Police, fire Department and Pedestrian Access Purposes, Public Utility purposes including Water, Sewers and Storm Drains, and Lot A in fee simple for Park and Recreation Purposes, as offered on the map, are hereby accepted. 11/06/06 PAGE SIX d. The City Council approves and authorizes the City Manager to execute the attached AGREEMENT FOR COMPLETION OF PUBLIC IMPROVEMENTS for Tract No. 63336-1 to construct required public improvements and also accept the attached Faithful Performance Bond in the amount of $421,600, the attached Labor and Materials Bond for $210,800 as guaranteed by Bond Safeguard Insurance Company, and a cash deposit in the amount of $44,475 to guarantee completion of the recreational landscaping improvements, e. That pursuant to Section 66436(a)(3)(A)(i-vii) of the Subdivision Map Act, the City Council hereby finds that the development of the property, in the manner set forth on the subject division of land, will not unreasonably interfere with the free and complete exercise of the easements held by Dhammakaya International Society of California and Azusa Land Partners, LLC and accepts map without the signatures of said easement holders. f. Approve Final Tract Map No. 63336-1, and g. City Clerk is hereby authorized to endorse maps, which embodies the approval of said maps and acceptance of dedications. 15. Approval was given to adopt the classification specification for Human Relations Commission Graduate Intern part time position along with recommended hourly rate. 16. SPECIAL CALL ITEMS Spec Call Items Mayor Pro -Tem Rocha addressed item regarding urgency palm tree trimming along Azusa Urgency Palm Avenue asking for clarification on when the trimming will be scheduled. Tree Trimming City Manager Delach responded stating that it will be scheduled immediately and clarified City Mgr that the monies are technically Gas Tax Funds, but are street maintenance savings, employee response vacancies in that department. Director of Recreation and Family Services Jacobs responded stating that there is a back log j, Jacobs of tree trimming calls and the work will be done as soon as possible. He responded to Response 'question regarding notification to neighbors stating that has not been standard practice, but that they will do the work during light hours. Moved by Mayor Pro -Tem Rocha, seconded by Councilmember Carrillo and unanimously Urgency Palm carried to confirm the budget transfer of $8,700 for urgency palm tree trimming along Azusa Tree Trim Az Avenue.
