MINUTES OF THE CITY COUNCIL
REGULAR MEETING
MONDAY, APRIL 2, 2007 — 6:30 P.M.
The City Council of the City of Azusa met in regular/special session at the above date and
time In the Azusa Auditorium.
Mayor Rocha called the meeting to order. Call to Order

Reverend Gilbert Becerril of the Pathfinders Outreach administered the Oath of Office to Gonzales
newly appointed Council Member Robert Gonzales.

Ms. Peggy Martinez introduced Miss Azusa Jamie Pezold, Miss Outstanding Teen Jamie P. Martinez
Alvarez and princesses Antoniett Smith and Crystal Munoz. She spoke with pride about the Comments
accomplishments of the young women, noting that they helped on some council campaigns.
She invited all to the Mariachl Festival on Saturday, April 21', at Citrus College Performing
Arts Center at 6:00 p.m. at a cost of $25 and $30. She also noted her new address at 730
N. Dalton, Azusa.
Mr. Jesse Avila Jr. addressed Council thanking those who attended Opening Day for the J. Avila
American Little League and thanked those who represented the City in Washington, D.C. on Comments
'that day. He announced the Little League Fundraising Dance to be held on April 14" at the
Woman's Club; tickets are $13 presale and $15 at the door. He recognized Assemblyman
Ed Hernandez who was in attendance at the meeting.
Mr. Mike Lee also recognized Assemblyman Ed Hernandez. He stated that the Dodgers M. Lee
have a Gonzo and we have a Gonzo. He asked that the Council be in unity with no self Comments
Interest, except the community. He asked that all continue to pray for our soldiers and
stated that he Is in favor of universal health care.
Ms. Pamela Vera expressed her appreciation to a new beginning, and a beautiful time for the P. Vera
city of Azusa, congratulated the new Council and expressed her blessings to all. Comments
Mr. Art Morales wished all a good evening; with special recognition to all Councilmembers. A. Morales
He expressed his concern regarding a water fountain at Slauson Park stating that it needs to
be looked at, as he feels not enough water flows from the fountain; further he asked that the
trash can signs be in more than one language.
Ms. Madelyn Payne, on behalf of Friends of the Azusa City Library Association, invited all to M. Payne
attend Mystery At the Library, on Thursday, April 19" 6 p.m.; guests will Include Joanne Fluke Comment
and Susan Campbell; there will be food, raffle and a silent auction.
Mr. Dennis Willut addressed Council stating that trash rates are excessive; landlords are D. Willut
'subJect to paying trash rates even if there is no trash. He asked that Library hours on Comments
Wednesday night be restored, the block wall 338 E. 8" Street is falling down; there are bees
In the area of the senior complex. He then mentioned that his mother is a senior who did
not pay late fees.
Mr. Bruce Knoles addressed Council stating that a year ago he asked for a four way stop sign B. Knoles
on the corner of Orange and 10'" street, as two boys were hit in front of his house by a Comments
speeding driver, and It has gotten worse on Crescent, between Angeleno and Vernon, and he
would like this to stop.

REPORTS, UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF
E. Hernandez .
Assemblyman Ed Hernandez provided a report on Transportation Summit he recently Report on
hosted. He provided a handout, introduced staff member Laura Jimenez and later his Chief Transportation
of Staff Water Hughes. He congratulated Mayor Rocha and new Councllmembers Macias, Summit
Gonzales and Carrillo. He talked about the 10/605 Interchange which was included in the
Local Government Summit on Transportation report he presented to Council. He spoke of
lobbying efforts to include the 10/605 in the CTC funding for bonding money and of
additional funding received for the 1-10 HOV lanes. He noted the landmark legislation
which will move the presidential primary to February. He talked about Universal Health
Care in the State of California and advised that he will bring back a report on the subject.
'Moved by Councilmember Carrillo, seconded by Mayor Pro -Tem Hanks and unanimously Proc Arbor Day
carried to approve the preparation of proclamations for Arbor Day Recognition and the 201" Senior Center
Anniversary of the Azusa Senior Center. Anniversary
Discussion was held regarding the Baldwin Park Ordinance on yard sales, which allows for Discussion
yard sale four week -ends per year, in March, June, September and December, which is Yard Sales
Saturday and Sunday only, and there Is no charge. It was noted that Azusa could chose City Attorney
their own months and since there is no charge, It would free up Code Enforcement Bring back
personnel to do other duties. The City Attorney was directed to come back to the next Proposed ord
meeting with a proposed ordinance for further discussion.

Moved by Councilmember Gonzales, seconded by Councilmember Macias and unanimously Donate YWCA
carried to approve a $100.00 donation to the YWCA.
Rosedale Project Manager Bruckner presented first quarterly report as follows: mass grading
completed, construction schedule, infrastructure on-site storm drain work is complete, all
backbone sewer lines are complete, a number of plans are in progress and are in plan check,
fire station design is in review, K-8 school is before the State Architects office; a temporary
site is being considered, and home construction has slowed in sales. Other issues
discussed were Palm Drive, and Monrovia Nursery Gates; the Commission is working with
the developer and modification of palm tree location north of the railroad tracks; out of 79
trees only 21 have survived due to poor drainage; a revised plan is being prepared to restore
' that part of Palm Drive and will be brought back for review. With regard to paleontology,
historical resources, Cogstone has found fossil angular fish 12-18 million years old, Topanga
Formation, oldest known fossil of this group, lived in a world of darkness; he talked about
the fish. Mr. Bruckner responded to question stating that new palm trees will be purchased;
they will be secured and are looking at different options. He stated they are seeking a
dump site for excess soil and would look Into the feasibility of the Kincaid Pit, as suggested.
With regard to Edison and Sierra Madre, he stated that the infrastructure will not stop; It's
almost complete with streets paved etc.
Public Information Officer Quiroz presented an update on Azusa Clean and Green Month In
April stating that there are free services available to all residents who wish to participate. In
order to discard bulky items they can be put out on regular trash days, no construction
materials. The Hazardous Waste Round Up will be held on April 28' 9-3, at Northrup
Grumman, junk cars will be towed by Azusa Police Department as long as proper paperwork
Is in order, there will be free yard sales, April 27, 28, and 291h, bid tires can be taken to
Azusa Land Reclamation at 1211 Gladstone Street, volunteers will be planting trees In
partnership with Azusa beautiful Program, Spring Fling Concert will be held at Memorial Park
on Saturday April 7`h, for more information call 812-5200 or look at info on the newsletter
with Utility Bill.
Director of Public Works/Assistant City Manager Makshanoff provided an update on the
Graffiti Program as follows: the City contracts with Urban Graffiti at a cost of $54,000 year,
' there have been 450 incidents per month, with clean up turnaround within 48 hours, if racial
or profane within 24 hours, average 200 — 250 calls per month; UGE, City Manager and
Chief Garcia have met with the School District to see what they can do together to combat
the problem. They are looking at a 24 hour turnaround on all graffiti, and on week ends it
will cost additional funding; this will be put in budget. The removal is by sandblasting, water
blasting, and paint match up use of solvent. When reporting call 812-5200 ext 5489, and
note location, address, what kind of surface, if possible. With regard to private business, if
the graffiti is reachable from the public right a way they will take it off, if they can't reach,
they need to work with the owner, otherwise It could turn into Code Enforcement matter.
Staff has County numbers i.e. Flood Control District, and Caltrans. He responded to
questions from Councilmembers regarding removal from alley walls, sidewalks, access to a
graffiti removal kits, working through court system to see If kids could clean up graffiti they
have done, liabilities, public awareness campaigns through schools by Councilmembers and
Illegal sales of markers and paint.

The item regarding Response to Mr. Willut's concerns was received and file with no Willut's
discussion at this time. Concerns
Mayor Pro -Tem Hanks advised that he will be out of town on April 16' and will not be In Hanks
attendance at the City Council meeting. Comments
Councilmember Macias expressed concern regarding the problems people have had trying to Macias
watch Council meetings; he advised that he has discussed this with staff and they are Comments
' looking at options to update, mics and cameras. He also stated that there is a need for
beautification projects for on and off ramps in Azusa, at Citrus and Azusa Avenues. He
suggested seeking aid from Assemblyman Hernandez and/or Caltrans, which was referred to
staff and will be discussed at the Workshop to be held on April 19th.
Mayor Pro -Tem Hanks advised that he has observed that Mayor Joe Rocha has not been Hanks
using his Council parking spot; he urged the community to call upon the Mayor to use his Comments
parking spot and that it is important that he do so.
Councilmember Gonzales announced the Ribbon Cutting Ceremony at Memorial Park for the Gonzales
new outdoor stage and the Annual Easter Hunt for the kids at 9:30 a.m. He wished all a very Comments

Councilmember Carrillo asked the status of funding to Azusa National Little League; City Carrillo
Manager Delach responded stating that Director of Public Works Makshanoff used money Comments
from graffiti budget and provided red and blue paint to the League and AUSD provided white City Mgr
and/or beige paint which solved the problem. Response
Mayor Rocha invited the public to Moonlight Story time every Tuesday at the Library from Rocha
6:30 p.m. - 7:00 p.m., to the Arbor Day Celebration at Gladstone Park on Thursday, April 5th, Comments
at 5:30 p.m. stating that Azusa is a Tree City USA; he announced that on Saturday at 8:00
a.m. they will be planting trees on Orange Place across from Memorial Park, and announced
the Azusa Sister City Day a; the Races on Sunday April 15' from noon to 5 p.m. at a cost of
$20 and under 18 years $7.

PUBLIC HEARING - reearding the financing of educational facilities with the proceeds of tax- Pub Hrg
exempt bonds to be issued by the Colorado Educational and Cultural Facilities Authority. The Fin Edu Fac
Public Hearing was removed from the agenda and was not held. Removed
Resolution approving and adopting the Third Amended and Restated Joint Exercise of
Powers Agreement of the San Gabriel Valley Council Of Governments. City Manager Delach
addressed the Item stating that it comes from the San Gabriel Valley Council of Governments
and it entails Inclusion of the County of Los Angeles Into the COG Board of Directors and the
proposal calls for three memberships for the Los Angeles County to represent each
Supervisor having a large unincorporated area within San Gabriel Valley which includes
Supervisor Gloria Molina, Supervisor Don Kanabe and Supervisor Michael Antonovich. The
COG has recommended their Inclusion and each seat comes with full dues which are based
on population; they will be paying at the highest level of membership. He recommended
approval, but to amend the Resolution and JPA to Include representation from only elected
officials, being either Neighborhood Council Representatives or the Supervisors themselves.

CONSIDERATION OF PROCEDURES FOR THE FORMATION AND APPOINTMENT BY THE Formation of
CITY MANAGER OF THE DOWNTOWN NORTH ADVISORY COMMITTEE. RECOMMENDED DNAC
ACTION: Approve the formation of a Downtown North Advisory Committee ("DNAC") and
authorize the City Manager to appoint members to the DNAC.
Economic Development Director Coleman addressed the issue stating that the City has B. Coleman
entered into an Exclusive Negotiation Agreement and Memorandum of Understanding with Comments
Watt Genton Associates for the area know as the Downtown North, generally bounded by 9'h Carrillo &
Street on the north, Foothill boulevard on the south, San Gabriel Avenue on the west and Macias
Dalton Avenue on the east. He stated that staff Is now recommending the formation of an Appointed
Advisory Committee to encourage community participation in the review process; the DNAC
would be appointed by the City Manager and would serve as an advisory body to make
recommendations to the City Manager and be composed of 2 Council Members, 2
'Residential Owner -Occupant or Tenant, 2 Business Owner (Include property owner) 1
Existing community Organization, and i Ex-Officlo Nonvoting Member (Developer -Watt
Genton). He asked that the applications, which will be made available via City Clerk's Office,
Community Development, and City's Web site, be submitted to the City Clerk by 5:30 p.m.
on April 16, 2007. Mayor Rocha appointed Councilmembers Carrillo and Macias as Council
representatives; they accepted.

Mr. Willut addressed Council detailing the incidents that have taken place regarding a Mr. Willut
business license fee paid late by his mother, Mrs. Kathryn Willut, and the misinterpretations Comments
and confusion it has caused. He cited many problems his mother has been having both
mentally and physically as well as illnesses and even the death of a family member. He
asked that the matter be reconsidered with the waiver of penalties.
City Manager Delach responded to the Issue stating that this has been an ongoing practice City Mgr
with the Willuts for several years and penalties have been waived in the past. He noted that Response
council has considered the matter and unanimously agreed that the penalties not be waived.
The CONSENT CALENDAR consisting of Items E-1 through E- 1 1 was approved by motion Consent Cal
of Mayor Pro -Tem Hanks, seconded by Councilmember Carrillo and unanimously carried Approved
with the exception of Items E-4, E-6, and E-7, which were considered under the Special Call
portion of the Agenda.
Minutes of the special/regular meeting of March 19, 2007 and the special meeting of Min appvd
February 26, 2007, were approved as written. Councilmembers Macias and Gonzales
abstained from the minutes of February 26th and Councilmember Gonzales abstained
from the minutes of March 19`h.

$17,866 including sales tax and all other applicable fees, to Wondries Fleet Group for 2007

Community Improvement Division.

8. Authorization was given for the purchase of foul ball netting and installation at Sports Fac
Gladstone Park from Sports Facilities Group, Inc. in the amount of $26,550.00. Ball Netting

Councilmember Macias questioned if the Canyon City Foundation Grant would be used to Canyon City
look at other funding sources for other grants. Library Director Tovar responded stating that Foundation
he had submitted a request for a grant with the Canyon City Foundation and they approved Grant Funds
one and the Library could use it to secure other grants. Budget Amend

Moved by Mayor Pro -Tem Hanks, seconded by Councilmember Gonzales and unanimously
carried to accept a $15,000 grant from the Canyon City Foundation and authorize spending
for the purpose of hiring a community consultant to identify future project for funding
consideration and write the next grant submission to the foundation.
Mayor Pro -Tem Hanks addressed the proposed RFP for Engineering Services stating that if
the City is unable to attract qualified applicants they should consider reviewing salaries and
raise them until they are competitive and qualified staff can be obtained. Mayor Rocha
expressed the same concern. Director of Public Works/Assistant City Manager Makshanoff
responded stating that they have already begun reviewing the positions, salaries and are
doing surveys of the position with other cities, staffing sizes and workloads to compare with
the City of Azusa and ho -or and where improvements can be made.

After additional comments, it was moved by Mayor Pro -Tem Hanks, seconded by Approved
Councilmember Gonzales and unanimously carried that the City Manager be authorized to Quantum
enter into an agreement with Quantum Consulting, Inc. for contract engineering services. Engr Svs
Mayor Rocha asked about bid specifications/bid documents for the proposed new air Rocha
conditioning unit for Memorial Park. Director of Public Works/Assistant City Manager Comments
Makshanoff responded stating that they are being developed at this time and should be
ready tomorrow; in an effort to expedite the process so it can get done by summer, the
specs will be presented along with agenda item to Council with the lowest responsible
bidder.
Moved by Mayor Pro -Tem Hanks, seconded by Councilmember Gonzales and unanimously Proposals
carried that Staff be authorized to solicit proposals for a new air conditioning unit for the AC Mem Pk
Memorial Park Gymnasium Facility.
