The City Council of the City of Azusa met in regular session at the above date and time in the Azusa Auditorium. CEREMONIAL Ceremonial The City Council members presented a proclamation to members of the Azusa Senior Center Proc 201" Advisory Group and Heath Hamilton, Recreation Superintendent, in honor of the 20th Anniversary Anniversary of the Azusa Senior Center. Senior Cntr The City Council members presented Certificates of Recognition to Jousce Gonzalez, 1 1 year Cert of Rec old who won the 2007 Junior Olympics and Danny Martinez, 22 year old who.won all three J. Gonzalez of his boxing matches in Tahiti. D. Martinez The City Council members presented Certificates of Appreciation to the Azusa Pacific Cert of Apprec University students who contributed to the preparation of the "Economic Development in APU students Azusa: A Retail Study of the Azusa Pacific University Community". CLOSED SESSION — PUBLIC COMMENTS Closed Sess Mr. Curtis Napier commented on Closed Session item, Real Property Negotiations for the C. Napier property located at 801 East Alosta, Crestview Apartments, expressing his concern regarding Comments the proposed purchase by Azusa Pacific University and the 375 families which will be affected of which 64 of the families are low income. He questioned the loss of tax revenue and any contract APU may propose with the City, of which he opposes. He also voiced his opposition to the City helping APU with the purchase via bonds. Lastly, he talked about a proposed seven year contract with the families and expressed concern that the families will not be able to afford regular rents if they are displaced. Mr. Mike Lee agreed with Mr. Napier and voiced his opposition to the City helping Azusa M. Lee Pacific University purchase the Crestview Apartments, stating that there is a need to help Comments senior citizens of Azusa with housing. He also noted that Azusa doesn't have a lot of tax base and should not give it up. He stated he opposed APU purchasing the property. Mr. Jorge Rosales expressed his agreement with both Mr. Napier and Mr. Lee stating that he J. Rosales brought this up to Council three meetings prior to this one; he is concerned that APU is Comments ' asking the City to purchase bonds to purchase the property. He stated that this will be for student housing, an APU expansion and that tax revenue will be lost. Mr. Art Morales addressed the same issue and his concern regarding Azusa Pacific University A. Morales purchasing property throughout Azusa. He also expressed concern regarding displaced Comments families. Mayor Rocha called the meeting to order. INVOCATION was given by City Manager Fran Delach. Mr. Danny Martinez led in the Flag salute. Mothers PUBLIC PARTICIPATION Pub Part Mr. Bill Baca, Field Representative for Congresswoman Solis, addressed Council and invited B Baca all veterans and their families to a free appreciation breakfast at American Legion Post 261 Comments on Saturday, May 19, 2007, from 8:00 — 10:00 a.m. at 4542 N. Peck Road, in EI Monte. ' Ms. Laura Jimenez, Field Representative of Assemblyman Ed Hernandez, addressed Council L. Jimenez inviting all to a free Community Health Fair at the Performing Arts Center at the City of Comments Baldwin Park. She also advised that there will be a Spring Forum at the City of Hope on May 17th at 6:30 p.m.; Assemblyman Hernandez will be at both locations on those dates. Recreation Superintendent Health Hamilton addressed Council and audience inviting all to H Hamilton the 12`h Annual Kids Come first Golf Tournament on June 8, 2007 at the San Dimas Golf Comments Tournament. He stated that there are still foursomes left open and sponsorship opportunities; i.e. the donation of $25 by five member committees could be a tee sponsorship and all proceeds go to Zacatecas Park Family Fun and Fitness Enhancement Project. 05/07/07 PAGE TWO Mr. Mike Lee addressed Council expressing his gratitude for the Azusa Police Department M. Lee and Mayor Rocha for responding to the incident regarding toy guns at Powell School; he was Comments grateful that Assemblyman Hernandez Is attempting to pass an Assembly Bill to prohibit the sale of toy guns that look like real guns. He wished all Mothers a Happy Mother's Day and wished the best to all Veterans. Mayor Rocha advised that children in local schools are upset with the toy guns issue and are Mayor In the process of a letter campaign against toy guns and will present It to Assemblyman Comment Hernandez. Mr. Jorge Rosales expressed concern regarding the Rosedale Project, and the destruction of J. Rosales 'over 50 palm trees, the delay of the opening of Sierra Madre; the hauling of soil, which he Comments stated cost 2 million dollars, the creation of massive retaining walls, which deviated from the Specific Plan and the Transit District being all residential and no commercial, also a deviation. He also addressed the Azusa/Arrow Highway property stating that It is owned by the County but the ENA is only with the Agency; the County and Agency rejected four proposals, and now the ENA is only with one developer without competitive RFQ's for the project. Mr. Bruce Knoles addressed Council reminding all that the speed limit in a residential area is B. Knoles 25 mph; he donated goggles for graffiti removal project and provided his business cards. Comments Ms. Stephanie Mills expressed thanks for the donations to the celebration for homecoming S. Mills veterans Little John and Brian Clark from Iraq on Saturday. She expressed concern regarding Comments free yard sales which conflict with the Cinco De Mayo Celebration offered by the City In the last week end of April and she offered suggestions. She expressed concern regarding rent hikes at the Villa Azusa Senior Apartments on Gladstone. She stated that there was a successful tree planning last Saturday and invited all to wall painting on Gladstone this upcoming Saturday at 9:00 a.m. (as corrected). Mr. Dan Simpson addressed Council with a historical overview of prior July 4"' celebrations D. Simpson and the discharge of illegal fireworks to raise awareness. He noted the significant decrease Comments In illegal fireworks with the stiffer laws/ordinances and offered suggestions for getting the information out to the public this year. Mr. Art Morales greeted all in attendance and at home, thank the Falcon's for the Mother's A. Morales Day Tribute, and wished a happy Mother's Day to all mothers of Azusa. He expressed Comments disappointment at Mr. Rosales not being selected to the Downtown North Advisory Committee, talked about the possibility of obtaining free swim for the youth and expressed blessings to American Soldiers. REPORTS, UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF City Manager Delach announced that the Downtown North Advisory Committee will hold its first meeting in the West Wing Conference Room at City Hall on May 14, 2007, at 6:30 p.m. where they will select a Chairperson and establish a schedule of meetings. Mayor Rocha asked if they could select another location and City Manager Delach advised that he would look to see If the Light and Water Conference Room was available. Mr. Delach explained how and why the selection was made for the Downtown North Advisory Committee, and Mayor Rocha commented that Mr. Delach has the total backing of the Council on his formation of the Committee. City Manager Delach advised that Total Quality Management will be meeting with Staff next week on the Issues at the Villa Azusa Apartment; rental rate increases. There will be a full report regarding Fireworks on the first meeting in June. With regard to the ENA at Arrow and Azusa, the City has the full cooperation and support of County Board of Supervisor Gloria Molina and her staff who are in favor of the selection of the Developer for the Exclusive Negotiation Agreement, they have been fully involved In the process and a full RFP was done for the developer selection. Rpts/Updates City Mgr Comments City Mgr Add'I Comments Moved by Mayor Pro -Tem Hanks, seconded by Councilmember Gonzales and unanimously Sponsorship carried to approve $100 sponsorship for Danny Martinez of Azusa Boxing Club, who was D. Martinez selected to go to the Olympics representing Azusa. Mr. Danny Martinez addressed the Council to thank them and all who supported him in his D. Martinez boxing career. Canceled Councilmember Macias wished a Happy Mother's Day to his mother as well as all the mothers in Azusa. He n. -ted that the auditorium cameras and microphones are being worked on and expressed thanks to the Mr. and Mrs. Falcons for their musical Tribute to Mother's. He advised that while attending a wedding in Zacatecas, he invited the Interim Mayor of Zacatecas to attend the City of Azusa's Golden Day celebration in October. He noted the importance of the proposed water rate increase due to the need for upgraded ' Infrastructure, to provide the best possible service and rates to the City of Azusa residents and to replace and maintain equipment; the public hearing will be held on June 18, 2007. Mayor Pro -Tem Hanks commended the Police Department for their response to the incident at Powell school and the toy handgun with special thanks to Officer Andy Sutcliffe. He wished all mothers a Happy Mother's Day, and talked about a recent newspaper article regarding the FTA approving the Ridership Model for the Gold Line; he noted that this has been worked on for nearly a year and cost quite a lot of money to produce. He congratulated Greg Ahern Jr. on his graduation. Councilmember Gonzales suggested that a clock be placed or installed on the podium where public speakers address Council in order to see when the five minute time period has ended, Instead of a beeper sounding the end of the period. City Manager Delach responded advising that staff would look into the feasibility of having a clock. Mr. Gonzales announced the Mariachi Festival at Azusa High school on Friday, May 1 1 th, at 5:30 p.m., noting they are trying to raise $3,000; for further information call Elaine Dominguez at (626) 858 -6182 . He wished all mothers a Happy Mother's Day. Councilmember Carrillo talked about the incident at Powell school and expressed his appreciation to Assemblyman Ed Hernandez who has said he would support legislation to stop the manufacturing of toy guns. He noted the dangers of air guns and the responsibility of parents and/or adults when purchasing the toy guns. He expressed his frustration regarding the speeding vehicles on San Gabriel Avenue between 12 midnight and 2 a.m., ' stating that something has to be done. He congratulated the Park and Recreation Department on the success of the Cinco de Mayo celebration, and expressed his gratitude to Louisa Miranda and her group for the Oral History of Azusa video, and noted its great Importance to the history of Azusa. He wished his mother and all mothers of Azusa, especially to his wife, who will soon be a mother, a very Happy Mother's Day. Mayor Rocha wished all mothers a Happy Mother's Day. He asked that the meeting be adjourned in memory of Victor Z. Vasquez and Peggy Rose. He too expressed his appreciation to the creators of the Oral History of Azusa video, thanked all who participated to the success of the Cinco de Mayo celebration and thanked the Azusa Police Department for how they handled the Incident at Powell school. He announced that on Friday, May 1 1 th, will be the JROTC, Passing Review at the Azusa High basketball courts at 6 p.m. There will be wall painting on Cerritos Avenue with kids from Center school, Christbridge Academy and Brownies helping; they are in need of small brushes and additional volunteers. Azusa Beautiful volunteers will soon be painting vines on the wall which looks like ivy, for more Information go to the website at: azusabeautiful.org. On Saturday, May 12, WOW Jam, Winning Our World, will be held at Azusa High school there will be free gifts, hair cuts, face painting, from 4-8 p.m. On Saturday, May 19' Council will be meeting at the Villa Azusa Apartments from 10 a.m. to noon, to talk about their rent Increases. He Invited his colleagues to welcome Brian Bugayong back from Iraq on Mother's Day at 1 p.m. SCHEDULED ITEMS APPROVAL OF MONROVIA NURSERY GATES PRESERVATION PLAN. Rosedale Project Manager Bruckner addressed the Issue stating that the initial Monrovia Nursery approvals required the preservation of the Monrovia Nursery gates, which are comprised of three structures; he stated that the originally approval state that the gates would be assessed to see if they would be able to be retained. Due to street Improvement plans, a revised Gate preservation Plan was created and presented to the Cultural and Historic Preservation Commission; Mr. Bruckner recited the new conditions of approval as follows: 1. A second gate Is to be constructed to replicate the existing, refurbished entrance gate, so that there will be two gates that lead to the Rosedale Development from Foothill Boulevard, one gate to be attached on the east entrance, and the other on the west exit. 05/07/07 PAGE FOUR Macias Comments Hanks Comments Gonzales Comments Carrillo Comments Rocha Comments Sched Items Monrovia Nursery Gates Preservation Plan Approved 2. Two plaques shall be fabricated and attached to the east and west wing walls of the entrance/exit monument, commemorating the local history. The design of the plaques is to be reviewed and approved by the Commission prior to fabrication and Installation. 3. Lighting is to be installed to illuminate the existing, center Monrovia Nursery monument sign and to Illuminate the two separate plaques on the east and west entrance wing walls. 4. When the buttress walls are removed, the existing bricks shall be salvaged and stored at a location to be determined by the Commission. 5. When the existing rock curbing is removed, it is to be salvaged and stored at a location to be determined by the Commission; and 6. The Commission shall be notified prior to the removal of the buttress wall. Moved by Mayor Pro -Tem Hanks, seconded by Councilmember Macias and unanimously Gate carried to approve the Gate Preservation Plan with conditions of approval as recommended Preservation ' in the Staff Report by Staff and the Cultural and Historic Preservation Commission. Plan appvd APPROVAL OF REVISED PALM TREE PRESERVATION PLAN FOR PALM DRIVE. Rosedale Revised Palm Project Manager Bruckner addressed the issue stating that the initial plan for Palm Drive was Tree adopted and that it called for most of the palm trees south of the railroad track were to be Preservation protected in placed and the palm trees north of the railroad tracks were to be relocated and For Palm Drive place back, but most of the trees did not survive due to drainage and over watering; a new revised plan has been developed. The essence of the revised Plan proposes to retain most of the palm trees, but proposes to plant new trees in the three following locations: Monrovia Place in front Dhammakaya and Monrovia Nursery, Intersection of Palm Drive and the Promenade, and the areas south of the future railroad bridge. He stated that the Cultural and Historic Preservation Commission have come up with seven Conditions of Approval located in the staff report. Mr. Bill Holman of Azusa Land Partners addressed Council detailing the events that led to B. Holman the demise of the palm trees i.e. drainage and over watering. He stated that they tried to ALP save as many trees as possible. He presented the revised plan noting that the plan for the Comments area south of the railroad is essentially the same, but are being backfilled with taller palms, except there are eight locations at the north end just south of the railroad where they will be backfield with the same species, and they will be twenty feet Instead of fifty feet. In the other areas they were unable to relocate taller palms were in the detention basin on 9th ' street; he detailed the proposed revised plan. The area they had a problem with was a five year warranty for the trees. He stated that they will now have new drainage and will be monitored by the two different arborists. He recommends a two year warranty and stated he has the blessings of the Cultural and Historic Preservation Commission. Lengthy discussion was held between Councilmembers, Staff, Arborists, Rosedale Project Lengthy Manager and Mr. Holman ALP regarding the proposed warranty period, a contingency fee, Discussion tree age, value for value, i.e. a fifty foot tree being replaced by a twenty foui tree, cost of planting a tree, the tree life time, replacement and care of the trees, maintenance plan, tree replacement plan, cost of relocation, and in lieu payments. ALP saved $76,500 by not having to transplant the trees that died. Moved by Councilmember Macias, seconded by Councilmember Carrillo and unanimously Palm Tree carried to approve the revised Palm Tree Preservation Plan for Palm Drive with conditions of Preservation approval and to give Mr. Holman of Azusa Land Partners the option of the five (5) year Pian approved warranty or put in a contingency amount of $76,500, to put in a landscape maintenance As amended fund with a one year warranty. Mr. Holman stated that it was a fair option and he would go back to the arborist and negotiate. The CONSENT CALENDAR consisting of Items D-1 through D-13 was approved by motion Consent Cal of Councilmember Carrillo, seconded by Councilmember Gonzales and unanimously carried D-3, 4, 7, 9, with the exception of Items D-1, 3, 4, 7, 9, 10, & 12, which were considered under the 10, 12 Spec Special Call portion of the Agenda. Mayor Pro -Tem Hanks abstained from the approval of the minutes of April 16h, as he was not present at the meeting. 2. Approved Mayor Rocha addressed the Helicopter Agreement with City of EI Monte requesting Rocha clarification regarding a clause about during the first year Azusa not participating with an Comments observer during the first year; Chief of Police Garcia responded stating that City of EI Monte will come and train Azusa which will be an observer during the that first year, he detailed the schedule. Moved by Mayor Pro -Tem Hanks, seconded by Councilmember Gonzales and unanimously Helicopter 'carried that the Seven (7) Day Helicopter Agreement between the City of Azusa and the City Agmt appvd of EI Monte be approved. Councilmember Macias addressed the Final Tract Map referring to the substantial agreements with the proposal development and asked about the major variances that were granted. Director of Economic Development Coleman responded stating the language substantial conformance is a legal term, if the final map is in substantial conformance with the tentative map, that language has to be included, but he stated that he is not aware of any variances from the tentative map to the final map. Moved by Mayor Pro -Tem Hanks, seconded by Councilmember Gonzales and unanimously carried to approve the Final Tract Map No. 54057-11, Magnolia At Rosedale and approve as follows: 1. That this project complies with the General Plan and is consistent with the approved tentative map and any amendments thereto. 2. The dedications as offered on the map for street and public park purposes are hereby approved and accepted. 3. That this project will not violate any of the provisions of Sections 66473.: and 66474.1 of the Subdivision Map Act. 4. The City Council approves and authorizes the City Manager to execute the attached Agreement for Completion of Public Improvements for Tract 5405? 11 to construct the required public improvements. 5. The City Council accepts the attached Faithful Performance Bond in the amount of $165,634, and the attached Labor and Materials Bond for $82,817 for streets, sewers and water lines, and the Faithful Performance Bond of $243,221 and Labor and Materials Bond for $121,610.50 for the construction of Lot G, Ridgeview Park and portion of the Sierra Madre Trail, as guaranteed by Bond Safeguard Insurance Company. 6. That pursuant to Section 66436(a)(3)(A)(i-vii) of the Subdivision Map Act, the City ' Council hereby finds that the development of the property, in the manner set forth on the subject division of land, will not unreasonably interfere with the free and complete exercise of the easements held by Monrovia Nursery Co., Azusa Land Partners, LLC, Azusa Land and Water Co. and Southern California Gas Co., and accepts the map without the signatures of said easement holders. . 7. Conditioning Councilmember Macias and Mayor Rocha addressed the Designation of a Survey Area for Macias the proposed amendment to the Merged Central Business District and West End Comments Redevelopment Project Area asking why California Burgers was Included in the area and the B. Coleman benefits of it being included. Economic Development Director Coleman responded stating Response that it is a survey area and doesn't Indicate that it will be included in the Redevelopment Project Area; they are including enough property in a boundary so it could be studied.
