REGULAR MEETING
MONDAY, OCTOBER 1, 2007 — 6:30 P.M.
The City Council of the City of Azusa met in regular session at the above date and time in the
Azusa Auditorium, located at 213 East Foothill Boulevard, Azusa, CA, 91702.

Counciimembers presented Certificates of Appreciation to the sponsors of the Summer Cert of Apprec
Reading Program — 2007. Summer Rdg
Captain Robert Hook of Los Angeles County Fire Department expressed appreciation to the Cpt Hook
City Council for their cooperation throughout the year. LA Co Fire
Certificate of Appreciation was read for Southern California Edison, Elisa Clifford, who was Cert of Apprec
not present, for their cooperation and efforts at assistance with the Rosedale Power Line SCE
Relocation Project.

Mr. Art Morales addressed items regarding 2 and 3, noting certain deficiencies on the A. Morales
properties.

Ms. Peggy Martinez addressed the site on San Gabriel Avenue and Foothill stating that the Comments
DBA is doing a parking study; she pointed.out that the City has already done one and
discussed it. She suggested Councilmembers Macias and Hanks would like to be a part of
the committee regarding the parking study.

Martinez, AJDM Corporation, D -Club, be brought forward for discussion at this time. Hrg D -Club
Mayor Rocha advised that Mayor Pro -Tem Hanks, who was not in attendance at the Rocha
meeting, requested that this item be continued to October 15, 2007 in order that he be Comments
able to participate in the proceedings. Further, Council received correspondence late in the
afternoon from the appellant and It would give them the opportunity to review it.
Discussion was held between Mr. Martin Kaufman, Counsel for Mr. Martinez of the Club D, Discussion
City Attorney Carvalho and Mayor Rocha regarding the option of continuing the Public
Hearing, appeal process, legal obligations as well as correspondence received by Council
from the Appellant.
Moved by Councilmember Carrillo, seconded by Councllmember Gonzales and carried by roll Public Hearing
call that the Continued Public Hearing on an appeal by David Martinez, AJDM Corp on the Continued
denial of a Cafe Entertainment Permit for property at 975 W. Foothill Boulevard, in Azusa, be To 10/15/07
continued to the City Council meeting of October 15, 2007. Councilmember Macias
dissenting.
PUBLIC PARTICIPATION Pub Part
'Ms. Carolyn Crawford representing the Rotary Club and Committee with representatives C. Crawford
from AUSD, HRC thanked Mayor and Councilmembers for their support of the Teen Comments
Leadership Conference, to be held the last weekend of October for approximately 80 high
school students. The following Friday they will be having a Middle School training, on
leadership and diversity; the emphasis at the Middle School is "Leading Themselves" and for
the High School level is "Leading Others", and the key note speaker will be Julia Chavez
Rodriguez, granddaughter of Cesar Chavez.
Mr. Mike Lee offered comments recognizing local restaurant, Jakes, APU groundbreaking for M. Lee
the Science Building, the need for the City to be business friendly, the Veterans Care Day at Comments
Belvedere Park In ELA, thanked staff for removing graffiti, and among other things expressed
appreciation to Mayor Rocha and Chief of Police Garcia.
Ms. Laura Jimenez,, Field Representative of Assemblyman Ed Hernandez, presented a L. Jimenez
Summary Report of the Public Safety Summit held on Gang Prevention and Intervention on Comments
June 29, 2007. She also announced that Assemblyman Hernandez will be hosting an
Education Summit on Declining Enrollment, Saturday, November 10, 2007, from 9:00 a.m. —
12:00 p.m. at Royal Oak Middle School in Covina.
Mr. Robert Aschenbrenner addressed Council noting the cars parked along the west side of Aschenbrenner
Citrus, south of Foothill Boulevard, present serious problems for cars going by southbound of Comments
Citrus; there is little room to go through there. Further, he stated, with regard to Rosedale
project egress, there Is a need for a turn signal at Citrus and Foothill Boulevard especially
' coming from the south; when school is in session there is traffic backed up. City Manager
Delach responded that staff Is aware of the parking problem on Citrus and it will be
eliminated. He stated he will get back with him regarding the turn signal.
Mr. Jorge Rosales addressed Council voicing his agreement with Councilmember Macias'
voted on item C-1, D -Club, stating that the item should have been discussed at this meeting. J. Rosales
He expressed his enjoyment over the commencement of the Foothill Center Project and Comments
hopeful that Block 36 is coming soon. If there are any problems he hopes the council
addresses them soon without delay.

Mr. Art Ramirez, Chairman of the Azusa Golden Days Committee, addressed Council and Art Ramirez
audience providing the following Event Calendar for Golden Days Week: Saturday, October Chairman

Run/Walk, Chalk Festival Awards Presentation and Celebrity Softball Game; Tuesday, October Days

Breakfast and Azusa Golden Days Parade. He announced Grand Marshall — Stella Stevens,
and Super Grand Marshals Mickey and Murray Hirota who thanked the Committee. Mr.
Ramirez asked Council and City Manager to distribute badges along the parade route and
also stated that the LA County Fair Azusa's Days was a success.
Ms. Linda Bean, member of the Golden Days Committee introduced Honored Citizens L. Bean
Barbara Welker and Don Flowers who both thanked all for the nomination. Comments
Parade Chairman Joe Guarrera, announced that there will be thirteen bands In the parade, J. Guarrera
noted that the printed program is being dedicated to Mr. Don Clark, vehicles have been Comments
obtained for all Council, Congresswoman Hilda Solis will be in the parade and it begins at 11
a.m.
Mr. Art Morales announced that Nanas Ice Cream received four Blue Ribbons at the LA A. Morales
County Fair this year, he requested a presentation regarding the Drought Ordinance, Comments
expressed concern regarding walls on the property parkway, he will be taking complaints, he
Is in favor of restrooms at Rosedale parks, asked about environmental issue and eminent
domain.
REPORTS. UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF
Rpts/Updates
Mr. Tom Wulf of Lowe Enterprises provided an update on the status of Block 36 and T. Wulf
responded to questions posed by Councilmembers regarding anchor stores, DDA, plan Low Enterprise
checking, B of A, groundbreaking, and sprinklers. Update
Councilmember Carrillo announced the birth of his new daughter, Sofia Camilla Carrillo, Carrillo
weighed 6lbs 4 oz, 18 inches long, with a full head of hair; he expressed his joy and thanked Comments
all for well wishes.
Councilmember Gonzales wished good luck to Gladstone football players and invited all to Gonzales
Azusa Freshman Football game at Memorial Parks at 6:00 p.m. on Thursday, October 4'h, Comments
and reminded all about the Sunday, October 7`h game against CS1 team and noted
Councilmembers from other cities, i.e. Peggy Delach (Covina), Mike Touey, (West Covina),
John Solis (La Puente), and Mark Breceda (Irwindale).
Councilmember Macias invited all to the 5K Run, noted the Mayor of Zacatecas will be Macias
attending Golden Days events, and he shared the experience of attending another City's Comments
Council meeting and noted in comparison to Azusa who keeps their citizens informed.
Mayor Rocha asked that the meeting be adjourned in memory of Joe Meza, a long time Rocha
resident of Azusa. He announced Jack Pot Bingo at Memorial Park: on Saturday, October Comments
6`h, Veteran's Care Day, Jesse Barajas will be receiving certificates and medals due to him;
Nicholas Miguel Ortiz will be honored in San Marino with his Eagle Scout badge on Saturday;
October 27 will be the Poverty Summit at Senior Center from 9 a.m. — 12:30 p.m.; and
announced a raffle of a replica orange crate to raise funds for students of Sierra High school.
City Manager Delach announced that City Staff will be available at Memorial Park, after the City Mgr

URGENCY ORDINANCE AMENDING DIVISION 6 OF ARTICLE VI OF CHAPTER 78 OF THE Urgency Ord
AZUSA MUNICIPAL CODE REGARDING WATER CONSERVATION. Wtr Conserve
Director of Utilities Hsu presented the Urgency Ordinance regarding the drought and water J. Hsu
conservation, requesting that certain sections of the existing ordinance be amended due to Dir of Utilities
many changes that are impracticality and unable to implement.

He summarized changes as follows: Phase 11 - residential customers limit to watering only
two days a week on Sundays and Thursdays, street address number ending in an even
number (0,2,4,6 or 8), and on Saturdays and Wednesdays for customers with a street
address number ending in an odd number (1,3,5,7 or 9), Phase Iii — residential customers
limit to watering only one day a week, Sundays for customers with a street address number
ending in an even number (0,2,4,6 or 8), and on Saturdays for customers with a street
address number ending in an odd number (1,3,5,7 or 9), commercial customers two days a
week Tuesday and Friday. There will be fines for violations of the ordinance by a water
patrol, fines are as follows: residential, very first is a advise, first violation $50.00, second,
$100.00, third $200.00 fourth $200, plus termination of water service. Commercial will
receive many verbal warnings and if they don't comply first violation $100.00, second
'$300.00 third $600.00, fourth violation $600.00 plus termination of water service. The
customer may be subject to up to 50% of surcharge of the water used above and beyond
what is required curtailment.

City Attorney Carvalho responded to question regarding the difference between an infraction City Attorney
and a misdemeanor stating that the difference in terms of the levels of the violation; an Comments
infraction may be a fine, and a misdemeanor may be a fine and Jail.
Mayor Rocha asked that the notices regarding the drought be sent home with (all) school Rocha
kids and in Spanish. Additional discussion was held regarding where we get Azusa water and Comments
why it may be different in other cities and the many obstacles the City faces. It was also
noted the City has assistance program that can help customers for converting their irrigation
system like Drip System and artificial turf.
Director of Utilities Hsu announced that there will be a meeting on Thursday at 8 a.m., with Hsu
fifty (50) large water users to talk about how they can conserve water, as savings from those Comment
customers will save significant impact on water usage.

The CONSENT CALENDAR consisting of Items D-1 through D-12 was approved by motion of Consent Cal
Councilmember Gonzales, seconded by Councilmember Macias and unanimously* carried items
with the exception of Items D-8 and D-9, which was considered under the Special Call
portion of the Agenda. Councilmember Carrillo abstained from the minutes as he as not
present at that meeting.

exceed $164,883.93; approval was based on a competitive bid process completed by
the Los Angeles County Sheriff's Department, Contract #31080234 that covered a
total of 350 Ford Interceptor vehicles.

5. Approval was given for the purchase of seven Code -3, 2100 Series emergency light Purchase Light

6. The following was approved with regard to the Final Tract Map No. 63336-2, Mapleton
at Rosedale: 1. That this project complies with the General Plan and is consistent with the
approved tentative map and any amendments thereto. 2. That this project will not violate any
of the provisions of Sections 66473.5, 66474.1, and 66474.6 of the Subdivision Map Act. 3.
The dedications of easements for Police and Fire Department and pedestrian access purposes,
public utility purposes including water, sewers and storm drains, and Lot A in fee simple for park
and recreation purposes, as offered on the map, are hereby accepted. 4. The City Council
approves and authorizes the City Manager to execute the attached Agreement for Completion
of Public Improvements for Tract No. 63336-2 to construct the required public improvements
and also accept the attached Faithful Performance Bond in the amount of $565,467.49, and the
attached Labor and Materials Bond for $282,733.74 as guaranteed by Arch Insurance Company.
5. That the City Council approve and authorize the City Manager to execute the attached
Agreement to construct the required landscape improvements and also accept the attached
Faithful Performance Bond in the amount of $70,796 and the attached Labor and Materials
Bond for $35,398 as guaranteed by Arch Insurance Company. 6. Make a finding that, pursuant
to Section 66436(a)(3)(A)(1-vii) of the Subdivision Map Act, the development of the property, In
the manner set forth on the subject division of land, will not unreasonably interfere with the free
and complete exercise of the easements held by Monrovia Nursery Company and accepts the
map without the signatures of said easement holders. 7. Approve Final Tract Map No. 63336-
2, and 8.Authorize the City Clerk to endorse on the face of the maps the certificates, which
embodies the approval of said maps and acceptance of dedication of easements for Police, Fire
Department and Pedestrian Access Purposes, Public Utility purposes including Water, Sewers
and Storm Drains, and Lot A in Fee Simple for Park and Recreation Purposes as offered on the
map.
7. Approval was given for the bond reduction request by Azusa Land Partners for Tract
54057-01, 54057-09, 54057-11, 54057-19 and 63336-01. TRACTS 54057-01
(BACKBONE STREETS), 54057-09 & 19 (EDGEMONT), 54057-11 (MAGNOLIA) AND

10. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING THE Res. 07-C81,
MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY AND THE AZUSA POLICE MOU APOA
OFFICERS ASSOCIATION EFFECTIVE AUGUST 1, 2007, THROUGH JULY 31, 2010.
11. Approval was given for the Notice of Completion for the construction of the Pioneer
Park Gazebo Shelter Project as completed by AH Contractors and Heisler Landscaping,
Inc. in the amount of $93,299.84 and authorization was given to staff to file the Notice
of Completion with the Los Angeles County Clerk

Councilmember Macias addressed item regarding specification for janitorial Seivices asking if Macias
it would make sense to allow each department to independently obtain its own janitorial Comments
service via the bidding system.
City Manager Delach responded stating that the Public Works Department handles the City Mgr
bidding for Janitorial Services and it's an economics of scale issue with better pricing if the Response
' service is bid for the whole City.
Moved by Councilmember Gonzales, seconded by Councilmember Macias and unanimously Specification
carried that the janitorial Specifications be approved and the City Clerk be authorized to janitorial
commence advertisement and the formal bidding procedure.
Councilmember Gonzales addressed the Concrete Management Plan asking if the City could Gonzales
consider Azusa companies "first". City Manager Delach responded that there is preferential Comments
language in the process and will make a sure all local contractors are aware of the bid: City Mgr

City Attorney Carvalho reminded Council that the City is limited under the California Public City Attorney
Works Laws that when a project is defined as a Public Works Project, depending on its size Comments
and whether it's maintenance or construction, the City has absolutely no choice in the
matter, it is preempted, but there are provisions in the City's ordinance that says when a
contract is not a Public Works Contract, the City can give local preferences based on
percentages, size of the project and amount.
Moved by Councilmember Gonzales, seconded by Councilmember Macias and
unanimously* carried that the City Clerk be authorized commence advertisement and the
formal bidding procedure for a Concrete Management Plan; contract will include an option
