The City Council of the City of Azusa met in regular session at the above date and time in the Azusa Auditorium, located at 213 East Foothill Boulevard, Azusa, CA, 91702. Monrovia Mayor Robb Hammond addressed Council presenting a plaque to the City of Azusa and its residents in appreciation of the support from the Azusa Police Department for the City of Monrovia during it's time of trouble. City Attorney Comments Mayor Pro -tem Carrillo called the meeting to order. Call to Order Chief of Police Bob Garcia led in the Salute to the Flag. Flag Salute INVOCATION was given by Pastor Samuel Martinez of Christian Faith Center of the Valley. Quiroz, Administrative Services Director -Chief Financial Officer Kreimeier, City Clerk Mendoza, Deputy City Clerk Toscano. 11/17/08 PAGE TWO PUBLIC PARTICIPATION Pub Part Mr. Mike Lee addressed Council with comments as follows: prayers and well wishes to Linda Rocha and M. Lee Mayor Rocha; expressed concern for fire victims; Veterans Day observation; Food Banks need food; good Comments luck to candidates in the March 91h election; support local businesses; and to pray for troops. Mr. Victor Flores addressed Council expressing his disappointment regarding the Homeowners Assistance V. Flores Workshop held at the Senior Center and requested genuine aid for people in Azusa who are losing their Comments homes; he stated the workshop was misleading. Mr. Nick Rosales addressed Council expressing his frustration with the workshop held regarding home N. Rosales foreclosures and relayed his experience at the workshop. He stated that there is a need for proper forms Comments and that he is willing to conduct a "how to" free workshop on loan modification. He requested that the city provide him with a facility and copier in order that he may help people. Mr. Mark Smith, a proponent of the Gold Line, addressed Council in favor of the City of Azusa's support M. Smith for the Gold Line extension. Comments Mr. Art Morales addressed Council commenting on the following: Homeowners Assistance Workshop; the A. Morales Veterans Monument in City of Irwindale; concern for fire victims and wished all a Happy Thanksgiving. Comments Mr. Dennis Willut addressed Council with comments as follows: a crisis at 741-743 Soldano; Azusa Light and Water access to a utility pole/locked panel box; Cable Television; scarred landscape; broken irrigation D. Willut system and loans. Comments REPORTS UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF Rpts/Updates City Manager Delach expressed appreciation to City employees who participated in the Azusa Rocks 11, City Mgr Earthquake Exercise on November 13, 2008. Comments Moved by Councilmember Gonzales, seconded by Councilmember Macias and unanimously' carried to Sponsorship approve sponsorship in the amount of $100 each for two students of Azusa High Drama Club to go to New Two Drama York in August 2009. Studens AHS Moved by Councilmember Macias, seconded by Councilmember Hanks and unanimously' carried to Proc to the approve request for proclamation to Mr. James and Mrs. Marge Wall for the many years of service to the Walls for sys City as precinct workers and for sharing their home as a polling place. to City Moved by Councilmember Hanks, seconded by Councilmember Gonzales and unanimously carried to Cert Criterion approve request for certificate of appreciation to Criterion Catalysts & Technologies in Azusa, CA for their Catalysts contribution of $6,400 to the Azusa City Library for use with the Library's new bookmobile service and Contribution operation. Library Councilmember Gonzales praised the Azusa City Employees for the excellent American Shake Out Drill. Gonzales He asked about a contingency plan for Mountain Cove if the bridge goes out. City Manager Delach Comments responded stating that there is high ground area of which residents will be directed. Mr. Gonzales wished all a Happy Thanksgiving from himself as well as the Rocha Family from Mayor Rocha. Councilmember Macias requested that staff look into the bollard lights which are out at Rancho Park; to Macias assist American Little League in repairing their lights; look into the feasibility of expanded the bathroom Comments facilities at Zacatecas Park and/or possibly placing it in the CIP for next year or following year. He announced that he is the Treasurer and Secretary of the Gold Line Joint Powers Authority and with the passage of Measure R, they will work towards getting the Gold Line extension from Pasadena to Azusa. He talked about his tour of the waste management facility and their long term goals; the disappointment of the mortgage workshop held on November 12°i on Saving the American Dream, and a new workshop he and Library Director Tovar are working on, and inquired about the payment to California Resource Connections in compliance with the MOU. City Manager Delach responded that they will issue funds as they were awaiting a final report. He wished all a Happy Thanksgiving. Councilmember Hanks expressed best wishes to people affected by the fire and to all a Happy Hanks Thanksgiving. Comments Mayor Pro -Tem Carrillo wished prayers to Joe and Linda Rocha,.the fire victims, and his father, reminding Carrillo all of the bad air quality. He wished all a Happy Thanksgiving and reminded all that kids will be out of Comments school during the holidays. 11/17/08 PAGE THREE Sched Items PUBLIC HEARING - ORDINANCE AMENDING CHAPTER 30 AZUSA MUNICIPAL CODE AND 2008 Fire Code ADOPTION OF THE 2008 FIRE CODE OF THE LOS ANGELES COUNTY CODE Prop Ord Mayor Pro -Tem Carrillo declared the hearing open. City Clerk Mendoza read the affidavit of proof of Hrg open publication of notice of said hearing published in the San Gabriel Valley Tribune on October 301h and November 6th, 2008. Economic and Community Development Director Christianson addressed the issue stating that this is a Com Dev Dir revision to the Azusa Municipal Code which adopts the Los Angeles County Fire Code by reference which Christianson hasn't been updated since 1871. The new amendments within the 2008 Fire Code require more restrictive Comments building standards within the Very High Fire Severity Zones and will protect homes in Azusa requiring sprinklers, fuel modifications, etc. Mr. Art Morales addressed the Public Hearing reiterating the need for high standards in the foothill areas. A. Morales Fire Battalion Chief Bob addressed the Public Hearing noting the importance of complying with die Fire Battalion .standards, especially those that live within High Fire Severity zones, of which the City adopted maps in Chief Comment June of 2008. Moved by Councilmember Gonzales, seconded by Councilmember Hanks and unanimously* carried to Hrg Closed close the Public Hearing. Councilmember Macias offered an Ordinance entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA ADOPTING BY REFERENCE THE 2008 FIRE CODE OF THE LOS ANGELES COUNTY CODE AND AMENDING AZUSA MUNICIPAL CODE SECTION 30-36 AND ADDING SECTION 30-37. Moved by Councilmember Macias, seconded by Councilmember Hanks, to waive further reading and adopt. Ordinance passed and adopted by the following vote of the Council: AYES: COUNCILMEMBERS: GONZALES, CARRILLO, MACIAS, HANKS " NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: ROCHA PUBLIC HEARING — EXPENDITURE PLAN — STATE AWARDED GRANT FUNDS. Ord 08-C 11 Adopting LA Co. Fire Code by Reference Pub Hrg COPS Mayor Pro -Tem Carrillo declared the hearing open. City Clerk Mendoza read the affidavit of proof of Hrg Open publication of notice of said hearing published in the Azusa Herald on November 6, 2008. City Manager Delach addressed the hearing stating that the total grant is $100,000, with carryovers in the City Mgr amount of $6,781. He responded to question regarding the helicopter program slating that the cost will Comments cover training, purchase of a helmet, flight suit and miscellaneous supplies for services from the City of El Monte. Chief of Police Garcia responded to questions stating that they will be purchasing 33 hand held radios. He COP Garcia took the opportunity to recognize Emergency Services Coordinator Olga Bruno, for the success of the Comments Earthquake drill on Thursday, November 13th. Mr. Art Morales praised the Azusa Police Department for the work they do and the need for the helicopter A. Morales service program. Comments Moved by Councilmember Gonzales, seconded by Councilmember Hanks and unanimously* carried to Hrg Closed close the Public Hearing. Moved by Councilmember Gonzales, seconded by Councilmember Macias and unanimously* carried to COPS Program include appropriations of funds to be received from the State Citizens' Option for Public Safety Program Approved ' (COPS) and approve the proposed expenditure plan and purchases. The anticipated funding from this program is $100,000. The proposed expenditure plan is detailed and also includes $6,781 in carryover funds from FY 07/08. The CONSENT CALENDAR consisting of Items D-1 through D-7 was approved. by motion of Consent Cal Councilmember Hanks, seconded by Mayor Pro -Tem Carrillo, and unanimously* carried with the Approved exception of items D4, D-5, and D-6, which were considered under the Special Call portion of the Agenda. The minutes of the regular meeting of November 3, 2008, were approved as written. Min appvd 2. The following resolution was adopted and entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN 08-C109 CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME Warrants ARE TO BE PAID. SPECIAL CALL ITEMS Spec Call Items Councilmember Gonzales addressed the Exchange Agreement clarifying that it was only a transfer of Gonzales funds. Director of Public Works/Assistant City Manager Haes responded stating that it is only a swap of Comments STP -L funds for flexible LACMTA funds and there are no new projects. Moved by Councilmember Macias, seconded by Councilmember Hanks and unanimously carried to Exchange Agmt approve the Exchange Agreement and assignment of Federal Surface Transportation Program - Local STP - (STP -L) funds and its execution was authorized Councilmember Gonzales addressed proposed resolution establishing the compensation and benefits for Gonzales non -represented positions asking if they get the same as a City employee if terminated. City Manager Comments Delach responded clarifying that the resolution is for confidential positions in the City which are tied to certain MOU's i.e. AMMA, ACEA. He.and the City Attorney defined confidential employees and noted they are not employees which are on contract. Councilmember Macias offered a Resolution entitled: ' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, Res.08-C107 ESTABLISHING THE COMPENSATION AND BENEFITS FOR NON -REPRESENTED POSITIONS. Comp & Benefil Non -Reps Moved by Councilmember Macias, seconded by Councilmember Hanks, to waive further reading and " adopt. Resolution passed and adopted by the following vote of the Council: AYES: COUNCILMEMBERS: GONZALES, CARRILLO, MACIAS, HANKS NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: ROCHA Councilmember Macias addressed the Amendment to the Capital Improvement Plan and reminded staff to Macias look into the feasibility of placing a bathroom expansion at Zacatecas Park in the CIP budget in the near Cormnents future. He also asked what the traffic signal modifications entailed and City Manager responded that they were traffic improvements in the Downtown North and synchronization, etc. Councilmember Macias offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING Res.08-C108 APPROPRIATION AMENDMENTS FOR FISCAL YEAR 2008./09 PURSUANT TO SECTION 2450 Appro. Amend OF THE AZUSA MUNICIPAL CODE. (The Capital Improvement Plan will also be amended and reflect the Redevelopment, Agency of the City of Azusa as the funding source for the proposed projects.) Moved by Councilmember Macias, seconded by Councilmember Hanks, to waive further reading and adopt.
