The City Council of the City of Azusa met in regular session at the above date and time in the Azusa Auditorium located at 213 E. Foothill Boulevard, Azusa, CA 91702. Cortez regarding the housing element and asking for additional time to hear additional input. Martinez everyone to the Memorial Park 60th Anniversary; events will be held at Memorial Park on July 25, 2009, Mem Pk 601h from 6:00 to 8:00 p.m.; she further thanked the committee and all who were involved in making this event Anniversary possible. Ms. Peggy Martinez addressed Council thanking all who attended and coordinated her retirement party to P. 'City Manager Delach, responded to statement made by Mr. Cortez, stating that staff has been working with F. Delach consultants, on the housing element for the homeless; since the last joint meeting, the comment period was Housing extended, Mr. Cortez was notified of all meetings held, but no comments have been received from him. Element Only few cities in Los Angeles County have adopted the housing element, and a draft from Azusa will be & homeless sent to the State Department of Housing by the end of this week. There will be time for public comment in shelters future planning and council hearings. The city has been working together with the County and San Gabriel Council of Governments, not only on the housing element, but the homeless shelter issue to which the County is taking the lead and will be making recommendations on shelter locations to all the cities that are involved in this process. Economic Development Director Christiansen added that because this is a general plan amendment, state law requires two additional public hearings be held, at which time there will be an opportunity for additional testimony by residents; he further invited everyone to participate. City Attorney Carvalho responded to statement made by Mr. Rosales regarding the adoption of resolution S. Carvalho on Minor Use Permit, explaining that the state regulations are separate from the city, if a state violation is MUP made, the city has the responsibility to refer it to the proper state authority; however, the city can only rule 526 Russell on land use regulations; the state citation imposed on the day care, was not within the city's preview to enforce. REPORTS, UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF Rpts/Updates City Manager Delach, acknowledged Mayor Pro -tem Macias and Councilmember Hanks who are actively Delach involved with the Gold Line, and commended Councilmember Carrillo who was named first vice president recognition the San Gabriel Valley Council of Governments and was installed first vice president of the League of to cncl for California Cities Los Angeles Division, emphasizing the need to recognize their work in representing the regional 'of community regionally. representation City Manager Delach, announced that the state is getting close to a state budget agreement that will take Delach away about 4 billion from cities; Azusa will be affected by the state taking away $800,000 on highway user state budget gas tax funds, which is used for street maintenance, and $350,000 to $500,000 from Redevelopment affecting Agency, and by Proposition 1 A, which the extend of this proposition is not known. The League of city California Cities and the California Redevelopment Association have committed to take legal action on behalf of the cities against the state for taking these actions. Mayor Pro -tem Macias, announced that he will be out of town and will not be attending the Utility Board Macias Meeting of July 27; Council authorized him to request donations to purchase military, national guard and announcements coast guard flags to be displayed in the auditorium; announced that on Saturday July 25, the California Conservation Corp and Azusa Beautiful will be helping in the cleaning of the on/off ramp referred as the triangle, located on First and Azusa behind the VFW Building, starting at 11:00 a.m., all 18 years and older are invited to help; Councilmember Gonzales has been working with him on a project they presented to the Chamber, to start the Silver Nights in Azusa next September, this will be a night show tasting in different restaurants in the city, shuttles and a caravan will go from restaurant to restaurant and there will be live entertainment in different sites. Council Member Hanks, with Council's approval, directed staff to prepare a proclamation for Ben Wallace Hans who will be receiving his Eagle Scout Award, on July 24, at 7:00 p.m., 1645 N. San Gabriel Canyon Rd.; request proclo announced that last Friday he attended a march gathering of city, county and school officials, in B Wallace & 'Sacramento, sponsored by the City Counties Equal Partnership, League of California Cities, California announcements State Association of Councils, California School Board Association and approximately 400 to 500 local officials, to look at the state's budget crisis and give some advise, and the strongest message to state legislation was that the local revenue sources need to be protected. He requested donation for soldiers in Afghanistan, items can be delivered to the City Clerk's Office up until Friday August, 7, 7:00 p.m. when the items will be delivered to the VFW; directed staff, with Council's approval, to send a $100 donation to Candace Wear to attend Fullerton Wrestling Camp; he then introduced Mr. Ed Chavez from the Upper San Gabriel Municipal Water District. Mr. Ed Chavez, Treasurer and Mr. Al Contreras, President, for the Upper San Gabriel Municipal Water SGVMWD District, spoke on the work that has been done in the past and what is planned for the future, and explained representatives that they are working on starting the Ground Water Reliability Improvement Program (GRIP), a project that will cost $300 million dollars for the next 5 to 10 years, and the program is to reclaim and recycle water in the community; due to the high increase of water cost, there is a need to become more dependent of our water and recycle it and hope that with the slow down of the economy, it will be an opportunity to up on the water industry. 'improve City Manager Delach, addressed item regarding the citywide cooling center policy, explaining that the Delach city's current cooling centers are the Sr. Center, Memorial Park and Library which are open between 12:00 cooling and 4:00 p.m., during the hottest hours of the days, Memorial Park is currently open on weekends and the center Library on Saturdays; he requested authorization to activate the cooling centers and to open the Sr. Center on Sundays when the Library is not open, to ensure availability. Moved by Councilmember Carrillo, seconded by Councilmember Gonzales, and unanimously carried, to Apvd to authorize City Manger to activate cooling centers when the National Weather Services Forecasts activate temperatures is in excess of 100 degrees, to open Memorial Park on weekends and holidays, the Library on cooling Saturdays and holidays and the Senior Center on Sundays and holidays, between 10:00 a.m. and 4:00 p.m. centers SCHEDULED ITEMS Sched Items PUBLIC HEARING — CITYWIDE ART IN PUBLIC PLACES POLICY MANUAL Pub Rig art in publ Economic and Community Development Director Christianson addressed the hearing explaining that they places have been working with Council and Planning Commissioners in putting together the policy and the draft ordinance being presented include changes requested by council; he addressed the 6 month referral of the ordinance, the creation of a new committee, and language regarding stolen and vandalized art. The Mayor declared the Hearing open. City Clerk read the proof of publication of notice of said Hearing Hrg open published in the San Gabriel Valley Tribune on July 9 and 15, 2009. Ms. Peggy Martinez, addressed the hearing noting that the Target site and Lewis Developer are not P. Martinez required to comply with the public art ordinance, because the developments have already started and asked comments who will be responsible for this area, and if the new developers and the ones who are being negotiated will be included; she expressed her concern of the adoption of this ordinance due to the current economic situation, and asked Council not to rush into approving it. Director Christiansen responded that the Target project already has an agreement in place, and it is not Christiansen subject to this ordinance; Lewis Developer has not been finalized, and if they are subject to this ordinance respond to it will be included on the agreement; Block 36 would fall under this ordinance only if there was a re- questions entitlement; he further stated that the deferral of this ordinance is for 120 days. 07/20/09 PAGE THREE Moved by Councilmember Carrillo, seconded by Councilmember Gonzales and unanimously carried to Hrg Closed close the Public Hearing. Resolution passed and adopted by the following vote of the Council: AYES: COUNCILMEMBERS: GONZALES, CARRILLO, MACIAS, HANKS NOES: COUNCILMEMBERS: ROCHA ABSENT: COUNCILMEMBERS: NONE HEARING — FOR THE CLOSURE OF A PEDESTRIAN WALKWAY BETWEEN CITRUS Pub Hrg 'PUBLIC AVENUE AND VICEROY AVENUE. closure of walkway Public Works/Assistant City Manager Haes addressed the hearing explaining that the walkway connecting btwn Viceroy Avenue to Citrus Avenue, was constructed in 1964 with the granting of a 25 year easement Citrus & through property owner at 236 N. Viceroy and in 2001, the easement was renewed on a permanent basis. In Viceroy the past few years there has been an increase in policing as a result of residents reporting illegal activities that include fighting, littering, graffiti, noise, transient sleeping, drug use, and it has become an issue for Public Works as well as Police Department. The Mayor declared the Hearing open. City Clerk read the proof of publication of notice of said Hearing Hrg open published in the San Gabriel Valley Tribune on July 9, 2009. Testimony City Clerk Mendoza announced that she received two letters opposing the closure of the walk way, one Letter opposing from Mr. David Hendricks, and one from the Azusa School District, which she read in its entirety for the closure record, per Mayor Pro-tem's request. Lengthy discussion was held between Council and staff on the issues that are affecting the walkway and the Discussion use, talked about alternative solutions such as scheduling additional cleaning by L.A. Works, getting the School District to participate and assist financially in the upkeep and find an alternative route for pedestrians to use. Works staff. PUBLIC HEARING — APPEAL OF POLICE DEPARTMENT DECISION TO DENY A REQUEST FOR Pub Hrg CAFE ENTERTAINMENT PERMIT NO, CE 2008-01, LOCATED AT 347 S. IRWINDALE AVENUE, appeal entertain AZUSA, APPELLANT: MARCO A. ORE, (OWNER OF CASA BLANCA BAR). cafe 347 Irwindale Economic and Community Development Director Christiansen addressed the hearing explaining that due to the application filed by Mr. Ore for a live entertainment permit, he made an investigation, and after reviewing the police department investigation report, and based on their findings, he is making a recommendation to deny the permit. City Attorney Carvalho explained that the business currently holds a permit to operate as a bar, which was Carvalho violated, and the owner was encouraged to apply for a live entertainment permit; however, due to the many comments violations, it is recommended that the live entertainment permit be denied for health and safety reasons. The Mayor declared the Hearing open. City Clerk read the proof of publication of notice of said Hearing Hrg. open published in the Azusa Herald on July 9, 2009. Mr. Al Galamidy, representative for business owner Mr. Marco Ore, addressed the hearing explaining that A Galamidy on August 22, 2008, Mr. Ore purchased this business and since he opened it, he has been in compliance on behalf of with licensing required to operate, keeps armed guard on the premises during operations, a taxi driver on owner staff, keeps the area clean, and that all violations that are stated on the police report are from the previous owner. If approved, the owner is willing to hire additional security guards to insure compliance. The main reason for this request is because the owner is trying to compete with surrounding business to keep his afloat; he further requested the possibility of a temporary permit so that the owner can prove that 'business he can run a safe business. Mr. Luis Valdez and Mr. Juan Contreras, addressed the hearing in support of the permit, and explained that L Valdez & J their job consists of driving people to their home as a safety precaution, and keeping the place clean. Discussion was held among Councilmembers regarding health and safety issues, known narcotics in this location, illegal activity at the bar; they suggested that instead of granting a temporary permit, the owner should improve the safety and stop the illegal activity, and then reapply for a permit. Due to the nature of the items, there is a need to have all commission members present and who are un -conflicting. Lengthy discussion was held between Council, City Attorney and staff on the removal or re -appointment of Discussion current commissioners, major potential projects that are coming up, the need to have complete non- re planning conflicting commissioners who will be making decisions that will impact the community and the region, commission the current open positions, the possibility of reviewing existing positions, alternative approaches to keep positions the current commissioners by re -applying, and the importance of having a policy in place to train new and re-train existing commissioners. 'Moved by Councilmember Hanks, seconded by Mayor Pro -tem Macias, to advertise for applications to fill Appv to the open planning commission positions including automatic renewal applications by the sitting advertise commissioners with the intention to hold interviews by the end of August and re -staff planning for planning commission, either with existing commissioners whose terms continue or new ones, but will interview for comm. positions all five positions. Approval was given for the issuance of a purchase order in an amount not to exceed $16,562, to Purch Konica Konica Minolta Business Solutions of Anaheim, CA, for the purchase of a Konica Minolta BizHub copier for 750 digital document imaging center, under the provisions of A.M.C. Section 2-523 (e), competitive WW bidding already completed (California Multiple Award Schedule (C.M.A.S.) Contract number 3-02- 36-0052A.) 5. Approval was given for the disposal of two (2) surplus dump trucks, one (1) surplus Ford van, two (2) Disposal of surplus Johnson sweepers, and two surplus Ford Crown Victoria Police vehicles in accordance with surplus vehicles Section 2-525(b) of the Azusa Municipal Code 6. The Notice of Completion for the construction of the Zacatecas Park Picnic Facilities Improvements in NOC Zac the amount of $74,790 was approved and authorization was given to staff to file the Notice of Pk picnic Completion with the Los Angeles County Clerk. imprvmnts 7.
