REGULAR MEETING
MONDAY, JULY 20, 2009 — 6:30 P.M.
The City Council of the City of Azusa met in regular session at the above date and time in the Azusa
Auditorium located at 213 E. Foothill Boulevard, Azusa, CA 91702.

Mr. Dick Cortez addressed council speaking on behalf of the homeless requesting additional information D. Cortez
regarding the housing element and asking for additional time to hear additional input. Hsg Element

Ms. Peggy Martinez addressed Council thanking all who attended and coordinated her retirement party to P. Martinez

'City Manager Delach, responded to statement made by Mr. Cortez, stating that staff has been working with F. Delach
consultants, on the housing element for the homeless; since the last joint meeting, the comment period was Housing
extended, Mr. Cortez was notified of all meetings held, but no comments have been received from him. Element
Only few cities in Los Angeles County have adopted the housing element, and a draft from Azusa will be & homeless
sent to the State Department of Housing by the end of this week. There will be time for public comment in shelters
future planning and council hearings. The city has been working together with the County and San Gabriel
Council of Governments, not only on the housing element, but the homeless shelter issue to which the
County is taking the lead and will be making recommendations on shelter locations to all the cities that are
involved in this process. Economic Development Director Christiansen added that because this is a general
plan amendment, state law requires two additional public hearings be held, at which time there will be an
opportunity for additional testimony by residents; he further invited everyone to participate.
City Attorney Carvalho responded to statement made by Mr. Rosales regarding the adoption of resolution S. Carvalho
on Minor Use Permit, explaining that the state regulations are separate from the city, if a state violation is MUP
made, the city has the responsibility to refer it to the proper state authority; however, the city can only rule 526 Russell
on land use regulations; the state citation imposed on the day care, was not within the city's preview to
enforce.

City Manager Delach, announced that the state is getting close to a state budget agreement that will take Delach
away about 4 billion from cities; Azusa will be affected by the state taking away $800,000 on highway user state budget
gas tax funds, which is used for street maintenance, and $350,000 to $500,000 from Redevelopment affecting
Agency, and by Proposition 1 A, which the extend of this proposition is not known. The League of city
California Cities and the California Redevelopment Association have committed to take legal action on
behalf of the cities against the state for taking these actions.
Mayor Pro -tem Macias, announced that he will be out of town and will not be attending the Utility Board Macias
Meeting of July 27; Council authorized him to request donations to purchase military, national guard and announcements
coast guard flags to be displayed in the auditorium; announced that on Saturday July 25, the California
Conservation Corp and Azusa Beautiful will be helping in the cleaning of the on/off ramp referred as the
triangle, located on First and Azusa behind the VFW Building, starting at 11:00 a.m., all 18 years and older
are invited to help; Councilmember Gonzales has been working with him on a project they presented to the
Chamber, to start the Silver Nights in Azusa next September, this will be a night show tasting in different
restaurants in the city, shuttles and a caravan will go from restaurant to restaurant and there will be live
entertainment in different sites.
Council Member Hanks, with Council's approval, directed staff to prepare a proclamation for Ben Wallace Hans
who will be receiving his Eagle Scout Award, on July 24, at 7:00 p.m., 1645 N. San Gabriel Canyon Rd.; request proclo
announced that last Friday he attended a march gathering of city, county and school officials, in B Wallace &
'Sacramento, sponsored by the City Counties Equal Partnership, League of California Cities, California announcements
State Association of Councils, California School Board Association and approximately 400 to 500 local
officials, to look at the state's budget crisis and give some advise, and the strongest message to state
legislation was that the local revenue sources need to be protected.
Councilmember Gonzales, with Council's approval, directed staff to prepare a proclamation for Zack Gonzales
Padilla World Boxing Champion who was inducted into the Boxing Hall of Fame, prepare certificates to proclo Z Padilla
the Azusa American Little League who won first place at the 2009 District 19 7-8 year old Tournament of cert ALL & $10
Champions, and to send $100 donation for the Charter Oak Youth Baseball and Softball Association donate charter
(COYBSA) who are heading to the national championship in Oregon next month; for additional donations school

Councilmember Carrillo spoke on the regional representation by Council, outside city boundaries, which Carrillo

Mayor Rocha announced that he attended the retirement party for Major Sergeant Patrick Flannery for 36 Rocha
years of service, who sent a message thanking Council and residents for honoring Azusa service people comments

attend the following events: Sunday, July 26, 9:30 a.m. comer of Azusa Avenue and 6t°, for the hanging of

at Dodger Stadium, on August 8, tickets are for sale at Memorial Park for $15, includes the lower reserve

Idol Daniel Noriega will sing National Anthem and God Bless America. He requested donation for soldiers
in Afghanistan, items can be delivered to the City Clerk's Office up until Friday August, 7, 7:00 p.m. when
the items will be delivered to the VFW; directed staff, with Council's approval, to send a $100 donation to
Candace Wear to attend Fullerton Wrestling Camp; he then introduced Mr. Ed Chavez from the Upper San
Gabriel Municipal Water District.

District, spoke on the work that has been done in the past and what is planned for the future, and explained
representatives
that they are working on starting the Ground Water Reliability Improvement Program (GRIP), a project
that will cost $300 million dollars for the next 5 to 10 years, and the program is to reclaim and recycle
water in the community; due to the high increase of water cost, there is a need to become more dependent
of our water and recycle it and hope that with the slow down of the economy, it will be an opportunity to
up on the water industry.

City Manager Delach, addressed item regarding the citywide cooling center policy, explaining that the

city's current cooling centers are the Sr. Center, Memorial Park and Library which are open between 12:00

Economic and Community Development Director Christianson addressed the hearing explaining that they places
have been working with Council and Planning Commissioners in putting together the policy and the draft
ordinance being presented include changes requested by council; he addressed the 6 month referral of the
ordinance, the creation of a new committee, and language regarding stolen and vandalized art.
The Mayor declared the Hearing open. City Clerk read the proof of publication of notice of said Hearing Hrg open
published in the San Gabriel Valley Tribune on July 9 and 15, 2009.
Ms. Peggy Martinez, addressed the hearing noting that the Target site and Lewis Developer are not P. Martinez
required to comply with the public art ordinance, because the developments have already started and asked comments
who will be responsible for this area, and if the new developers and the ones who are being negotiated will
be included; she expressed her concern of the adoption of this ordinance due to the current economic
situation, and asked Council not to rush into approving it.
Director Christiansen responded that the Target project already has an agreement in place, and it is not Christiansen
subject to this ordinance; Lewis Developer has not been finalized, and if they are subject to this ordinance respond to
it will be included on the agreement; Block 36 would fall under this ordinance only if there was a re- questions
entitlement; he further stated that the deferral of this ordinance is for 120 days.

Mayor Pro -tem Macias stated that he is happy to see this moving forward, Azusa has few arts but they have Macias
made a difference; he envisioning fountains, landscaping, lighting such as the breezeway, it looks like they comments

Council Member Hanks stated that individual homes are to be exempt from this ordinance; the second Hanks

Public Works/Assistant City Manager Haes addressed the hearing explaining that the walkway connecting

Viceroy Avenue to Citrus Avenue, was constructed in 1964 with the granting of a 25 year easement

the past few years there has been an increase in policing as a result of residents reporting illegal activities
that include fighting, littering, graffiti, noise, transient sleeping, drug use, and it has become an issue for

City Clerk Mendoza announced that she received two letters opposing the closure of the walk way, one Letter opposing

Lengthy discussion was held between Council and staff on the issues that are affecting the walkway and the Discussion

School District to participate and assist financially in the upkeep and find an alternative route for

Economic and Community Development Director Christiansen addressed the hearing explaining that due to
the application filed by Mr. Ore for a live entertainment permit, he made an investigation, and after
reviewing the police department investigation report, and based on their findings, he is making a
recommendation to deny the permit.
City Attorney Carvalho explained that the business currently holds a permit to operate as a bar, which was Carvalho
violated, and the owner was encouraged to apply for a live entertainment permit; however, due to the many comments
violations, it is recommended that the live entertainment permit be denied for health and safety reasons.
The Mayor declared the Hearing open. City Clerk read the proof of publication of notice of said Hearing Hrg. open

Mr. Al Galamidy, representative for business owner Mr. Marco Ore, addressed the hearing explaining that

City Attorney Carvalho reiterated that the reason for denying Mr. Ore's permit is due to the high volume of Carvalho
calls to the police department received in the past 24 months received from this location, and it is important addtl comments

Discussion was held among Councilmembers regarding health and safety issues, known narcotics in this
location, illegal activity at the bar; they suggested that instead of granting a temporary permit, the owner
should improve the safety and stop the illegal activity, and then reapply for a permit.

PROCEDURES REGARDING THE FILLING OF SEATS ON THE CITY PLANNING COMMISSION
City Attorney Carvalho provided existing rules regarding the appointment of Planning Commissioners, and
expressed concerns regarding items that are coming before the commission. Due to the nature of the items,
there is a need to have all commission members present and who are un -conflicting.
Lengthy discussion was held between Council, City Attorney and staff on the removal or re -appointment of Discussion
current commissioners, major potential projects that are coming up, the need to have complete non- re planning
conflicting commissioners who will be making decisions that will impact the community and the region, commission
the current open positions, the possibility of reviewing existing positions, alternative approaches to keep positions
the current commissioners by re -applying, and the importance of having a policy in place to train new and
re-train existing commissioners.

The CONSENT CALENDAR consisting of Items D -I through D-19 was approved by motion of Consent Calend<

' 8. Mayor Rocha addressed the item asking about Area #55 on Grandview to cost $500 a month and
asked what services are involved. He stated that students need to do 15 hours of community services
and suggested that they can do their hours helping with the clean up.

Moved by Councilmember Hanks, seconded by Mayor Pro -tem Macias and unanimously carried to Landscape
remove area #55, Grand View Project from the contract which will be done by student volunteers, and Irrigation
approved the amendment to the 2008-2009 and 2009-2010 Landscape and Irrigation Maintenance Maint Contr
Contract to reflect (4) new additional areas and appropriate additional funding.
12. Councilmember Hanks addressed the item asking staff about the requirements on publication. Public
Works Directors Haes responded that Covina Irrigation Company will be heading this bid, and they
will follow their procedures to notice it. It is estimated that the bid process will start in approximately
3-4 weeks.

16. Mayor Rocha addressed the item asking if the resolution was to have July 7'h as the adoption, being Madre Ave.
that the hearing was held on July 7. City Attorney Carvalho stated that at that meeting Council's
direction was to bring back a resolution for consideration, therefore the resolution is to be dated with
today's meeting.
