The City Council of the City of Azusa met in regular session at the above date and time in the Azusa Auditorium located at 213 E. Foothill Boulevard, Azusa, CA 91702. Proc C. Dodson Proclamation was presented to Mr. Christopher Dodson for his services to City while on the Planning Commission. Pub Part PUBLIC PARTICIPATION D. Gonzales Request for Ms. Destiny Gonzales, 2011 Miss Outstanding Teen addressed Council requesting sponsorship in the Scholarship Annual Scholarship Book, in the amount of $150 each for herself and Miss Azusa. City Manager Delach was directed to work with Ms. Gonzales on the sponsorship funds. B. Weir, ABC Request Dial A Ms. Blanch Weir member of the Architectural Barrier Commission addressed Council to express her Ride Seniors opinion in favor of the Farmer's Market which began on Saturday. She did note that the ground was Farmers Mkt rocky and hard for wheelchair access. She asked if the Azusa Dial A Ride Service could transport Senior Citizens to the Farmer's Market. She noted the vacancy on the Architectural Barriers Commission and invited anyone interested to fill out an application. M. Payne Farmer's Mkt Ms. Madelyn Payne reiterated the comments made by Ms. Weir with regard to the Farmer's Market and possible Senior Transportation. She also asked that reconsideration be given to the parking lot and area of the market layout and that they be reversed to accommodate strollers and wheelchairs. B. Knoles Comments Mr. Bruce Knoles addressed Council expressing his opinion in opposition to any oparking structure in the park area. He expressed his opinion in favor of the Waste Management Project. He requested that a public education be created to insure drivers keep to the 25 mph speed limit surrounding schools. J. Rosales Conflict Waiver Mr. Jorge Rosales addressed Council regarding the request for Conflict Waiver to allow BB&K to continue to represent the agency in its negotiations with Lewis Operating Corporation, stating that the perception is more dangerous than reality and talked about potential impacts. S. Kim APU Ms. Stacy Kim of Azusa Pacific University addressed Council announcing the end of the year Azusa Reads celebration of Azusa Reads, Writes, and Counts and Azusa Calculates to be held on Thursday, April 14, 2011 at the Azusa Library; she invites all to attend the event. A. Morales Farmer's Mkt Mr. Art Morales addressed Council expressing his opinion in favor of the Farmer's Market, requested to keep the old depot station at the tracks in back of City Hall as soldiers returned through there after the war. He asked to continue with improvements to the Farmer's Market, which he announced is open from 9 a.m. — 1 p.m. on Saturdays. Dir Pub Wks Responseto Director of Public Works/Assistant City Manager Haes responded to questions posed regarding the Questions re: Farmer's Market stating that it would cost about $300 a Saturday to have a Transportation Bus for Farmer's Mkt Seniors to be taken there and they would proceed with it for a trial period for one month. He stated that asphalt walking areas will be installed within the next couple of weeks at the Farmer's Market. Council gave general direction to City Manager Delach to work on the issues with the Farmer's Market. City Attorney Re: Conflict City Attorney Carvalho responded to comments made regarding the Conflict Waiver and provided Waiver details surrounding the issue and legal obligations regarding the conflict. She noted that Best Best & Krieger does not negotiate ENA's, staff does and it's up to the City Council how they would like to move forward on this item. 04/04/11 PAGE TWO REPORTS, UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF Rpts, Updates Discussion was held regarding options for filling the vacancy on the Planning Commission. Moved by Discussion Councilmember Gonzales, seconded by Mayor Pro -Tem Hanks and unanimously carried to direct the Filling Vacancy City Clerk's Office to post notice to accept applications to fill the vacancy on the Planning On Planning Commission. Moved by Mayor Pro -Tem Hanks, seconded by Councilmember Gonzales and Commission unanimously carried to direct the City Clerk's Office to post notice to accept applications to fill the vacancy on the Architectural Barriers Commission in addition to the Planning Commission, that the last day to submit applications be April 25'h, that all applications be by newly applied applicants, and that staff choose a date for interviews to be held by Councilmembers. Director of Utilities Morrow announced that the Azusa Light and Water Department has been Dir of Utilities designated a Reliable Public Power Provider (RP3), by the American Public Power Association. He -Reliable Public talked about the process involved in receiving the Award. Assistant Director of Electric Operations Power Provider Langit addressed the issue talking about his goals which focus on reliability, safety practices, workforce Award development, and improvements. In documenting this criteria they were submitted and received the Reliability Award. Macias Councilmember Macias thanked Fire Station 32 for the celebration on Saturday where they received a Comments check from the City; he talked about the opening of the Farmer's Market, and announced the groundbreaking of the Applebee's Restaurant on Tuesday, April 5h. Carrillo Councilmember Carrillo talked about the success of the Farmer's Market, Relay For Life Event and the Comments Applebee's Groundbreaking. He announced that that Highway 39 is now open to Crystal Lake. Gonzales Councilmember Gonzales announced the Golden Days fundraiser at Canyon City Barbeque on Comments Wednesday, April 6`h; he talked about the success of the Farmer's Market, and congratulated Ginny Dadaian and Maricela Cueva for receiving awards. He asked that the meeting be adjourned in memory of Donald Annis. Rocha Comments Mayor Rocha announced that the meeting will be adjourned in memory of Chon Martinez Espinoza and Donald Annis. He thanked all for attending the Farmer's Market and the Relay for Life events over the weekend. He announced upcoming events as follows: Saturday, April 9°i 9:30 a.m. Be A Walker, 10:00 a.m. Community Garden Ribbon Cutting, (both at Memorial Park), Saturday, April 14t4 Business Showcase featuring local businesses in front of City Hall 4-8 p.m., April 16th 8 a.m. — 12 noon Clean and Green event- Azusa Canyon, from 8 a.m. — noon there will be Tree Planting, clean up, and spreading mulch. He asked all to pray for Soldiers. City Mgr Report on City Manager Delach provided a detailed report on a recent accident by Azusa High school involving Accident kids from the school. He advised that the signal was working properly and there was a crosswalk which Baseline & was safe. Rockvale He provided an update on crossing guard program costs. Discussion was held regarding flashing radar light, regular speed signs, traffic analysis of crossing guards, computer controlled flashing radar light, and responsibility of the pedestrians. Staff was directed to come back with a report on what the radar controlled signal would cost, the outcome of contacting the AUSD to share in the cost of radar controlled sign as well as a possible partnership regarding educational program, and the cost of what crossing guard would be just until the end of the school year. Sched Items SCHEDULED ITEMS Policies & Procedures CONTINUED ITEM - CONSIDERATION OF AMENDING THE RESOLUTION OF THE CITY Proc/certs COUNCIL OF THE CITY OF AZUSA REGARDING POLICIES AND PROCEDURES FOR THE PRESENTATION OF PROCLAMATIONS. CERTIFICATES TO OUTGOING BOARD AND COMMISSION MEMBERS. Discussion Staff directed Discussion was held regarding the matter and it was consensus of Councilmembers to bring back a Amend Reso resolution to re -adopt that states a proclamation should be automatically given to a commissioner who To include honorably leaves through no fault of their own. The City Manager and/or City Clerk shall be Automatic responsible for insuring that proclamations or recognition of any of the commissioners that have Commission honorable served shall be automatic. Mayor Rocha requested that a proclamation be prepared for Mr. Recognition Logan Westbrook of Human Relations Commission. It was found that Mr. Westbrook left the Commission, but returned and still remains on the Commission. Cont Pub Hrg ZCA 231 CONTINUED PUBLIC HEARING -ZONING CODE AMENDMENT ZCA 231 ORDINANCE Office Uses AMENDING CHAPTER 88.24 OF THE AZUSA MUNICIPAL CODE PERTAINING TO OFFICE USES IN THE DOWNTOWN TOWN CENTER DISTRICT C. McNamara Comments Assistant Community Development Director McNamara addressed the Public Hearing stating that this is an amendment to the Development Code allowing professional office uses on the ground floor of the downtown center except on Azusa and San Gabriel Avenues. He stated that Staff was asked to look into why real estate offices would be allowed, but law offices would not, and responded to questions posed by Councilmembers. 04/04/11 PAGE THREE The Mayor declared the Hearing open. City Clerk read the affidavit of proof of publication of said Hrg Open hearing published in the Azusa Herald on March 10, 2011. Testimony was received from Mr. Art Morales stating that they shouldn't allow anything on Azusa Testimony Avenue other than retail. It was consensus of Council to close the Public Hearing. Hrg Clsd Councilmember Macias offered an Ordinance entitled: AN ORDINANCE OF THE CIT COUNCIL OF THE CITY OF AZUSA APPROVING AMENDMENT V1 Rdg Ord ZCA 231 TO CHAPTER 88 —DEVELOPMENT CODE OF THE CITY OF AZUSA MUNICIPAL ZCA 231 CODE. Moved by Councilmember Macias, seconded by Councilmember Gonzales and unanimously carried to waive further reading and introduce the proposed Ordinance amending the Azusa Municipal Code Chapter 88.24 Districts allowing Professional Office use on the ground floor in the Downtown Town Center District, except on Azusa Avenue and San Gabriel Avenue. Pub Hrg PUBLIC HEARING — ZONING CODE AMENDMENT ZCA 232, AN ORDINANCE AMENDING ZCA 232 CHAPTERS 88.42.082, 88.36.50, 88.24.005, 88.42.120, 88.32, & 88.70.020 OF THE AZUSA MUNICIPAL CODE PERTAINING TO THE IMPLEMENTATION OF PROGRAMS 10, 14, and 15 IDENTIFIED IN THE 2008-2014 HOUSING ELEMENT UPDATE. K. Christiansen Director of Economic and Community Development Christiansen addressed the Hearing presenting and Comments detailing the proposed Development Code Amendments identified within the Housing Element as follows: Program 10: Mixed -Use Sites, Program 14: Density Bonuses and Program 15: Extremely Low Income and Special Needs Housing. He responded to questions posed by Council regarding the Special Needs Housing Element, Rental Housing Conditions, Other Incentives, and the Density Bonus Agreement — Procedures. The Mayor asked that the word "or" be removed from the last sentence of 88.32.070. - Density Bonus Agreement. A. Procedures. Hrg Open The Mayor declared the Hearing open. Mayor Pro -Tem Hanks offered an Ordinance entitled: I" Rdg Ord AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING Code Amend AMENDMENT ZCA 232 TO CHAPTER 88 — DEVELOPMENT CODE OF THE CITY OF AZUSA Housing MUNICIPAL CODE Element Moved by Mayor Pro -Tem Hanks, seconded by Councilmember Gonzales and unanimously carried to waive further reading and introduce the proposed Ordinance, as amended, amending the Azusa Municipal Code Chapter 88.42.082; 88.36.50; 88.24.005; 88.42.120; 88.32; and 88.70.020 of the Development Code to implement Programs 10, 14, and 15 of the 2008-2014 Housing Element. Azusa Cares Event CONSIDERATION OF ENDORSING AND SPONSORING "AZUSA CARES"; AND FUNDING AN EVENT MAY 21, 2011 AT THE AZUSA SENIOR CENTER. Discussion Azusa Cares Discussion was held regarding sponsorship of the "Azusa Cares" event Saturday, May 21, 2011 on First Event Mental Health. The workshop will be held by Dr. Scott Bledsoe of Azusa Pacific University and May 21" discussions will include suicide prevention, depression, and self-mutilation. This is series of workshops Azusa Senior being held in partnership with Senator Roger Hernandez, Azusa Unified School District, Azusa Pacific Center University, local clergy and the Wellness Center. The workshops include: May 21" - Mental Health, July 16th - Obesity and Dental Health, September 17th - Bullying, November 19th - Diabetes, January 21st, 2012 - Anger and Anger Management. There will be experts at each of these workshops, and the tentative time is 9:30 a.m. to 12:30 p.m. Approved Moved by Councilmember Macias, seconded by Councilmember Carrillo and unanimously carried that the first workshop be held at the Azusa Senior Center on May 21", others will be held off-site. Consent Calendar The CONSENT CALENDAR consisting of Items D-1 through D-10 was approved by motion of Mayor Pro -Tem Hanks, seconded by Councilmember Gonzales, and unanimously carried with the exception of item D-5 which was considered under the Special Call portion of the Agenda. HUMAN RESOURCES ACTION ITEMS. Human Resources Action Items were approved as follows: Merit Increase and/or Regular Appointment: R. Zuniga, and C. Davis. New Appointment: S. Smith, Police Records Specialist 1. 3. The City Treasurer's Report as of February 28, 2011 was received and filed. 4. Bid was awarded to Waterline Technologies Inc. in the amount of $10,694.19 for the following 2010- 2011 Capital Improvement project: Purchase and installation of 22 LED light fixtures in the interior of Aquatic Center's (3) pools. (CIP#41011 E) SPECIAL CALL ITEM. 6. Approval was given for the award of contract to C.P. Construction of Ontario for Water Project W -266A, which includes replacement of approximately 675 linear feet of water main of various sizes plus appurtenances in Hilltop Avenue in Azusa; 2,780 linear feet of water main of various sizes plus appurtenances in San Bernardino Road in West Covina and Los Angeles County; 5,662 linear feet of water main of various sizes plus appurtenances in Workman Avenue in West Covina; and staff was authorized to issue a request for proposals for inspection services for same project. I1 -C28 APPROVING THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY AND THE SEIU SERVICE EMPLOYEES INTERNATIONAL UNION EFFECTIVE AUGUST 1, 2010 THROUGH MOU JULY 31. 2011. 9. Approval was given for the purchase of ten Panasonic Toughbook laptop Panasonic computers and associated equipment for mobile digital computer (MDC) use in marked police cars from Toughbook CDCE — Mobile Computing, Inc. in the amount of $59,518.75. Approval of the purchase of this Laptop equipment based on the competitive bid process completed under GSA Contract Number GS -35F -0143R. Compters This type of purchase is authorized by AMC Section 2-523(E) when the competitive bid process has already been completed. 10.
