The City Council of the City of Azusa met in regular session at the above date and time in the Azusa Auditorium located at 213 E. Foothill Boulevard, Azusa, CA 91702. The City Council Recessed to Closed Session at 6:25 p.m. to discuss the following: CLOSED SESSION Closed Session CONFERENCE WITH LABOR NEGOTIATOR - Gov. Code Sec. 54957.6. Labor Negot City Negotiator: City Attorney Marco A. Martinez Exec Mngmnt Organizations: Executive Management Group, Unrepresented Employees. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION - Gov. Code, See. Anticipated 54956.9(b)(3)(A). Litigation 2 Potential Cases The City Council reconvened at 7:39 p.m., City Attorney Martinez announced that all members were present in closed session and that there was no reportable action taken. 'Mayor Rocha called the meeting to order. Call to Order Pledge to the Flag was led by Ms. Teresa Bonilla Flag Salute Invocation was given by Pastor Eddie Velasquez of Azusa Ministerial Association Invocation ROLL CALL Roll Call PRESENT: COUNCILMEM 3ERS: GONZALES, CARRILLO, MACIAS, HANKS, ROCHA ABSENT: COLINCILMEM 3ERS: NONE ALSO PRESENT: Also Present City Attorney Martinez, City Manager Makshanoff, Public Works Director Assistant City Manager Haes, Police Chief Gonzalez, Interim Finance Director Paragas, Library Director Johnson, Economic and Community Development Director Christiansen, Director of Utilities Morrow, Assistant Director to Economic and Community Development McNamara, Director of Family and Recreation Services Jacobs, Information Officer Quiroz, Recreation Supervisor Chavez, City Clerk Mendoza, Acting Assistant City Clerk Hernandez. PUBLIC PARTICIPATION Pub Part Ms. Stacey Kim, Program Manager at Azusa Pacific University, addressed council announcing the S. Kim beginning of this year's tutoring programs: Azusa Reads/Writes/Counts, Azusa Calculates, Girls and Comments Kids on the Move, and Computer Lab; she gave times, days, locations and stated that programs will run throughout the school year. Mr. Mike Lee addressed Council congratulating Councilmember Hanks on his retirement, talked about M. Lee the proposed parking structure, local businesses, concerts in the park kids riding bikes and skateboards Comments not wearing helmets; voter registration, and asked prayers for soldiers. The following addressed Council expressing their opposition for the location of the proposed parking Oppose structure and the proposed amendment to the Environmental Impact Report (EIR): Messrs. Jorge Rosales, Parking Ronald Lohr, Bruce Knoles, Sergio Benavides, and Joe Guarrera; Mses Marrie Suydam, Madelyn Payne, Structure Sandra Benavides, and Jeri Vogel. They expressed their concerns to the additional cost to amend the EIR, safety of Police Officers, traffic noise, cost of maintenance agreement, affecting surrounding businesses, flood plan, and no access to Santa Fe from San Gabriel. A proposed alternative was presented. Mr. Robert Donnelson addressed Council congratulating Azusa/Glendora Library for the presentation of R. Donnelson author John Corcoran, and gave a biography of his accomplishments and efforts to improve libraries; he Comments emphasized on the importance of public libraries and requested not to cut funds for libraries. Mr. Matt Milburn, addressed council announcing the Effective Post -Divorce Parenting event on M. Milburn Saturday, September 22, 9:00 a.m. at Lee Elementary School. Comments Mr. Joe Guarrera, addressed council regarding the entry sign west of Foothill which is gone, asking what J. Guarrera happened to it and when will it be replaced; expressed his concern regarding the newly placed no left turn Comments sign on 5'h Street and Alosta where his neighbor was recently fined and asked the reason why it was placed and why it was not announced City Manager Makshanoff addressed questions stating that: regarding the West End sign on Foothill, City Manager Recreation and Family Services staff is working on a report that will be presented to Council at a later Answer date, for consideration on alternatives of a new sign; the no left turn sign on 5'h and Alosta, was placed Questions after a review of that intersection by the traffic engineer as it was deemed to be a hazardous intersection based on speed of vehicles coming out of Alosta. Questions regarding the proposed parking structure and the EIR will be addressed with item C-1 in tonight's agenda. REPORTS UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF Rpts, Updates Moved by Councilmember Gonzalses, seconded by Councilmember Hanks and unanimously carried to J. Velazauez approve a $100.00 sponsorship for James Velazquez, 5th grade student at Powell Elementary School, to sponsorship take a trip to Washington D.C. in June. Moved by Councilmember Hanks, seconded by Councilmember Gonzales, and unanimously carried to Proc Child prepare a proclamation, a request by the American Cancer Fund for Children, Inc., proclaiming Cancer Aware Childhood Cancer Awareness Week September 30 - October 6, 2012. Mayor Pro -tem Carrillo addressed the meeting stating that he recently attended the League of California A. Carrillo Cities Conference, where cities voted for resolutions to be presented to the courts, regarding parking Comments citations from which, cities should collect a fair share; he congratulated The Outlet ELS for their successful opening and stated that this was the last Redevelopment Agency project, and that it was unfortunate that not legislative representation was present at the opening ceremony. 'Councilmember Gonzales addressed the meeting congratulating The Outlet ELS on their recent opening R. Gonzales on September I lb, setting a sales record ever sold. Comments Councilmember Hanks addressed the meeting congratulating The Outlet ELS for their success; he stated K. Hanks that together with Mayor Rocha, they attended an Eagle Court Honor for two young men, and of the Comments honored scouts spoke about continuing his mission with his church, which was put on hold as a result of a car accident he was involved in. Councilmember Macias addressed the meeting congratulating The Outlet ELS and invited all to visit the U. Macias store; he wished happy birthday to Suzanne Avila who has done a lot of good volunteer work for Azusa. Comments Mayor Rocha addressed the meeting stating that it will be adjourned in memory of Richard L. Garcia, J. Rocha Georgia Barbosa Silva Lopez Morales Garcia, Linda Amador, Vidala "Chita" Luevano; he announced Comments Effective Post -divorce Parenting on September, 22, 9:00 a.m. at Lee. School; Azusa Day at the Fair, Thursday September 27, where they will honor Azusa adult heroe Rosemary Garcia, and Azusa youth community hero Jose Corona; gave thanks for contributions to care packets for soldiers; and asked to keep soldiers in prayers. Sched Items CITY COUNCIL TO REVIEW INFORMATION REGARDING EXPANSION OF THE Intermodal "ALTERNATIVES" SECTION OF THE DRAFT AZUSA INTERMODAL ENVIRONMENTAL EIR Impact IMPACT REPORT .(DEIR) AND PROVIDE DIRECTION REGARDING AMENDMENTS AND Report 'RECIRCULATION OF THE DEIR: Amendment Public Works Director Assistant City Manager Haes addressed the item stating that at the Meeting of 7'. Haes September 4, Council expressed concerns regarding the level of analysis of the Intermodal Environmental Comments Impact Report (EIR) and requested additional information from staff on an alternative location, specifically north of the railroad tracks. Because of the additional time required to gather the additional information and analyze it properly, the following information was gathered in answer to questions presented: Consultant, Terry A. Hayes & Associates, estimates four months to complete the additional information, to be ready by February 2013, Planning Commission to review on March 2013 and Council to review May 2013; the estimated overall project budget would increase by approximately $90,000 that comes from a federal grant that can only be used for a parking structure in the Azusa Downtown, this 09/17/2012 PAGE TWO includes the EIR; Foothill Transit confirmed that the new timeframe would not pose a problem; Gold Line gave the City a new date of July 2013 to environmentally clear the parking structure, giving the City enough time to complete the review. After lengthy discussion, it was moved by Councilmember Macias, seconded by Mayor Pro -tem Carrillo Amend and unanimously carried to authorize the City Manager to amend the Memorandum of Understanding MOU (MOU) between the City of Azusa and Foothill Transit to prepare the additional analysis necessary to expand the "alternatives" section of the DEIR and re -circulate the DEIR. The CONSENT CALENDAR consisting of Items D-1 through D-9 was approved by motion of Consent Councilmember Macias seconded by Councilmember Gonzales and unanimously carried. Calendar 1. Human Resources Action Items were approved for: HR Action Merit increase and/or regular appointment: S. Soria, L. Maldonado, A. Martinez Item 5. Ridgeview Park, Alisal Park, Sierra Madre Walking Path (East) and the Roundabouts as completed Rosedale projects in the Rosedale Development were accepted (these will now come under the operational Parks Complete supervision of the Recreation and Family Services Department); and an amendment to the existing Budge Amend Landscape and Irrigation Maintenance Contract between the City and Valley Crest Landscape Maintenance was approved. The additional increase will be $23,040.00 per fiscal year. This will increase the annual total amount of the contract from $177,900.00 to $200,940.00. 6. Staff was authorized to circulate a Request for Proposals (RFP) to solicit an experienced consultant or RFP Plan consultants to provide contract plan review and inspection services for the Economic & Community Insp Svcs Development Department Building Division. 09/17/2012 PAGE THREE 7. The agreement between the Azusa Unified School District and the Azusa Police Department, for the APU & provision of law enforcement services at a shared cost was approved. This agreement will result in PD Enforce the assigning of one full-time Azusa Police Officer to the Azusa High School campus for the 2012- Agmnt 2013 school year. 8. A Report on a request for an extension of the amortization of the nonconforming use located at 633 Rprt Extend N. San Gabriel Avenue, Express Tire and Auto Services, was received and filed. Amortization 9. Exclusive Negotiation Termination Mutual Release of Claims Agreement with Kal Pacific & Termination Associates for 229 S. Azusa Avenue was approved.
