The City Council of the City of Azusa met in regular session at the above date and time in the Azusa Auditorium located at 213 E. Foothill Boulevard, Azusa, CA 91702. CEREMONIAL Ceremonial A proclamation was presented to Ms. Mary Dodd representing One Legacy, proclaiming April, 2013 as "DMV/Donate Life California Month" in Azusa. CLOSED SESSION Closed Session The City Council Recessed to closed session at 6:43 p.m. to discuss the following: LCONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION - Gov. Code Sec. WCA ' George Richard Stanford vs. City of Azusa, Workers Compensation Appeals Board numbers Stanford ADJ2217325, ADJ970699, ADJ729734 The City Council reconvened at 7:30 p.m., City Attorney Martinez announced that regarding closed session item no. 1 on a 5-0 vote, Council authorized an extension for a period of 3-6 months, of an existing tolling agreement relating to a motion to tax cost that are due to the City of Azusa; regarding item no. 2, there was not reportable action taken. Mayor Rocha called the meeting to order. Pledge to the flag was led by Angel Rocha and A.J. Rocha. Kim University, addressed Council announcing the year end celebration of the program, on Thursday, April Comments 18, 4-5:00 p.m. at the children' section of the Azusa Library. Mr. John Fincher addressed the meeting stating that Citrus College Board of Trustee Member Dr. Gary L. J. Fincher Woods lives outside city boundaries, asked that Council to consider a resolution supporting the idea that Comments an elected Board Member be properly domiciled, and announced the Citrus College Board of Trustees meeting on April 2, 4:15 p.m. at the Center of Innovation Building. Mr. Tom Gonzales addressed Council regarding Azusa High School Band fire works stand, thanking T. Gonzales them for allowing them to have an additional stand last year, and requested the same be allowed this year. Comments Mr. Hector Elizalde, representing Congresswoman Grace Napolitano, addressed Council regarding an H. Elizalde upcoming 2nd Annual Veterans Forum, on Saturday June 1, 2013, at the National Guard Armory, 1351 Comments W. Sierra Madre Ave., Azusa, and thanked Mayor Rocha for assisting with a location to hold the forum. Mr. Art Morales addressed Council to talk about the Citrus College Board Members and their elections. A. Morales Mr. Joe Guarrera addressed Council on the revised Environmental Impact Report (EIR) of a proposed J. Guarrera parking structure regarding the accommodations for buses. Comments 'City Manager Makshanoff addressed Mr. Gonzales' question, stating that there is a system in place J. REPORTS, UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF Repts, Updates City Manager Makshanoff addressed Council updating them on the replacement of the West End J. Makshanoff monument on Foothill that was damaged due to an auto accident; announced April 18, Arbor Day in front Comments of City Hall; he introduced Ms. Andrea Miller, Executive Director to the San Gabriel Valley Council of Governments (COG), who thanked them for the opportunity to introduce herself; she gave her background experience, and explained the functions and programs that COG has for the benefit of the community and available resources. It was consensus of Council to appoint Mayor Rocha and Councilmember Gonzales to the Ad -Hoc Ad Hoc Committee to re -negotiate Rosedale Land Partners Disposition and Development Agreement (DDA), Rosedale DDA which is soon to expire. Councilmember Gonzales addressed the meeting congratulating Parks and Recreation Department for the R. Gonzales Easter Egg Hunt event; he addressed an upcoming free compost and mulch for residents at the North Comments Recreation Center. 'Councilmember Carrillo addressed the meeting congratulating Azusa Youth Pony League on their A. Carrillo opening day; City Manager Makshanoff stated that the Gladstone Park CDBG foul ball fence extension Comments project is estimated to be completed by November or December. Mayor Rocha addressed the meeting stating that it will be adjourned in memory of Azusa Educator Mr. J. Rocha Homer May; announced: yard sales Saturday and Sunday April G and 7; Families on the Move be a Comments Walker, Saturday April 13, 2013, 9:30 a.m., Veterans Park; Grace Napolitano's Veteran's Event Saturday June 1, 2013, 8-2 p.m., National Guard Armory; the California Conservation Core open recruitment events every last Thursday of the month, at L.A. Works, corner of Irwindale and Arrow Hwy., City of Irwindale, open for men & women ages 15-25; Saturday April 13, 2013, the soft grand opening of Wisteria Housing Development Rosedale; he gave information on a meeting he attended with cities of Pasadena, Monrovia and Duarte regarding communities coming together to share ideas and solutions on how to combat violence; and asked to keep service men and women in daily prayers. The CONSENT CALENDAR consisting of Items D-1 through D-9, was approved by motion of Mayor Consent Cal Pro -tem Macias, seconded by Councilmember Carrillo, and carried, with the exception of item E-7 which was considered under the Special Call portion of the agenda; Councilmember Alvarez abstained from item No. 5. 1. The minutes of the special meeting of March 18, the regular meeting of March 18, and the special Minutes meeting of March 25, 2013, were approved as written. ' 2. The following Resolution No. 13-C21, was adopted and entitled: Reso A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN Warrants CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. In accordance with the City of Azusa Civil Service Rules and applicable Memorandum of H.R. Action Understanding(s), the Human Resources Action Items were approved as follows: Items Merit Increase and/or Regular Appointment: F. Chavez, T. Patlogar, R. Sok New Appointments: F. FINAL TRACT MAP NO. 54057-16, WISTERIA: Tract Map a) The Final Tract Map No. 54057-16 including the street, storm drain, sewer and public utility 54057-I6 dedications as offered on the map was approved, and the City Clerk was authorized to record said Rosedale map with the County Recorder's Office of Los Angeles County; b) The Mayor was authorized to execute the AGREEMENT FOR COMPLETION OF PUBLIC IMPROVEMENTS FOR Tract No. 54057-16 to construct the required public improvements; c) The Faithful Performance Bond No. PB 03010400629 in the amount of $710,584, and the Labor and Materials Bond for $710,584, as guaranteed by Philadelphia Indemnity Insurance Company were accepted; d) The Monumentation Bond in the amount of $10,600 as guaranteed by Philadelphia Indemnity Insurance Company; pursuant to Section 66436(a)(3)(A)(i-vii) of the Subdivision Map Act was accepted. 5. The Following Resolution No. 13-C22, was adopted and entitled: Reso Co Sanitation A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA DESIGNATING AN District ALTERNATE MEMBER TO THE GOVERNING BOARD OF THE COUNTY SANITATION Member DISTRICT NO. 22 OF LOS ANGELES COUNTY. 6. The Plans and Specifications were approved, staff was authorized to solicit a notice of inviting bids Plans & Specs for CIP Project #66113A - Pavement Management Project and a budget amendment in the amount of Pav Ivingmnt $400,000 was approved. 7. The Notice of Completion for the Pavement Management Program Project #66112D & 66112E — All NOC Pav American Asphalt, Corona, CA 92878 was approved, and staff was authorized to file the Notice of Mngmnt Completion with the Los Angeles County Clerk. 8. The City Manager was authorized to enter into a professional services agreement with CSG CSG Prof Svcs Consultants, Inc. and Interwest Consulting Group in an annual amount not to exceed $100,000.00 Agmnt and $20,000.00 (respectively), for as needed outside building plan check and inspection services. 9. SPECIAL CALL ITEM SPECIAL CALL ITEMS NEW CLASS SPECIFICATION — UTILITIES ADMINISTRATIVE & FINANCIAL SERVICES MANAGER. Utilities Director Morrow addressed the item stating that this is a specialized position that focuses on financial and administrative services; there is currently no specialized personnel for this position at the utilities department; this position is responsible for budgeting, financial planning, water and electric rates analysis, deals with agencies that handle bonds, oversees refuse contract, responsible for all facilities, purchasing and contracting, and the roll for regulatory and legislative affairs has been added to the specs. Discussion was held regarding not having this item at the Utility Board due to it being under the Civil Services Rules; duplication of the duties of other positions; the title appearing to be downgraded; and the duties of the position. Moved by Mayor Pro -tem Macias, seconded by Councilmember Gonzales and unanimously carried to, Pursuant to the City of Azusa Civil Service Rules Section 3.5, adopt the new class specifications of Utilities Administrative & Financial Services Manager. SUCCESSOR AGENCY RELATED BUSINESS Councilmember Gonzales offered a Resolution entitled: A RESOLUTION OF THE SUCCESSOR AGENCY OF THE FORMER REDEVELOPMENT AGENCY OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS AND DEMANDS TO BE PAID OUT OF SUCCESSOR AGENCY FUNDS.
