MONDAY, JULY 15, 2013 — 6:30 P.M.
The City Council of the City of Azusa met in regular session at the above date and time in the Azusa Auditorium
located at 213 E. Foothill Boulevard, Azusa, CA 91702.

The City Council Recessed to closed session at 6:31 p.m. to discuss the following:

The City Council reconvened at 7:30 p.m., City Attorney Martinez announced there was no reportable City Attorney
action taken in closed session. Reports

Invocation was given by Pastor Woody Calvary from Praise Chapel of Azusa.

Public Part
Ms. Barbara Dickerson addressed Council thanking them for recognizing Azusa Unified School District 13. Dickerson
High School graduates by placing their names on a banner in front of City Hall; she requested an update Continents
on a previous request to place similar banners on the east and west entrances of the city; and spoke of
Azusa Pacific University (APU) and Citrus College City of Azusa Scholars.
'Ms. Andrea Cruz addressed Council regarding Mr. Cruz' property located at 730 N. Azusa Ave., stating A. Cruz
that no notice was received regarding the Planning Commission Hearings on the Environmental Impact Comments
Report (EIR) of the proposed parking structure; the only notice received was for the Public Hearing of
July 1, 2013, by the City Council; if his property is impacted by the project, he will continue with the
existing use on the basis of failure by the Planning Commission, to notify him of the construction.
Mr. Jorge Rosales addressed Council regarding the conditions of approval, in connection with the J. Rosales
Environmental Impact Report, Use Pennit and Design Review of the proposed parking structure, not Continents
being referenced or included in the resolutions; he expressed concerns of additional operational cost on
Condition No. 1, and Resolution 13-C44 Design Review conflicting with Condition No. 4.
Ms. Peggy Martinez addressed Council announcing that applications for Ms. Azusa, ages 18-22, and Ms. I'. Martinez
Outstanding Teen, ages 13-17, will be accepted until the end of August 2013; the pageants will be held Comments
October 5, 2013, at the Woman's Club; she requested sponsorship in the amount of $2,000 to fund
scholarships; and spoke Ms. Azusa and Ms. Outstanding Teen accomplishments last year.
Ms. Sandra Benavides addressed Council regarding the proposed parking structure, stating that residents S. Benavides
input, at the Citizen's Congress, on the downtown did not include a parking structure; she further stated Comments
that the Development Code and the General Plan call for other types of development.
Misses Katie Perry, Christina Para, Emily Schwedler, Cadet Girl Scouts Troop #1164, addressed Girl Scouts
Council requesting financial assistance for their silver project that will consist of a first Back To School Troop #1 164
Fair, August 12, 2013, at the Azusa Park Apartments to provide backpacks with school supplies to Comment
students K-12.
City Manager Makshanoff answered questions posed at Public Participation as follows: the request for .I. Makshanoff
banners for the Azusa Schools graduates to be placed on the east and west entrances of the City, staff Comments
estimated the minimal cost of $100 per banner, totaling $30,000-$40,000 for approximately 300-400
'graduates, which is high during these budget times; the parking structure project is compatible with the
area and does not contemplate changes to Mr. Cruz' property, he was notified of the proceedings and
staff made a courtesy phone call to him to notify him of the construction; in previous years, the City
provided $10,000 funding for the Ms. Azusa Pageant, because of the loss of Redevelopment and the lack
of funds, the contribution was suspended, staff found a potential sponsor, but the sponsor and Ms.
Martinez were not able to come to an agreement on how the funds were to be handled.

Councilmember Alvarez addressed the meeting thanking all who participated in the City Walks event at E. Alvarez
Poineer Park, and thanked Chick-fil-A for their support by providing free meals and certificates for free Comments

Councilmember Gonzales addressed the meeting announcing the third annual Canyon City Camp Out, R. Gonzales
Friday, July 19, 2013, 3:00 p.m. thru Sunday July 20, 2013, 10:00 a.m., at Northside Park, cost $30.00 Comments

Councilmember Carrillo addressed the meeting stating that the Independent Cities Association (ICA) is A. Carrillo
an organization that represent cities that have internal Police and Fire Department rather than Comments
contracting; he recently attended the ICA summer seminar where Azusa's City Attorney gave a
presentation; the main topic of the seminar was the economic development that continues to be a
challenge for cities throughout the state; there is legislation waiting to be approved, and efforts are being
'made to restore some kind of Redevelopment and new ways to provide economic development; he
wished all a great and safe summer.

He requested from staff, to place on the agenda an item for discussion regarding fireworks, at the
Council Meeting of September 16, 2013; and asked to keep Service Men and Women in daily prayers.
Police Chief Gonzalez addressed the meeting stating that July 4, is the busiest day of the year for the S. Gonzalez
Police Department; this year's illegal fireworks activity was the highest of the last 3 years on the number Illegal Fire
'of citations issued; he will be making a recommendation to Council on how to amend the existing works
ordinance to strengthen rules and regulations pertaining to illegal fireworks and reduce its illegal use.
Mayor Rocha re -addressed the meeting to answer Ms. Benavides' continents; he stated that the Down .l. Rocha
Town does not define the Azusa's Development Code (Code), as it is a City wide concept; the result of Additional
the Code was: Target, Azusa being one of the 10 cities in the continent selected for this store; ELS, the Continents
owner chose Azusa for its uniqueness; Rosedale, residents like the affordable community. The Code
called for walk -ability, which was accomplished by making our city a safe place to live, to work, and to
play; the dissolution of Redevelopment was a setback, and the parking structure is a new start; Azusa
was once known as the hate capital of the San Gabriel Valley, and the General Plan was for the entire
city, to bring families together to work and improve Azusa for the better.
Councilmember Carrillo re -addressed the meeting stating that there have been interested developers that A. Carrillo
are willing to develop around the parking structure; the parking structure will be a challenge for Additional

CONTINUED HEARING - INTERMODAL PARKING FACILITY. Continued
Hearing
A request to certify an Environmental Impact Report (EIR) and approve the Use Permit and Design Proposed Inter
Review applications to permit the construction and use of a 38 -foot high, three-story parking structure Modal Parking
(Intermodal Parking Facility) with rooftop parking, containing 550 parking spaces, for use by the public Facility for the
and government agencies ("Project"). The Project is generally located on properties north of 213 E. Alameda Gold
Foothill Boulevard, East of Azusa Avenue, West of Alameda Avenue and approximately 100 feet south Line Station
of 9th Street (Public Hearing was Closed on July 1, 2013).
City Manager Makshanoff addressed the hearing stating that Ms. Benavides' concerns regarding the J. Makshanoff
item are addressed in the July 1, 2013, staff report page 6, and that staff disagrees with her interpretation Comments
of the Development Code and General Plan.
Public Works Director/Assistant City Manager Haes addressed the item presenting the four conditions of 1'. 1-laes
approval requested by Council at the Public Hearing of July 1, 2013, as follows: Address

Condition 1. Contributions by other agencies towards the maintenance of the project: Condition 1, of
Approval
Foothill Transit, Metro and City of Azusa, shall negotiate an agreement to share equally on the normal
per parking spaces and expenses, such consent shall be in writing in the form of maintenance or share
use agreement, and to be presented to the City Council for approval prior to issuance of the certificate of
occupancy; he suggested that the best way to get true return payment by each agency is by some form of
re -payment at the end of each year; a summary cost can be prepared and presented to each agency for
auditing, and the agencies to reimburse the actual cost.
'Condition 2. Regulating bus movement on 9th Street:
Because of Council's concerns of buses traveling east on 9th St., to merge south on Pasadena Ave.,
where children walk to and from Dalton and St. Francis of Rome Schools, Foothill Transit, being the
only bus operator in Azusa, agreed to route the four bus lines as follows:
Line 185, bus route will go north on Azusa Ave., make a loop to go out and turn west on 9th St.;
Line 187, bus route will go north on Azusa Ave., go through the structure and exit west on 9th St.;
Line 280, bus route will go north on Azusa Ave., and turn west on 9th St.;
Line 494, bus route will go north on Azusa Ave., and turn west on 9th St.;
All four bus routes, once they have turn west on 9th St., they will continue with their respective routes,
i.e. south of San Gabriel Blvd., and Foothill Blvd. castor west.

Condition 3 Requiring posting of signage with phone numbers for notice complaint and other Condition 3, of
construction related issues: Approval
Prior to issuance of the final building plans, a construction plan site we will be presented to the City
Council, which will include signage listing of a contact number for complaints; this would not be an 800
number but a local number that will be monitored by staff 24 hours should there be noise complaints,
disturbance or burglary at the construction site.
Condition 4. Final Design refinements review by Planning Commission and City Council:
tThe final structure or architectural design and layout of the building shall be presented to the Planning
Commission for design review and approval, and then to the City Council with Planning Commission's
recommendation.
He answered questions posed by Mr. Rosales at public participation as follows: the reference lie made to
a 1996 survey, salaries and benefits being $120.00 per parking space; employees salaries to supervise
the project and associated contracts, are already paid for through a non -general find, some cities have
salaries as part of the parking structure maintenance and operations, which explains the discrepancies
compared to Azusa's estimate; there will not be cashiers at the structure, after a trial period, Police
Department can do review to determine if private security is needed; one addition that will be made to
Resolution Dios. 13-C43 and 13-C44, will state that "Hereby the city approves the use permit application
for the project subject to the conditions attached here to as exhibit A."

Discussion was held regarding the different plans that will come before Council for final review; Discussion
resolution of the final design, will be presented to the Planning Commission for review, as this is one of
the four conditions; all additional architectural refinements and small details of the project will be
reviewed by the Planning Commission and the City Council; staff is not contemplating big changes, as
the construction will be constrained by the already approved documents that are specific to the EIR.

The CONSENT CALENDAR consisting of Items D -I through D-10, was approved by motion of Consent Cal

1. The minutes of the special meetings of June 24, 2013, were approved as written. Minutes
2. The following Resolution No. 13-C49, was adopted and entitled:

13. The following actions regarding Final Tract Map 54057-12 (ROSEDALE) were taken: Tract Map

The project complied with the General Plan and was consistent with the approved tentative map and (Rosedale)
any amendments thereto;
The agreement for of public improvements for Tract No. 54057-12 to construct the required public
improvements was approved and the City Manager authorized to execute the same;
The Faithful Performance Bond in the amount of $64,700, the Labor and Materials Bond for $64,700,
as guaranteed by Philadelphia Indemnity Insurance Company, and cash Monument Bond in the
amount of $6,000 were accepted;
Pursuant to Section 66436(a)(3)(A)(i-vii) of the Subdivision Map Act, it was found that the
development of the property, in the manner set forth on the subject division of land, will not
unreasonably interfere with the free and complete exercise of the easements held by Azusa Land and
Water Company, Starfield Azusa Heritage Oaks LLC, Southern California Edison Company,
Monrovia Nursery Company, and Rosedale Land Partners 11 LLC, and the map of said easement
holders was accepted.
4. The School Resource Officer Agreement, July 1, 2013 — June 30, 2014, between the Azusa Unified SRO
School District, and the Azusa Police Department, for the provision of law enforcement services at a Agreement
shared cost, was approved. AUSD
' 5. The agreement between the City of Irwindale and the City of Azusa, for the provision of Irwindale
supplementary law enforcement services at the Irwindale Event Center between August 1, 2013; and Agreement
August 4, 2013 was approved.
6. Staff was authorized to enter into a professional services agreement with SA Associates for a not to SA Assoc, Safe
exceed fee of $11,550 to provide topographic survey and mapping services for the Gladstone Routes to

9. The City Treasurer's Report for the City of Azusa for the month of May 2013, was received, Treas Report
' reviewed, and filed.
10. The improvements required for Tract No. 64417-1 Arborview; Tract No. 54057-8, Greenbriar; Tract Rosedale
No. 54057-11, Magnolia; and Tract No. 54057-14, Heritage Oaks in the Rosedale Development as Improvements
complete and release the improvement bonds, were accepted.
