The City Council of the City of Azusa met in regular session at the above date and time in the Azusa Auditorium located at 213 E. Foothill Boulevard, Azusa, CA 91702. CEREMONIAL The entire Council presented certificates of appreciation to all who contributed to the "2013 Kool Cuts Event' held on August 18, 2013, at Memorial Park; and certificates of recognition to the National Little League All Stars for winning the District 19 Tournament of Champs and Section 3 Runner Ups, and to the National Little League Rockies for winning the League Champs, City Series Champs and District 19 Tournament of Champs CLOSED SESSION The City Council Recessed to closed session at 6:45 p.m. to discuss the following: I. Reconvene Mayor Rocha called the meeting to order. Call to Order Pledge to the flag was lead by Messrs. Ronald Smith and Ryan Anderson, and Miss. Jacqueline Rubio. Invocation was given by Pastor James Burke of Foothill Community Church. PUBLIC PARTICIPATION Ms. Barbara Dickerson addressed Council to announce that the Azusa Unified School District will be joining the national attendance awareness `9'm In School Campaign;" and a Citrus College Area i Candidate's Forum, September 4, 2013 at 2:30 p.m. in the Citrus College in the CFI Building of the Community Room, hosted by the Citrus Faculty Union. Mr. Ronald Lohr addressed Council expressing his appreciation to Azusa Police Officers Mike Bites and Dennis Tremblay, and all the emergency staff members for their assistance and compassion in assisting his Daughter In -Law while suffering a heart attack on July 22, 2013. Flag Salute Invocation Roll Call Also Present Pub Part B. Dickerson Comments R. Lohr Comments Ms. Lauren Ramirez, Senator for Azusa Pacific University (APU) Student Government, addressed L. Ramirez Council stating that she will like to work together with Council and welcomes their ideas and suggestions Comments on any issues they deem necessary to address. Ms. Peggy Martinez addressed Council announcing the 65 year anniversary of the Ms. Azusa program P. Martinez that was originally started by Mr. Leo Nasser, the 2013 Pageant will be held at the Azusa Woman's Club Comments on October 6, 2013, at 7:00 p.m., and rehearsals will be held the week prior, for Miss. Azusa, Miss Azusa Teen and Ms. Azusa Princes, for information call (626 6)513-6149. Mses. Adriana Mendez, Vanessa Alikhan, Alina Chan, Romietta Ellingotn, Kathy Van, and Mr. Zafar Alikhan, Rosedale residents, addressed Council expressing concerns for the lack of markings for fire hydrants, as emergency respondents are not able to access them, problems with excess parking, suggested to find alternative parking for visitors to the Garcia trail; and stated that residents created a committee to address these problems and requested that Council keep them informed regarding a possible ordinance to set up parking regulations in the area. Mses. Diana Williams, Helen Jaramillo and Carolyn Crawford, Lead in Harmony Committee, addressed Council announcing the 7th annual Lead In Harmony Conference, October 9, 2013, 9:00 a.m. at APU Upper Turner Campus Center, and invited Council to say a few words to students; they gave a brief back ground history of the program, explained that this is a national movement, this year the theme will be on bulling, and requested donations for the program, for information call (626)969-2383, or visit wvaw.lead inharmony.com Mr. Vincent Hernandez addressed Council regarding rental inspections conducted at 634 N. Angeleno St. 41; he explained that the property has violations that he reported to the Community Development Department, and expressed dissatisfaction of how the inspection were conducted. City Manager Makshanoff responded to the Rosedale parking concerns stating that fire hydrants markings will be look into and residents will be notified of the results; there are a number of streets that have not been accepted by the City, to which the Police Department cannot enforce parking regulations, staff will determine which have been accepted and report back to the residents; the Garcia Trail is owned by Rosedale Partners, and staff continues to address this problem to them in trying to find a solution; conversations on the ordinance for parking regulations originated with staff and residents as a way to find parking solutions, the Home Owners Association (HOA) has a parking plan that does not encompass all of Rosedale, staff requested that it be revised so that it can be consistent with Azusa's parking regulations, it will presented to Council once changes have been made and the HOA approves it. Regarding Mr. Hernandez' concerns, this has been an ongoing issue, he no longer a resident of Azusa, his case is now a civil matter with the owner, Community Improvement conducted inspections in that unit and the Health Department cleared the property as they saw no problems with the sewer, should the landlord rent the unit again it will continue to be part of the rental inspection program. 09/03/2013 PAGE TWO Rosedale Residents Comnmet Lead in Harmony Committee Comment V. Makshanoff Responds to Questions ■1 REPORTS, UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF Rprts/ Updates Recreation and Family Services Director Jacobs presented to each Azusa and Gladstone High Schools, a Checks to High $500.00 check from the proceeds of the Kids Come First Golf Tournament to assist them with their Golf Schools Program. Moved by Councilmember Gonzales, seconded by Councilmember Alvarez and *carried to approve a Plaques Azusa request to prepare plaques for Mr. Jim Rose Adult Community Hero and Miss. Brandy Linares Junior Heroes Community Hero to be presented on Azusa Day at the Los Angeles County Fair on September 27, 2013. 'Moved by Councilmember Carrillo, seconded by Councilmember Gonzales and *carried to approve a $100 Sponsor request for $100.00 sponsorship for Ms. Daisy Hooper, Azusa High School Student, to assist the Azusa High Volleyball team to purchase supplies. Councilmember Carrillo expressed concerns regarding the request from Citrus College stating that he $200 Sponsor wants to ensure that it will benefit Azusa students; moved by Councilmember Gonzales, seconded by Citrus College Councilmember Alvarez and unanimously carried to approve a request from Citrus College for a $200.00 sponsorship for the Gladstone High School marching Band to pay for bus transportation to attend the `'Saluting Our Veterans" event on November 7, 2013, at 11:00 a.m. at the Citrus College Campus Center. Councilmember Carrillo addressed the meeting stating that he is happy to be back after being in recess A. Carrillo from the Council Meetings the month of August; however, city business continued and Council Comments continued attending regional and committee meetings as well. Councilmember Gonzales addressed the meeting stating that he is happy to be back, congratulated Parks R. Gonzales and Recreation Director Jacobs and his staff for the successful concerts in the park this summer, and Comments announced that the "Keel Cuts" event was a success; he addressed the social hosting ordinance, which curtails underage drinking at social events and requested that an item regarding this issue be brought forward to the next Council Meeting for discussion. Councilmember Alvarez addressed the meeting stating that August was a busy month for Council; he E. Alvarez thanked all who attended to Summer Time Blues event at the Parish Hall on August 24, and was happy to Comments see the hall is being used; he thanked the Golden Days Committee for putting together the Golden Days ' program and encouraged all to support the events. Mayor Rocha addressed the meeting stating that it will be adjourn in memory of Mrs. Antonia Rubio, Mr. J. Rocha Juan Antonio Martinez, Mr. Joseph Lee Mendez, Mr. Richard Robledo, Mr. Dan Rivera and Mr. Comments Christopher Lane; Azusa has homeless voucher program in place since 2007, they verify that the children of the homeless family attend Azusa schools and place them in a local hotel while they are in transition, the most recent being Mr. Vincent Hernandez family; Housing Rights workshop hosted by the Fair Housing was a success, and future workshops will be scheduled each year. He thanked the following: - Police Officers Torres, Martinez, and Horeczko, for treating his grandchildren with compassion in the recent passing of their father, - Councilmember Gonzales and all the sponsors for the Kool Cuts event, - Parks and Recreation Director Jacobs and Recreation Coordinator Martinez, for concerts in the park, - Supervisor Molina for funding two busses to transport families to cleanup of Seal Beach, organized by the Save Our Beach Foundation; and the Azusa Beautiful, the Eagles, the Azusa American Legion for supplying the Hater; - Parks and Recreation Director Jacobs and Recreation Superintendent Gonzales for scheduling field trips during school vacations, - the Azusa Veterans Memorial Committee, Victor Padilla and his staff for painting of the Veteran's monuments and restoring the WWI monument in front of City Hall, - the Azusa Beautiful for the bench installed on the walking path from Pioneer Park to Rancho Park. He made the following announcements: ' Azusa Cares Workshop, Stranger Danger, September 7, 2013, Library Auditorium, - Yard Sales Saturday and Sunday, September 7 and 8, 2013, November 26, 2013, student's field trip to the California Science Center, - April 1, 2014, student's field trip to the J. Paul Getty Museum, - Azusa VFW will have a complete makeover courtesy of Home Depot, September 12 and 13, 2013, - Azusa and surrounding cities have been challenged by City of Hope for the "Foothill hill Fitness Challenge," the kick off event will be October 5, 2013, at City of Hope. 09/03/2013 PAGE THREE Sched Items PUBLIC HEARING - RESOLUTIONS ADOPTING 2013/14 FISCAL YEAR SC14EDULE OF FEES Pub Hrg Fees AND CHARGES. & Charges , automatic adjustment by future Consumer Price Index (CPI) of the affected fees; however, should the fees increase more than the annual CPI, or new fees be included, the matter will be presented to Council for its approval in accordance with state law. Finance Director Paragas addressed the item stating that it is recommended that Council ratify the 2013 S. Paragas City's Schedule of Fees and Charges, which recovers the city's cost of various activities and services; an Address Item addition to this year's resolutionsincludes an automatic adjustment provision that will authorize the 'Discussion was held regarding concerns of the provision of automatic increase based on the CPI, and the possible increase of certain fees that have remained the same each year; Councilmember Alvarez requested a list of specific fees that are affected by the CPI. Mayor Rocha declared the Public Hearing open; City Clerk Cornejo read a notice of proof of publication Open Hrg published in the San Gabriel Valley Tribune on August 19 and 26, 2013, and announced that there were no letters of protest received in the Office of the City Clerk regarding this item. PUBLIC HEARING - ANNUAL METROPOLITAN TRANSPORTATION AUTHORITY (MTA) Pub Hrg CMP CONGESTION MANAGEMENT PROGRAM (CMP) LOCAL DEVELOPMENT REPORT. Economic and Community Development Director Christiansen addressed the item stating that this is an K. Christiansen annual report that is required to be filed by each City in the region, there is no impact, the program has Address Item been suspended while the Metropolitan Transportation Authority (MTA) conducts a study on how to do a County wide impact fee; however, the resolution is required to be adopted each year. Mayor Rocha declared the Public Hearing open; City Clerk Cornejo read a notice of proof of publication Open 1-1rg published in the San Gabriel Valley Tribune on August 23, 2013, and announced that there were no letters of protest received in the Office of the City Clerk regarding this item. It was consensus of the Council to close the Public Hearing. Councilmember Alvarez presented a Resolution entitled: A RESOLUTION OF THE CITY OF AZUSA, CALIFORNIA, FINDING THE CITY TO BE IN CONFORMANCE WITH THE CONGESTION MANAGEMENT PROGRAM (CMP) AND ADOPTING THE 2013 CMP LOCAL DEVELOPMENT REPORT, 1N ACCORDANCE WITH CALIFORNIA GOVERNMENT CODE SECTION 65089. Moved by Councilmember Alvarez, seconded by Councilmember Gonzales and carried to waive further reading and adopt Resolution No. 13-055, by the following vote of the Council: AYES: COUNCILMEMBERS: GONZALES, CARRILLO, ALVAREZ, ROCHA NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: MACIAS PUBLIC HEARING - 2013 JUSTICE ASSISTANCE GRANT (JAG) APPLICATION. Close Hrg Reso 13-055 CMP Pub 1-1rg JAG Police Chief Gonzalez addressed the item stating that this is an annual Justice Assistance Grant, S. Gonzalez and the amounts granted vary each year; this year's grant will help fund the replacement of on Address Item old Computer Aided Dispatch (CAD)/ Records Management System (RMS). Moved by Councilmember Gonzales, seconded by Councilmember Alvarez, and *carried to accept 2013 Accept Grant JAG grant funds in the amount of $18,017. It is anticipated that the funds from this grant will be utilized towards the purchase of a new CAD/RMS system to replace a 13 year old, antiquated Lucent product. 09/03/2013 PAGE FOUR INTERVIEWS FOR BOARD AND COMMISSIONS Date for Interview of It was consensus of the Council to schedule Monday, September 9, 2013, as a date to conduct interviews Brds & Comm for the various Board and Commissions, in the Light and Water Conferrence Room. City Manager Majkshanoff requested that Consent Calendar Item D-13 be pulled from the agenda to be Pull Consent brought back to the next meeting with corrected information. Item D-13 The CONSENT CALENDAR consisting of Items D-1 through D-16, was approved by motion of Consent Cal, Councilmember Carrillo seconded Councilmember Gonzales and *carried, with the exception of Item D- D-5 Spec Call, '5, which was handled under the special call portion of the agenda, and Item D-13, which was pulled from Pull D-13 the agenda. 1. The minutes of the regular meeting of July 15, 2013, and the Special Meetings of July 22, and August Minutes 6, 2013 were approved as written. 2. The following Resolution No. 13-056, was adopted and entitled: Reso 13-056 Warrants A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. 3. In accordance with the City of Azusa Civil Service Rules and applicable Memorandum of H.R. Action Understanding(s), the Human Resources Action Items were approved as follows: Item Merit Increase and/or Regular Appointment: J. Martin, C. Kalscheuer, T. Rivera, J. Picazo, L. Maldonado. S. Sutcliffe; New Appointments: A. Juarez: Flexible Staffing Promotion: E. Vazquez; Separation: E. Grijalva, T. Corwin. 4. MIG/Hogle-Ireland consulting firm was approved to provide consultant services for the HiG/1-logle environmental impact report preparation and Specific Plan review related to the Dhammakaya Ireland Consult International Meditation Center project, and the City Manager was authorized to execute the City's Agmnt standard professional services agreement in the amount of $134,767. 5. SPECIAL CALL. Spec Call 6. The dedication and improvements of Olive Hill Park as a completed project in the Rosedale Rosedale Olive Development was accepted; and an amendment to the existing Landscape and Irrigation Maintenance Hill lmpr Contract between the City and ValleyCrest Landscape Maintenance was approved. The additional yearly increase will be $7,500.00 per fiscal year. This will increase the total annual amount of the Landscape Contract from $200,940.00 to $208,440.00. 7. An extension of the Use/Lease Agreement with Azusa Pacific University for the Slauson Park APU Pool Leas Community Pool/Azusa Aquatics Center from September 4. 2013 — May 2, 2014, was approved. Agmnt 8. The purchase of three 2013 Ford Police Interceptor Sedans, one 2013 Ford Police Interceptor SUV, Purchas P.D. and one 2013 Ford E350 XLT Passenger Van (Jail Transport Van) vehicles from Wondries Fleet Vehicles Group, in Alhambra, in an amount not to exceed 5136,051.71, were approved; and the purchase of these vehicles based on the competitive bid process completed by the County of Los Angeles as authorized under AMC Section 2-523 (e), from which they ordered Ford Police Interceptor vehicles, Order 4DPO-SI-1-1232418-1 and Contract #102811 (Ford Van), was approved. 9. The purchase of radio equipment to upgrade the Azusa Police Department dispatch center console to Purchase P.D. allow compatibility with new encrypted radio technology was approved. Radio Console 10. The City Manager was authorized to enter into a professional services agreement with Local LGC Agment ' Government Consultants, LLC ("LGC") for a period of three years beginning September 4, 2013 to June 30, 2016 at $7,000 per year for services to prepare and submit mandated cost claims to the State of California. 11. Staff was authorized to circulate a Request for Proposals (RFP) to provide consultant services for RFP for L'IR preparation of an Environmental Impact Report for the proposed Tenth Street Center Industrial Park project, located at 1001 N. Todd Avenue. 12. The selling price of the land was approved, and the Mayor was authorized to sign the agreement for Sale of Tax - the City of Azusa for the Los Angeles County Flood Control District to purchase the tax -defaulted Default property (Assessor's Identification No. 8684-025-008). Property 09/03/2013 PAGE FIVE 13. The Grant Deed from Rosedale Land Partners, LLC (RLP), conveying to the City the right of way for Grant Deed, Palm Drive, a private access to the former Monrovia Nursery, south of the Rosedale project from Rosedale Land south of Railroad right of way to Foothill Boulevard (along Sierra Madre) in order to provide access Partners to the development from Foothill Boulevard was accepted, and the City Clerk was authorized to submit it to the County Recorders Office for recordation. 14. Ms. Esther Grijalva was appointed, as a temporary part-time Accountant, and it was certified that the Temp Empl E. appointment was necessary to fill a critical position for the City of Azusa in compliance with Grijalva recent state-wide pension reform laws (AB 340). 15. The City Treasurers Report for the City of Azusa for the month of June 2013, was received, Treas Rprt reviewed and filed. 1 16. The following actions were taken regarding the Final Tract Map No. 54057-3. Tract Map No. 54057-3, It was found that this project complies with the General Plan and is consistent with the approved Rosedale tentative map and any amendments thereto; The City Manager was authorized to execute the Agreement for Completion of Public Improvements for Tract No. 54057-3 to construct the required public improvements; and the Faithful Performance Bond in the amount of $759,900, the Labor and Materials Bond for $759,900, as guaranteed by Philadelphia Indemnity Insurance Company, and cash Monument Bond in the amount of $26,000 were accepted; Pursuant to Section 66436(a)(3)(A)(i-vii) of the Subdivision Map Act, Council found that the development of the property, in the manner set forth on the subject division of land, will not _unreasonably interfere with the free and complete exercise of the easements held by Southern California Edison Company, Monrovia Nursery Company, Southern California Gas Company, San Gabriel Municipal Water District and Antonio and Lupe Figueroa; and accepted the map without the signatures of said easement holders; It was found that this project will not violate any of the provisions of Sections 66473.5, 66474. 1, and 66474.6 of the Subdivision Map Act; ' The Final Tract Map No. 54057-3 was approved, and the offers of dedication shown on said Map were accepted; The grants in Fee Simple of Lots A and M for public parks purposes was accepted; The City Clerk was authorized to endorse on the face of the map the certification of approval of said map and acceptance of dedications. SPECIAL CALL ITEMS Special Call CONTRACT WITH THE AZUSA CHAMBER OF COMMERCE FOR FISCAL YEAR 2013/14 Chamber Contract Councilmember Carrillo addressed the item stating that the Chamber has done a fantastic job with the reduce City's allowance/sponsorship; several years ago they presented a plan to become self sufficient including a 10% decrease and a 5% reduction in the ongoing years; the Redevelopment and Light and Water each funded a portion; the fund was reduced by 49% due to the loss of Redevelopment; he requested consideration to waive this year's 5% reduction. Moved by Councilmember Carrillo, seconded by Councilmember Gonzalez and *carried to Authorize staff to finalize and execute the Agreement Regarding Chamber of Commerce Funding and Support between the Citv of Azusa and the Azusa Chamber of Commerce for Fiscal Year 2013/14, with an amendment to keep the recent subsidy amount, same at last year, and not to reduce it by 5%. JOINT CITY/SUCCESSOR AGENCY CONSENT ITEMS Jnt Succr Agency PROFESSIONAL SERVICES AGREEMENT FOR PROPERTY TAX CONSULTING AND REVENUE AUDIT SERVICES Moved by Councilmember Carrillo, seconded by Councilmember Gonzales and *carried to authorize the HdL Tax City Manager to enter into a professional services agreement with HdL Coren & Cone to perform Consultant property tax consultation and audit/revenue recovery services for a five-year period, commencing July 1, Agreement 2013 and terminating on June 30, 2018. 09/03/2013 PAGE SIX SUCCESSOR AGENCY RELATED BUSINESS Councilmember Gonzales offered a Resolution entitled: A RESOLUTION OF THE SUCCESSOR AGENCY OF THE FORMER REDEVELOPMENT AGENCY OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS AND DEMANDS TO BE PAID OUT OF SUCCESSOR AGENCY FUNDS.
