The City Council of the City of Azusa met in regular session at the above date and time in the Azusa Auditorium located at 213 E. Foothill Boulevard, Azusa, CA 91702. CEREMONIAL Oaths of Office were administered to the following officers: Office to Sergeant Chris Grant, was administered by Police Chief Sam Gonzalez; Office to Corporal Jerry Jarrett, was administered by Councilmember Angel Carrillo; Corporal Bertha Parra, was administered by Councilmember Edwai&d Alvarez; Corporal Rocky Wenrick, was administered by Councilmember Robert Gonzales; Lieutenant Tim Harrington, was administered by Mayor Joseph Rocha. The City Council reconvened at 7:40 p.m., City Attorney Martinez announced that there was no City Attorney reportable action taken in closed session; the Executive Management Group in Item No. 1, was not Reports discussed by Council. Mayor Rocha called the meeting to order. Pledge to the flag was led by Ms. Peggy Martinez. Invocation was given by Reverend Rick McDonald from Azusa House of Prayer. Call to Order Flag Salute Invocation Roll Call Also Present PUBLIC PARTICIPATION Public Part Mr. Art Ramirez, Chairman to the Golden Days Committee and the members, addressed Council Golden Days announcing Azusa Golden Days, which will be held from October 5 to 12, 2013; this year's theme Committee "Turning Back the Hands of Time to 1949" as suggested by City Clerk Cornejo; they introduced parade Golden Days Grand Marshal Ms. Shirley Clark and Honored Citizens Mr. Jim Rose and Mr. Frank Perez Morales and gave brief histories of their life's journey in Azusa; he gave detailed information of the events; Mr. Reed Strege, Azusa Librarian, announced that during the week of Golden Days, if outstanding library items are returned or lost items replaced, fines will be waived, except those who are already in collections. Ms. Peggy Martinez addressed Council announcing the Ms. Azusa and Ms. Azusa Outstanding Teen P. Martinez Pageants, on October 5, 2013, in the Azusa Woman's Club; introduced the contestants, and announced a Ms. Azusa fund raiser at Yogurtland on Saturday, September 21, 2013, to help fund the pageants. Pageant Mr. Hector Elizalde, Representative for Congresswoman Grace Napolitano, addressed Council asking H. Elizalde Rep for a moment of silence for those who were killed in the recent Washington Navy Yard shooting; lie to Congress stated that recruitments for U.S. Military Academies are currently taking place at various Highr Schools; Napolitano and announced upcoming events; for information contact Congresswoman Napolitano's Office at Comments (626)350-0150 ' Mr. Arno Conley addressed Council expressing his support to build a K-8 school at Rosedale A. Conley Development. Comments Ms. Vanessa Alikhan, addressed Council regarding excessive parking at Rosedale Development by V. Alikhan visitors to the Garcia Trail and expressed her support for a K-8 School at the Development. Comments Mr. Ray Ayon addressed council regarding illegal fireworks as they pose a danger to residents and R. Ayon encouraged Council to approve the proposed ordinance to increase fines. Comments Mr. Adrian Greer, Coordinator of the My Third Place Program, and Pastors James Burke and Rick A. Greer McDonald, addressed Council regarding the two units at Atlantis Garden Apartments that are scheduled J. Burke to be demolished, and requested delay of the demolition as they plan to make a proposal for an R. McDonald alternative use of the unit. Continent Mr. Tony Alvarez addressed Council requesting traffic lights be placed on Sierra Madre by the Golf T. Alvarez Course to slow down traffic; he requested that Council promote Azusa Pacific University Football Comments Team. City Manager Makshanoff answered public questions stating that the construction of a school at the James responds Rosedale Development is an agreement between the Azusa Unified School District and the Developer, to questions only; the agreement is contingent to start construction of a school upon the enrollment of 300 students from Rosedale and once enrollment increases to 450, the Developer will transfer the school to the District to be operated; currently there are 49 students living in Rosedale, 40 are enrolled in Glendora ' School District and 9 in Azusa School District; Glendora has the capacity to accept 100 additional students from Azusa; city staff has made efforts to meet with Azusa Unified School District, but requests have been declined and the Developer does not provide information on the matter. Staff continues to work with the Developer on the parking problems and making modifications to the proposed parking regulations by the Developer, and once the city has accepted all streets, enforcements will be taken. The Atlantic Gardens units continue to be vandalized, and due to the nature of the vandalism, the demolition cannot be postponed much longer as it poses a liability to the city, and the property will eventually be transferred to Los Angeles County. Staff will contact Mr. Alvarez to find potential solutions for Sierra Madre speeding traffic; on the request to promote APU Football team at the 210 Freeway marquee, due to the former Redevelopment Agency's policy, it is limited to only featuring City of Azusa sanction events and celebrations. 09/16/2013 PAGE TWO Ms. Katie Fitzpatrick, Community Organizer at Azusa Pacific University (APU), and Mr. Reed Strege, K. Fitzpatric Azusa Librarian, addressed Council regarding the Azusa Grassroots English as a Second Language Comments (ESL) Program, to ask for partners and volunteers to help with the program; she gave a brief description of the program; announced the first tutor training on September 28, 2013, at 1:00 p.m. in the Azusa Library, classes to begin in October 2013, at various locations throughout Azusa. Misses Stacey Kim and Lorna Ramirez from APU, and Mr. Reed Strege, Azusa Librarian, addressed S. Kim Council announcing the start of the Azusa Read, Azusa Writes, Azusa Counts, Azusa Calculates, Girls Comments on the Move, Kids on the Move and Computer Lab Tutoring After School Programs, and gave a brief After School 'background of the programs, locations and schedule of classes. Ms. Elaine Stricklin addressed Council introducing the Sierra High School Under Dog Mural Program Programs E. Stricklin Project, stated that the south wall of the Azusa Veterans of Foreign War (VFW) building will be painted Comments starting November 2013, and requested donations for the project. REPORTS, UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF Repls, Updates Request from the League of Women Voters (LWV) to waive the fees for the use of the Auditorium to Request conduct a School Board Candidate's Forum on September 24, 2013, at 6:30 p.m. League Women Voters City Manager Makshanoff addressed the item stating that the LWV requested that fees be waived for the use of the auditorium, to conduct a School Board Candidates' Forum; the cost is approximately $225.00 'including the recording of the event. Discussion was held regarding candidates contributing to cover the cost and finding an alternate location as Azusa School District is a separate body from the City; Councilmember Robert Gonzales volunteered to cover for the cost of renting the auditorium by LWV on September 24, 2013. _Update on Proposed Legislation establishing National Recreation Area. Manager Legislation City Manager Makshanoff addressed the item stating that Congresswoman Judy Chu is working on a Update legislation where she will be proposing to establish a national recreation area in the San Gabriel Mountains; efforts are being made to stop the project by concerned local communities who have water rights; the San Gabriel Valley Council of Governments (SGVCOG) established an Ad Hock Committee to review proposed project; the Ad Hock Committee has written a 3 page document with concerns on this legislation and the City Managers Steering Committee has reviewed and agreed to these document, it will be presented to SGVCOG Boardmembers for approval, and the to the office of Congresswoman Chu. Changing the time to hold the Architectural Barriers Commission Meeting. ABC Chg Mtg Time It was consensus of the Council to direct staff to work with the commissioners to set up a time to hold their meetings when all the members are able to attend. Councilmember Alvarez addressed the meeting thanking the Veteran's Committee and all who attended E. Alvarez the hanging of the Military Banner for Mayor Pro -tem Macias on September 15, 2013; lie announced Comments Azusa Pacific University Football Game on September 21, 2013. Councilmember Gonzales addressed the meeting congratulating Waste Management for the opening and R. Gonzales ribbon cutting ceremony on September 13, 2013, of the Materials Recovery Facility (MRF); he Comments encouraged everyone to vote on November 5, 2013, and announced that all who vote on November 5, can receive a 10% discount from a list of restaurants who signed up with the Azusa Chamber of Commerce. Councilmember Carrillo addressed the meeting congratulating Waste Management for the ribbon cutting A. Carrillo ceremony of the MRF located on the corner of Gladstone and Irwindale; thanked the Veteran's Comments Committee for organizing the hanging of the banner for Mayor Pro -tem Macias who is currently serving; lie explained that not being able to continue with projects such as Atlantic Garden Apartments and Mercy Housing, are the result of the Governor's actions to dissolve the Redevelopment Agency. Mayor Rocha addressed the meeting thanking Waste Management for the MRF facility; thanked all who attended Mayor Pro -tem Macias banner hanging; and made the following announcements: - Clean up of Atlantis Gardens, Edgewood Shopping Center and Citrus Crossing, September 21 and 28, and October 5, 2013; - Care Packets will be made on Saturday, December 14, 2013, 8:00 a.m., at the VFW, to be mailed to service men and women; - Azusa Day at the Fair, Friday September 27, 2013, Azusa Heroes, Jim Rose and Brandy Linares, will be honored; ' - Ms. Azusa and Ms. Outstanding Teen Pageants, October 5, 2013, Azusa Woman's Club; - 5k 2k Family Run -Walk, October 6, 2013, Senior Center 7:30 a.m.; - Foothill Fitness Challenge, register at City of Hope. He congratulated Azusa Boxing Champions and requested that they be recognized with a certificate at the October 7, 2013, Council Meeting. SCHEDULEDITEMS J. Rocha comments Sched Items 1. CONTINUED PUBLIC HEARING — RESOLUTIONS ADOPTING 2013/14 FISCAL YEAR Continued SCHEDULE OF FEES AND CHARGES. Hearing Sched of Fees & Charges 09/16/2013 PAGE THREE r Finance Director Paragas addressed the item stating that two changes were made to the item: notations to the schedule with a pound sign to reflect which fees are not affected by the Consumer Price Index (CPI) fees; and the automatic CPI adjustment has been removed, proposed increase of fees will be presented to Council on an annual basis. Mayor Rocha solicited public comment, but none was received. Moved by Councilmember Carrillo, seconded by Councilmember Gonzales and unanimously carried to Hrg Closed close the hearing. Discussion was held regarding alarm system fees, the Azusa Woman's Club fees for the Quincianera Discussion events, and waving fireworks permit fees for non-profit organizations. Councilmember Gonzales offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, ESTABLISHING CERTAIN DEVELOPMENT PROJECT FEES AND SERVICE CHAGES Moved by Councilmember Gonzales, seconded by Councilmember Carrillo, and carriedo waive further reading and adopt Resolution No. 13-053, by the following vote of the Council: AYES: COUNCILMEMBERS: GONZALES, CARRILLO, ALVAREZ, ROCHA NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: MACIAS Councilmember Gonzales, offered a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, ESTABLISHING A USER FEE SCHEDULE FOR VARIOUS MUNICIPAL ACTIVITIES AND SERVICES Moved by Councilmember Gonzales, seconded by Councilmember Carrillo, and carried to waive further reading and adopt Resolution No. 13-054, by the following vote of the Council: AYES: COUNCILMEMBERS: GONZALES, CARRILLO, ALVAREZ, ROCHA NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: MACIAS 2. City Attorney Martinez addressed the item stating that the ordinance makes adults and persons in charge of the household responsible of taking certain steps to prevent the consumption of alcohol by anyone under the age of 21; e.g. controlling the issuance of alcohol and tobacco to minors in home gatherings; with the reasonable assumption that the adults were aware of such consumption, they will be cited by the Police Department. Moved by Councilmember Gonzales, seconded by Councilmember Alvarez, and *carried to waive further reading and introduce the following Ordinance No. 13-01: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, ADDING SECTIONS 46- 129 TO 46-132 TO ARTICLE IV OF CHAPTER 46 OF THE AZUSA MUNICIPAL CODE TO PROHIBIT THE HOSTING OF GATHERINGS AT WHICH ALCOHOLIC BEVERAGES AND/OR OTHER HARMFUL SUBSTANCES ARE CONSUMED BY MINORS. ' 3. INTRODUCTION OF ORDINANCE NO. 13-02, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA. AMENDING SECTIONS 30-137 AND 30-105(23) OF THE AZUSA MUNICIPAL CODE RELATING TO ADMINISTRATIVE FINES FOR THE DISCHARGE OF ILLEGAL FIREWORKS IN THE CITY. Police Chief Gonzalez addressed the item stating that this ordinance is an effort to have the maximum fine allowable by law for people that illegally discharge fireworks that do not fall raider the safe and sane category; the fines for discharging safe and sane fireworks outside the allowed perimeters of the Municipal Code will remain at $250. 09/16/2013 PAGE FOUR Resolution Establishing Development Fees Resolution Establishing Various User Fees Introduce Ordinance Re. Under Age Drinking at Residences Introduce Ordinance Re. Increase of Fines for Discharge of Illegal Fireworks Discussion was held regarding other cities already having in place the $1,000 fine for discharging illegal fireworks, increase of fines will help alleviate the problem, educating to the public, home owners ensuring that visitors don't bring illegal fireworks to the City, the Police Chief three prong approach, ordinance applying through the entire year; enforcement originally started as a criminal citation, and now is an administrative citation that can be signed by anyone present at the scene, the home where the problem was found is where the citation is given, or to the individual found on the act, and Code Enforcement is in charge of collecting the fines; most fines are paid on time, but some are appealed to a Hearing Officer. Moved by Councilmember Carrillo, seconded by Councilmember Gonzales, and *carried to waive further reading and introduce the following Ordinance No. 13-02: 'AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, AMENDING SECTIONS 30-137 AND 30-105(23) OF THE AZUSA MUNICIPAL CODE RELATING TO ADMINISTRATIVE FINES FOR THE DISCHARGE OF ILLEGAL FIREWORKS IN THE CITY Discussion The CONSENT CALENDAR consisting of Items D-1 through D-13, was approved by motion of Consent Cal Councilmember Carrillo, seconded by Councilmember Alvarez and *carried, with the exception of Item D-11 Spec Call D-11, which was handled under the Special Call Portion of the Agenda. 1. D-11: HELICOPTER SERVICE CONTRACT. Police Chief Gonzalez addressed the item to answer Mayor Rocha's question regarding the funding of Helicopter Svcs the Helicopter Service Contract, which runs from September 15, 2013, to September 15, 2018, stating Contract that the first year it will be funded by COPS/Brulte Funds; historically it has been paid from the Brulte Funds, a grant that is received every year and is distributed to pay Police Department needs, but it is not 100% guaranteed; if funds were to exhaust before the end of the contract, funds would need to be re- addressed and presented to Council for approval, or stop service all together. for which the agreement includes a section that it can be terminated with a 30 day notice. Moved by Mayor Rocha, seconded by Councilmember Carrillo, and *carried to approve a five (5) year, Helicopter service contract with the City of EI Monte.
