The City Council of the City of Azusa met in regular session at the above date and time in the Azusa Auditorium located at 213 E. Foothill Boulevard, Azusa, CA 91702. CEREMONIAL Ceremonial City Librarian Reed Strege, and Senior Librarian Leila Hassen, presented Certificates of Appreciation to Certificates the contributors of the "Reading is so Delicious, 2013 Summer Reading Program." Library Spnsrs The entire Council presented certificates of recognition to the Azusa Youth Boxing Club Boxers: Jousce Certificates to Gonzales, Jajaira Gonzalez and Jaonjairo Gonzalez, for winning the Gold Medal, and Jesus Santoyo and Boxers Jose Esteban Velasquez, for their participation, at the Annual Desert Showdown Boxing Tournament held July 8-13, 2013, at the Fantasy Springs Casino, Indio, California. CLOSED SESSION Closed Session The City Council Recessed to closed session at 6:48 p.m. to discuss the following: CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION Pursuant to Potential 'California Government Code, Section 54956.9(d)(4). Appeal, Donna Ramirez vs. City of Azusa, Workers Compensation Appeals Board number ADJ6767235 Ramirez The City Council reconvened at 7:30 p.m., City Attorney Hull announced there was no reportable action City Attorney taken in closed session. Reports Mayor Rocha called the meeting to order. Call to Order Pledge to the flag was led by 2013-14 Miss. Azusa Valeria Vazquez and Miss. Azusa Outstanding Teen Flag Salute Daisy Hooper. Invocation was given by Mr. Joseph Guarrera. Invocation ROLL CALL Roll Call 'PRESENT: COUNCILMEMBERS: GONZALES, CARRILLO, ALVAREZ. ROCHA ABSENT: COUNCILMEMBERS: MACIAS ALSO PRESENT Also Present City Attorney Hull, City Manager Makshanoff, Director of Public Works/Assistant City Manager Haes, Police Chief Gonzalez, Community Development Director Christiansen, Human Resources Director Neiuber, Utilities Director Morrow, Assistant Director of Community Development McNamara, City Engineer Hassel, Information Officer Quiroz, City Clerk Cornejo, Deputy/Assistant City Clerk Hernandez. PUBLIC PARTICIPATION Public Part Ms. Peggy Martinez addressed Council to introduce the 2013-2014, Miss. Azusa Valeria Vazquez and P. Martinez Miss. Azusa Outstanding Teen Daisy Hooper, and thanked everyone for their support to the Pageant. Comments Mr. Art Ramirez, Golden Days Chairman, addressed Council to give an update on Golden Days events, A. Ramirez and announced that Mr. Bryan Clay, two time Olympic Champion, 2004 and 2008, will be the parade Comments Grand Marshal; he presented Councilmember Alvarez with his official Golden Days Badge. Mr. Steven Castro, Chamber of Commerce Chief Executive Officer, addressed Council to announce that, S. Castro as suggested by Councilmember Gonzales, 20 Azusa restaurants will be offering a 10% discount on Comments election day, as an incentive to those who vote; he also invited all to attend the annual Taste of the Town, on Tuesday, October 8, 2013. Ms. Christina Madrid addressed Council to announce that she is running for the Citrus College Board of C. Madrid Trustees, presented her position of what she has to offer to the community if elected, and requested Comments everyone's vote and support. REPORTS, UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF Rprts/Updates Mr. Raul Romero from the San Gabriel Valley Municipal Water District, gave a presentation regarding R. Romero 2012 activities in Azusa, which included cost savings and water conservation; he announced 2013 goals SGV Municipal and current plans to fund the installation of a new hydraulic plant in Azusa, and to work with other water Water District districts on a regional approach for water issues; he gave highlights of work in progress, operational financial status, and school youth education outreach; he also announced their new web page. Resolution opposing any bills or measures that would weaken the Medical Injury Compensation Reform Reso MICRA Act (MICRA), increase health care costs for state and local governments and limit patient access to health care services. Councilmember Carrillo and City Manager Makshanoff addressed the item explaining that this will authorize staff to forward the resolution to elected representatives to inform them of Azusa's opinion in the proposed legislation that would weaken MICRA, which would potentially increase health care cost 'that could threaten the closure of local community clinics. Councilmember Gonzales introduced a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA OPPOSING ANY BILLS OR MEASURES THAT WOULD WEAKEN THE MEDICAL INJURY COMPENSATION REFORM ACT (MICRA), INCREASE HEALTH CARE COSTS FOR STATE AND LOCAL GOVERNMENTS AND LIMIT PATIENT ACCESS TO HEALTH CARE SERVICES. Moved by Councilmember Gonzales, seconded by Councilmember Carrillo, to waive further reading and adopt Resolution No. 13-C77 by the following vote of the Council: AYES: COUNCILMEMBERS: GONZALES, CARRILLO, ALVAREZ, ROCHA NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: MACIAS Councilmember Carrillo addressed the meeting commending all first respondents for a job well done on the recent Madre Fire; he announced that he and Councilmember Alvarez, attended the League of California Cities' Annual Conference on September 18-20, 2013, in Sacramento, workshops included dealing with labor negotiations and other topics affecting communities, but water was the main topic of discussion at the conference; representatives are working on a potential water bond to get funding to secure a water source and a delivery system from Northern California, and noted that Azusa is currently experiencing water rationing. He thanked the Golden Days Committee for the Golden Days Activities, and congratulated the newly elected Miss. Azusa and Miss. Azusa Outstanding Teen. Reso 13-C77 Opposing Bills that Will Weaken MICRA A. Carrillo Comments Councilmember Gonzales addressed the meeting thanking Mr. and Mrs. Steve and Mercedes Castro, for R. Gonzales putting together the incentive program for people to vote, and hopes other cities offer similar programs; Comments he encouraged all to participate and enjoy Golden Days; and he sent his condolences to the Pedroza family for the passing Mr. Alfred "Dorn" Pedroza. Councilmember Alvarez addressed the meeting announcing the upcoming School Board Elections and E. Alvarez provided his phone number for anyone interested in knowing which candidate he endorses; he thanked Comments all who where involved and supported the recent Miss. Azusa and Miss. Azusa Outstanding Teen Pageant on October 5, and the 5k run on October 6; and announced October 12, 2013 Azusa Pacific University football game. 10/07/2013 PAGE TWO Mayor Rocha addressed the meeting announcing that it was to be adjourned in memory of Mr. Alfred .I. Rocha "Doro" Pedroza; he thanked the following: Los Angeles County Fair for honoring Azusa Community Comments and Youth Heroes, those who participated in the City of Hope Foothill Fitness Challenge, and all the first respondents on the Madre Fire, and noted that a presentation on how to plan for emergencies will be made after the next Utility Board Meeting of October 28, 2013. He congratulated Miss. Azusa and Miss Azusa Outstanding Teen, and asked to keep service men and women in daily prayers. It was consensus of Council to give direction to staff to provide a $100.00 sponsorship to Nathan Nunez Two Jr. from Gladstone High School who will be representing Azusa in the Lifting Weight Competition in Sponsorships Las Vegas, Nevada, and a $200.00 sponsorship to the Azusa at Boxing Club. The CONSENT CALENDAR consisting of Items D-1 through D-9, was approved by motion of Consent Cal Councilmember Gonzales, seconded by Councilmember Alvarez and *carried. 1. The minutes of the regular meetings of September 16, 2013, and the special meeting of September Minutes 23, 2013, were approved as written. 2. The following Resolution No. 13-C78, was adopted and entitled: Reso Warrants A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. 3. In accordance with the City of Azusa Civil Service Rules and applicable Memorandum of H.R. Action Understanding(s), the Human Resources Action Items were approved as follows: Item Merit Increase: V. Benavidez, A. Martinez Separation: N. Carpenter 4. Authorization was give for Azusa's participation in the East San Gabriel Valley Regional JPA- ESGV Communications Network, to establish a Joint Powers Agreement (JPA); and the Mayor was Regional authorized to execute the agreement. Comm Ntwrk 5. The acceptance of a grant award from the Library Services and Technology Act (LSTA), and the LSTA Grant budget amendments associated with this grant award, were approved. 6. The acceptance of the California Library Literacy Services (CLLS) award from the California State CLLS Grant Library in the amount of $10,000, and the budget amendment associated with this grant, were approved. 7. The following actions regarding Final Tract Map 54057-10, Wisteria Rosedale, L.P., Monrovia Nursery, were taken: It was found that the project complies with the General Plan and is consistent with the approved tentative map and any amendments thereto; the Agreement for completion of Public Improvements for Tract No. 54057-10 to construct the required public improvements was approved, and the City Manager was authorized to execute the same; the Faithful Performance Bond in the amount of $311,453, the Labor and Materials Bond for $311,453, as guaranteed by Philadelphia Indemnity Insurance Company, and cash Monument Bond in the amount of $4,000, were accepted; pursuant to Section 66436(a)(3)(A)(i-vii) of the Subdivision Map Act, it was found that the development of the property, in the manner set forth on the subject division of land, will not unreasonably interfere with the free and complete exercise of the easements held by Monrovia Nursery Company, Southern California Gas Company, Azusa Water Development Company and Rosedale Land Partners II, LLC; and the map without the signatures of said easement holders was accepted; it was found that this project will not violate any of the provisions of Sections 66473.5, 66474.1, and 66474.6 of the Subdivision Map Act; the Final Tract Map No. 54057-10 and the offers of dedication shown on said Map, were approved; the grants in Fee Simple of Lot D for public parks purposes were accepted; the grants in Fee Simple of Lot E for street, highway and other public purposes were accepted; the City Clerk was authorized to endorse on the face of the map the certificates, which embodies the approval of said map and acceptance of street, storm drain, sewer and public utility dedications. 8. The City Manager was authorized to execute an agreement with Enterprise Fleet Services for the lease of 5 vehicles at an annual cost of $57,217.20. The City Treasurer's Report for the City of Azusa for the month of August, 2013, was received, Treas Rport reviewed, and filed. Moved by Councilmember Carrillo, seconded by Councilmember Gonzales and carried to adopt Resolution No. 13-RI3, by the following vote of the Council: AYES: COUNCILMEMBERS: GONZALES, CARRILLO, ALVAREZ, ROCHA 'NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: MACIAS ORDINANCE/SPECIAL RESOLUTIONS Councilmember Gonzales offered an Ordinance entitled: Ordinance Hosting Social AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, ADDING SECTIONS 46- Gatherings 129 TO 46-132 TO ARTICLE IV OF CHAPTER 46 OF THE AZUSA MUNICIPAL CODE TO PROHIBIT THE HOSTING OF GATHERINGS AT WHICH ALCOHOLIC BEVERAGES AND/OR OTHER HARMFUL SUBSTANCES ARE CONSUMED BY MINORS. 'Moved by Councilmember Gonzales, seconded by Councilmember Alvarez, to waive further reading and adopt Ordinance No. 13-01, by the following vote of the Council: AYES: COUNCILMEMBERS: GONZALES, CARRILLO, ALVAREZ, ROCHA NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: MACIAS Councilmember Carrillo offered an Ordinance entitled: Ordinance Fire Increase of 'AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, Works Fines AMENDING SECTIONS 30-137 AND 30-105(23) OF THE AZUSA MUNICIPAL CODE RELATING TO ADMINISTRATIVE FINES FOR THE DISCHARGE OF ILLEGAL FIREWORKS IN THE CITY.
