The City Council of the City of Azusa met in regular session at the above date and time in the Azusa Auditorium located at 213 E. Foothill Boulevard, Azusa, CA 91702. CLOSED SESSION Closed Session The City Council Recessed to closed session at 6:31 p.m. to discuss the following: CONFERENCE WiTH LABOR NEGOTIATOR - Gov. Code Sec. 54957.6 Labor City Negotiators: City Manager Makshanoff Negotiators, Organizations: ACEA (Azusa City Employees Association) and AMMA (Azusa Middle ACEA, Management Association). AMMA The City Council reconvened at 7:30 p.m., City Attorney Martinez announced that there was no City Attorney reportable action taken in closed session. Reports Mayor Rocha called the meeting to order. Pledge to the flag was led by family members of the late Mr. Luis Miranda. Invocation was given by Mr. Ray Chavira. PUBLIC PARTICIPATION Mr. Jorge Rosales addressed the meeting to wish everyone a Merry Christmas and Happy New Year Call to Order Flag Salute Invocation Rall Call Staff Present Public Part J. Rosales ' Mr. Mike Milton addressed the meeting to announce a toy drive at his house, Friday December 20, M. Milton 2013, 6-11:00 p.m., 210 E. Viewcrest Drive, and photos with Santa 7-9:00 p.m.; he wished everyone a Comments Merry Christmas and Happy New Year. Mr. Ray Chavira addressed Council to thank them for honoring the late Mr. Luis Miranda, WWII R. Chavira Veteran and a life-long resident of Azusa, and for welcoming his family to the meeting. Comments REPORTS, UPDATES COUNCIL BUSINESS AND ANNOUNCEMENTS -STAFF Reprts/Updates City Manager Makshanoff announced that Consent Calendar Item D-8 was being removed from the J. Makshanoff agenda due to California Environmental Quality Act (CEQA) related issues that need to be addressed; Comments staff will bring back the item to a future meeting for consideration; he wished everyone a Merry Christmas and Happy New Year. Moved by Councilmember Alvarez, seconded by Councilmember Gonzales and *carried to approve a APU Football request for certificates for: Azusa Pacific University (APU) Football Team congratulating them for Team winning the Great Northwest Athletic Conference (GNAC) Championship, the Head Coach Victor Certificates Santana Cruz for leading the team, and the Athletic Director Gary Pine for his oversight and management of the program; certificates will be presented February 3, 2014. Moved by Councilmember Gonzales, seconded by Councilmember Carrillo and *carried to approve a Certificate request for a certificate for the APU Women's Soccer Team for winning the championship; certificate APU Woman's to be presented February 3, 2014. Soccer Team Councilmember Carrillo encouraged everyone to do their Christmas shopping in Azusa, and reminded A. Carrillo ' all that Light & Water offers a rebate on television and/or computer Light -emitting Diodes (LED) Comments screens; he thanked staff and colleagues for the time and dedication to the city and community; and wished everyone a Merry Christmas and Happy New Year. Councilmember Gonzales wished everyone a Happy Holiday season and a prosperous 2014; he thanked R. Gonzales staff for their daily work and Public Works for hanging the holiday ornaments on Azusa Ave. Comments Councihnember Alvarez stated that Edwards Park was a success, as it is used on a regular basis, and E. Alvarez thanked staff for getting that project completed; he wished everyone a Merry Christmas and a Comments prosperous 2014, reminding everyone to be safe. Mayor Rocha announced that the meeting was to be adjourned in memory of Michael R. Lee and Alberto M. Ramos; he thanked the following: Azusa Unified School District (AUSD) for the 15th annual holiday food drive; the Chamber of Commerce, Azusa Fraternal Order of Eagles 42810 and National Guard Armory for the 7th annual food and toy drive; the community, staff and colleagues for donations of items that were mailed on December 7, 2013, to Azusa service men and women. He made the following announcements: the Milton's toy drive December 20, 2013, and at Lee Elementary School, December 21, 2013; Azusa Boxing Club car wash, Saturday, December 21, 2013, 8-1:00 p.m. at Benny's Liquor store. He asked to keep service men and women in daily prayers and wished all a Merry Christmas and Happy New Year. INTRODUCTION OF AN ORDINANCE AMENDING SECTION 3-3 OF CHAPTER 3 OF THE AZUSA MUNICIPAL CODE TO INCREASE THE SETTLEMENT AUTHORITY OF THE CITY MANAGER FROM $10,000 TO $25,000 FOR RESOLVING CLAIMS AGAINST THE CITY. Human Resources Director Neiuber addressed the item stating that this ordinance amends Section 3-3 of Chapter 3 of the Azusa Municipal Code, increasing settlement authority for the City Manager, from the current $10,000 to $25,000; a public hearing on this subject will held at a future meeting. Moved by Councilmember Carrillo, seconded by Councilmember Gonzales and *carried to waive further reading, read by title only and introduce Ordinance No. 13-05, amending Section 3-3 of Chapter 3 of the Azusa Municipal Code to increase the settlement authority of the City Manager from $10,000 to $25,000 for resolving claims against the City. INTRODUCTION OF AN ORDINANCE, AMENDING CHAPTER 14 OF THE AZUSA MUNICIPAL CODE PERTAINING TO THE REGISTRATION AND MAINTENANCE OF VACANT AND ABANDONED PROPERTIES. Economic and Community Development Director Christiansen addressed the item stating that the ordinance adds a chapter to the Municipal Code that requires owners to register and maintain vacant and abandoned properties, which is basically a foreclosure ordinance. He responded to questions posed by Council stating that section 14-453(A) sentence "...employment of an on-site security guard..." would be an additional tool that staff can use to safeguard vacant ' properties; however it can be removed as it is not a requirement to the ordinance, Council can decide what measures to take if any vacant property requires security; staff currently assigned to monitor these type of properties, do not have the expertise in handling these cases, and to determine if outside expert assistance is needed, the first step is the adoption of the ordinance, then solidify fines and fees, which staff will do next year together with the schedule of fees, and during the process staff can put out a request for proposals for consulting or professional services that specialize in this field. Christiansen Answers Questions Further discussion was held regarding neighbors taking care of vacant properties, the current number of Discussion vacant homes to be approximately 198, how the foreclosure process works, staff to enforce registered owners to maintain vacant properties, and for banks to know that the purpose of this ordinance is to have stricter laws for maintaining the neighborhood and the housing stocks. 12/16/2013 PAGE TWO City Attorney Martinez stated that the title of the ordinance was being revised, and the section numbers M. Martinez, to be changed as stated on the title, as follows: Revisions to Ordinance AN ORDINANCE OF THE CITY OF AZUSA CALIFORNIA ADDING ARTICLE 17, SECTIONS 14-456 TO 14-466 PERTAINING TO THE REGISTRATION AND MAINTENANCE OF VACANT AND ABANDONED PROPERTIES Moved by Councilmember Gonzales, seconded by Councilmember Carrillo and *carried, to waive further reading, read by the title only and introduce an Ordinance No. 13-06, with the following revisions: revise title and section numbers as stated, and remove from section 14-463(A) sentence `...employment of an on-site security guard...." The CONSENT CALENDAR consisting of Items D-1 through D-10 was approved by motion of Consent Cal Councilmember Gonzales, seconded by Councilmember Alvarez and *carried, with the exception of D-4 Spec Call Item D-4 which was handled under the Special Call Portion of the Agenda; and Item D-8 which was & D-8 removed from the agenda. Removed 1. The minutes of the regular meeting of December 2, 2013, and the special meeting of November 25, Minutes 2013, were approved as written. 2. The following Resolution No. 13-C93, was adopted and entitled: Reso Warrants A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. 3. In accordance with the City of Azusa Civil Service Rules and applicable Memorandum of H.R. Action Understanding(s), the Human Resources Action Items were approved as follows: Items Merit Increase and/or Regular Appointment: J. Poulos, G. Espinoza. New Appointments: J. Palacio. Spec Call 4. SPECIAL CALL ITEM Reso Response 5. The following Resolution No. 13-C94, was adopted and entitled: Alarms Fees A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ESTABLISHING A FEE AND FINE SCHEDULE FOR THE CITY'S REGULATORY PROGRAM FOR ADMINISTERING AND MANAGING THE CITY`S RESPONSE TO ALARMS. 6. The City Treasurer's Report for the City of Azusa for the month of November, 2013, was received, Treas Rprt reviewed, and filed. 7. The following Resolution No. 13-C95, was adopted and entitled: Reso Authorize City Manager A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA AUTHORIZING to Enter ENTERING INTO A MASTER AGREEMENT AND A PROGRAM SUPPLEMENT Agreement AGREEMENT WITH CALTRANS FOR THE REHABILITATION PAVEMENT ON AZUSA AVENUE PROJECT NO. HPLUL-5112 (014). 8. The item regarding a request to authorize staff to award the Safe Routes to School Project No. Pulled Item SR2SL-5112(017) to E.C. Construction was removed from the agenda. SRS 9. The professional services agreement with R3 Consulting Group, Inc., for not -to -exceed amount of R3 Consulting $24,930, to review Athens Services' increased transportation costs following closure of Puente Group Hills Landfill, was approved. 10. Amendment No. 4 to the City Manager's Employment Contract that repeals provisions freezing Amend #4, authorized vacation accrual cash -outs approved by the City Council in 2012 was approved. Mngr Contract SPECIAL CALL ITEMS FALSE ALARM MANAGEMENT AGREEMENT. Mayor Rocha addressed the item requesting information on what sort of public education awareness and information regarding Azusa alarms management program will the consultant provide to the general public; Police Chief Gonzales responded that the contracting group PMAM, is a firm that specializes in alarm management for municipalities, the consultant acquires vendor information from the alarm providers, i.e. AT&T, Time Warner, and sends customers information about the program, proper use and responsible ownership of alarms. 12/16/2013 PAGE THREE Spec Call PMAM False Alarm Consulting Agreement Moved by Councilmember Gonzales, seconded by Councilmember Alvarez and *carried to award the false alarm management contract to PMAM Corporation, and to authorize the City Manager to execute the agreement on behalf of the City of Azusa. SUCCESSOR AGENCY RELATED BUSINESS Councilmember Gonzales offered a Resolution entitled: A RESOLUTION OF THE SUCCESSOR AGENCY OF THE FORMER REDEVELOPMENT AGENCY OF THE CITY OF AZUSA ALLOWING CERTAIN CLAIMS AND DEMANDS TO BE PAID OUT OF SUCCESSOR AGENCY FUNDS. ' Moved by Councilmember Gonzales, seconded by Councilmember Alvarez and carried to waive further reading and adopt Resolution No. 13-R16, by the following vote of the Council: AYES: COUNCILMEMBERS: GONZALES, CARRILLO, ALVAREZ, ROCHA NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: MACIAS It was consensus of the Council to adjourn the meeting in memory of life-long residents of Azusa Messrs.
