MONDAY, APRIL 21, 2014 — 6:30 P.M.
The City Council of the City of Azusa met in regular session at the above date and time in the Azusa Auditorium
located at 213 E. Foothill Boulevard, Azusa, CA 91702.

The City Council Recessed to closed session at 6:32 P.M. to discuss the following:

REGULAR MEETING
The City Council reconvened at 7:30 P.M., City Attorney Martinez announced that all Council was
present at Closed Session, they heard a presentation from the negotiating organizations and there was
no reportable action taken.
Mayor Rocha called the meeting to order.

PUBLIC PARTICIPATION Pub Part
Mr. Javier Perez addressed the Council expressing concern in the cost of obtaining a City Building J. Perez
Permit to build a patio, and requested that Council look into the possibility of reducing those fees. Comments
Ms. Barbara Dickerson, Boardmember for the Citrus College Board of Trustees, gave an update on B. Dickerson
Citrus College programs, which include a newsletter sent to Azusa High School students identifying 10 Comments
reasons why students should consider Citrus College; she further announced students programs that
will be held during the summer, 2014.
Mr. James Kitto addressed the Council regarding parking violations issued to his motor home by City J. Kitto
Staff; his motor home has been impounded, he is now homeless and living at the encampment at the Comments
'Canyon; a two week notice has been issued to vacate the Canyon, and he requested that the evacuation
be extended to at least 4 weeks to allow him time to find housing.
Mr. Armando Yanez, representing Assemblyman Roger Hernandez, addressed the meeting to invite A. Yanez
everyone to a Veterans Community Resource Fair, May 9, 2014, 10:00 A.M., at Citrus College. Comments
Mr. Salvador Pedregon addressed the Council regarding Senate Bill 1266 (SB 1266), which allows S. Pedregon
transgender youth to use whatever bathroom and participate on whichever sports team they believe Comments
matches their gender identity; he requested that Council take action to prevent this bill from passing.
Ms. Vanessa Alikhan addressed the Council regarding a 2 acre parcel of land located on 9th Street that V. Alikhan
was granted to the Rosedale Home Owners Association (HOA) by Rosedale Partners, expressing Comments
concern that the land is un -kept and in public view adjacent to the Goldline; she proposed a dog park
and wild flower meadow to be built on the parcel, and requested Council's support on this project.
Mr. Dan Simpson addressed the Council regarding a proposed Legislation by Congresswoman Judy D. Simpson
Chu for a National Recreation Area (NRA), at the Angeles National Forest; the NRA would take some Comments
of the areas at the upper Canyon and turn them into scenic and wilderness areas; the San Gabriel Valley
Council of Governments (SGVCOG) has been actively involved in the review process; he suggested
that public meetings be conducted to discuss this Legislation.
Mr. Jorge V. Rosales addressed the Council stating that the updated Goldline parking structure design J. Rosales
presented at a recent Planning Commission Meeting, is different than the original design, and requested Comments
a public presentation of the updated design; he addressed Item D-3, a Letter of Agreement (LOA) for
'the Intermodal Transit Center, stating that the dollar amount is higher than the amount approved by
Council, it does not address the value of the land contributed by the City, and the total cost for the
project is different than what was originally stated; he suggested that Council review the LOA before
considering its approval.
Ms. Mercedes Castro addressed the Council thanking them for attending the recent Chamber Mixer, M. Castro
and invited them to: the Texas Hold'Em & Casino Night and Bunco, Friday, May 16, 2014, at the Comments
Eagles Club, and the Scrabble Tournament/Dinner, May 22, 2014, 6:00-8:00 P.M. at the Azusa Library
to benefit the Literacy Program; tickets are available at the Chamber of Commerce for both events.
City Manager Makshanoff answered public comments: staff will contact Mr. Perez regarding his
concerns on the cost of Building Permits, and Mr. Kitto regarding his concerns on the two week notice
issued to the homeless encampments in the Canyon; he suggested that Mr. Pedregon contact the Azusa
Unified School District regarding SB 1266; staff has been discussing the dog park suggested by Ms.
Alikhan, and is looking at the specific plan to see what is allowed in that area and what is the
responsibility of the HOA on this land, they will also contact the Water Resource Board and L.A. Co.
Flood Control to find out if dog waste can have a negative impact in this area; the SGVCOG has been
actively involved in the proposed NRA Legislation, as stated by Mr. Simpson, and has taken a position
on the issue, the way this Legislation was presented by Congresswoman Chu, did now allow enough
time to hold public meetings, Utilities Director Morrow has been reviewing it and will be presenting it
at the next Utility Board Meeting, this topic has been discussed with Congresswoman Napolitano's
Office, and staff will continue the dialog with Congresswoman Chu's Office; regarding Mr. Rosales'
comments on Item D-3, they will be answered at the time the item is discussed.
Councilmember Carrillo addressed the meeting stating that he has been discussing the NRA issue with
the Council, it is a topic that he has not taken lightly; Congresswoman Chu initially informed the cities
that this project was going to move forward and they could participation in the review process, but the
time allowed for the review was limited; Azusa and surrounding Cities have expressed concerns on the
ramifications of water rights; as a result, the SGVCOG created an Ad Hoc Committee consisting of a
number of cities and water agencies to participate in the discussions; Azusa Utilities Director Morrow
has been working with other water agencies giving his input; the SGVCOG needed to take a vote on
April 17, 2014, and, unfortunately, there was not enough time for public input; this Legislation was not
proposed by the cities, it was originally proposed by former Congressmembers Solis and Drier.

Utilities Director Morrow addressed the meeting stating that the proposed Legislation on the NRA has G. Morrow
been discussed at previous Utility Board Meetings; it is an issue of great importance to the Cities and Comments
the water agencies; Azusa is the most affected given its location, as the City's water rights emanates
from the mountains and river; the first draft of the Legislation was poor with respect to protecting the
City's water rights, and has since been revised; staff and the different water associations to which the
City belongs, feel that the revisions will protect water rights under the Legislation; at the next Utility
Board Meeting, the Board will hear on the subject and staff will be proposing additional revisions to
the wording to add clarification to some of the definitions; within a month, further discussions will be
held on the two additional pieces of Legislation regarding the wilderness and the wild scenic
designations; additional designations tend to be more complex and staff will ensure that Azusa is
protected; he congratulated the SGVCOG and the Ad Hoc Committee for a job well done in
representing the cities and the water utilities, as all the concerns were addressed and considered.
Moved by Councilmember Carrillo, seconded by Mayor Pro -tem Gonzales, to approve Councilmember Ratify Letter
Macias' request to ratify the letter in support of Assembly Bill 257 (AB 257), by the following vote of AB 257
the Council:

Carrillo's request to authorize the Mayor to sign a letter of support for the San Gabriel River Discovery Discovery
Center, by the following vote of the Council: Center

Selection of Council for City Representative and Alternate to the California Contract Cities Representative

Carrillo as the representative to the California Contract Cities Association, by the following vote of the
Council:

Mayor Pro -tem Gonzales addressed the meeting congratulating the Parks and Recreation Department R. Gonzales
for the recent and well attended Easter Egg Hunt, and announced: second Annual Shredathon, April 26, Comments
2014, 9:00-12:00 P.M., Azusa Light and Water; Cinco de Mayo celebration, April 27, 2014, 12:00-6:00
P.M. in front of City Hall.
Councilmember Macias addressed the meeting stating that his request to ratify the letter in support of U. Macias
AB 257, is for the extension of the GoldLine from Montclair to the Ontario Airport; he expressed Comments
concern regarding the proposed NRA and its direct impact to Azusa; he discussed the need for
additional funds to help with the anticipated cost for the necessary first responders, parking
enforcement, street lighting, trash collection and increase asphalt maintenance, as a result of having
additional people travel through City streets, and he feels that Azusa may not have enough
representation at the Ad Hoc Committee; he requested from staff additional information regarding the
property addressed by Ms. Alikhan.
Councilmember Alvarez addressed the meeting to announce the Azusa Youth BBQ, Saturday June 7, E. Alvarez
'2014, 5:00 P.M.; he thanked all who assisted with the beach clean-up on April 19, 2014, and on the Comments
recent Easter Egg Hunt Event.
Mayor Rocha addressed the meeting stating that it was to be adjourned in memory of Mr. Manuel J. Rocha
Valenzuela, former longtime Azusa resident; he thanked: Parks and Recreation Director Jacobs, for the Comments
past activities; Ms. Alikhan for addressing the un -kept parcel, stating the Azusa has a large group of
volunteers that can help with the cleanup if allowed; Azusa Beautiful and an anonymous donor, for
their donation, which helped bus people to Seal Beach for the Save Our Beach program, on April 19,
2014; he announced: Father Boyle film screening of G -Dog, April 25, 2014, 6:00 P.M., at Azusa
Pacific University (APU), and Picnic with Father Boyle April 26, 2014, 5:00 P.M., in front of City
Hall; Relay for Life, April 26, 2014, 9:00 A.M., Northside Park; Cinco de Mayo Celebration, April 27,
2014, in front of City Hall; and Parent University, 8:00 A.M., at Azusa High School; he asked to keep
service men and woman in daily prayers.

Letter of Agreement (LOA) between the City of Azusa and Los Angeles County Metropolitan LOA with
Transportation Authority (LACMTA) for $3,520,190 in grant funding for the Azusa Intermodal LACMTA
Transit Center.
'Senior Management Analyst Del Toro responded to questions posed by Councilmember Alvarez and
Mayor Rocha stating that the funds stated in Schedule A, from Proposition C and Measure R, are sales
tax revenue that are guaranteed and set aside for this project; staff has already been utilizing the
Safetea-Lu Grant funds for the cost associated with the Environmental Impact Report (ETR); there is a
need to approve the LOA in a timely fashion, or there may be the risk that the funds are redistributed to
another agency, as stated on the conditions; for the purpose of the LOA, the 400 parking spaces for
transit users as stated on Attachment B, do not relate to Foothill Transit at this time, this LOA is for the
commitment of Azusa in terms of what the total cost will be and what the total allocation will be for the
City; per the requirements on the original grant application, the City is legally required to provide up to
150 spaces for patrons, but the City will grant 400 spaces as previously discussed, this is also addressed
in the parking plan; the distribution of parking spaces take separate actions by the Council.
