Foothill Boulevard, Azusa, CA 91702. Mayor Rocha called the meeting to order. Call to Order ROLL CALL: Roll call was taken by City Clerk Cornejo. Councilmember Macias joined the meeting Roll Call at 6:31 P.M., and Councilmember Carrillo at 6:33 P.M., after the roll call by the City Clerk. Literacy Prog The Mayor and Councilmembers presented Certificates of appreciation to the Sponsors of the 2014 Cert Golf Kids Come First Golf Tournament. Sponsors The Mayor and Councilmembers presented donation checks to Gladstone High School and Azusa High Check to High School Golf Teams, from the proceeds of the 2014 Kids Come First Golf Tournament. Schools The Mayor and Councilmembers presented Certificates to the Azusa Youth Boxing Club Boxers for Cert Boxing their participation and winnings at the 13th Annual Desert Showdown Amateur Boxing Championship. Club The Mayor and Councilmembers presented a Certificate to JaJaira Gonzalez for winning the Gold Cert JaJaira Medal at the 2014 Youth Olympic Games in Nanjing, China. She introduced the Hometown Heroes for the Azusa Day at the Los Angeles County Fair on September 26, 2014: Ms. Aileen Salmaron, Gladstone High School student who co -runs a Folklorico Dance Class from Kindergarten to 5th grade; Ms. Mercedes Castro, a local business owner, previous Chamber of Commerce President and Chairperson for the recent Library scrabble fundraiser; Ms. Terri Harbin, a lifelong Azusa resident who volunteers and promotes Veterans Programs. Fomba addressed the Council to give an overview on the homeless program and asked the Council to continue Comments 'partnering with community organizations to end homelessness in the Valley. Ms. Peggy Martinez addressed the meeting to congratulate and wish good luck to City Manager James P. Martinez Makshanoff on his new position with another city, and asked that Council consider that the recruitment Comments for the selection of the new City Manager, be open to the community and suggested a committee for the recruitment process as this has been done in the past. She announced the Azusa Golden Day's Talent Show on October 8, 2014. Gonzales Kool Cuts Event, close to 250 hair cuts were done, and back packs and school supplies giveaway; he Comments requested certificates of appreciation be presented at the meeting of September 15, 2014, to all the donors and stylists. He announced the opening season of Azusa Pacific University (APU) football on Thursday, September 4, 2014, at Citrus College. 09/02/2014 PAGE TWO Councilmember Carrillo addressed the meeting stating that he was glad to resume business after a A. Carrillo recess for the month of August; Golden Days will begin soon and children are back to school; he asked Comments all to use caution and be on the look out for students crossing the streets. Councilmember Macias addressed the meeting with remarks of support towards the Council's U. Macias participation, as proposed by Ms. Peggy Martinez, in the Azusa Golden Days Talent Show event; he Comments hoped that everyone had a great summer and enjoyed being with family as much as he did; he thanked the Police Department for the DUI check points and their presence at the City Parks during the summer; he invited all to the Azusa Day at the Los Angeles County Fair, on September 26, 2014, to celebrate with Azusa's Heroes. Councilmember Alvarez addressed the meeting stating that he hoped everybody had nice Labor Day; E. Alvarez 'he announced that students are back in school, and reminded everyone of the 2K/5K Family Run/Walk Comments on October 5, 2014. Mayor Rocha stated that the meeting would be adjourned in memory of Mr. Lucio Diaz Cruz, lifelong J. Rocha Azusa resident and former Azusa City Councilmember, and Mr. Joe R. Marquez, long time Azusa Comments resident. He thanked City departments and staff for all the activities during the summer, Congressman Hernandez for the Health Fair, and residents for conserving water; he announced free Yard Sales on September 6 and 7, 2014, and Families on the Move, September 13, 2014, at Gladstone Street Park. The minutes of the regular meeting of July 21, 2014, and the special meeting of July 28, 2014, Minutes were approved as written. 2. Two Resolutions Nos. 14-C46 and 14-C47, were adopted and each was entitled: Resos 14-C46 & 14-C47 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ALLOWING CERTAIN Warrants CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID. 3. The Human Resources Action Items were approved in accordance with the City of Azusa Civil H.R. The Treasurer's Reports for the month of June 2014 and July 2014, were received, reviewed, and Treas Reports filed. 5. The following Resolution No. 14-C48 was adopted and entitled: Reso 14-C48 ICRMA A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPOINTING A REPRESENTATIVE AND AN ALTERNATE AND SUBSTITUTE ALTERNATE REPRESENTATIVE TO THE GOVERNING BOARD OF THE INDEPENDENT CITIES RISK MANAGEMENT AUTHORITY (ICRMA). 6. A contract was awarded to R.R. Construction of Azusa in the amount of $39,895.00 for Museum Impr. improvements at the Durrell House -Azusa Historical Society Museum; and a budget amendment in RR Constr the amount of $13,884.50 to fully fund the project, was approved. 7. The City Manager was authorized to execute a Temporary Construction License Agreement Lic Agmnt, 150 between the City of Azusa and the property owner of 150 W Foothill Boulevard to perform Foothill improvements on the south side of Foothill Boulevard between San Gabriel Avenue and Azusa Avenue (Chase Bank.) 09/02/2014 PAGE THREE 8. The following Resolution No. 14-C49 (a requirement, by the Civil Rights Act of 1964, for all Reso 14-C49 agencies receiving Federal Transit Administration grant funds) was adopted and entitled: Title VI Program A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA ADOPTING THE TITLE VI PROGRAM. 9. SPECIAL CALL ITEM. Spec Call 10. Staff was authorized to purchase material to install flashing beacons at the intersection of Sierra Flashing Madre Avenue and Vernon Avenue. Beacons 11. The following Resolution No. 14-050, authorizing the City Manager to enter into a Master Reso No. 14 - Agreement and Program Supplement Agreement with the California Department of Transportation C50, Caltrans (Caltrans) for the receipt of state highway and federal transportation funds for current and future Agreements projects, was adopted and entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, TO ENTER INTO A MASTER AGREEMENT AND PROGRAM SUPPLEMENT AGREEMENT WITH CALTRANS FOR THE FOOTHILL BOULEVARD AND PALM DRIVE TRAFFIC SIGNAL PROJECT NO. STPL-51 12(018). 12. The extension of the Use/Lease Agreement with Azusa Pacific University for the Slauson Park APU Lease Community Pool/Azusa Aquatics Center from September 3, 2014 — May 1, 2015, was approved Agreement 13. Formal sealed bids, in accordance with Azusa Municipal Code Section 2-523 section B, computer Sungard, Bi - software maintenance services and 2-523 section C, no competitive market, were waived; and the Tec Maint annual software maintenance and support agreement from Sungard Bi -Tech Inc, in the amount of Agreement $52,087.85, was approved. 14. The grant awards from the LSTA, WIA and CLLS in the amount of $99,370.00 for Library projects Acceptance of were accepted, and the budget amendments associated with these grant awards were approved. The following Resolution No. 14-051 was adopted and entitled: Reso 14-051 OTS Grants A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, CALIFORNIA, APPROVING A GRANT AGREEMENT WITH THE CALIFORNIA OFFICE OF TRAFFIC SAFETY (OTS) FOR THE "SELECTIVE TRAFFIC ENFORCEMENT PROGRAM (STEP)/AVOID LEAD AGENCY" 2014-2015 GRANT NO. PTI 5102. 16. The extension of an existing contract with Benchmark Resources to continue providing consultant Benchmark services for the various reviews associated with Surface Mining and Reclamation Act (SMAR) Agreement for compliance, as well as biennial monitoring of the Fish Canyon/Azusa Rock Mine Conditions of SMAR Review Approval was approved; and the City Manager was authorized to execute the City's standard professional services agreement for three years in an amount not to exceed $110,000. 17. Formal sealed bids, in accordance with Azusa Municipal Code Section 2-523 section D, no Sunguard Bi - competitive market, were waived, and the software and hardware upgrade cost from Sungard Bi- Tec Inc. Agmnt Tech Inc, in the amount not to exceed $242,830, was approved. 18. Pursuant to the City of Azusa Civil Service Rules Section 3.5, the revised classification Class specification of Assistant Director of Economic and Community Development was adopted. Specifications 19. SPECIAL CALL ITEM. SPECIAL CALL ITEMS AGREEMENT BETWEEN THE CITY OF AZUSA AND LOS ANGELES COUNTY METROPOLITAN TRANSPORTATION AUTHORITY (LACMTA) — AZUSA INTERMODAL TRANSIT CENTER. Assistant Public Works Director/City Engineer Bobadilla responded to questions posed by Mayor Rocha, stating that the City of Azusa is not authorized to receive Federal Transit Administration (FTA) grant funds directly and must use an authorized agency as a pass-through; the City has the option of using the California Department of Transportation (Caltrans) with a service fee of 10% of the grant amount, or the Los Angeles County Metropolitan Authority (MTA) with a 5% service fee; due to the cost difference staff recommends MTA. Currently, the City is not able to apply for and receive these federal funds; MTA will prepare and submit a grant application to the FTA and will enter into a grant agreement with them on the City's behalf. The total estimated cost for the project is $13,264,766.00. The City has agreed to provide the required federal match only if any cost exceeds the estimated cost and the City would have to find additional funding sources for the match portion. The estimate is on the high, and staff does not anticipate bids to come higher than estimated. The City's Federal Funds are contingent upon the FTA's approval of the grant application, if they don't approve the application, staff would contact FTA to find out the reason; historically FTA does not reject applications, it is a standard 09/02/2014 PAGE FOUR Spec Call Item Spec Call Consent Item D-9, Agreement with LACMTA- Intermodal Transit Center process that MTA or Caltrans go through. The City will pay upfront for expenses, and request a reimbursement from LACMTA for actual costs. It is standard of all contracts to retain 10% of the invoice amount, to ensure that all the sub -contractors are paid; MTA may also retain 10% of the invoice amount for the same reason. MTA will not be responsible for any additional fees that exceed the overall cost; however anything over of the estimated amount will be shared between Foothill Transit and the City; currently there is an agreement with Foothill Transit to share any overage expenses. Assistant Public Works Director/City Engineer Bobadilla responded to question posed by Councilmember Alvarez stating that the estimated amount is 10% above the original estimate, for potential change orders; payments will be made and reimbursed based on project completion. 'Councilmember Carrillo stated that it is standard of all contracts to hold 10% of the invoice to protect the sub -contractor, in this case should. the contractor not pay them; MTA will pay from the percent being withheld. Moved by Councilmember Macias, seconded by Councilmember Carrillo to authorize the City Manager to execute an Agreement between the City of Azusa and Los Angeles County Metropolitan Transportation Authority (MTA) to act as a designated grant recipient for Federal Transit Administration grant funds for the Azusa Intermodal Transit Center, by the following vote of the Council: YES: COUNCILMEMBERS: GONZALES, CARRILLO, MACIAS, ALVAREZ NOES: COUNCILMEMBERS: ROCHA PROFESSIONAL SERVICES AGREEMENT WITH MORSE PLANNING GROUP. Consent Item D-19, Economic and Community Development Director Christiansen responded to questions posed by Professional Councilmember Alvarez stating that the contract is being capped at $25,000.00, and it will be funded Services from the salary savings of the position currently vacant; the position is funded at $13,000.00/mo., it Agreement. will take approximately 3 to 4 months for the hiring process, a total $52,000.00 in wage savings; after Morse Planning paying for the services, there will be a total savings of $25,000.00. Joint Item APPROVAL AND AUTHORIZATION TO EXECUTE RATIFICATION AND AMENDMENT Ratification & AGREEMENTS TO VARIOUS LOAN AGREEMENTS BETWEEN THE CITY OF AZUSA AND Amendment THE FORMER REDEVELOPMENT AGENCY OF THE CITY OF AZUSA. City & Sneer Agency Finance Director Paragas presented the item stating that the request was for the approval and Agreement authorization to execute the ratification and amendment agreement between the City and the Successor Agency, regarding various loans. On February 2012, the State dissolved the Redevelopment Agencies of the various municipalities; one of their laws includes that loans between City and Redevelopment Agencies are invalid; however, with passing of AB 1484, which states that if Cities meet certain criteria and receive the completion of findings, the loans may be ratified provided that the ultimate decision maker is the State's Department of Finance (DOE). Should Council approve ratification and amendment of the agreements, staff can move forward, present it to the Oversight Board for consideration and approval, and send it to the DOF. Should the DOF approve these loans, it will become an enforceable obligation for the Successor Agency that can be included in the Recognized Obligation Payment Schedule (ROPS). The 3 loans date 1989-90, and the interest rates at that time varied from 7%-8%; according to the new law, current rates of .244% have to be used; this reflects a impact to the City's finances.
