The City Council of the City of Azusa met in regular session at the above date and time in the Azusa Auditorium
located at 213 E. Foothill Boulevard, Azusa, CA 91702.
Mayor Rocha called the meeting to order.
Call to Order
ROLL CALL: Roll call was taken by City Clerk Cornejo. Councilmember Macias joined the meeting Roll Call
at 6:31 P.M., and Councilmember Carrillo at 6:33 P.M., after the roll call by the City Clerk.

Ms. Barbara Dickerson, Boardmember for the Citrus College Board of Trustees, addressed the Council
to announce the kick off celebration of Citrus College 100th birthday on October 11, 2014. She
introduced the Hometown Heroes for the Azusa Day at the Los Angeles County Fair on September 26,
2014: Ms. Aileen Salmaron, Gladstone High School student who co -runs a Folklorico Dance Class
from Kindergarten to 5th grade; Ms. Mercedes Castro, a local business owner, previous Chamber of
Commerce President and Chairperson for the recent Library scrabble fundraiser; Ms. Terri Harbin, a
lifelong Azusa resident who volunteers and promotes Veterans Programs.

Mr. Stephen Fomba, Program Manager for the San Gabriel Valley Consortium on Homelessness, S. Fomba
addressed the Council to give an overview on the homeless program and asked the Council to continue Comments
'partnering with community organizations to end homelessness in the Valley.
Ms. Peggy Martinez addressed the meeting to congratulate and wish good luck to City Manager James P. Martinez
Makshanoff on his new position with another city, and asked that Council consider that the recruitment Comments
for the selection of the new City Manager, be open to the community and suggested a committee for
the recruitment process as this has been done in the past. She announced the Azusa Golden Day's
Talent Show on October 8, 2014.

Mayor Pro -tem Gonzales addressed the meeting thanking all who donated and helped with the recent R. Gonzales
Kool Cuts Event, close to 250 hair cuts were done, and back packs and school supplies giveaway; he Comments
requested certificates of appreciation be presented at the meeting of September 15, 2014, to all the
donors and stylists. He announced the opening season of Azusa Pacific University (APU) football on
Thursday, September 4, 2014, at Citrus College.

Councilmember Carrillo addressed the meeting stating that he was glad to resume business after a A. Carrillo
recess for the month of August; Golden Days will begin soon and children are back to school; he asked Comments
all to use caution and be on the look out for students crossing the streets.
Councilmember Macias addressed the meeting with remarks of support towards the Council's U. Macias
participation, as proposed by Ms. Peggy Martinez, in the Azusa Golden Days Talent Show event; he Comments
hoped that everyone had a great summer and enjoyed being with family as much as he did; he thanked
the Police Department for the DUI check points and their presence at the City Parks during the
summer; he invited all to the Azusa Day at the Los Angeles County Fair, on September 26, 2014, to
celebrate with Azusa's Heroes.
Councilmember Alvarez addressed the meeting stating that he hoped everybody had nice Labor Day; E. Alvarez
'he announced that students are back in school, and reminded everyone of the 2K/5K Family Run/Walk Comments
on October 5, 2014.
Mayor Rocha stated that the meeting would be adjourned in memory of Mr. Lucio Diaz Cruz, lifelong J. Rocha
Azusa resident and former Azusa City Councilmember, and Mr. Joe R. Marquez, long time Azusa Comments
resident. He thanked City departments and staff for all the activities during the summer, Congressman
Hernandez for the Health Fair, and residents for conserving water; he announced free Yard Sales on
September 6 and 7, 2014, and Families on the Move, September 13, 2014, at Gladstone Street Park. He
asked to keep service men and women in daily prayers.

6. A contract was awarded to R.R. Construction of Azusa in the amount of $39,895.00 for Museum Impr.

7. The City Manager was authorized to execute a Temporary Construction License Agreement Lic Agmnt, 150

8. The following Resolution No. 14-C49 (a requirement, by the Civil Rights Act of 1964, for all Reso 14-C49

12. The extension of the Use/Lease Agreement with Azusa Pacific University for the Slauson Park APU Lease

SAFETY (OTS) FOR THE "SELECTIVE TRAFFIC ENFORCEMENT PROGRAM
(STEP)/AVOID LEAD AGENCY" 2014-2015 GRANT NO. PTI 5102.
16. The extension of an existing contract with Benchmark Resources to continue providing consultant Benchmark
services for the various reviews associated with Surface Mining and Reclamation Act (SMAR) Agreement for
compliance, as well as biennial monitoring of the Fish Canyon/Azusa Rock Mine Conditions of SMAR Review
Approval was approved; and the City Manager was authorized to execute the City's standard
professional services agreement for three years in an amount not to exceed $110,000.
17. Formal sealed bids, in accordance with Azusa Municipal Code Section 2-523 section D, no Sunguard Bi -

SPECIAL CALL ITEMS
AGREEMENT BETWEEN THE CITY OF AZUSA AND LOS ANGELES COUNTY
METROPOLITAN TRANSPORTATION AUTHORITY (LACMTA) — AZUSA INTERMODAL
TRANSIT CENTER.
Assistant Public Works Director/City Engineer Bobadilla responded to questions posed by Mayor
Rocha, stating that the City of Azusa is not authorized to receive Federal Transit Administration (FTA)
grant funds directly and must use an authorized agency as a pass-through; the City has the option of
using the California Department of Transportation (Caltrans) with a service fee of 10% of the grant
amount, or the Los Angeles County Metropolitan Authority (MTA) with a 5% service fee; due to the
cost difference staff recommends MTA. Currently, the City is not able to apply for and receive these
federal funds; MTA will prepare and submit a grant application to the FTA and will enter into a grant
agreement with them on the City's behalf. The total estimated cost for the project is $13,264,766.00.
The City has agreed to provide the required federal match only if any cost exceeds the estimated cost
and the City would have to find additional funding sources for the match portion. The estimate is on the
high, and staff does not anticipate bids to come higher than estimated. The City's Federal Funds are
contingent upon the FTA's approval of the grant application, if they don't approve the application, staff
would contact FTA to find out the reason; historically FTA does not reject applications, it is a standard

process that MTA or Caltrans go through. The City will pay upfront for expenses, and request a
reimbursement from LACMTA for actual costs. It is standard of all contracts to retain 10% of the
invoice amount, to ensure that all the sub -contractors are paid; MTA may also retain 10% of the
invoice amount for the same reason. MTA will not be responsible for any additional fees that exceed
the overall cost; however anything over of the estimated amount will be shared between Foothill
Transit and the City; currently there is an agreement with Foothill Transit to share any overage
expenses.
Assistant Public Works Director/City Engineer Bobadilla responded to question posed by
Councilmember Alvarez stating that the estimated amount is 10% above the original estimate, for
potential change orders; payments will be made and reimbursed based on project completion.
'Councilmember Carrillo stated that it is standard of all contracts to hold 10% of the invoice to protect
the sub -contractor, in this case should. the contractor not pay them; MTA will pay from the percent
being withheld.

Manager to execute an Agreement between the City of Azusa and Los Angeles County Metropolitan
Transportation Authority (MTA) to act as a designated grant recipient for Federal Transit
Administration grant funds for the Azusa Intermodal Transit Center, by the following vote of the

Finance Director Paragas presented the item stating that the request was for the approval and

authorization to execute the ratification and amendment agreement between the City and the Successor
Agency, regarding various loans. On February 2012, the State dissolved the Redevelopment Agencies
of the various municipalities; one of their laws includes that loans between City and Redevelopment
Agencies are invalid; however, with passing of AB 1484, which states that if Cities meet certain criteria
and receive the completion of findings, the loans may be ratified provided that the ultimate decision
maker is the State's Department of Finance (DOE). Should Council approve ratification and
amendment of the agreements, staff can move forward, present it to the Oversight Board for
consideration and approval, and send it to the DOF. Should the DOF approve these loans, it will
become an enforceable obligation for the Successor Agency that can be included in the Recognized
Obligation Payment Schedule (ROPS). The 3 loans date 1989-90, and the interest rates at that time
varied from 7%-8%; according to the new law, current rates of .244% have to be used; this reflects a
impact to the City's finances.
